CNN's Expert on Separation of Powers & Executive Privilege Engages In Furious Debate

He now says no US Attorney should take the contempt charge to a grand jury.

Guess what he said when Harriet Miers was found in contempt of Congress?

e contempt statute refers such matters to “the appropriate U.S. attorney, whose duty it shall be to bring the matter before the grand jury for its action.”

It is “unambiguous,” said Peter Shane, an Ohio State law professor who is an expert in executive privilege.

One thing he's definitely an expert in is donating to Democratic candidates and Moveon.org.

There is no point in noting it for the millionth time, but Republicans and conservatives are identified as such, while MoveOn.org members are called merely "experts."

I'm a bit conflicted about this.  I like it that Fox News is the conservative TV news channel, even though I think that US news channels should be out of the closet like UK newspapers are and drop the whole objectivity charade.  But I also like the ball-busting aspect of "Fair and Balanced". 


I like it when Kirsten Powers, Remi Spencer, and (to a much lesser extent) Tamara Holder or Juan Williams occasionally call out the liberal position on something as baseless bullcrap (as rare as that happens).  Then again, it's probably the same sensation that liberals get when they watch MSNBC and Joe Scarborough or Michael Steele are on.

Think of Cronkite. Now, because of Fox and Rush and Ace et al, they are spooked and hardening to the left and thereby making their true allegiance obvious. Call it the free market effect. When competition appears, you naturally gravitate to your base to protect your position. That's bad news for the MSM, because their base is far to the left of mainstream America.
