But, yes, Memento was good. And Dark Knight was brilliant.

I am predicting that the third one will be like Prometheus. It will get 70-something on RottenTomatoes, and as the weeks go by it will be understood that the movie was a disappointment. The debate will be over whether it disappointed because it was a crappy movie or because it could not live up to its predecessors.

44 I dunno. I'm just not into all this doom and gloom. I really think what Roberts did is the best thing that could have happened. One of the main reasons why I think so is it has prevented the left from playing victim and ginning up the sympathy vote. Don't underestimate how powerful the sympathy vote can be when people perceive that someone has been treated unfairly or "partisanly." The Dems have to acknowledge they have been treated fairly here, while under the surface their power has been curtailed. As Jay Cost said, don't overreach, take opportunities where they present themselves. That's how you promote your ideology effectively over time. It's our job to fight for freedom. Roberts has shown he won't do it for us, but he has given us the tools to get it done easier. Just think, we can repeal this thing with 51 votes! We've got momentum going into the election, Obama has to defend this thing as a tax and more and more people are waking up to the damage this is doing to the economy. The states have it easier to rebel too with the Medicaid expansion ruling, which will make the thing even harder to implement. In short, this is a bloody mess that Roberts just made messier which is going to make it fall apart of its own weight. Think how much better it will be to have this boil removed the same way it came about, instead of removing it through the court. This way it won't have the stench of illegitimacy that breeds resentment that would hurt our cause. Yeah, in a perfectly just world it would be great if Obamacare was overturned and all the sudden people understood how good and true conservatism is. But in the real world, I think this decision gives us the best shot to change hearts and minds and begin the slow process of turning back big government. If we will use the tools Roberts has given us.

95 God I hope Dark Knight Rises isn't a disappointment. I got bored during the Avengers when they ended up fighting the nameless, faceless aliens in New York. No dramatic tension whatsoever. The fact that 100,000s of innocent people should be getting blown the fuck up in this battle gets glossed over. Prometheus pisses me off the more I think about it.

 I hate the fact that they are rebooting the DK series after this one to lead into a Justice League movie like the Avengers. Batman should be like James Bond. Put enough effort into a movie every 4 years or so and the series can go on forever. Not all of the Bond movies are great but are still of high quality. But NO, DC thinks (incorrectly) that they'll make more money if we see Batman hanging out with Green Lantern and Aquaman (aka Semen). The next Batmen will probably be a 17 year old angsty shithead to bring in the Twilight crowd.

Yes, I have gotten some unusual reactions from the decision from people. 

My boss said something that really floored me, and I think it's because how much health insurance is costing our company in the US.

And I know quite a few people tha appear to accept this, and even embrace it. My wife's cousin is a professional parasite, has milked his disability (he hurt his back many years ago as a fireman and has not worked since, because he could get away with it, although he used to play golf all the time), and really loves the idea of Obamacare. And that's typical of him, the lazy bum. He's overweight and wonders why his knee is killing him. Well, he put on all the weight after he gave up the cocaine habit (at least that's what his brother thinks).

20 minutes ago I'm having the positional look (nobody there tight left otherwise wide still under brake) before making the left onto my road and zip a guys goes thru the stop sign, intersection and into the next street.  No passenger wheel, sparks flying.  I go home.  meanwhile giant T-storm has finally busted loose.  It's raining to hard to get out of the car.  Call 911, being sane and therefore worried about people vs. my cat.  Is anyone hurt?  So I drive back. It's one of my neighbors he looks ok.  I drive back up the street and pull his wheel out of the road then Montco Fire and EMT arrive.   It looks like he hit one  SUV with his SUV knocked the wheel clean off and went sparking > 40 yards.  Plus the hit SUV hit 2 cars in front of it.  You could smell gas in the downpour too.

Actual effects are pretty wild to see.

 Sometimes I wish that I was as oblivious as the many drones out there. I watched the SCOTUS decision in a waiting room filled with people who had no idea what the hell was going on. While I was literally shaking with rage, the others in the room read their shitty magazines or yakked it up on the cell phone, When Obama came on to gloat, one woman in the room was nodding and saying "amen" repeatedly. But again, the rest of the room collectively yawned. I don't know which reaction was worse.

But it's in my nature to give up. I've been politically ware for a long time now but I've never actually done anything tangible. This time I'm going to be pro-active. Knocking doors, persuading friends, maybe even volunteer as a poll watcher. With my luck I' ll get the North Philly Black Panthers precinct.........

We can treat the symptom perhaps, if we get lucky - but the disease is folks like Roberts and for that we have no cure. His decision was more than just bad, it's a nightmare. I know a lot of people are trying to say he "limited the Commerce clause" and such, trying to put a positive spin on this - but when you actually read the decision he did no such thing. When he wrote that note how he very clearly states he is speaking for himself, and not for the majority in that regard. That puts no limitation on anything and will not be regarded in future decisions as precedence because he very carefully stated that opinion was his own, and not that of the court. What the Chief Justice of the Supreme Court did was to completely ignore the Constitution and the facts of the case before him and to be blunt did the legal equivalent of a magician yanking a rabbit out of his ass. The Constitution is crystal clear that Congress only has the power to levy taxes, but it must be one of only a very limited list of taxes and if a tax does not fit into one of these categories, Congress may not levy it. Roberts ignored this completely. He also ignored the fact that in order to consider this a tax you have to rewrite certain sections of Obamacare which specifically state that it is not a tax. He also ignored numerous amicus briefs that spelled out in very specific terms that the tax argument could not be used for many of the reasons I listed above, so the man was well aware his written opinion was total horseshit from a legal perspective. I have no idea what Roberts was thinking or what his motivations were, but this opinion is quite possibly the worst thing to come out of the Supreme Court since the Dredd Scott decision and that is really saying something. Congress now has to power to levy any sort of tax it wants without limitation, something specifically forbidden by the Constitution, and it now has the blessing of the Supreme Court. The people who's only job was to prevent Congress from making laws that violated the Constitution. Obamacare? It's a moot point. It most likely won't survive at all regardless because states can now simply opt out and the Feds can't force them to do otherwise. That is the only slightly muted silver lining that came from this absolutely terrible, illegal, reprehensible SCOTUS decision. What really happened is that Congress now has a green light to do more or less anything it wants under the taxation clause. What the Obama administration has managed to do in four short years is to more or less completely destroy the separate but equal branches of Government and Roberts put the last nail in the coffin with the most horrible decision ever made by a "Justice". Yes, we can elect Romney. We can hopefully take back the Senate. Maybe they will appeal Obamacare. All nice things in the short term. But in the long term? In the long term Roberts just signed the death warrant of what we all once knew as the United States of America. No way to polish that turd. Sorry, but their simply isn't. Ok, going to take my gal, grab some Mt. Dew and another pack of cigarettes. Back after a few.

Joffen, I've pretty much always thought Republicans/conservatives have to do all the heavy lifting to save fucking retards from themselves (and taking us down with them).

 

A great example of this was Wednesday night, pre-SCOTUS ruling.  Hannity had Frank Luntz on his show with a bunch of Obama dipshits - either all or the majority had voted for that POS.

 

Luntz asked how many were against Obamacare and all but a few raised their hands.  Of course they all proceeded to yak about how bad it was, even a couple of doctors were there.  Just hated it.  On and on and on.  Then, Sean asked Luntz to ask the most stupid people on earth how many of them were thinking of leaning towards Romney and only a few of them raised their hands!  Maybe around three or four people said they weren't going to vote for Obama again.  WTF.

 

The next day I was thinking about these douchebags, and I thought, well, fuckity fuck, these fuckers all expected Obamacare to be overturned just like the rest of us.  But these fuckwads are the kind of people who let everybody else do the heavy lifting - SCOTUS, the Republicans, you, me - so they can keep on being the stupidest freaks on God's green earth, all the while hating the very people who will get rid of Obamacare for THEM.

 

Hey, I live in California so I see these freaks everyday.  I do feel surrounded.  But I'm lucky.  Every member of my family, except for one (and he's a real piece of work to resist us), is a conservative Republican.  And I come from a big, big family.  So that's how I make it through.  That and  God and the blogs.  But every election I vote to save fucking assholes from themselves.  It doesn't do much good here, but I celebrate it when I hear and see it in other states.

But what i want to point out is that the Left steadily worked over our system for years and years, and their Long March through the institutions is paying off. And the way they did it is by exploiting all the small options they had over time to advance their cause. All I'm saying is, are we going to look at this decision and just sit around and say, oh I guess they beat us and always will because the system is too far gone? Oh hell, I think they've moved the rail project Harry Reid's been pushing into the middle of the MOJAVE desert, then run it to Las Vegas.  The problem was some natural habitat for turtles was in the way.  So, you'd have to drive 90 miles (from L.A.) to the Mojave desert (can't remember the town), leave your car, then ride the rail to Las Vegas (probably at 60 mph), where you'd have to either take the bus around town or rent a car.  Yeah.  Brilliant.

I think what upset me about this ruling is that I honestly thought that for the first time in decades SCOTUS might overturn a federal welfare program. But it was business as usual. I think they wanted to put it in Victorville possible Barstow, and yes there is a huge Desert Tortoise preserve in the Mojave. Not like they don't have enough Mojave green rattlesnakes to keep them company. It's probably cheaper to fly to Vegas anyways.

No matter how hard you try to tell people there is no such thing as a free lunch, guess what - sadly most people simply will never get it. Look at Greece. They are totally fucked. They have gone down this road already and even now a good percentage of their population after watching their own economy collapse is whining to the government and expecting the government to fix the problem. These people would reject austerity measures that are no longer an option, but an absolute necessity and just pretend that they can keep living off their government forever. The point of this latest SCOTUS decision? Twofold. First, it was the one man in the nation charged with defending the Constitution above all else who pulled this nonsense and completely ignored the very legal document he swore to protect. He didn't read something into it, he didn't twist things around a bit or push or pull at the edges of legal interpretation. He absolutely flat out ignored an ironclad, no uncertain clause in the Constitution laid out in black and white that stated in no uncertain terms he could not render the decision that he rendered. The other decisions you mentioned were pretty bad, I'll grant you that - most of them were based on some pretty hinky interpretations of implied "rights", etc. But this wasn't some "well you can infer the Constitution means this because" sort of argument. This was a "The Constitution says this is completely, flat out, 100% illegal. However I'm just going to completely ignore that" decision. No way to gloss that over. Roberts is the absolute poster child for just how wrong we have gone as a nation. So yes, of course, we try to turn things around. 509 I'm beginning to suspect that Roberts did indeed change the decision at the last minute because of political pressure from the Thugocracy......but did it because it pissed him off and not because he chickened out, and that there's a big FU in the way this will play out.

To start with, remember the SCOTUS' workload. they only issue a couple of dozen opinions per term, and mostly just ignore the hoi-polloi. Real work of judging is done in "inferior courts" -- original jurisdiction and courts of appeal. But the SCOTUS is supposed to guide these courts by means of their opinions.....and what did SCOTUS just tell them?

Roberts' opinion says, "we've got 5-4 that it fails Commerce Clause -- take that down. If anyone shows up, waves the piece of paper around and says 'Commerce Clause', they lose -- and DON'T SCREW THAT UP BECAUSE WE DON'T WANT TO OVERRULE YOUR FOOLISHNESS. Next, we were supposed to look at the individual mandate, which says you're supposed to buy insurance....but if you look at the law real carefully, it says that you pay this weird income tax if you don't buy insurance but can't go to jail. Can't keep Congress from doing weird income taxes or we'd never do anything else. Now, speaking off the cuff....and not part of the opinion....I've heard through the grapevine that there's supposed to be zillions of pages of regulations spewed out of this pustulent carbuncle -- but they weren't included in the hot mess that came to our court. Let's just make sure that everyone understands that these regulations must be consistent with a tax, so we don't have any conflicting circuit issues that feed things up to us again [shoots meaningful gaze at 9th circuit judges, who look at their shoes -- except for Kozinski, who's trying to keep from laughing out loud]."

So, the way this plays out is that Roberts gets 5 Justices to torpedo the thing on the basis that it's not Commerce Clause. Might even have drafted the opinion. Then he gets this constant shitstorm from the WH, along with Kagan and Sotomayor whining, and this gets on his nerves. So he comes up with a way to apparently approve Obamacare at SCOTUS, but make this thing consistently fail at the appellate level or below just to twist the knife -- it need never rise to SCOTUS again. He takes it back to his original buds, and they recoil from the waste and human cost and say, "we can't sign up to that!!!"

He goes back over to the lefties and says, "let's make a deal. We've had a lot of unpleasantness -- Ruth says she wants to retire while Obama can choose a replacement, I've got 5-4 that Obamacare fails on the Commerce Clause, I've got a media shitstorm, Kagan keeps whining about being ruined if the WH's sexual history dossier on her is ever published, Sotomayor's got that cousin.....Ruth stays until after the inauguration, and we'll sustain Obamacare -- but only on the "taxation" grounds that were brought up for five minutes on day 2 by what's-'is-name, the idiot."

Walking away with the agreement made, he thinks: "wait until Sibelius finds out she's been made into a 3rd-level IRS agent instead of Health Queen....."

I got to this scenario by pondering the fact that it wasn't really a choice between SCOTUS giving us all we wanted or giving the Administration all they wanted.....it was whether SCOTUS did anything at all. Imagine how much worse off we'd be if SCOTUS had ruled that the issue wasn't "ripe"! Instead, SCOTUS borrowed a page from improvisational acting and told BHO -- "yeah, sure, it's legal....so long as you continue to act like a lobster." SCOTUS could have just said, "no, it's not legal" or "we don't yet care" -- but the Administration managed to piss Roberts off. Now they'll get bundles of court decisions on the regulations that say, "you could only do that if you were a lobster (oops, sorry, this was a tax)....and it sure doesn't look that way."

To put icing on that cupcake, he's pranked the lefties into crowing about the screwjob and clarified that reconciliation can spike the heart of this monster, made it so that the death-of-a-thousand cuts comes from some other court than SCOTUS -- and, further, that it will look like the Administration's ineptitude every time it happens.....and provided a blueprint for combating overly-broad legislation in the future ("Dodd-Frank? Oh, sure it's constitutional....it appears to be one of the 'uniform Laws on the subject of Bankruptcies throughout the United States' in the enumerated powers.")

I don't know if I'm convinced -- and events can certainly go different ways from here. But I'm not quite ready to burn Roberts at the stake yet.

I recognize that our enemy is powerful, entrenched, and has a lot of firepower. That doesn't mean I'm giving up the fight, it just means that I'm identifying their strength so I can best prepare for the battle. I'm also making contingency plans as well, because that's what you do in a situation like this one. So yes, I will continue to fight within the system for as long as I can to save America. The real game changer for me was that after this latest SCOTUS decision, I have realized that it might someday become a very real possibility that it just might not be possible. It might someday become a very real possibility that at some point the only option we have left is a second revolution, and another Constitutional convention so we can make certain that this doesn't happen again. Until yesterday I never believed that I would see such a thing in my lifetime. Yesterday I was confronted by the cold hard fact that it might very well come to pass. That was what changed for me yesterday. I guess others may not see it that way, and that's fine. All I can do is call out a warning. So I'll just keep doing what I can to prevent it, but now I am also forced by these events to prepare for it as well. I hope others will do the same. I just really, sincerely hope that it will never come to the point where my preparations were necessary. The last thing in the world I want is to tell someone I told you so - I will be far happier if a decade from now someone is telling me "See, I told you that you were just being paranoid".

Cthulu, I get your point. I think your also aware I have a great deal of respect for your opinions, not to mention the fact that HB loves you to death.. lol. My thought process here is a little different. No matter what Robert's motives might have been, regardless of how this plays out - the only way to justify the opinion he wrote is to ignore not only the Obamacare law as it is written but to ignore a very specific limitation in the Constitution as well. Even if one accepts the notion the Obamacare debacle is a tax even though several sections of the law spell out in no uncertain terms that it is not, the Constitution does not allow Congress the power to levy this type of tax. It doesn't fall into any acceptable category of tax that Congress has the power to levy, and the Robert's opinion flat out ignores this fact. Maybe Roberts did have good reasons to want to uphold Obamacare and toss it back in Congress's face. Maybe he is wicked smart and that everything you say will come to pass will come to pass as a result. My thinking here is it doesn't matter. The ends will not justify the means. SCOTUS should never be able to simply ignore the Constitution, no matter what the eventual outcome. So yes, get where your coming from and really hope you are right. But in the end, If a supposedly conservative Chief Justice has gotten to the point where he thinks he can ignore the Constitution, then where are we as a nation? Just some food for thought I guess. 569 Stuck, Is the Security+ certification(CompTIA)worth anything? In terms of actual, real world, useful knowledge? Iffy at best. It's not that hard to pass and the cert that is considered pretty entry level. Any cert you've got makes you a little more employable to a certain extent and looks good on a resume. But truthfully as security certs are concerned Security+ would be pretty much the lowest end. If you can take it without it costing you an arm and a leg it might be worth considering again just from the resume filling aspect.

To begin with, I only know what I read -- and I'd have to be in mortal peril to submit to reading the actual text of the law. But from what I hear, there are many, many, many parts where the drafters were "too clever by half."



Most everyone is familiar with the severability clause, that was intentionally yanked (it's in the word processors of legislators as "yadayada" and attached to the end of every bill -- even those with just one section). Another one -- and my failing neurons are dredging this out of the sludge -- was that the penalty was X% of taxable income to a maximum of $Y, was to be included on your 1040, the IRS was going to collect it, but (in order to feel more like a fine), you could not be jailed for failing to pay it even though you could be jailed for not paying anything else on the return.



And Roberts is going, "oh, you hiked the income tax by X%". Not a previously unknown tax; not a poll tax; not a fine or penalty; not a tax on breathing or imminent enslavement.... If everyone told Obamacare to take a hike (to avoid the penalty, you'd have to provide information about your qualifying insurance plan), it'd look just like an across-the-board increase in Federal tax rates.


Now this is very much like, "ok, do the scene again, but pretend you're a lobster." Federal tax administration has been heavily litigated, and there's case law out the yingyang for all sorts of strange things. 



It's completely obvious that this is a bolt from the blue....and there is every indication of shady machinations behind it.....but it's not outright capitulation -- it sounds more like "come down and fight in the bayou, after dark...." But there was the "easy out" of joining with the cons -- why'd that get passed up?



Alternatively, why not just punt? There were a zillion opportunities -- it's not "ripe", it's not a tax under anti-injunction, can't see the regs....they could easily have kicked the can. They have no obligation to take a case at all.


And then I thought.....what would be worse than overturning and guaranteeing that you will see it again time and time again? How about sustaining, and guaranteeing that you WON'T see it again, because all subsequent cases are decided against it and never make it to SCOTUS?

Thing is many of the higher level certs actually require you to have worked in computer security for a year or longer before they will actually let you take the certification. So from that aspect if you can take it for free, hell yes. It won't be a game changer for most employers, but it least it indicates you have an interest in pursuing that career path and that you have some aptitude for it.

But I think to myself this: People tax cigarettes and the government openly admit it's to discourage people from smoking. Is there a Mandate to get married? If not, why do they get a tax benefit? Is that unconstitutional? Is it governing "commerce"? And marriage is commerce (e.g. the license). Many here would have cheered for the mandate being called a tax in 2009 because we could have used it against the Dems in the mid-terms. But now it's absurd? Look, I can only tell you from a personal view: I always considered it a tax and was told by a person or two who knows tax law better than me (but so does everyone) that that was the way to defend the law. I would've tossed the Mandate out and then forced the Dems to raise taxes honestly not by another name. But Roberts got the four Libs to admit it was a tax. That's not nothing. Use it. Once I was dead set against Romney. No more. Not after Obama kept blaming Bush well into the fourth year and Romney showed some guts in not throwing Trump overboard. We can defund this thing w/ Budget Reconciliation and use that as leverage to pick off Dems to initiate repeal and replace (and it will have to be replaced to be repealed). It's not over. Not even close. But never never never...I mean NEVER resort to legislating from the Bench. When you do you just tried to kill someone else by drinking poison yourself. And then you're truly, as the Red Baron said in his last words: "kaput".

If you're going to get certs get certs in an area you intend to spend time in to become proficient. Nothing so maddening as someone with a cert who doesn't actually *do* that. Certs drive me nuts anyway, because of the Certification Explosion, people with expendable income who are good at taking tests have a million of 'em, and they're like a "tax" on IT people otherwise. Yes, they make a difference, more with some companies than others. They can be as expensive as a college education for certain specializations. Feels a little "guildy." Wish I'd come up with the idea, though.

I guess the other thing that really hit me was the recent announcement by POTUS (or in deference to Steevy, SCOMAF) that he now has the power to selectively enforce whatever laws he likes and ignore those he doesn't, and the deafening silence that resulted from it. Frankly, that scares the shit out of me.

If you don't purchase them, you don't have to pay the tax. The "tax" in Obamacare is pretty much bass ackwards from this concept. If you don't want healthcare, tough shit. You will either purchase it anyway or you will pay a tax. The rub here is that taxes, like the ones on cigarettes, are permitted by the Constitution. The tax like the one in Obamacare is not. It does not fall into any of the very limited powers of taxation granted to Congress by the Constitution. The income tax didn't either, not initially. They had to pass a Constitutional amendment to grant Congress that power (the 16th I think, could be wrong, going off the top of my head). That is my issue. Hopefully that clarifies. Also, I never stated I wished anyone to legislate from the bench. I do however think that above all people the Chief Justice of the Supreme Court should actually take note of what is in the Constitution and not ignore restrictions that are spelled out in crystal clear language when issuing a ruling.

The evidence suggesting he might have changed his vote as well as his statement regarding elections having consequences only reinforce that conclusion. Ultimately, then, it appears he (ironically) made a political decision in a desire to appear "above the fray".

Security+, like most of the CompTIA certifications, is like Pre-Med. It's what you have to do to get into the serious training for the better jobs. A bunch of stuff uses it as a base requirement or as an elective.

It's mostly memorizing trivia and essential concepts. If you cannot walk through the test after a couple weeks of studying you probably shouldn't aspire to anything serious in IT anyway. If nothing else it serves as a filter in that respect.

The BH is doing fine and will do better with rest. She recently shucked about 70 pounds, has had a minor illness, but had a larger safety margin for some things at her prior weight. It's more of an embarrassing clusterfuck of crossed circuits than a serious problem. We're probably doing a short hike in the hills tomorrow, after she sleeps in.

624 The BH is doing fine and will do better with rest. She recently shucked about 70 pounds, has had a minor illness, but had a larger safety margin for some things at her prior weight. It's more of an embarrassing clusterfuck of crossed circuits than a serious problem. We're probably doing a short hike in the hills tomorrow, after she sleeps in. Well I'm sure you will anyway but pack plenty of water and keep a close eye on her. Also congratulate her on the weight loss, 70 lbs is remarkable!

There's a bit in Frank Herbert's "The Godmakers" where the lead character has been sent out to this world to find out whether they can be peacefully assimilated into the dominant culture. After traveling aimlessly around for a while, he pulls the fire alarm, and the military peacekeepers scramble in. The chief peacekeeper guy asks, "so, what's up?" and gets the reply....."er, I had a bad feeling" -- which gains the lead ridicule and abuse. Turns out, the immediate trigger for the call was an abnormally cruel practical joke.

You do realize that by law the Anti Injunction Act would make it illegal for Roberts to rule on this one way or the other, because the so called tax hasn't taken effect yet? By calling it a tax Roberts himself should have been well aware that he could neither uphold or strike down the law on that basis until the tax itself actually took effect in 2015. That of course is just the tip of the iceberg.

672 Ok, a little deeper into the ice. Here is the really big Constitutional problem with calling Obamacare a tax. The Congress is limited by the Constitution to the following types of taxation. The 16th Amendment gives Congress the power to levy an income tax. I think you will agree this is not a tax on income. The Constitution gives Congress the power to levy both a direct tax and an excise tax. This cannot be considered a excise tax, because it is not applied uniformly across the states. The penalty varies by location. So all you have left is a direct tax, but according the Constitution a direct tax must be apportioned among the states by population. So, sorry, but even if one pulls that magic tax rabbit out of one's ass and calls this debacle a tax, it is not a tax that the Constitution allows Congress to levy.

So a person making 100,000 a year might not be "taxed" and yet a person making 50,000 a year could be taxed. Since the basis for taxation is not income, this is not an income tax. How big of a penalty you pay might be based on income, but that still doesn't make it an income tax.

I think the point that is being missed her is that the Constitutional restrictions on Congress's ability to tax has nothing to do with the "intent" behind the tax. And they can't file criminal or civil charges. Ok, a couple of points that most likely got lost in the minutia. Obamacare? Pretty much DOA. They can't force states to join in, so it will die under it's own weight. My problem? Not so much with whether or not Obamacare survives, as I don't believe for a moment it will. My problem is that the Chief Justice of the US Supreme Court now thinks its perfectly acceptable to ignore the rather plain language of the Constitution to achieve a desired outcome. Regardless of motive, plan, intent, etc.. this is totally unacceptable. It only makes it that much worse that the guy is supposedly a conservative justice. Final point, the ends cannot justify the means. Hope that clears things up.

685 A bit of background.


Stung by the Harriet Miers thing, I actually researched Roberts when he got the nom. While my heart said JRB or Kozinski, I thought Roberts was a brilliant pick. He's technically 24 carat, had managed to do solid work without picking up controversy, and clearly had a love for the law itself and not for the policies that could be enacted with the law.


A little more about that last.....there is such a thing as "judicial temperment" -- the idea that one should see the question at hand using the law as it exists before applying reason to drive toward a resolution, and only allowing bias within certain parameters. I was pleased (and surprised) that Clinton's justice RBG actually has this; I'm continually dismayed that Reagan-appointee Kennedy's "rolled out of bed toward the window" has less. But Roberts lives and breathes this quality.

So it's disappointing that he didn't go for the slam, and I really think he did it from personal pique. Instructing lower courts to rule against while gaming up a ruling for is chickenshit chicanery.

Apparently I should have realized that this wisdom applies more broadly.  What is the premise here?


The premise in Kelo was that a branch of the government could deny a private person the right to say no to a private transaction simply by acting as a sham intermediary.  The justification was that the government could collect more money from the favored party.


The premise of this bullshit is the government can use coercion to deny people the right to say no to a private transaction regarding purchasing insurance.


The very heart, or maybe even the only definition, of liberty is the right to say no.  Why accept any other premise?


The constitution was written to limit government power, and certainly those limits occur before the power to deny people the right to say no to another private party.

Probably the reason he (John Roberts) ignored it was because he was catering to some outside group of men, instead of the law, and wanted a ruling before the election.
