They want to use it as a way to destroy the 'self defense laws'....and they want to use it as a way to get Barky's base all fired up to vote for him.

This is why I was yammering away about the need to rein in prosecutorial immunity earlier.  There needs to be consequences for filing unsupported charges and for throwing the kitchen sink, and a charge for stealing the kitchen sink, at a defendant.  I am not well versed enough in criminal law, let along FL criminal law, to make definite statements, but my reading of the affidavit raised all kinds of red flags about false statements.  I wouldn't have signed it and I wouldn't have ever prepared something like that on a civil case for anyone else to sign.  Plus misleading a judge is a great way to violate Rule No. 1:  never tick off the judge. 

 

Obligatory:  not all prosecutors are bad eggs and there are those who are trying to achieve justice and not just drive up their conviction numbers.  But the system is designed to give incentives to getting the most convictions in the faster manner possible.  Given that, of course a prosecutor is going to hurl everything at a defendant in hopes of getting a quick plea down to a lesser charge.

What I would love to know (and likely never will) is whether or not she thinks he is guilty of 2nd degree murder. If she's overcharged in an attempt to get a plea deal that's one thing (bad IMO but understandable), but if she's overcharged hoping that someone else will take it off her hands (either from a dismissal or an acquittal) then what she's done is highly immoral.

The new judge set bail at 150K....which I thought was very reasonable. And he talked about, acknowledged, the risk of harm to both Zimmerman and the Witnesses.

 

Zimmerman can now leave the state and hide out until the trial. .....Which if we are lucky, will not happen until some time next year. ....The judge also mentioned how swamped he was with other cases.

The really new piece of news here is “gunpowder burns on Martin’s gray hoodie”.

While the injuries have been noted before and the pictures help confirm them, the burn marks have never been mentioned before. Now if we can find the location and eventually the angle of the shot it will seal the deal on the self defense shot. You donÂ’t get powder burns on someone you are stalking but you do when they are top of you and your are struggling for your gun. I think the autopsy will eventually reveal a lower torso shot location with an up angle trajectory, which helps explain why one shot killed him and quickly too.

He claims he was headed back to his truck, and not even really aware of where Martin was anymore (evidenced by, "He ran." on the 911 call) when Martin "confronted" him and attacked him.  That would clear him from manslaughter charges in my view.

Well so far all the new revealed details of the case have been consistent with Zimmerman's original story. So unless something dramatic comes out during discovery I don't see a conviction for murder 2 or manslaughter based on the evidence.

I suspect that since this occurred Feb. 26th and no charges were immediately filed, IF there was tape of him, the convenience store recycled the tape and it wasn't available 6 weeks later.

Another bad thing, about the delay in charges being filed.....in addition to the loss of possible video of Trayvon at the market.....is that there was probably no Tox Screen done on Trayvon's  body.

 

For all we know, the kid was out there in the rain smoking a joint, or waiting for someone to do a drug deal. .....If he was stoned, or on something, at the time of his death....then that would have bearing on Zimmerman's self-defense plea.

The visibility from the riots and fallout might also lead to more publicity about the upcoming flash robs that will happen this summer.  People need to know for their own safety and because knowing the truth will hurt O's chance of re-election.  Most people have no idea about what has been happening.

There was a shooting a few weeks ago outside a Taco Bell in Laveen, AZ (outside Phoenix).  A hispanic man walking his dog walked in front of a car that was going through the drive-thru.  The driver of the car, a black man in his 20's, had words with the man walking the dog, and then shot him dead.  The man walking the dog was mentally disabled and according to his family, had the mental capacity of a 12-year old.  The black man claimed that the hispanic man had swung a pipe at him, and that he shot him (from inside his car) in self defense.  Police found no pipe or other weapon at the scene, and one witness said the walking man swung nothing but his hand.  Police have not arrested the black shooter.

Where are all the race-baiters demanding justice for this victim?

They will find at least one witness who will lend some plausibility to this narrative.

That's the case for Murder Two.

They are trying to convict him on a perceived probability, to a sympathetic jury, that he acted the way they say he did.

In short,  the prosecution will use the OJ defense strategy in reverse, to prosecute rather than defend. Zimmerman will be painted as a racist by the prosecution in a court of law. If/when he is found not guilty he will have to go into hiding for the rest of his life. He'll probably move and change his name. In any event he will live in fear for his life.
