Drudge Speculation: Did Obama Get A Leak From The Supreme Court?
— Ace

And is that, then, why he took a shot at them, should they continue along with current plans?

Kaus wondered a few days ago if/when we'd get a leak from the result of the conference vote -- the first, non-binding vote by the judges.

This is the hottest question in the nation-- could any wife or husband not help but beg to be told? And what about all those clerks? Secrets are fun to keep, but even more fun to tell!

Could a secret this size not leak?

Not sure if Drudge is hinting he's heard something (and if he did-- it couldn't be a great source, verified, or he'd report it) or just indulging in blogger-ish speculation.

78 But the bigger problem in America is that the Supreme Court has too much power

Congress seems to have forgotten that it has the power to define and re-define the Supreme Court's jurisdiction

of course, the way things go in America today, Congress could change the Court's jurisdiction, and the Court would find that unconstitutional

If Axelrod can get a sealed divorce record out into the public (e.g. Jack Ryan), figuring out a 5-4 ain't nothin' but a thang...

Grammer nails this character. The things he does to further his power and political fortunes are exactly what Dems in those posistions do. It is very scary how accurate most of it is.

111 Bam calling out the SCOTUS... how low can we go, Barry?

Kagan probably was the snitch... she needs to be impeached if she was.

Pulled from Answers.com

Yes.

Under normal circumstances, a Supreme Court justice is awarded a lifetime commission.

A Supreme Court Justice may be impeached by the House of Representatives and removed from office if convicted in a Senate trial, but only for the same types of offenses that would trigger impeachment proceedings for any other government official under Articles I and II of the Constitution.

Article III, Section 1 states that judges of Article III courts shall hold their offices "during good behavior." "The phrase "good behavior" has been interpreted by the courts to equate to the same level of seriousness 'high crimes and misdemeanors" encompasses.

In addition, any federal judge may prosecuted in the criminal courts for criminal activity. If found guilty of a crime in a federal district court, the justice would face the same type of sentencing any other criminal defendant would. The district court could not remove him/her from the Bench. However, any justice found guilty in the criminal courts of any felony would certainly be impeached and, if found guilty, removed from office.

In the United States, impeachment is most often used to remove corrupt lower-court federal judges from office, but it's not unusual to find disgruntled special interest groups circulating petitions on the internet calling for the impeachment of one or all members of the High Court.

Given the questions asked by the SCOTUS, and the fact that some of them seem so basic that this case should never have made it to the SCOTUS case should have been decided at the circuit level ObamaCare was clearly unconstitutional, was never properly voted on, was opposed but the majority of the taxpayers, and should never have made it out of committee, ... was/is a leak likely?

JEF, that Ayatollah of Con Law, missed the lack of a severability clause and the unconstitutional reality of ObamaCare, the government's lawyers were stumbling (doing, I think, the best that anyone could do in such a situation), the Leftists and MSM are having conniptions (and editing videos badly) ... was/is a leak needed?

Now JEF sees that he's going to take 7 or so of 9 torpedos, while not at battle stations, and has to do something ... arm the Teleprompter.

If only we had a group of people whose job it was to ask questions of the government and report the answers.

194 Always wondered how the conservatives and the liberals on the Supreme Court could be so cordial to each other, even hanging out and stuff when they are so ideologically different.  Shit, I couldn't even think of marrying someone that wasn't at least in the same ball park politically as I was.  I would spend all day looking at him and wondering how he got to be so fucking stupid.  It would never work.

There was a leak back in the 60s or 70s.  It was mentioned at NRO.  Some copier operator blabbed a day early.  He got re-assigned.  Typical Govt. job.  They didn't can him.  They moved him to another slot.

206 Looks like the Prelim vote went against Ocare. Of course, that can change as draft Opinions circulate the next few weeks. Watch the NY Slimes and the DC Compost this week. If they come out with editorials fretting about judicial activism, we have our confirmation, the first vote went for us. Its gonna be a helluva party, the one we should have had back in 10, when we thought we'd won this thing by getting Scottie Brown elect.

No, they can't.

Federal courts have no subpoena power or power to issue warrants,  EXCEPT through the application of the legislative and executive branch, or regarding administrative law questions DIRECTLY related to the courts (such a disbarment of an attorney licensed to practice before them, for offenses committed IN court.  cf. Bill Clinton.).

"Standing" refers to a judicial standard that needs to be met in order for a party to bring a suit before the courts.

The judiciary can't bring their own cases; they decide "cases or controversies" brought before them from parties who have standing. So "standing" is a meaningless term when applied to the courts themselves.

No standing, no ability to pursue a case, therefore no ability to issue subpoenas re evidence or witnesses.

Neither Congress nor the Executive can force the Judiciary to issue warrants or subpoenas. And vice versa.

OTOH, some executive branch agencies have the power to issue subpoenas in certain cases before them.  Ditto Congress.  In the former case, Congress delegates that power to the Executive.  In the latter,, Congress operates under its "oversight" powers.

But there's no way SCOTUS has a "Payback Power".

214 "President Barack Obama took an opening shot at conservative justices on the Supreme Court on Monday, warning that a rejection of his sweeping healthcare law would be an act of 'judicial activism' that Republicans say they abhor."
Jeff Mason, Reuters

Abhor! Woohoo.

The SCOAMF is stuck in his own mire. Can't wrap jug ears around "judicial activism". Gee, as if fulfilling a constitutional obligation determining the relevance of a law is the same as pulling a law out of your ass from the bench.

And the birfers are still hanging on. Run with it. You look like fools. Bigger fools, actually.

Racist homophobic zenophobes who are on the wrong side of literally every significant political issue facing us.

President Obama mops the floor with mittbot.

Did you know that the mormon church has one single desire that rises above all others? That is their plan to control the US government. Its an undeniable fact. mormonism blends faith and political control together. Plus, mittbot will take his orders from the living mormon prophets. If he fails to follow their demands, mittbot loses his god status, loses his own planet in the afterlife, and loses the ability to resurrect his dead wife in order to fuckity fuck non-stop to polulate the new planet.

I ask you, if a Dem had these beliefs, would you not be going apeshit at the crazification factor demonstrated by libruls to put forth a theocrat-a theocrat who does not share your beliefs about god and jesus and heaven and hell?

Im staying home this election. It aint worth the fight. Frankly, all the wildest claims about our country being on the brink of something is outlandish pathetic babble.

217 The Mormon Church, through its political organization, the Kingdom of God, says John J. Stewart in Joseph Smith the Mormon Prophet, plans on gaining a political stronghold in the U.S. government. The goal is to “bring the United States Government under the rule of the priesthood.” (6)
This is reiterated by John Heinerman and Anson Shupe:
For them the prophecy [of Daniel 2:31-45] says that the Mormon people and the resources of         their corporate empire will be the prime movers in a millennial overthrow of the United States         government.” (7)
Eventually, their ultimate aim is to create an ecclesiastical, one-world government.” (
This means, as Brigham Young stated in the Journal of Discourses, “no more or less than the complete overthrow of the nation, and not only of this nation, but the nations of Europe". (9)
Believing this goal to materialize sooner, Brigham Young declared, according to historian Bancroft, that “he would himself become President of the United States, or dictate who should be President.” (10)
Further, Joseph Smith, as well as all succeeding Presidents of the Church, determined that this new government would be a theocracy, not a democracy.

"Earth to President Obama. You arent FDR."

But he will relive one of those “FDR moments”.
There was Humphrey’s Executor v. United States, Schechter Poultry Corporation v. United States, U.S. v. Butler, Carter v. Carter Coal Co., and Morehead v. New York ex rel. Tipaldo. All cases where “New Deal” legislation was struck down by the SCOTUS, often with the three liberal leaning justices, Louis D. Brandeis, Benjamin N. Cardozo and Harlan F. Stone, in the majority.
