Alan Dershowitz: Drop the Zimmerman Murder Charge

From the New York Daily News:

A medical report by George Zimmerman’s doctor has disclosed that Zimmerman had a fractured nose, two black eyes, two lacerations on the back of his head and a back injury on the day after the fatal shooting. If this evidence turns out to be valid, the prosecutor will have no choice but to drop the second-degree murder charge against Zimmerman — if she wants to act ethically, lawfully and professionally.

There is, of course, no assurance that the special prosecutor handling the case, State Attorney Angela Corey, will do the right thing. Because until now, her actions have been anything but ethical, lawful and professional.

After that freak show press conference, I don't expect her to act ethically either. Oh, yeah. Shout out to Governor Scott. Great work, pal.

I'm not throwing Governor Scott under the bus for this. Corey had a reputation for being very tough on crime. Appointing her meant that if no or minimal charges were filed, nobody would be able to claim she's soft on crime.

He could not have known that she would go rogue.

Yet... I will be writing to Governor Scott to express my feelings and to inform him that if/when this case goes tits up, his response will make all the difference in whether I vote for him, or actively campaign against him next time.

"Tough on crime" + "attention whore" + "authoritarian audience" = "Nancy Grace". A more experienced Right politician would have seen this coming. Scott's generally done pretty well, from what I've seen, but he did make a little mistake here. There's not much he can do about this now, except to keep a lid on the ongoing anti-white violence in his state.

Consider this situation and others like it.  It is more like the reverse; the political situation has been created where no one knows the difference between right and wrong, the Constitution is stood on its head, and everyone in office is a grasping and greedy opportunist, out for themselves and their career first, last and always.  We are  and will continued to be screwed by the government and the people in it.

 

As others more knowledgeable have said, Angela Corey was supposed to be this super - tough State attorney, who would bow to no pressure.

 

Ha.

She caved as soon as this case was dropped into her lap.

I would not be too quick to think George Zimmerman is going to come out of this travesty with any money because of libel, wrongful prosecution, prosecutorial misconduct, etc.

 

Because he will have to be alive to do this. If he is acquitted and released from jail to be a "free man" again, I would not think he has too long a life expectancy unless he can hire several permanent body guards and moves out of Florida immediately.  They are going to come after him.

In fact, my parents and the majority of my dad's family actually live in her jurisdiction. They all know Corey through various police functions (the grandparents are very active in the police benevolence org. in Jax) and every last one of them were convinced Scott had made the best decision possible. Obviously not, but hindsight is always 20-20. My parents are genuinely shocked at all this. I was just talking to mom last night and she just could not understand how we ended up here. My dad's family is convinced there has to be some additional evidence that's been held back that is damning for Zimmerman because they can't believe Corey would have charged him otherwise. So, yeah, I give Governor Scott the benefit of the doubt. But I hope when this all shakes out, if things are as they appear right now, that Corey is given the Nifong treatment and Governor Scott will be receiving a letter from me as well.

Corey's actions are pretty   transparent to anybody with  two functioning  neurons to rub together. There was no reason to have   her come  come riding into town to save the day. It speaks more to the weakness of Gov. Scott and the authorities that were genuinely afraid of race riots down here, the pussies. All they did was give a green light to Not-so-Sharpton and Jacks-sunh to continue their race-baiting and inflaming a case  that was already settled. This could have been nipped in the bud, had Scott had any cojones.

 

What should have happened was that Scott should have stated that this case  had already been investigated to the satisfaction of Sanford, Seminole County and the State of Florida. He then should've sworn out arrest warrants to the NBPP for their bounty on Z, stating that no type of  "vigilante justice" will be tolerated and say he  was prepared to  call up the National Guard to supress any riots. It is, after all, his duty and responsibility to the citizens to enforce the law. All the time.

 

And you just know that the respective investigators and prosecutors' offices who did the initial legwork cannot, in any measure, be happy with Corey.

Over at Volokh, I recall (but could be misremembering location) a discussion that Corey was an expert in Self-defense law and cases (having worked on a few). So there was a deep breath when she took over because at least a few people thought she would restore some sanity to this.

Cleary she went off her rocker.  (Zombie Nietzsche is proud of her use of the power of the bully pulpit.)  I'm not sure many people expected that.  (I did at some level.  I had hoped she'd act honorably.)

Corey was supposed to look at all the facts and proceed according to the facts in case.  By choosing a "side" in the case, she has not only disqualified herself as an impartial member of the court, she has the blood on her hands of all the people who are going to be victims on racial violence in the next however many months this will drag on.

 

How many incidents have we already seen of black-on-white violence, where the offenders have shouted "This is for TrayVon!"  This is going to be a long, hot summer and it will be hotter still because of Angela Corey.

This isn't just a clear case of self-defense on GZ's part - this is a text book example of how localities should be dealing with would be criminals, and were it handled as a model by the government instead of a crime would be a powerful example to the thug class that actions have consequences.

Again, consider;

1) A drugged out violent teenager with a history of theft is seen acting suspiciously in a neighborhood with a burglary problem.

2) The neighbor watch follows him and alerts the police.

3) The thug assaults the citizen watching him and attempts to murder him.

4) Thanks to being armed the citizen is able to stop the thug cold. Literally.

Oh, and the rash of burglaries in GZ's neighborhood...have they stopped since Trayvon's death?

Therefore, even if the charges were dropped, Corey had still helped Martin's parents out by filing them.

 

I hope someone can confirm or deny this. And explain if there's some way the charges could be expunged so that he can't be sued...

The problem is that fear of the State Media narrative consistently paralyzes conservatives from doing what is right.

Based on the available evidence, is a Murder 2 charge justified? If no, and it is pretty clear the answer is no, those in elective office should be attempting to defend the integrity of the justice system by dealing with the rogue prosecutor.

Murder 2 is "manslaughter" in FL. Here are FL murder codes explained:


First Degree Murder

According to Statute 782.04 ("Murder"), Florida defines first-degree murder as an act "perpetrated from a premeditated design to effect the death of the person or any human being." The charge may also be applied to a person who is engaged in the perpetration of arson, sexual battery, robbery, burglary, kidnapping, aircraft piracy, narcotics trafficking, and numerous other felonies during which a person is killed. So, if a criminal robs a bank and kills a security guard during the act, he will be charged with first-degree murder. This act is a capital offense in Florida.

Second Degree Murder

Florida state law defines second-degree murder as a killing that "evinces a depraved mind regardless of human life" but "without any premeditated design to effect the death of any particular individual." Also, if you commit a felony in which someone dies but you are not directly responsible for the victim's death, Florida law may still prosecute you for second-degree murder. For example, if two men rob a bank and one of them kills a security guard, the other one will be charged with second-degree murder even though he did not pull the trigger. Florida law allows for this act to be punished by life imprisonment.

Third Degree Murder

Like second-degree murder, third-degree murder is also an unintentional killing, according to Florida law. The crime is defined by the circumstances in which it occurs. Murders that do not involve felonies such as robbery, burglary, kidnapping and other heinous crimes may be considered to be third-degree offenses. For example, possession of a firearm by a convicted felon is a second degree felony in Florida. If that felon accidentally shoots and kills someone while cleaning his illegally-owned gun, he could be charged with third-degree murder.

Justifiable Force

In rare instances, Florida allows for the killing of others in self-defense. Under Statute 776.013, if someone unlawfully enters your dwelling and you possess "a reasonable fear of imminent peril or death," lethal force may be justified. This law does not apply to situations in which a law enforcement agent attempts to enter a dwelling as part of his official duties.



At best he could be charged with third degree, but I would say this is one of those "rare" instances of self-defense.

From several different law firm websites I found that most felony charges in Florida also include lesser charges. Murder charges include all lesser charges.

137 .....basically yes a jury could refuse to convict for murder 2 and come back with manslaughter instead. From several different law firm websites I found that most felony charges in Florida also include lesser charges. Murder charges include all lesser charges.

Here's the thing.....

 

In a Condo Complex...the grounds around the condos are considered "common grounds", for which all the condo owners are expected to share in the expenses of 'upkeep, maintenance and liability insurance'.

 

Because of this....it is like the grounds around the units, are the same as the 'front yard' in the case of a single dwelling.

 

So....I would hope that Zimmerman's attorney would bring this up...and argue the point that Zimmerman was on 'common ground', for which he is legally responsible for as a condo owner. .....Thus, the stand-your-ground law should be available to him.

It took that long for the Martins to contact Ben Crump.  Mr Crump and his law firms friends put this out as a story of an evil white racist gunning down an innocent little black child in the night. 

The story was complete with pictures of angelic little 12 yo Trayvonn and the nasty thug Zimmerman complete with a mug shot.

Saw Martin's father giving an interview a month or so ago, and wondered myself if the attitudes with which Martin was raised had not played a part in his being dead by violence at age 17. 

 The father was talking about how he had sat his son down and talked with him about how dangerous it is to be a black man in America, and how he had to look out for himself.  Was that why Martin was so intent on teaching "white" Zimmerman a lesson? 

Most people would have just asked Zimmerman "why are you following me?" -- instead of jumping on him and trying to beat him to death.  But Martin was walking around with a  big  chip on his shoulder -- put there in part by a father who taught him that white people were his enemy.

Stay tuned for the next step, the self defense immunity hearing for George Zimmerman.  He needs to show on a PREPONDERANCE of evidence (not reasonable doubt) that he acted in self-defense. 

 

If he wins it (and I think he probably will), he goes free (as he can with a price on his head).

I don't quite understand why, if you see a stranger in your neighborhood, you can't ask him or her what they are doing, who they are here to see.  Or that asking such a question is the equivalent of fighting words.  We are learning that Trayvon was a thug criminal and, luckily, the person he attacked was armed and able to defend himself.  Quite often, the person attacked by the urban thug like Trayvon isn't quite so lucky and ends up the victim of the robbery, rape or murder.  Trayvon's parents are the same as the parents (or "auntie") of every black criminal shot in Chicago.  "Why, (fill in the blank) was just getting ready to turn his life around.  He only smoked blunts 5 days a week and was fixing to start supporting his three baby mamas.  If only the po po hadn't shot him while he was trying to rape that woman."  He wasn't a child, he was a ghetto thug and criminal ready to start his career with a murder.  His being shot isn't a tragedy given that it saved the lives of his future victims

Crump needs to be able to file wrongful death lawsuits in order to be paid off from the settlements.



If GZ and OÂ’Mara succeed in having the Florida charges thrown out at the immunity hearing, Crump does not get to file civil lawsuits and will not get paid. George Zimmerman will be Immune from any lawsuits based on Florida law. Therefore, Crump cannot file a wrongful death lawsuit.



So, Crump will then need to have the Holder DOJ file Federal hate crime charges. Then Crump can file his wrongful death lawsuits and get paid. Holder does not have to have a case, and does not need to win his criminal case. Crump can file his civil case if GZ is indicted by the feds.



Crump has invested a lot in this tragedy. He will expect to get his money back via the wrongful death lawsuits.    As usual, follow the money and you will find the motivations.

Kelly has always been an idiot.  I understand that people liked her because she was kind of hot, but she hasn't changed much.  Every once in a while she would defend the conservative case but she rarely did it intelligently or correctly and almost never for the right reasons.  She always had an attitude and usually it was annoying and bothersome.

I haven't watched her coverage of this because I stopped watching Fox a while ago.  I just couldn't take it anymore.  Not even the true hotness of Shannon Bream could make me wade into that channel, and frankly, this idea that just putting hot women on the air to attract viewers has gotten totally out of control.  There are enough of them running around everywhere that the interest of them on TV reading teleprompters (or even worse when they let them ad-lib) really loses its appeal after seeing them once or twice.

I can't say that I've found a better channel.  I just don't bother with TV for any news.

Zimmerman, age 27, is the local neighborhood watch captain for the Retreat at Twin Lakes.  His wife ________, said he was a devoted family man and involved in the community.  He tutored several youths in Orlando last year, and was an activist convinced the local police to bring charges in the beating of Sherman Ware, a black homeless man.  __________, the son of a Sanford police officer was convicted of assaulting Sherman Ware on December 4, 2010. 

 

Neighbors report that there has been a rash of burglaries in the neighborhood in the last year, including a home invasion.  Mrs. Zimmerman stated her husband was returning from shopping at the Target store when he spotted a suspicious person and contacted the police.  “I do not understand why he did not take his handgun with him on Sunday night.  He almost always carries it after he was advised to by the police after we had trouble with a vicious dog.”  Mr. Zimmerman has a valid Florida CCW permit, but he was not carrying his handgun Sunday night.

I bet a few of us have stories like this. I do, I'm happy to say.

I went to visit my baby bro once upon a time, and oh, he's Hispanic because my evil Rethuglican parents adopted a Mexican because it was the right thing to do, go fig. He lived in one of these lower-middle-class-but-decent Hispanic neighborhoods in L.A. county at the time. Lots of them in SoCal.

Well he wasn't there so I'm waiting for him in my Volvo and my business clothes, car door open because it was hot -- nice white girl in Hispanic neighborhood, probably looked like I was waiting for my cocaine dealer.

Hispanic guy comes out of his apartment and gives me the evil eye. "ExCUSE me! May I HELP YOU?" I explained who I was waiting for and he backed off, although not with a smile -- still half-threatening. "Oh. We like to keep an eye on our neighborhood."

WHOA, I was profiled! And I thought it was great. I thanked the guy and felt better that baby bro was in such a tight neighborhood.

That's all Trayvon had to do.

195 A couple of thoughts on the Zimmernan case. Wow, is this guy fucked. Sorry, normally I don't lay you in depth legal analysis like that, but that is pretty much it in a nutshell. Obviously the facts don't support a murder charge, in fact they barely support manslaughter and that is only if you look at them in the most generous light possible. But it won't matter, they will railroad Zimmernan for the purpose of political expedience. His fate is in the hands of 12 people looking for a book deal and their own 15 minutes of fame, and that just doesn't bode well at all. Even if by some bizarre twist of fate he manages to avoid conviction by the state it will only be the beginning, Holder and his Department of Injustice will inevitably file federal charges most likely based on some bogus civil rights claim. The facts have been swept aside, the law has been ignored, and all that matters is now is the rule of the mob. Sad, but true.

204 Let the case go to trial. Get an acquittal so they can't charge him with a lesser (and easily provable) crime. Double Jeopardy will then kick in to protect him from other state charges at least. I would be worried about the DOJ charging him with a civil rights violation because Double Jeopardy would not protect him and he would be theoretically at risk of the DEATH PENALTY. Knowing the scum that works at the DOJ I would bet on them trying to charge him.

I don't either. When I was a teenager some stranger started cruising through our little 10 lot subdivision. The guy looked like the "dud" from Mystery Date (ratty shirt, unkempt hair, beard stubble). His car was a real beater.

I didn't care for his frequent visits and apparently my father cared even less for them. He called all of our neighbors and they all had noticed him too, and none of them or their family members knew him. After that, he acted: the next time the guy cruised by my father motioned he wanted to talk to him. He then told the guy "If I see you here again you'll be a better man than me because you'll have stopped a .30-30."

He never came back.

Yeah, Martha was okay from what I recall. 

The stuff with the legs is totally out of hand.  I watch Bloomberg (spit) for the late-night market news and morning openings (Fox business has no late night programming, at all, and that horse's ass Imus in the morning) and Bloomberg is even more overboard with the hot bodied women and tight, tight dresses and legs (they have them all sitting on the tables for the early morning euroscum news - seriously - it's crazy) but it's just distracting when they are doing serious interviews.  I often wonder how guys can be interviewed by them and not just stare at their tits and legs.  Everybody else is.

Sex sells, for sure, but sexy women aren't any rare commodity these days.  Knowledgeable commentators and serious channels are.

And they don't even try to hide the crudity of it all.  Bloomberg has a commentator, Betty Liu, and her show is "In the Loop" ... yeah ...  And some other chick, Trish Regan, with her segment, "Three against Trish".  I mean, it's cute and funny the first time you see it, but after that it's just idiotic and demeaning to the viewer.

If you do get one.....it is often reciprocated in the other states that also have CC. .....Our governor just signed our Open Carry into law here in Oklahoma.

It also makes it now legal to open carry on your own property....which is cool.

 

The new law here converts all CC permits to open carry. ....You can't carry openly without a permit, unless you are on your own property.  ....Oklahoma also reciprocates CC permits from other states.

So, you admit Zimmerman had a gun. Ok, then explain why Zimmerman allowed Trayvon to get in the first punch, knock him to the ground, break his nose, beat his head into the ground, etc., etc., before shooting Trayvon?

 

Or was Zimmerman already pointing a gun at Trayvon and Trayvon was not afraid of a gun pointed at him? Why would Trayvon be not afraid of a gun pointed at him? What would cause this?

 

Why not just cap Trayvon before taking a potentially fatal beating, then make up something convincing ... like maybe plant a sharpened screwdriver or 18" of rebar on Trayvon ...

And he could have used his cell phone to call for help.

In every State where you are allowed to own a gun you can always open carry on your own property. As soon as someone takes them to court NYC will be legal too.

 

You can carry concealed on your property as well.  Something the pedophile son in law of my former neighbors found out when he assaulted me.  

His lawyer tried to get me charged with unlawful carry and was laughed out of the local PD.

If the lawyers can't prove that the news media acted with a specific and demonstrable intent to defame Zimmerman the case is pretty much dead in the water. They can be as wrong or as incompetent as they want, they are only open to a lawsuit if the plaintiff can prove they acted with a specific intent to harm or defame him, and that only works if he's not a public figure. It's total horseshit of course, but the news media is pretty much untouchable when it comes to stuff like this.

I imagine he fired somewhat blindly (while his head was being dribbled on the sidewalk) and could have just as easily hit him in the shoulder or even the leg if Trayvon was kneeling to pin him. 331 #31-- I know a longtime law-enforcement officer from Jville who knows Ms Corey very well. His estimation of her was dead on with Mandy P's. But her bizarre politicization of the case has been a shock to him, as well. Important to note that Rick Scott was ABSOLUTELY HATED by the GOP establishment here in FL (not to mention the Dhims), he is a truly courageous, talented outsider who I think did what he thought was necessary to preserve order & justice in Sanford. For those thinking it's impossible to get a conviction on this case take a look at the OKC pharmacist who shot a robber, chased another one down the street, then came back, freaked out and then shot the kid 5 more times on the ground.

First degree murder conviction, now serving life in prison.

He was a loon, a bullshitter and he probably shouldn't have shot the kid again, but it sure as hell wasn't first degree homicide. It seemed like the system was more concerned about the racial aspects than actual justice. At the very worst it might have been manslaughter. Police are trained to deal with stressful situations, pharmacists aren't.
