Full Opinion Now Out

Opinion here. Enjoy the pain.
It's Constitutional. Bitches. So says Executive Director of the DNC Patrick Gaspard.
No, he really said that. Screencap here, thanks to @slublog.

Anybody know if Toronto and the other cities in Canada understand you need air-conditioning in the summertime?

I suspect yes, but the decision is 193 pages long. I don't have time to read it (though I think the majority opinion is only 123 pages or so).

Yup. It's one thing to keep him in office when there is the possibility the Court will curtail his worst impulses. That safety is now gone, so this will concentrate people's minds like a hanging.

Good to hear it. Denver dwellers didn't seem to believe in A/C when I lived in CO -- they thought it was Some Newfangled Fad from Back East, even when temps hit 100. And I don't care how dry the air is, 100 is HOT.

The sad thing is is that if you are going to do national healthcare, there are good and bad ways to do it. But of course we chose the worst possible way that will probably leaves us with a worse system than the NHS.

Precisely. Roberts didn't think it wise to strike it down so he found a way to split the baby. Then the majority sewed it back together and presented it to the people as a monster.

One could argue that the civil war was the point at which the feds unconstitutionally usurped power from the states. Or IOW the beginning of the end.

1. If it's a tax, who must pay?
2. If it's a tax, can it be repealed through reconciliation?
3. What can the states opt out of and what is the penalty for doing so?
4. If some states opt out, how does that affect the states that don't?
5. How can Congress go about repealing this law?

If it's a tax, what kind of tax is it? A tax on inactivity? Is it a capitation tax? Should it be challenged that way?
I always thought it was a tax but was surprised when it was argued this way in Court it wasn't much publicized (hurts the team, man.) Thing is, I don't know if it is constitutional as a tax, and Roberts opinion might tip us to whether he's begging for it to be challenged as such.
Again, I dunno if that argument was ever presented--if it is a tax, it is it an unconstitutional one?

1. Since it's a tax, it should be possible to calculate people's effective tax rate once the tax kicks in. That's a powerful campaign commercial right there.
2. What happens to people who have plans through their employers? In short, how will this law make people's lives more complicated and expensive? That too is a powerful arguing point.

1. First I feel quite bad for my children.
2. Best health care system in the world will belong in a different country.
3. All though we have had it here and there for a while, we can say socialism has "officially" come to this country.
4. The Repubs decided Romney would be there best option. He will do nothing even if he wins.
5. This law will continue to kill small business.
6. With no defense of borders, millions upon millions of people will overwhelm the health system.
7. Boned.

Reconciliation is a Senate rule. Just because the Senate broke their own rule doesn't make the law unconstitutional.
That noted, I recall that a provision put into the law was to require a supermajority in the Senate to repeal it. I suspect as a way to ensure that the same rule wouldn't be broken to repeal it.

Independents hated the mandate before and now ...
If Obama gets 45% I'd be shocked ... he's toast ...
The Senate will now be much easier to take and the House will easyily stay in the GOP column ...
Jan 20th 2013 ... a 4 line reconciliation bill repealing the whole thing, signed that afternoon ...

Color me stupid, but how does the mandate survive as a tax? The question still remains: how do you justify taxing someone based on not buying a product?
Something doesn't smell right about Roberts' "justification." Any chance this whole matter could be brought back up to the Supreme's after someone has been taxed? Maybe that was Roberts attempting a punt on the issue?
