Fake Indian Elizabeth Warren Also Representing Clients As A Fake Lawyer?

Did her mother tell her she was 1/32nd Massachusetts lawyer, because she had high cheekbones like all other bar-certified Massachusetts lawyers?

This story is not as old as you may be thinking. There's a new twist.

First, Legal Insurrection noted that Warren was representing clients in Massachusetts without actually being a barred lawyer in Massachusetts.

That story got knocked down, sort of, because people contended that's not a problem. Federal courts make up their own rules about what lawyers can appear before them, and they permit lawyers from whatever state to argue cases that are about federal issues and Constitutional law.

The idea is that state bar laws can't dictate to a federal court who they may entertain when federal law and Constitutional law are in play.

Okay.

But now Legal Insurrection, which just won't give up on skull-f***ing Elizabeth Warren (are those cheekbones hard to maneuver around?), has dug up a case where she seems to be representing a Massachusetts client in a case about Massachusetts state law.

One of Warren's previous defenders -- someone who argued with LI previously about this -- has jumped ship and praised LI for their diligence.

Professor Jacobson has uncovered this morning a case in which Elizabeth Warren entered an appearance in a federal appellate court as a representative of a Massachusetts client in a case that appears to have clearly implicated Massachusetts law. Although this is still a federal appellate court, because weÂ’re dealing with a Massachusetts client and issues of Massachusetts law, this looks really, really bad for Professor Warren. With this bombshell, I would no longer view the case against her as weak.

I want to know more about her work fighting compensation for victims of asbestos.

As reported earlier by Globe reporter Noah Bierman, Travelers hired Warren to represent the insurance company in its fight to gain permanent immunity from asbestos-related lawsuits; in exchange for that immunity, the insurance company said it would establish a $500 million trust for current and future victims of asbestos poisoning. Warren succeeded in that mission, successfully arguing Travelers case before the U.S. Supreme Court. She was paid $212,000 by Travelers from 2008 to 2010.

However, after she left the case, a separate court ruled that Travelers did not have to pay out the money and it never has. As one judge saw it, Travelers got “something for nothing.”

The federal bar can do what it wants.  You can't hang out a shingle in a state, practice law in that state, and not get into trouble with that state's bar, no matter if it is on a federal or state matter.  Try it and see.

From what I see here in the political sewer that is MA, I think you're being over-optimistic. The state will go for Choom Boy, who continues the proud tradition of Devil Patrick, John F'n Kerry, Bawney Fwank and of course the Great Statesman himself, Ted "Killer" Kennedy. I doubt it will even be close.

Lieawatha, on the other hand, has to contend with a nice moderate Democrat-in-Republican-clothes in Scott Brown. They can vote for him without wavering much from their traditional liberal sickness.

Good for him. There's all kinds of undercurrents about legal ethics (I know, I know) going on with this but one of them is this - if the bar doesn't police itself, those outside the bar will. The bar does not want that to happen. Thus, there are those who may be on her side politically who will hold her to account because of the longer term implications. It is inexplicable to me why she did not seek reciprocal admission in MA. If she'd been licensed in NJ for several years, which it appears she was, then it shouldn't have been that difficult to get admitted in MA as well.

All during the time Lieawatha has been handling cases for big-bucks clients, she has been listing her office at Hah-vud as her law office. This is shown on all the documents produced (so far) in bloggy places.

It strikes me that running a business from space in a tax-exempt institution is of questionable legality. Does that apply to minority/female Democrats, too?

And B) We're afraid some liberal douche like a Occupy fuck or some MSNBC CNN Twat are going to vandalize our cars. So don't get disheartened.

I understand the feeling, Naes (Sean?).  I'm feeling pretty gloomy today, too.  But whether we win or lose, we still have to fight with all our hearts and souls -- and what's more, with our brains.  If we do lose the Republic, we'll just have to make up our minds to get it back, is all.


Think of it this way:  Suppose Obagman and his merry band of socialists and crooks does take the trifecta (WH, Senate, House).  What then?  Whatever they put in place won't be sustainable.  Do you suppose for one second that our enemies won't swoop in to attack, seeing how weak and confused our response will be?  (As proved by current events in Libya.)  As terrible as that will be -- many millions of innocent people will die, including many of us posting on this very thread -- the American people will demand an effective war leader.  At which point, either they will throw Obagman out at the ballot box, or if that is no longer possible, then in some kind of coup.


I reiterate, this will be terrible beyond description.  But Obagman and his crew cannot prevail forever.   The Soviet Union fell -- so will they.


Make sure you vote.  Give what you can to your candidates' campaigns.  If you are convinced that we will lose, then make up your mind to lose gallantly and go down fighting.

150 FYI, whether a case involves state law or federal law doesn't really impact who   can represent whom in federal court.  The issue is whether you're   admitted before the particular federal court or not admitted before the   particular federal court.  If you're admitted to that particular federal court then   you're admitted.  End of story.  If you're not admitted to that specific federal   court but the argument relates to a pending federal case in another federal   court, in which you are duly admitted, then that's OK too.  If it's a one-time   thing (e.g., a one-off motion hearing) it's OK pro forma.  If it's a steady thing   then you'll need a temporary admission to the other federal court, which is   obtained with routine and basic paperwork.  It's called being admitted pro hac   vice.  But if you're not admitted to a federal court and there's no direct tie to a   case in a federal court in which you are admitted, and you don't get admitted   pro hac vice, then you can't just go willy nilly representing people in whatever   federal court you wish.  Come on, let's get real.  I can't go and handle a brand   new Title VII case in a federal court in Massachusetts on the grounds that,   hey, I'm admitted to all the federal courts in California, and, hell, Title VII is a   federal law.  Again, come on.  Get real.  Doesn't work that way.  Never has.    Never will.

153 In fairness somebody had to put the breaks on the asbestos lawsuit industry.  The insurance co's liability had been expanded so much that the entire US Property Casualty insurance industry was in jeopardy (well, certain very large insurance groups and reinsurers were in enormous jeopardy due to the ever expanding pool of possible litigants and the out of control fraud.  Systemically their insolvency would have had enormous consequences if for no other reason than the loss of the writing capacity they brought and the extreme unlikelihood that other investors would be looking to jump in and put their capital at risk).  I'm sure she didn't make any friends with the trial lawyers bar on that deal.
