— Ace Who was Susan Catharine "Kitty" Genovese?
A victim who was brutally murdered over a long period of time. Neighbors heard her cries, but did not contact police.
They didn't want to get involved.
The case became notorious, especially for the syndrome which took the victim's name -- the "Genovese Syndrome," or "The Bystander Effect."
Put shortly: It is very easy to decide "this isn't any of my trouble" and permit vicious behavior.
Easy. Perhaps understandable.
But hardly ethical. And certainly not heroic.
Who wants to get involved? Easier, and surely safer, just to duck one's head and hide, and hope the danger visits someone else.
Perhaps the alligator will prefer to eat someone else first. Perhaps his belly will be full.
And why should you stick your neck out?
Hey, it's not like the Conservative Media is supposed to cast a spotlight on injustice, stick up for the common man abused by bullies, or fight leftist outrages.
It's not as if we're supposed to fight the fights that others shy away from, right?
We're all just supposed to sit back and let the traffic money roll in.
Right?
It's easier that way. A few victims here and there aren't our concern. We've got bigger things to worry about. We've got to keep focused on The Big Things, which just happen to be, felicitously enough, the things that won't draw any heat.
There are a lot of smaller bloggers who've heroically covered this. And one big blogger. And another big blogger is very interested (and I imagine that blogger will post soon; I just don't want to commit this blogger to anything).
I will note them later. Right now, I'm just disgusted. Disgusted at my allies, disgusted at myself.
Cowards die a thousand deaths.
I already died 40 cowards' deaths this past week. That's enough for me. I will die no more of them.
Am I to understand only the smallest, least-well-financed bloggers are going to be covering this? While large media franchises with lawyers on retainer all decide "we'd rather let tiny one-man blogs take the lead on this?"
Does that make sense?
If that's the case, maybe we could do with fewer large media franchises. Perhaps we need more of the little guys, who actually cover important, outrageous newsworthy stories.
Oh: And hit Stace McCain's tip jar.

So summarizing in case you haven't read the links (and there are extensive links and documentation):
This guy Kimberlin is a real criminal, who blew things up. He was sent away to the grey-bar hotel for a spell, but got out early. He founds this organization to drum up financial support from the Left by inciting revolution through "music": The Tides foundation (Teresa Heinz Kerry), Soros Money, some big and little contributions, including some money from Barbra Streisand.
And he's trying to intimidate people, on the Right. And there seem to be a lot of people that are OK with this. So what about this 1st Amendment thing, and what is the future of free speech and is everybody okay with this?

Let's see:
There's a bunch of lawyers who run a blog--neither Powerline nor Volokh has said anything.
There's this other website with some resources--run by a guy it is common to append "pussy" to the end of his pseudonym.
And this other website run by a doughy fellow who's on the radio frequently, on CNN, and got butthurt about Romney not sucking up to Evangelicals.

Fucking Brett Kimberlin. I'm from Indianapolis and personally know two people he's hurt, a (now elderly) mother and her (now middle-aged, schizophrenic) son, a childhood friend of Brett Kimberlin's who was one of the witnesses against Kimberlin in the Speedway bombing trial and the Julia Scyphers murder investigation, and whose name appeared on one of Kimberlin's 'hit lists' slipped to another inmate (a police informant) while Kimberlin was awaiting trial for the bombings. The mother to whom I referred is my artistic mentor, a woman who has known Kimberlin since his early childhood. She is convinced the stress of the Speedway Bomber trial, along with the death threats, triggered her son's latent schizophrenia and has brought enormous hardship and grief into both their lives. She is also convinced Kimberlin is as batshit crazy and as murderous today as he's ever been, as he's always been. As a kid, Kimberlin was a firebug and was at one time strongly suspected of killing and burying mysteriously disappearing neighborhood pets. Other kids avoided him, for the most part.
Kimberlin's been batshit crazy, evil and homicidal from the beginning. Everywhere that murderous psychopath goes, he destroys lives. He is much hated here in Indiana. Oh, and as an aside, Kimberlin is a pedophile with a fetish for very young girls. Some studies indicate this particular brand of pedophilia often indicates a fear of women and an overwhelming sense of inadequacy regarding the size of the pedophile's genitalia. In short, Kimberlin has (or believes he has) an unnaturally small penis. I mean really, really small: insignificantly small, miniscule, tiny, nearly nonexistent.
And if he's reading this (and my sources tell me Kimberlin always reads his own press, including--and maybe especially--the comments), he would be well-advised to stay the hell away from Indiana. He should also know that I use my own name here and elsewhere, and should keep in mind that I don't do lawsuits. You get my drift, Brett? You hurt people I know and care about. Coming after me in any sense would be a bad idea.

A woman with her two middle-school aged children was right next to me and her response was to turn her back and ignore me, while her son and daughter stared with their mouths hanging open.

Kimberlin is not a lawyer.
There are two nonprofits, Velvet Revolution and Justice Through Music Project, which are very closely related. Both have the same executive director, a Jeffrey R. Cohen, and each has only one other director. In the case of Velvet Revolution, that director is Brad Friedman. In the case of Justice Through Music Project, the director is Brett Kimberlin. Cohen does not receive any compensation.
Kimberlin, supposedly, works for JTMP 40 hours per week, and received (in 2010) $19,500. Yet, somehow, out of these copious resources, he lent VR $4,500 and files lawsuits right and left. One does wonder where he finds the time.
As to the Streisand Foundation, it did not fund Kimberlin or Velvet Revolution in 2010. I believe that last year in which JTMP received funding was 2008, but I am not through searching the 990's, yet.

U.S. common law dictates that there is no general duty to act in an emergency, however, at least eight states have enacted laws requiring citizens to assist strangers in peril. These states include Florida, Ohio, Massachusetts, Rode Island and Vermont. You can be charged with a misdemeanor for not responding to someone in danger. Citizens are never required to place themselves in peril. This allows for so much subjectivity that the laws are generally ignored by law makers and citizens

A vexatious litigant is defined as follows:
(b) “Vexatious litigant” means a person who does any of the following:
(1) In the immediately preceding seven-year period has commenced, prosecuted, or maintained in propria persona at least five litigations other than in a small claims court that have been (i) finally determined adversely to the person or (ii) unjustifiably permitted to remain pending at least two years without having been brought to trial or hearing.
(2) After a litigation has been finally determined against the person, repeatedly relitigates or attempts to relitigate, in propria persona, either (i) the validity of the determination against the same defendant or defendants as to whom the litigation was finally determined or (ii) the cause of action, claim, controversy, or any of the issues of fact or law, determined or concluded by the final determination against the same defendant or defendants as to whom the litigation was finally determined.
(3) In any litigation while acting in propria persona, repeatedly files unmeritorious motions, pleadings, or other papers, conducts unnecessary discovery, or engages in other tactics that are frivolous or solely intended to cause unnecessary delay.
(4) Has previously been declared to be a vexatious litigant by any state or federal court of record in any action or proceeding based upon the same or substantially similar facts, transaction, or occurrence. (Code Civ. Proc., § 391)
I've dealt with a few litigation terrorists in my career and managed to get one case dismissed under the statute when the plaintiff refused to post the bond.

Seriously. Can these legal actions simply be ignored? I can't imagine anyone anywhere giving a shit about a small political blog enough to spend all sorts of cash, resources taking it down. Again, on what grounds? I'm not trying to be disagreeable. I just don't understand.
And there aren't any R politicians anywhere who'd made this an issue? Didn't some Tea Party fave win something last week in IN? Where's he on this? I can't imagine Politician Big Shot "R" saying "this blog must stand. Free speech is sacred." While Lefty Big Shots counter with: "Free speech is bad when it makes us look bad." While the American people think: "Hmm, the Left has my vote!" No way would that fly, so again? Any politicians wanna help, you know, for free, gratis, as part of your fucking job descriptions? Guy who beat Lugar I might be glancing in your general direction.
Now ** is obviously because of familial connections obviously ain't going this alone. **'s got help. So be it.
Anyway, why can't bloggers just refer to him as ** or Assholifer or anything other than has real name, since this former prisoner has found a way to game the legal system? Other than his 'good name' being dragged through the mud (in this case, the truth), what legal action is there?
Maybe it went over my head, but I don't get it. You refer to his guy's former public record online and he calls your boss? Yeah, ** is a total fuckwad for doing so, but your boss ain't no prince if he takes the call with any degree of seriousness.
Also: if your boss (especially one who's a dick and not a pal) says: "Hey, don't you run blahblah.com?" You know what I'd say? I'd lie and say: "Nope." Just like if same boss asked me who I'm voting for: I might say: "I don't vote."
I'm sorry, but as George Costanza may have once said: "It's not a lie if the person asking the question has no effing reason for asking said question."

(Md. Rule 1-341)
Unfortunately, Maryland apparently doesn't have a mechanism to stop a lawsuit preemptively (by requiring a large bond, for instance). The right to collect your attorneys fees from the plaintiff at the end of the day doesn't mean much when the plaintiff has squirreled away all his assets.

I'm betting Ace is very aware. On the bright side, Kimberlin relies mainly on bluff and a murderous reputation to silence critics or anyone else he construes as an enemy. A lawsuit can be defended against. Harassment calls to employers can be reported. On the downside, Kimberlin has historically used flunkies to do his really dirty work. One of his drug-dealing henchmen murdered Julia Scyphers, a grandmother who strongly (and rightly) suspected Kimberlin was molesting her granddaughter and was going to the police with her suspicions.

Your trunk is probably held up by air springs, replacements available at any auto parts store. A good store will even go out and look at them and fix you up with replacements. They're cheap and very easy to replace -- you just prop the lid all of the way up with something sturdy, remove the clips from the old ones and install the new ones. Or better yey use vice grips to lock one air spring as you replace the other. Replace them one at a time.
If your trunk lid is held up by torsion bars it's a bit more tricky and unless you have some big pry bars you won't be able to fix it yourself. But a mechanic can fix it cheap because there's no need to replace anything. You just have to pry the torsion bars into the next detente, meaning you only have to pay for labor.
Get it fixed ASAP -- you'll be glad you did.

Things like this.....like Stacey McCain having to put himself and his family in hiding....are why 'stand your ground' laws have been passed in so many states.
People shouldn't have to live in fear for their lives.
That is not what living in a 'free country' should be like.
This is probably why the Leftists want to get rid of 'make my day laws' and 'stand your ground laws'....
They want people to live in fear....in fear of the sort of tactics that this guy Kimberlin deploys on a regular basis.

Until you have been targeted by someone who is hell-bent on destroying you by whatever means, you have no idea what it's like being in a situation like this. A couple of years ago I found myself on the receiving end of two lawsuits...one filed in an out-of-state court and, when that failed, another filed in federal court under the RICO Act. My tormenter was suing me for four million dollars. We could've lost our business and life savings.
For three years those lawsuits overwhelmed my life. They were the last thing I thought of at night and the first thing that came into my mind on awakening. I ran the gamut of emotions from white-hot anger to total despair. My life changed forever because of that experience.
It cost my co-defendant and me just shy of a hundred thousand dollars to get our lives back and those suits never even went to trial. They were thrown out, with a stern admonishment from the federal judge to the plaintiff that if he did it again he would find himself facing harassment charges.
Happily, a friend established a legal defense fund which covered about half the attorney's fees but we're still recovering from the hit to our finances.
This is what Stacy is facing now. He needs every bit of help we can give him.
Except we may need to save a little for Aaron, too.

Nobody picked on Kimberlin, he and his vile cohorts could have proceeded to suck free money from idiot leftist foundations right along in peace, but they chose to engage in the BS defense of Anthony Weiner, making up a bunch of crap, stalking critics, and generally trying to stop the truth from coming out.
Patterico and Worthing, who was blogging there, pointed some of this out, which led to Kimberlin's harassment of them. Then the object of another of Kimberlin's nuisance suits, one Sean Allen, I believe, had a chance encounter with Worthing, who is an attorney in Virginia, in a courthouse. Worthing gave him some free advice on dealing with Kimberlin, which is what put Worthing in the cross-hairs.
Kimberlin is a violent and dangerous convicted felon who should still be in prison. Democratic prosecutors will not prosecute him for anything, because he is a liberal Democrat and all Democrats are just corrupt criminals themselves.

What you fail to understand, is that terorism, is working in todays society.
Whether its being called a Racist, or Sexist, or Homophobe, or Islamophobe... people are constantly NOT saying what they are thinking...
Note that the National Organization of Women, takes on the safe Catholics, but won't say a word to the murderous Islamists, who are 2000% worse...
And the RIGHT plays that game as well.... how many of you have derided someone as an 'idiot birther' for continuing the story Obama himself started, that he was born in Kenya...

Psychologists say this isn't unusual - the chances a bystander will intervene to help a stranger being victimized goes down the more bystanders there are. It's a sort of group paralysis.
Turned out the guy who killed her had killed two other women (for which another man had been arrested and confessed) and attempted to rape several others on the streets at night. He was married, employed, and had no criminal record.

Big surprise that. That's been their modus operandi for years now. They're all "rah rah" when leading from the behind, but when it comes time to put their asses and their reputations on the line, off they caper into the tall grass.
I give you conditional props for this post, Ace.
Yes, you're doing a service by bringing up obliquely mentioning the whole Kimberlin thing (by way of the third party video) even as you chickenshit out by studiously avoid any mention of Beetlejuice by name. The whole Kitty Genovese thing would be more convincing if it wasn't obvious you were trying to dodge the real topic.
Likewise, your not naming names on the right, when one of our own is under attack is three inches away from chickenshittery.
But, as I said, conditional props for dipping your toe into the pool.

Outing people out of spite when there is no gain is a tactic of the left.
I'm unconvinced that fearing for one's life is necessarily chickenshit. Some bloggers don't enjoy the level of annonymity that Ace has managed to maintain. That provides some level of insulation/distance from all but the most determined psychos.
This clown appears to be a pretty determined psycho. Deciding which hill is worth (perhaps literally) dying on is a personal and individual issue.

There is no impediment, if he's not the executive director, so far as I can tell, and I'm in nonprofit world.
Chuck Coleson (sp? darnit!) founded that prison ministry, but I don't believe he ever was the executive director or had fiduciary responsibility.
Now, it's not the same with Kimberlin, obviously, but I can find nothing to keep a felon from having a nonprofit.

Anyone see this:
Last week PJM Interconnection, the company that operates the electric grid for 13 states (Delaware, Illinois, Indiana, Kentucky, Maryland, Michigan, New Jersey, North Carolina, Ohio, Pennsylvania, Tennessee, Virginia, West Virginia and the District of Columbia) held its 2015 capacity auction. These are the first real, market prices that take Obama’s most recent anti-coal regulations into account, and they prove that he is keeping his 2008 campaign promise to make electricity prices “necessarily skyrocket.”
The market-clearing price for new 2015 capacity – almost all natural gas – was $136 per megawatt. That’s eight times higher than the price for 2012, which was just $16 per megawatt. In the mid-Atlantic area covering New Jersey, Delaware, Pennsylvania, and DC the new price is $167 per megawatt. For the northern Ohio territory served by FirstEnergy, the price is a shocking $357 per megawatt.

Farcebook has 900 million users? Even if we assume that most of them are real people *wink wink* ... Big friggin deal. Yahoo has 700 million and people wouldn't pay squat for them. And touting the fact that Farcebook is mostly outside the US, now. Great. How much is it worth to advertise to poor third worlders, no matter how targeted?
The story is not the farce of the Farcebook IPO but the idiocy and whining of the people who jumped in head-first fully aware. Fuck 'em.

I saw that the IPO ended up making Facebook worth more than Amazon is. Seriously? Its a free timesuck. And I bet companies can create pages there for free. Bet Anheuser Busch has a few pages set up there. So why pay for advertising when the people that connect to you there can do it for you by promoting something you put up.

I can't remeber the price per m/w here but it's going up and the local lib blogs/alt weeklys are already trying to blame it on lack of regulation, basically saying those evil power companies refuse to build any new infrastructure because they're greedy and don't want to spend the money, hence m/w cost gets raised so they'll have incentive to build and if we just had some of that sweet, sweet gubmint regulation we could force those evil companies to build without raising the m/w cost. I'm sure that story will be repeated elsewhere as prices go up.

BK is also tied pretty closely to a former Dem operative named Neal Rauhauser who has been hors de combat with a few of the Breitbart folks for quite a while. LibertyChick, whose name I won't list here even though it is now public may have had some of her private personal records breached by folks connected to them. Stacy did some pretty good legwork on the associations between the two here.

I am encouraged by so many deciding to cover this.
I'm angered by one comment in this thread that harshly criticizes you.
One guy finally came out today with a piece on Kimberlin. I'm not going to name him, but he has kids. He went back and forth about whether he should openly take him on. He lost sleep. He felt sick to his stomach. He didn't just fear for himself (which is understandable), but for his friends and loved ones. But he eventually came around. And his contribution is great.
It's easy to understand that there are fears that you have taken seriously. It's harder to understand why 'MSM' type organizations don't step in. A newspaper with a legal department and superior legal protections (in Maryland anyway) can discuss Brett without the 'he's just some loner harassing me!' lawfare being effective. Without the phone call to a spouse's employer. Without the 'I just lost my job and ... now I'm kinda screwed' repercussions. Yet here we are: it's only bloggers... for the most part modest ones, brave enough to take up this story.
So you're right. What use is the MSM? Not much.
If we all stand together, I think this will work out OK.

Everyone seemed to be convinced that it'd someday be worth as much as Action Comics #1, Superman's first published appearance. If not more. But I knew that wouldn't be the case. Everyone was buying multiple copies and preserving them, and there were millions of them out there. Very few people back in 1938 thought Action Comics #1 would have any value in the long run, and so most copies have been lost or destroyed. That is why Action #1 is so valuable (on top of it being such a major milestone in comics). For every copy of Action #1 in Near Mint condition, there's a million copies of Superman #75 in similar shape.
For comparison, Jeff Smith's Bone #1 came out at around the same time as Superman #75. Small press indy comic with a great story and nice art. Last I checked (quite a while ago), it was worth around $600... twenty times what Superman #75 was worth. I'm sure that gap has only widened since then.
When everyone expects something to be valuable, it won't be. Because everyone will hoard it to sell later, creating a glut. It's the little things that come out of nowhere in limited quantities that skyrocket in value. Microsoft came out of nowhere, like Bone #1. Facebook was hyped months ahead of its release to be the thing that'd make you a zillionaire, like Superman #75.
DC made a killing from Superman #75. Retailers made a good profit selling it. Nobody else made a damn thing off it.
In the case of Facebook, people caught on to the lack of substance behind the hype before they had a chance to bet the farm on a losing proposition. I suspect Eduardo Saverin was the real eye-opener for most of the would-be rubes.

Ace, do you know what the real difference between yourself (along with many of the folks here) and the MSM truly is? That you get disgusted and ask yourself hard questions, and try to find answers. No one at ABC, CBS, NBC, WaPo, NYT, LAT would think of being so "unprofessional" and "subjective" --- not without a major payoff in ego or in the hand.

Kimberlin had one of his drug-dealing associates murder the grandmother of a young girl he was molesting. Several people involved in the murder and bombing investigation have been disappeared or intimidated into silence. Lives were ruined. He crippled a good man with one of his bombs, and that good man later killed himself as a result. Kimberlin has (probably/possibly) millions of dollars at his disposal. In short, he has had innocent people killed. He has enough resources to do it again and--more importantly--to get away with it. And you're talking about beating him up, teaching him a lesson? Please.
The best weapon against this evil bastard is exposure. Show the world who the American Left is using as their attack dog: a murderous lowlife pedophile psychopath with money. That's how you beat him.

Jimi Ray,
RSM regularly lauds Ace for his comedic talents and his ability to rip some idiot to shreds in great detail and pain for the idiot. One can be, as me, a YEC and regard conservative atheists as valuable allies who are seriously mistaken about certain aspects of reality.
People like you remind me of LGF when he went nuts about creationism, and then shortly thereafter went liberal. I would not be at all surprised if you're actually a liberal, or will be one in a years' time.
As to Kimberlin, let us hope and pray he soon finds himself again in the gray-bar hotel, but not at the cost of hurting anyone else. I wonder....embezzlement is likely for this type of person, as a guess. Some of our financial deep lookers might find something in that line....That would be good.

I strongly suggest you shut the hell up. Internet tough guy routines are not impressive and they are also helpful to Brett when he goes to court and tells them that he's being threatened.
No one should even consider resorting to violence against these thugs. It wouldn't help. And merely talking about it does real damage. Do not say stupid shit like that, please, if you actually care about Aaron, Ace, RSM, or others trying to get the truth out and also stay safe.
For all I know you're dropping comments like that to help Brett claim he's been threatened. That would be par for the course.
