Lindsey Graham: Obama's Lockheed Illegality Is a "Mini-Coup"
— Ace

It is. More and more Obama simply disregards the law, or asserts his authority -- apparently as a tyrant, unchecked by a legislature -- to change the law via his sole decision it should be changed.

Graham is deeply concerned about the move, and about the lack of attention it is receiving — within and without Congress. The manouvre is “incredibly disturbing,” he told me. How disturbing? “It is exhibit A in the march toward an imperial presidency.” The “statute is clear,” Graham continued, “the WARN Act is the law of the land.” Here, “we have a White House saying, ‘we don’t care what the law we signed says.’” The OMB analysis — which holds that as the law might change, there is no need for businesses to comply with it — is “absurd on its face,” the senator told me, and the Department of Labor’s advisory opinion “a political move.” It is “patently illegal for the federal government to absorb the financial cost of a private company for not following the law. Never have we put the taxpayer on the hook for a private company failing to follow the law.”

Graham wondered aloud, “why are Democrats are not upset about the precedent? This has implications beyond this election cycle.” What implications?, I queried. “Imagine if a Republican president said that, because his proposed tax cuts were likely to become law, there was no need for the existing rates to be paid.” What we have here, I suggested, is the government instructing people to violate the law, and offering to mitigate the consequences. “Yes,” Graham agreed. “It’s crazy legal analysis. We are in danger of being no longer a rule of law nation. It’s a mini-coup.”

As you probably heard, Michelle Obama has never been more proud of her country than when her husband "worked around" Congress and the Constitution he swore to defend.

41 Well, when the serious news media continuously portrays the president with halos, we can hardly blame him for thinking that he doesn't have to follow the rules of mere mortals. I no longer think Obama is the story. The real story is the news media people who have completely given up any responsibility toward the public. 59 Ace, Keep banging this drum. Out of all the things he has done, this is intolerable in the highest. How about this-- lead the charge. Breitbart may be gone, but you still have a blog and a podium. Requiring corporations and citizens under penalty of law and other federal censure, to break the law, and promising to use public monies to pay any fines/etc incurred in the process. Not only must he be defeated, but he needs to do jail time over this. This is a direct action against the Constitution and the Republic. Lead the charge. Further, Romney must bring this up directly. This election is now about the continuation of the Republic or a shift to a new form of government. This, combined with the NDAA and the Catholic Persecution are a national emergency. Combined with foreign policy, can we now suggest malicious intentions?

Unless you understand this is the last stand in their mind, that if Obama wins they will be in charge when it doesn't matter anymore.

I didn't believe it when I heard it during the 90's re; Clinton but I do now.

These people, I know Racist, are going for broke.

They know if they win the opposition will fade away. Law abiding people don't take to the streets.

A second Obama term will put the nails in the coffin of this country. It will become something completely different.

More benign, less free, less consequential, less prosperous and much, much more divided.

One thing they never seem to think about is what the world will become if a nation of 300 million people is reduced to just "another country".

Lindsey Graham: "...We are in danger of being no longer a rule of law nation. ItÂ’s a mini-coup."

Duh.

What was your first clue?

Barky uses "fighting words" to incite violence...for decades.

He is a master Agitator.

The clues were there.

Barky became a Lawyer, in order to learn how best to circumvent our laws....not uphold them.

He uses 'race' as a cloaking device to destroy, that which he thinks should be destroyed.

If you look at everything that Barky has done...

The only conclusion that makes sense of it all, is that he wants to destroy this country.

That's what he meant, by "Fundamental Change".

91 Let's not get too carried away here.  My understanding is that the WARN act requires that 60 days notice be sent.  If no contracts are immediatedly cancelled when sequestration when it kicks on Jan 2, then there is no violation of the law.  When/if contracts are identified - if the contractors are given 60 days notice and they send out the notices, there is still no violation of the law.  Also, I read that - according to current regulations - those lawsuit costs can currently be submitted as contract termination costs - so no violation there either?    At least Lockheed stood up and pushed back on the WARN notices - let's look at the defense companies that agreed to not send out WARN notices without any assurances.

92 A second Obama term will put the nails in the coffin of this country. It will become something completely different. More benign, less free, less consequential, less prosperous and much, much more divided. One thing they never seem to think about is what the world will become if a nation of 300 million people is reduced to just "another country". Read that again, and again. Even a Republican win may be too late. And yes, we will bequeath slow impoverishment to the next generation. Baked in the cake.

The best options I can think of is that they are idiots or they know of a secret plan to keep Obama in office in perpetuity. They may also think that, even if a Republican tried to do something as illegitimate as this, the media would be shrieking at eleventy for months on end about it, so there would be no way for a Republican to get away with it, so it won't come back to bite them in the ass.

Which is why I say that the only truly serious political consideration that needs to be debated is "When do we secede?". Everything else just seems like filler to me at this point.

Shouldn't the Republicans in the House and Senate also be holding up checks and new requisitions from these companies?

There are lots of ways to play this.  YOu could also include this in a commercial listing all of the ways Obama has violated and selectively enforced the laws.

I doubt that many contracts are up for renewal - they'll be issuing contract mods to remove work or they'll be terminating contracts and paying termination costs.  If - and this is a big if - the sequestration actually goes through.  Do you think Romney is going to let those defense cuts take effect?

The bottom line is the government made assurances that no cuts would take effect on Jan 2 - that it would be a few months before any cuts would occur and the contractors would have time to send out the WARN notices.  Lockheed pushed back and said - hey, we'll still liable for the lawsuit costs if you do decide to do something on Jan 2.  The government then said - well, if that's the case, we'll cover the lawsuit costs as a part of the termination costs.

What's lockheed supposed to do at point?  Say you're a liar and never get another contract while Obama is in office again?  It's not like the Obama admin hasn't proven to be a bunch of vindictive a-holes.

Ultimately, the House holds the purse strings and it is the House's job to keep the finances in order. If the Senate refuses to pass a budget and shuts down the feral government, then, so be it. How?  Make SCOTUS order them to produce one?

Obama response would just be: "how many tank divisions does the Supreme Court have again?  Refresh my memory"

Once you've crossed the line and decided to ignore the law completely, pieces of paper won't enforce themselves.  The legislative and judiciary have no enforcement staff -- that resides with the executive.

This is perhaps a flaw in the design.  The framers never anticipated a president who would be totally lawless.

Your link lays out the fact the Lockheed was guaranteed that no cuts would take effect for months and they would still have time to comply with the law.

"The additional guidance offered important new information about the potential timing of DOD actions under sequestration, indicating that DOD anticipates no contract actions on or about 2 January, 2013, and that any action to adjust funding levels on contracts as a result of sequestration would likely not occur for several months after 2 Jan."

-----------

"WARN offers protection to workers, their families and communities by requiring employers to provide notice 60 days in advance of covered plant closings and covered mass layoffs. This notice must be provided to either affected workers or their representatives (e.g., a labor union); to the State dislocated worker unit; and to the appropriate unit of local government"

It's only a violation if notices aren't sent out 60 days prior.  If there's no contract actions on Jan 2 to notify about, then there's no violation of the law.

259 O/T but this is getting a bit creepy from over at the Daily Caller: Obama and Romney to face real lie detector test during debate When Barack Obama and Mitt Romney face off for the first time at tonight’s presidential debate in Denver, they’ll also be taking a lie detector test. A spokesman for the group Americans for Limited Government told The Daily Caller on Wednesday they have contracted with a company to use new truth detecting technology to determine whether either candidate is lying during the debate. “For the first time, within a few hours of a political debate, the American people will know if the candidates are telling the truth, and better be able to judge what promises are real, and which ones are nothing more than political pandering,” Bill Wilson, president of Americans for Limited Government said.

Posted by: lymond at October 03, 2012 05:43 PM (RxLT6) As a general rule, suborning a crime is a crime. Now, in the sense that DC is going to let Obama get away with ANYTHING, you can claim there's no crime (from the nihilist point of view that there's no crime if you aren't prosecuted). But from the point of view that circumventing legal processes on spending to promise to pay certain people to break a law, that's fucking illegal on several levels, from violating prohibitions on due process and arrogating authority illegally to actually suborning lawbreaking and beyond. But this is all part of that legal grey area, you know the one where Democrats can break any God-damned law they want.

He took a huge mandate handed to him from the Tea party in 2010 and shit all over it until those same people felt defeated and that their votes were meaningless. I believe that this is a large part of the drag on Romney. It's not Mitt but the nearly two years of a GOP House that has done nothing but the bidding of Barky and the Dems. They, led by the Weeper, have beaten the Tea party into apathy, as seemed to have been their intention and motivation. As I said, the Weeper was happy to show that he sympathized with the Occupooping scum (who didn't even understand themselves) but he held the Tea Party at arm's length most of the time - worried about us being all racisty and violent and rapey. This took a toll that I think we are seeing, in part. They have also let the administration get away with every type of lawlessness one can imagine. I doubt anyone thinks there are any defenders of the Constitution or America to even bother voting for. I'm voting for Romney and GOP all the way through but I certainly hold no illusions about what they are going to do to turn things around and hold Barky and his junta accountable for the many, many, many serious crimes they have committed and serious damage they have done to our nation. And I wouldn't have even gone into this explanation if you hadn't complained about a straightforward and honest explanation of how this nation could have continued on without a budget for the past two years.

Now you are getting it. That is exactly what they think and what WILL happen.

1) The major newspapers will be "bailed out" by the local cities and some states. They'll form a quasi-private corporation along the lines of PBS or Fannie Mae that will, more or less, make them officially what they already are: Mouthpieces for the state. It'll be a loan or bonds or something but, there will be taxpayer money going to the major newspapers. They will do it at the state and local level to avoid any constitutional questions. (and even then, that piss-yellow coward, John Roberts will be fine with it.)

2) The Fairness Doctrine will be the law of the land by May. I don't think I need to explain just how erronous and malicious this law is to any conservative. Short answer: No more Fox, no more talk radio and--because they will apply it to the internet--no more conservative websites. "Cut, jib, newsletter" won't be a joke, it'll be the only way you'll hear conservative opinions. Opps. Nope. Not even that will be allowed. Or  did you think that "arrest" of the filmmaker was a one-time deal?

See Weeper and Issa - this is how leaders LEAD. They are PROACTIVE. Politics be DAMNED. The country is being destroyed before our eyes and these fuckers sit around and do jack. Most of these bastards in DC need to be swept out of office. Some of the Republicans are among the worst because they are BETRAYING our trust.

Huh?  We're talking about sequestration - forced cuts due to the legislation - and the governments failure to provide info on what programs would be effected.  Of course Lockheed knows which of their contracts are expiring and can manpower plan based on new business and existing contracts.  Contracts don't automatically re-up when they expire.  They can be partially funded year by year - but would still require a contract mod to terminate or decrease work.

Expiring contracts is not the issue at all.   It the impact of not knowing what is going to cut via sequestration that caused the threat of sending WARN notices to everyone in the company.

WHAT THE FUCK! I thought ours was a constitutional republic. Is there no remedy, short of impeachment, to stop the Imperial Tyranny of the Stuttering Clusterfuck of a Miserable Failure?

Why don't the Republicans in the house do something? Obama's thumbing his nose at the clear letter of the law and his offer to have the taxpayers indemnify all who fail to follow the law are much more substantive grounds for impeachment than getting a blowjob from a fat wannabe yenta.

359 There's where you err, my friend. There's not going to be a future for us. Many people really seem to think this is just a Carter on steroids era, and that we'll get a Reagan to straighten this all out. Four more years of al-obama and it's all over...completely. Even if we somehow manage to survive long enough to elect a Conservative President, he'll have to contend with a Supreme Court that consists of at least 3 more al-obama appointees. That's a game-over scenario. I really believe that it all hinges on tonight. This is really damn scary. If Romney doesn't make his case tonight, the battle is over. The other two debates won't matter. The razor thin segment of the population Romney needs to win will form their opinion tonight. This is it folks.

There was no reason to let this drag on this long. Do you think it was a coincidence that JEF exerted EA when he did? They knew they were going to do it the whole time, and Issa knew they were going to do it as well. It's not like JEF hasn't established a pattern of 'letting the law catch up'. Issa COULD have been pushing this along to get the contempt vote sooner to force Obama's hand sooner so that the lawsuits could be over with before the election. He could have had everything place ready to file the lawsuit - instead, they had to have a vote then find someone to hire, etc etc. Again, do you think it is just 'coincidence' that now the suits won't be heard or decided until after election day? I have a bridge to sell you.

Posted by: Jean at October 03, 2012 06:13 PM (u5ozF) I agree with this - I just think that the Republicans by-and-large have bought into it. We have example after example of a president and his administration that aren't just 'gray areas' but are COMPLETELY lawless, and nothing ever happens. NOTHING. Throw out immigration laws? No big deal. Attack a foreign country and fail to report to Congress? Who cares? Trillions thrown away, donors literally getting 100s of millions from the government? Keep on keeping on. During the Bush years we saw Dem after Dem POUNDING away at Bush - did everyone forget the accusations about Iraq and Katrina. The Dems brought up 'impeachment' multiple times. Have you EVER heard a Republican leader mention that word with respect to Obama? Can you imagine, if this were Bush doing these things, Harry Reid or Pelosi sitting quietly? Yet, here our guys sit, like bumps on a log 'well, he shouldn't do that' and 'we are looking into it' It is frustrating. Sorry if I've been rude but I'm sick of it.

393 Now, in the sense that DC is going to let Obama get away with ANYTHING, you can claim there's no crime (from the nihilist point of view that there's no crime if you aren't prosecuted).

Posted by: Merovign, Dark Lord of the Sith at October 03, 2012 05:51 PM (bxiXv)

I agree, in general.  This is certainly the most lawless administration I've ever seen - from violating the war powers act to illegal amnesty to ignoring court orders on the gulf, etc.  Those are concrete violations of the law.

In this case, though, the violation of the law is theoretical and not actual.   If the government acts in good faith and gives a few months heads-up to contracts on contract cuts/terminations (or if a law is passed that nulls the sequestration) - then the WARN act would never be violated.  If the government says no cuts on Jan 2 - and then decides cuts come on Jan 2 and the contractors have to lay people off without 60 days notice - then that would an unfaithful government that needs to be taken out big time.   It just seems to me that people are assuming that the government's assurances that no cuts will be occurring on Jan 2 is faithless  - and hopefully there's still some good people in the DoD that see that doesn't happen.

Lockheed put the Obama admin in a horrible position politically - they either had to specify the cuts and the timelines so Lockheed could issue  targeted WARN notices - and take the flak of actual discrete impacts due to the cuts (instead of just having nebulous cuts coming).  Or they could guarantee the cost of the lawsuits in the case the the government is faithless and doesn't give the contractors enough time to comply with the law.

It is this willingness to pay somebody for violating the law that is most damning - the administration put politics in front of doing their duty and specifying the cuts and timelines or letting Lockheed issue WARN acts to all employees.  **But**, if everybody acts in good faith then there is no violation of the law and no paying for somebody to violate the law.

You offer to pay someone to commit a crime, and did so under the color of authority. And you didn't have the authority to spend the money on that in the first place. If that's *not* against the law, there's a metric fuckton of disgraced and jailed former public officials that need to be reinstated, stat. Also, official corruption is legal, apparently. Report to your work camp, unless you're a politician. Now, I'll give you one thing, I'm not gonna spend hours trying to read the alien language they write Federal code in to give you code numbers, but I'd bet there's at least a dozen this breaks.

But are they setting new precedents?  The question I had to do with the offer to pay for the lawsuits arising from the civil liability of not sending out the notices.  Did existing FAR/DFAR regulations already say that type of cost could be covered or did the admin make up new law/regulations?  If they did - that would be pretty huge - but really no more than the crap that the EPA or HHS has been doing.  (But what's congress going to do about it?)

Anyway, the OMB stated that the offer does "not alter existing rights, responsibilities, obligations, or limitations under individual contract provisions or the governing cost principles set forth in the Federal Acquisition Regulation (FAR) and other applicable law." Thus, "agencies may treat as allowable other costs potentially associated with sequestration, including WARN Act-related costs arising under circumstances not specified in th[e memorandum], based on the usual cost principles of allocability, allowability, and reasonableness as set forth in the FAR."

So I they're saying there's latitude in the FAR to already allow those costs based on the fact it would've have been the governments breach that caused the costs.

Posted by: lymond at October 03, 2012 03:16 PM (RxLT6)

400 Lymond: But would this latitude in the FAR protect the CEO of Lockheed from criminal prosecution for violating a ton of anti-corruption acts?

last time I checked, in oreder to violate criminal code with government permission ( sting perations, etc ), you needed a writ of immunity signed by both a federal judge and a US attorney.

Does the CEO of Lockheed have such an instrument in his possession?

I'm not sure it's a crime , since the penalties in the WARN act are civil fines and not criminal.  But I can go along with that if we can get labor and OMB on it.  But we're saying the Lockheed and the other contractors didn't commit a crime, right?  Or are you saying that they accepted bribes - even though any cost recovered would go to the laid off employees and not to Lockheed martin?

Hi Kristophr - would any criminal code be violated - even in the event that Lockheed didn't give 60 days notice?  The WARN act consists of only civil penalties/fines.

Even so, I'm sure that Lockheed could delay the layoffs to comply with the law even if it ate into their profits.  They could lay off 499 people for two months and then the rest after 60 days and still be in compliance of the law regardless of what cuts the government decides on - or when.

Posted by: lymond at October 03, 2012 03:43 PM (RxLT6)

404 I'm not talking about WARN by itself.

There are a raft of laws on the books forbidding collusion between private individuals and government officials to break the law for personal profit.

Obama is profiting by this, and the CEO of Lockheed is as well.

He could easily face criminal charges for outright crimes, crimes with statute of limitations that run well past the end of Obama's term.

Posted by: Kristophr at October 03, 2012 04:00 PM (wYVte)

405 You are assuming, Lymond, that Obama will be making decisions about who will be prosecuted for corruption in Jan. of 2013.

I don't think this will be the case. The CEO of Lockheed needs to consider the possibility that a Romney appointee will be trying to make a criminal corruption case out of this.

How is the CEO of Lockheed profiting by this?  They're _cutting_ his business with sequestration.   He'll be losing business and profit.  You guys think are he's already scheming to break the law - you remind me of the seers in Minority Report.  The only way that Lockheed would even get reimbursed for the WARN fines would be if (a) the government cut programs without giving them enough time to send out notices; (b) Lockheed decided to actually lay off enough people in 60 days to qualify for fines.  Everybody seems to be assuming that Lockheed is going to intentionally violate the law just so they can be reimbursed for fines that they wouldn't get if they followed the law.   Makes no sense.

Let me ask this:  What about the CEOs that already agreed to not send out WARN notices before this latest direction from OMB?  Are they guilty of some crime too?  Or only Lockheed who waited because they wanted to be sure they complied with the law?

Posted by: lymond at October 03, 2012 05:19 PM (RxLT6)

409 Lockheed is getting value in not having to warn employees about layoffs.

Companies do not like warning employees about such becuse their best folks all jump ship early.

So, yes, there is quid pro quo here ... Lockheed avoids having to comply with the WARN act, and Obama does not have to have a bunch of folks that are effected by his decisions get layoff notices before an election.

And the other CEOsare just as guilty here.

Do not think a corruption charge can't stick.
