Not to play devil's advocate (even though I owe him a few favors), but I recall reading over the years that mean people who are turned down are later approved due to having the same name as someone with a felony conviction, etc.
just the same, I doubt the Barky Administration is that eager to enforce laws that might punish, you know, actual bad people.

1) Prosecutors should _not_ be able to drop the firearms portion of the charges when working out plea-bargains with criminals. The firearm offense must ALWAYS be prosecuted.
2) Using a firearm in commission of a crime should count as one strike on its own--that is, if you rob a bank using a gun, the bank robbery is one strike and the fact that you used a gun is a second strike.
The third is something that the tyrant voted against when he was in the state senate in Illinois: membership in a gang should be an aggravating factor in getting the death penalty (useless in Illinois now, as they've abolished the death penalty, but would work on states not bent on heir own annihilation)--if you're a member of an organization that exists only to commit crime, you ought to be more eligible for the death penalty than some schmo off the street.
Treat gun crime and gun criminals as though they were serious problems, and lay off of law-abiding gun owners. These two rules would also have the benefit of making David Gregory a felon with one strike on him, which would be awesome...

I find it hard to beleive the statatician John lot said there was a false positive rate of 94% for all checks. Though out of the 70,000 persons rejected above 4,000 is pretty close to 6% of that limited group. and 70,000 is not near 94% of 16.5 mil. Stats are a bitch.

(JJ Sefton might remember this one, I think he's also from the NYC area.)
The result? A guy facing five to fifteen years for armed robbery would plead down to a year for illegal possession of a gun. Big improvement that.

Two weeks is what it took my grandson to recover from 2 concussions, back-to-back. He was kept at home with no electronics, long conversations, television, etc. But he wasn't Secretary of State.
This supposedly showed up on a routine check-up today. Routine on Sunday?
Why aren't we getting doctor's reports? When Bill had a bypass, we had doctors giving reports every few hours. Why aren't we hearing from doctors?
So, is she really sick, is she hiding from doing the testimony, or is she hiding from Obama?
And where are those survivors from Benghazi? By now one would think someone would have found at least one of them. Are they hiding, too?

Your 1040 is merely your reported income. It's the unreported income they can harm you for.
US Customs made the mistake of trying to use the IRS to bust a drug smuggler in the 1990s ... he showed up at tax court, and made the judge order him to report his income.
He did so, reporting a gigantic figure, and admitting it was drug income, and BTW, how much tax do I owe? The judge gave him an enormous figure, and he calmly wrote a check for that amount.
And then left the country. No one could touch him, as he had paid his taxes in full, and his testimony about his income source was privileged.

Felon buying gun charges have to be developed not using the 4473 as evidence.
The 4473 CAN be used to prove FFL holder crimes, such as US vs Lassiter, where the FFL holder had a bunch of kids in his gradeschool class fill out blank forms with their names as an "exercise", and then used those forms to sell firearms to felons.

I expect to make a little money in my business next year, but it has been a shadow of its former self since late 2008. OTH, my BIL owns LOTS of local commercial real estate and it is all rented, and he says business is good.

Recession in the middle with subpar growth for the next few years. Wildcards are the bubbling ports strike esp. if other unions join and municipal bankruptcies. Gas prices I think will be a driver as well and if they continue on their downslope some of the blow from tax hikes will be lessened. Worst case would be a sharp rise in gas prices, a layoff wave because of the "pass it to find out whats in it" tax hike from Ocare, and a ports strike that drags on for months causing spot shortages and an inflation wave.

A drug dealer could report all of his ill gotten gains on their tax returns, and list their occupation as Drug Dealer, and the IRS would not be able to turn that information over to the police, or DEA, due to disclosure laws. That much is true. However, the US Attorney can petition a federal judge to issue a court order, (called an Ex Parte order) compelling the IRS to turn over all tax returns. Happens all the time in Federal cases. I would assume that these 4473 forms would be obtainable the same way.

Not true. These 4,000+ denials were referred to field divisions for review; not necessarily for prosecution. Special agents at the field offices verify conviction and prohibition information and conduct additional investigations. In 2009, almost 600 of these referrals were found to be persons who were not prohibited.
It is not illegal for a prohibited person to undergo a background check for the purchase or transfer of a firearm. Just because they were red-flagged and denied does not mean they broke any law. And, contrary to your summary, it could be well argued that the government is serious as these background checks are working as planned and preventing guns from getting into the hands of prohibited individuals.

For a brief period, the Supreme Court held in 1968 (Haynes v. U.S., 390 U.S. 85) that felons were exempt from federal and state laws regarding registration because it violated their Fifth Amendment protection against self-incrimination. In other words, only people who were not criminals could be prosecuted for failing to register a firearm or found to be in possession of an unregistered firearm. However, in 1971, (U.S. v. Freed, 401 U.S. 601) the Court held that due to changes in the National Firearms Act of 1968 the law no longer violated the 5th Amendment rights of felons.
