Brit Hume: Obama's Executive Privilege Claim Has the "Stench of Cover-Up"
— Ace

And this Investors Business Daily editorial agrees.

Back in February 2011, Assistant Attorney General Ron Welch, in response to the investigations by Rep. Issa and Sen. Chuck Grassley of the Fast and Furious gun-"walking" program run out of ATF's Phoenix office, wrote a letter stating that the "allegation that ATF 'sanctioned' or otherwise knowingly allowed the sale of assault weapons ... is false."

Later, Deputy Attorney General Cole, in another letter to Congress, wrote: "Facts have come to light during the course of this investigation that indicate the Feb. 4 letter contains inaccuracies." In other words, the Department of Justice lied to Congress. The cover-up continues with the invocation of executive privilege.

Committee member Rep. Patrick Meehan, R-Pa., spoke in written remarks about the active intimidation of ATF agents and potential witnesses in the Fast and Furious probe by high officials at the Department of Justice. As we have reported, some ATF agents have already testified that Fast and Furious and its variants were no accident.

"Allowing loads of weapons that we knew to be destined for criminals — this was the plan," ATF Agent John Dodson told Issa's committee. "It was so mandated." ATF agent Olindo James Casa said that "on several occasions I personally requested to interdict or seize firearms, but I was always ordered to stand down and not to seize the firearms."

Fast and Furious has become worse than Watergate. No one died at Watergate. Just what is in those documents that Obama and Holder so desperately want to hide? Brian Terry's family and the American people deserve answers.

A third-rate gun-running operation?

The claim from the left is that this is just a case of "criminalizing policy differences."

But that's absurd. Does either wing of American politics support giving assault weapons to Mexican druglords?

I didn't think either did, but if it's "policy differences" we're criminalizing, that's the policy difference in question.

And, as a matter of fact: Selling guns to Mexican drug lords is criminal.

So is the United States' government's involvement in the murders of 200+ Mexicans and two Americans.

I don't think this is a cover up.

We (and by we, I mean "I") thought that the fact Obama fought so hard to prevent disclosure of his long form birth certificate meant that he was hidding something.

But there turned out to be nothing there.  No mbarassing mention of his father being arab, not black, or muslim, or negro or incriminating, like he was really born in Africa.  Nothing at all.

Obama just didn't feel like we needed to see that.

I think there is a very good chance that Obama is doing the same thing.  He thinks that we peons have no business dictating to him or his people anything at all.

We want the Fast and Furious documents?  Well Obama doesn't agree, so we can go take a flying leap as far as Obama cares.

I think he will fight this just on the "principal" that we don't dictate a damn thing to him.

27 Brit Hume, are you trying to take my job?

Posted by: Cpt. Obvious at June 21, 2012 09:51 AM (UZQM8)

28 Wild guess:

One feature of this operation was the propaganda against 'assault weapon' sales.  Another feature was affecting the balance of power of Mexican drug cartels by arming the weaker and prolonging the violence while perhaps gaining some measure of control over that now somewhat dependent cartel (obviously not a great plan).  It may even be that Mexico's government was aware of this and hoping to keep one cartel from being so dominant it was more of a threat to the government.

And thus, this is, in Obama's eyes, plausible national security secrets.

I think that kind of effort goes far beyond what is acceptable and Americans deserve to know about it.

98 "Botched" from the MFM continues to tick me off though. It was not botched, it was willful, and it was purposeful.

Meh.  It was botched, just not for the reasons the MFM would have you believe.

If the purpose was to weaken the Zetas and help the Sinolas: failed.
If the purpose was to weaken the Second Amendment: failed.
If the purpose was to catch the leaders of the Cartels: failed.

Only if the purpose was to weaken our own National Security while assisting in an armed rebellion against an allied nation did the operation not fail.

106 If FF was and is nothing as the administration claims, why executive privilege? Should've thought that one out Barky. Posted by: dogfish at June 21, 2012 01:58 PM ******* Correct. Executive privilege, as Issa noted in his opening remarks, can only be asserted when it involves direct presidential decision-making and communications. It cannot be invoked, legally, to prevent others in the chain of command from explaining their actions or responding to requests for information on their decisions in which the president is not involved.

Barky's administration can "leak" highly classified information on things like Stuxnet and Flame, and that is hunky-dory.

But correspondence on something that we have been assured over and over again is a great big nothing burger is deemed to be "For Your Eyes Only", and releasing that information could endanger national security or something.

145 Now this is irony ...

The Democratic Party is facing an awkward problem Thursday because white supremacist David Duke has endorsed a leading candidate in the Democratic Party’s primary race for a New York House seat. Duke says he’s endorsing Charles Barron, the leading candidate for the 10th district primary on June 26, because of their shared emnity toward “zionists.” Barron is an African-American city politician who has been slammed as an anti-white racist and as a Jew-hater. However, he’s already got the endorsement of the retiring Democratic congressman, Rep. Edolphus Towns.

ICE hands person of interest a work permit (Obama may issue a revised OE at any time)

191 Fun contrast with the NYT editorial. Liberal editorials are always such mushy drivel.

Are events conspiring to push Romney to pick Rubio? First the report that Rubio was categorically not being vetted. Romney is forced to say Rubio is being vetted and conservatives are worked into a lather about Rubio's wonderfulness. Obama panders to hispanics with this declaration of letting some illegals stay. Bill Kristsol says that's pretty great. Latest Quinnipiac poll shows Obama leading in Florida. Will these events, and events yet to come, encourage Romney to choose Rubio? Is there a crafty conservative scheme to push Romney in that direction?

My only argument with that -- and it's pretty slim -- is that when Reagan was Prez, Biden was     the   opposition.   Now he's the #2 and directly in the line of fire should there be any fallout.

Of course, he might be trying to be sneaky and get Obama ousted so that he can slide into the Oval Office for the remainder of Barky's term and then run at the head of the     Dem ticket.    The old Joe, pre-brain surgery, might have done that.

WAAAAH!  NYT op-ed:

"The political feud between the White House and Congressional Republicans has now culminated in a House oversight committee vote to cite Attorney General Eric Holder Jr. for criminal contempt. His supposed crime is failing to hand over some documents in an investigation of a botched gunrunning sting operation known as “Fast and Furious."

The Republicans shamelessly turned what should be a routine matter into a pointless constitutional confrontation. And the White House responded as most administrations do at some point: it invoked executive privilege to make a political problem go away.        While Mr. Holder has turned over more than 7,600 documents to the committee, he has withheld some subpoenaed documents. The committeeÂ’s chairman, Representative Darrell Issa, has treated this refusal as a cover-up of wrongdoing by the Justice Department. Mr. Holder claims that surrendering some of the documents would jeopardize criminal investigations and the confidentiality of the departmentÂ’s decision-making process."

Can you imagine the NYT response to F&F if GWB was President?  Yeah, me either.

The GOP really has no understanding of how to use the media to lambaste an opponent and obtain results.  Why not send a Congressman or Senator out to the media and ask this simple question:

"Why are the President and the Attorney General attempting to cover up an act of war committed by the United States against the sovereign nation of Mexico?"

Think about it.  The US Government permitted Mexican drug cartels (who are engaged in open warfare with the Mexican military and police forces) to obtain hundreds of military-style assault rifles, didn't notify the Mexican government and refused to track the weapons.  This action resulted in the deaths of 300 Mexican citizens and 2 Americans (that we know of).  There are likely to be many, many more.  What would the United States have done had Mexico supplied Timothy McVeigh with a few hundred pounds of TNT, not notified the US and decided not track it?  Suppose you could trace Oklahoma City straight to the Mexican government.  Is that not an act of war?

To me, this is probably the worst scandal in the history of the United States.  Watergate?  Big deal.  The President had a merry band of misfits who attempted to screw over the Democrats.  Who got hurt?  No one.  Iran-Contra?  We sold weapons to Iran and used the money to train anti-communist forces in Nicaragua.  Yes, it was kept from Congress, who likely would not have authorized it, but again, who got hurt?  Did the US contribute to the deaths of Americans and 300 foreign nationals?  No.

I truly cannot believe that the GOP doesn't get this.  If what's been reported about F&F is true, and the GOP doesn't find out: who created it and who authorized it, and send those people to jail, then they're a bunch of incompetents.  And if the President had any knowledge at all that this was going on, he needs to be impeached.  Now.  And if Congress votes to hold Holder in contempt, I would put him in jail until he releases the documents.  Forget the civil suits.  This is a matter of national security and criminal wrongdoing on a scale unheard of.

300 The explanation for Fast and Furious has been 'evolving.'

First it was touted as a way to try and trace the supply lines on how weapons got into cartel hands.

Now the Obama administration is claiming they shut down a Bush operation called Wide Receiver after it become Fast and Furious.

Wide Receiver was a joint US/Mexican operation to trace weapons and arrest the bad guys before the weapons vanished.  Even with diligent tracking and Mexican co-operation, some Wide Receiver weapons still slipped over the border.  Only 200 weapons were involved in Wide Receiver.

For Fast and Furious.  There was no Mexican involvement and in fact ATF agents were told not to inform their Mexican counterparts.  No diligent tracking by ATF was done on these weapons once they were sold.  And over 2,000 weapons vanished across the border due to Fast and Furious.  And in 302 cases of murder, Fast and Furious weapons were recovered at the scene.

So yeah there is a lot of similarity between the two operations.  Not.

The media also fails to note that the DNC had been pushing harsher gun laws and using US guns making their way into the hands of Mexican drug cartels as an excuse. Hmm liberal government shipping guns to Mexican drug cartels, guns in the hands of Mexican drug cartels being used to justify harsher gun laws in the US. It seems like there should be a profession that would investigate something like this and then inform the public about what is going on. I guess not though.... You know we're always told that The Bamster is the smartest fellow ever to occupy the Oval Office.  (Okay you guys in the peanut gallery, stop laughin yer ass off!)

But Jay Know Carney had this spin this morning.  "This all started in the previous administration.  It was a field directed operation out of the Phoeniz Arizona ATF office.  When Eric Holder found out about it, he put a stop to it! "

Okay there's the obligatory blame Bush shot.  But if this is true then why not just put all the cards and documents on the table and be done with it?

Well there is that little problem that Eric Holder first told Congress  he'd never heard about it before February of 2011.  He said that under oath.  But then he had to "retract" the statement--i.e. he admitted he'd lied.  He's since had to retract a couple of other sworn statements to Congress.

Okay Holder is a fuckup of limited intelligence and credibility. He's done this several times before so throw him under the bus and dump all the documents.

But no the genius in the Oval Office has to invoke executive privilege--which covers communications within the White House and between the President and his closest advisors--for documents relating "to a field operation directed out of the  Phoenix ATF office".  WTF--was Da Bamstah out in Phoenix directing this thing?  I don't think so.

But stupid things like that are par for the course for the SSCOAMF--aka Stupid Stuttering Clusterfuck Of A Miserable Failure.

It’s not a leak, but a flood. What does all that [public disclosure of foreign policy secrets] have in common? It’s a way to show how strong and assertive this administration is in foreign affairs. This [Fast and Furious] might show negatively on the administration. That is the only difference. If it’s national security, then they have no regard for secrets — and here [with Fast and Furious] all of a sudden they are extremely guarded.

335 @Al

Issa has some of the exact documents he's looking for, as well as a couple whistleblowers and a mole.

This is how he -knows- this is not a 'Dry Well' being defended for no good reason other than 'Nyah nyah na nyah na!'

He doesn't seem to have -quite- enough to just lay them on the table and have proof positive. The DOJ says they have "140,000 responsive documents". They've handed over 7,600 of those. And Issa is supposed to have dozens of the 'unreleased' documents. (See last week, or the week before, where the press was in a tither about how him having these documents was 'blatantly illegal!')

338 "14 I don't think this is a cover up. ... [Birther analogy] ...I think he will fight this just on the "principal" that we don't dictate a damn thing to him."     That's a legitimate point to consider. Just remember how Obama responded to the national security leaks - he was "insulted". He's so overwhelmingly narcissistic that it all has to be about HIM - and whether he imagines himself to having been disrepected (which is how he looks at anyone who isn't enthralled by him). At the same time, he didn't deny it, didn't vow to purge and/or prosecute the leakers, and didn't express concern about the damage to national security.     But the difference here is that we KNOW that large quantities of arms were given to drug lords. It is simply not possible that the Justice Department STILL "doesn't know" who was behind that operation, so to say a "cover-up" is going on is like saying "water is wet". The new twist is that we also know KNOW - for sure - that Obama is involved (at least in the cover-up part).

344 well if Cantor announced the date of the vote, then the pubs have the votes (probably a few dems too) and this game of chicken will go on. I think Holder and BN have enough hubris to keep saying no and force a constitutional crisis. They probably think they can drag it out until after the election and then BN will grant pardons all around. Or perhaps BN would like going out in a blaze of glory, on some pretend prog principle, thinking of himself as a prog martyr, since he is going to loose the election anyway

3. DOJ lying about it.

349 Once upon a time in Germany, 1980's we had ration cards for smokes and booze, all our firearms safe in the armory. One day, a disillusioned soldier decided he no longer wanted to be part of the Green Machine. Fell back to the end of a march formation and slowly disassembled his M16 and thew away the parts along the way. When it was found out, we spent the next 1/2 day looking for the pieces. Justice was served by the Platoon, then by the Top Sgt. Needless to say, losing a weapon on purpose is an offense not tolerated. Fast and Furious is same but not same. Larger number of weapons and higher placed individuals. The big difference, blood on the hands of a government toady's. Many things can be ignored in ones lifetime. Blood is not one of those things.

Watergate?

Well, there's some similarity, but Watergate was an illegal act to directly attempt to undermine the political process. FnF was an illegal act, but it remains somewhat speculative as to it being an indirect attempt to instigate political change. Personally, I believe it - but it's unproven.

"Dead bodies"? Yes, but let's keep in mind that DOJ was complicit, not directly responsible. The argument against bearing arms is that "guns kill people", rather than "(bad) people kill people (sometimes using guns)", so let's be careful with that kind of talk. That being said, when you give weapons to drug lords, it's reasonable to expect that said "lords" will kill more people.

Posted by: Optimizer at June 21, 2012 11:33 AM (As94z)

351 I said it before and I will say it again.  THIS is a Big 'Effing Deal.  Former Chihuahua state attorney general,  her brother was kidnapped, tortured and killed with one of the two thousand weapons smuggled into the country as part of operation ‘Fast and FuriousÂ’.  http://tinyurl.com/86unpgz    Plus, a Mexican attorney is preparing a civil lawsuit against the Bureau of Alcohol, Tobacco, Firearms and Explosives   http://tinyurl.com/btcfm8d   They are collecting “50 cases to present a solid foundation for a civil complaint” to add to the four cases currently documented.

Posted by: Optimizer at June 21, 2012 03:33 PM (As94z) That is too fucking stupid for words, and it seems to be the "new talking point" over the last few days. The fucking DOJ smuggled arms to narco-terrorists, DELIBERATELY. And they knew ahead of time that their "donation" would lead to innocent deaths, and when they were reminded they joked about it (according to whistleblowers). This is not about legal sales, this is not about guns as objects, this is about Holder's DOJ taking it upon itself to arm goddamned terrorists. The DOJ committed acts of war against a neighboring allied country. All the mealy-mouthed shit in the fucking world does not wash that away. And the fact that the US government under Obama is also running guns and explosives to Honduras under similar programs just makes it worse. And the fact that the so-called "liberals" aren't falling on Holder like a pack of wild dogs means that they're soulless political whores.

The fact that weapons were supplied to drug lords is practally a side-issue, at this point.

The BFD is that DOJ lied to Congress (gave a statement with - as THEY put it -" inaccuracies"). That was part of a cover-up, but now they are covering THAT up, too.

With Plame, in contrast, there wasn't even a crime, and the only prosecution was for some schmuck who was stupid enough the lie to the investigators.

358 @Optimizer, " Yes, but let's keep in mind that DOJ was complicit, not directly responsible".
Decision-makers and their legal advisers knew exactly what the term 'walking guns' meant and what the end result would be.  This makes THEM one hundred percent responsible AND guilty of multiple counts of murder.  Not to mention numerous violations of Federal Laws regarding international sales and transport of weapons.  THEY DID NOT ALERT MEXICO.  President George Bush administration did.  Why is this so hard to understand?

How convenient.  You guys normally claim that Pres. Obama knows Fu*k nothing.  Well, I tell you, Pres. Obama knows fu*k all.  The sweet variety, naturally.

That wasn't mine.  I think Director Michael Curtiz (Director of Charge of the Light Brigade) said something like this and it was recounted by David Niven in one of his autobiographies (maybe "Bring on the Empty Horses).   Another fun fact, surprisingly, it is believed both men died with the pleasure of never having experienced Mr. Obama in any way.
