From the way Aaron talks about it upsetting his wife, I'm picturing a full on SWAT'ing with cops bursting in through the door, weapons drawn. PS - just to be clear, I do not think there's ever been a report of Walker being SWAT'ed before. Others have been - Patterico, Erick Ericson, etc. but not Aaron Walker.

Sounds as if one should live as if in witness protection, with phony ID, a bunch of burner cellphones, and a few safe-houses in which to chill.  Access to web via 3G only, through a phony account.

One of two things: 1. Not enough for a search warrant yet. In Philly, getting a search warrant is an arduous endeavor.  Sometimes, even probable cause isn't enough for our ADAs.  2. The appropriate agencies don't wish to pursue the matter.

Most likely #2.

911 shouldn't be using caller id, that can be spoofed very easily.  They should be using ONI (originating number identification) which can NOT be spoofed by the originator.

GPS can also be spoofed and devices are made to do this.  You can get a device which basically spoofs GPS satellite signals and can make the phone believe it is in any location you want it to be.  You just enter the location where you wish the phone to be located and it will think it is there.  So even GPS information from the phone isn't believable.

78 I don't get it myself.  I find this swatting and irrational hatred on the part of people like BK and others is alien to me.    I admit I have a significant temper and have been working on it over the years, but my temper is a flash and gone, delivered in a moments pique, but the malice in the hearts of these people is something alien to me.

I hope that tools are granted to Law Enforcement to track these calls to their source, so that they might be punished suitably.  If these stories get more play, I can see the officers around the nation petitioning for those tools, because the few times that I have been manipulated into playing someone else' game I was more angry than if they had punched me, and cops aren't exactly maidens or forgiving being played the fool.

Probable cause.  The fact that they are tangentially connected to the victims and have reason to do the actions probably isn't enough to get a judge to issue a warrant.  Especially when the warrant will be served on a hyper-litigious douchenozzle.  Patterico's audio expert might be enough to get a warrant, but most judges and LEO's (especially federal LEO's) like to get a smoking gun before they will issue a warrant.

Well that would be the rational action. But if you look at the MO of BK and NR, they think they're very clever and know how to game teh system. So they will tend to escalate in order to intimidate rather than back down. In NR's case he may very well be mentally ill as well so who knows what's going on in his head.

Actually, their "bag of tricks" seems pretty limited.  Not that I want them to get more creative, but this swatting thing is going to be harder to pull off once law enforcement catches on.  I assume the guys who participated in the "let's blog about Voldemort Day" has already reached out to police.

Aaron Walker' attorney needs to file a motion to trace the call; after all, this looks like an attempt to cause "Death By Cop", i.e., Attempted Murder, ... and maybe Conspiracy to Commit ...

 

Where will the trace lead? That's part of the point of forcing the trace ... the companies that facilitate forged calls need to be held accountable, and required to cooperate with police when properly served.

 

My guess is that untangling the call will lead to many people who do not wish to be revealed ... particularly when it looks like being part of a Conspiracy charge will drag them into many other things.

What I don't understand with this SWATing thing, is that in each case the caller seems to be able to make it look as if the call comes from the residence on caller I.D. (called caller I.d. spoofing) and acts like he is a resident claiming to have shot his spouse. In a situation like this, why do police departments immediately call the residence, or cell phones of the resident, back? They could be preparing swat and sending out a squad car or two, but a call back would likely defuse the situation before 16 men in black battle gear and nasty guns show up freaking everyone in the neighborhood out, costing taxpayers a bundle, and even potentially mistakenly harming someone in the process.

130 I don't know the particulars of the tech. But, what I do know, is the only way to not be tracked is to be off the grid completely. No electric, no phone, no nothing.  That's almost impossible lately, and obviously so for a blogger, but if you're on, you can be tracked.  There are ways to minimize that, but most people don't care to learn. At least at the moment, like me.  Otherwise, if you're exposed in the least through services and/or payments of any kind, you can be found if someone wants to try hard enough.

SWATting is just a term.  I don't think, in many of these cases, actual SWAT teams respond.  But it's likely a whole shift of patrol officers shows up, which isn't really much different.  That's just my guess.  "Regular" police officers do respond to shootings & gun calls, it's not just a SWAT thing.  Many departments don't even have SWAT teams.

141 I think S.30 from the 2009 Senate docket is languishing in committee, having already passed the House. That bill, IIRC (I'm looking at notes) provides for making CID spoofing and other VOIP abuses a federal offense (I don't know the penalty terms). False police reports are already a crime, sometimes felony grade. People who get caught doing that generally get a bunch of other goodies tacked on to their charges too, as it's a rather frowned-upon activity. heh.

142 Glad to hear that Aaron and his wife are safe... the SWATting  today really puts BK and his minions in the spotlight, considering that the incident happened on the same day as the court ruling.

Whomever is doing this is probably using Vonage/Skype and going through a proxy server to try and hide their tracks... too bad someone like the FBI or NSA are not working on this, I'm sure that the NSA has the tools to find out who is behind this and the other incidents of SWATting... before it is too late.

147 When I was in grade school we had a visit from FDNY.   They were their usual amazing but they told us never to pull a fire alarm and never call 911 to report a fire if there was no fire.  They told us that it was not only the wrong thing to do but against the law.  They told us that a false alarm could inadvertently cause a problem if another alarm is called in with a real fire.  They said they take risks racing to the fire and the risk is proportionate if it's a real emergency but if it isn't and a firefighter gets hurt that's a horrible consequence.  I feel like this swatting stuff is like calling in a false alarm.

My friend who is a cop when I asked him about this said that there is a danger that the calls from this house will not be answered so quickly the next time, with everyone assuming it's another set up.  He said this would be horrible if the next time there is a real situation that would require the swat team, stat.  He said this probably won't happen cause the police are professionals but that the attitude of "oh it's that address again" is wearing on all involved.

And why oh why doesn't the police dispatcher call the home phone or make some other attempt to verify the problem is a real one? Seriously, some evaluation needs to be made re the identity of the caller before the person should be taken seriously. What is the point behind anonymity in a complaint if it is a real one?

149 Almost every home had a land line phone when I was growing up.  They instituted a system whereby they could tell where the call was coming from so that ambulances could find you if there was an emergency.  Then everyone realized that a land line phone with their cell was a redundancy they were paying for and got rid of their land line phone.  There are programs that will give your specific location but you have to download them to your phone I think and you have to have some reason to want to do that, like a teenager whose parents want to be able to see exactly where they are when they call.

As far as a 911 operator deciding that a call is a prank, would you want to be that operator in the event it wasn't a prank?   Plus, if there was a real emergency situation not of your making and they called you to ask if you called wouldn't it be logical that is your safety were compromised that the compromiser would force you to say you were fine?

This is a very tough situation.  Look at the emergency call from the boaters where the guy calmly made the call.  Apparently this cost a small fortune and when you hear the call, you would have set the wheels in motions too, it sounded real.  They still haven't found that guy and they are saying this wasn't the first call like that in recent months.

I haven't commented on the specifics of this, just the generalities.  Is it possible that someone is using the "kill two birds with one stone theory" as regards this situation?
