It's called a republic. We have a constitution because certain political choices, even if supported by 100% of the nation, are not allowed. I hate that "if you don't like it, vote them out" argument. If that were true, then we would have a pure democracy with no need for a constitution. Under that view, if we vote in a theocracy, that's ok because it was democratic.

No it wasn't. The actual bill was passed while they still had 60 votes in the Senate on Christmas eve. The "fix" which supposedly eliminated financing abortions (for the so-called blue dogs) and giving the unions a break on the taxes on Cadillac plans was done with reconciliation.

The SCOTUS interprets the Constitution. They struck down the application to the Commerce Clause. Americans elected the folks who did this/allowed this to be done.
It starts there.
We have been too apathetic for far too long.

Seriously, the more I think about it, the more I think this ruling "proves too much." There's basically no limit on taxing based on "behavioral triggers."
So, what's to stop a Republican congress from taxing abortion doctors $10000 per procedure? Nothing in this ruling would. It wouldn't make abortion illegal under Roe v. Wade, it would just be a tax, right Justice Roberts?

That is the nub. The Commerce Clause needs to be completely amended so that such a ridiculous interpretation can never again even be suggested. That still leaves the problem of this authorization to do anything by way of calling it a tax. I'm not sure how we solve that problem.

Health Care and Education Reconciliation Act of 2010 passed after the actual Obamscam was passed. Its intent was to fix problems with the act that was already passed
It did the following
Increasing the tax credits to buy insuranceEliminates several of the special deals given to senators, such as Ben Nelson's "Cornhusker Kickback"
Lowers the penalty for not buying insurance from $750 to $695
Closes the Medicare Part D "donut hole" by 2020 and gives seniors a rebate of $250.
Delays the implementation on taxing "Cadillac health-care plans" until 2018 (more union payoff)
Requires doctors who treat Medicare patients be reimbursed at the full rate
Sets up a medicare tax on the unearned incomes of families that earn more than $250,000 annually.
Offer more generous subsidies to lower income groups. Households below 150% of the federal poverty level would pay 2% to 4% of their income on premiums. Health plans would cover 94% of the cost of benefits.[18] Households with incomes from 150% to 400% of the federal poverty level ($88,200 for a family of four) would pay on a sliding scale from 4% to 9.8% of their income on premiums, rest will be covered by government advanceable, refundable tax credit. Health plans would cover 70% of the cost of the benefits.[18][19]
In 2014, if a company with more than 50 workers does not offer coverage, they will be obligated to pay $2,000 for each full time worker in the company, exempting the money due for the first 30 employees. For example, an employer with 53 workers will pay the penalty for 23 workers, or $46,000.[18]
Would increase Medicaid payment rates to primary care doctors to match Medicare payment rates, which are higher, in 2013 and 2014.[18]
The federal government would pay all of the costs of expanding Medicaid under the reform until 2016, 95% in 2017, 94% in 2018, 93% in 2019, and 90% thereafter. Some states that already insure childless adults under Medicaid would receive more federal money for covering that group through 2018.
The Medicare patients will receive 50% discount on brand-name drugs would begin in 2011. By 2020, the government would pay to provide up to 75% discount on brand-name and generic drugs, eventually closing the coverage gap.[18]
Would extend the ban on lifetime limits and rescission of coverage to all existing health plans within six months after signing into Law.[

Folks, I ain't happy with the ruling either. But John Roberts just
1) set serious limits on the Commerce clause
2) redefined Obamacare as a huge tax on the middle class, and
3) energized the tea party as well as a lot of folks who don't consider themselves tea partiers.
None of those are bad things. It may not be what Roberts intended to do; but I'm pretty sure he understands what the effects of this ruling will be.

It would mean that the Executive could GRANT Bills of Attainder, which are expressly forbidden by the Constitution for Congress to pass.

Yes, but now they don't need to actually call it a tax -- they can call it anything they want when passing it, and only if challenged will they have to argue that it within their taxing power.

To the right, something is constitutional on its own merits, reason, and based on the founding fathers' writings and thoughts on the matter. How the court rules is irrelevant: if they rule differently than the constitution states, they're just wrong. If they rule properly, they're right. They don't decide constitutionality, only how the government perceives it.

Paying the fees for a HC plan is a tax. Paying the penalty is a tax. Supreme Court just said so.But heres the thing.No policy,No problem ,because the hospital and Now the Insurance companies CAN'T refuse to give me coverage till the end of time. That penalty is nothing compared to what a full year of health insurance will cost especially for single adults. Bring on the penalty boys, I got a ferrari to save up for.
