Never have we put the taxpayer on the hook for a private company failing to follow the law.”Graham wondered aloud, “why are Democrats are not upset about the precedent? This has implications beyond this election cycle.” What implications?, I queried. “Imagine if a Republican president said that, because his proposed tax cuts were likely to become law, there was no need for the existing rates to be paid.” What we have here, I suggested, is the government instructing people to violate the law, and offering to mitigate the consequences. “Yes,” Graham agreed. “It’s crazy legal analysis. We are in danger of being no longer a rule of law nation. It’s a mini-coup.”
As you probably heard, Michelle Obama has never been more proud of her country than when her husband "worked around" Congress and the Constitution he swore to defend.

The best options I can think of is that they are idiots or they know of a secret plan to keep Obama in office in perpetuity. They may also think that, even if a Republican tried to do something as illegitimate as this, the media would be shrieking at eleventy for months on end about it, so there would be no way for a Republican to get away with it, so it won't come back to bite them in the ass.
Which is why I say that the only truly serious political consideration that needs to be debated is "When do we secede?". Everything else just seems like filler to me at this point.

I doubt that many contracts are up for renewal - they'll be issuing contract mods to remove work or they'll be terminating contracts and paying termination costs. If - and this is a big if - the sequestration actually goes through. Do you think Romney is going to let those defense cuts take effect?
The bottom line is the government made assurances that no cuts would take effect on Jan 2 - that it would be a few months before any cuts would occur and the contractors would have time to send out the WARN notices. Lockheed pushed back and said - hey, we'll still liable for the lawsuit costs if you do decide to do something on Jan 2. The government then said - well, if that's the case, we'll cover the lawsuit costs as a part of the termination costs.
What's lockheed supposed to do at point? Say you're a liar and never get another contract while Obama is in office again? It's not like the Obama admin hasn't proven to be a bunch of vindictive a-holes.

Once you've crossed the line and decided to ignore the law completely, pieces of paper won't enforce themselves. The legislative and judiciary have no enforcement staff -- that resides with the executive.
This is perhaps a flaw in the design. The framers never anticipated a president who would be totally lawless.

What laws does the link say were violated? I don't see any. Lockheed was trying to get info from the government on which programs on what time table were going to be cut. Without that info, they were going to issue WARN notices to all employees 60 days prior to the Jan 2 start of sequestration.
Your link lays out the fact the Lockheed was guaranteed that no cuts would take effect for months and they would still have time to comply with the law.
"The additional guidance offered important new information about the potential timing of DOD actions under sequestration, indicating that DOD anticipates no contract actions on or about 2 January, 2013, and that any action to adjust funding levels on contracts as a result of sequestration would likely not occur for several months after 2 Jan."

Huh? We're talking about sequestration - forced cuts due to the legislation - and the governments failure to provide info on what programs would be effected. Of course Lockheed knows which of their contracts are expiring and can manpower plan based on new business and existing contracts. Contracts don't automatically re-up when they expire. They can be partially funded year by year - but would still require a contract mod to terminate or decrease work.
Expiring contracts is not the issue at all. It the impact of not knowing what is going to cut via sequestration that caused the threat of sending WARN notices to everyone in the company.

I agree, in general. This is certainly the most lawless administration I've ever seen - from violating the war powers act to illegal amnesty to ignoring court orders on the gulf, etc. Those are concrete violations of the law.
In this case, though, the violation of the law is theoretical and not actual. If the government acts in good faith and gives a few months heads-up to contracts on contract cuts/terminations (or if a law is passed that nulls the sequestration) - then the WARN act would never be violated. If the government says no cuts on Jan 2 - and then decides cuts come on Jan 2 and the contractors have to lay people off without 60 days notice - then that would an unfaithful government that needs to be taken out big time. It just seems to me that people are assuming that the government's assurances that no cuts will be occurring on Jan 2 is faithless - and hopefully there's still some good people in the DoD that see that doesn't happen.
Lockheed put the Obama admin in a horrible position politically - they either had to specify the cuts and the timelines so Lockheed could issue targeted WARN notices - and take the flak of actual discrete impacts due to the cuts (instead of just having nebulous cuts coming). Or they could guarantee the cost of the lawsuits in the case the the government is faithless and doesn't give the contractors enough time to comply with the law.
It is this willingness to pay somebody for violating the law that is most damning - the administration put politics in front of doing their duty and specifying the cuts and timelines or letting Lockheed issue WARN acts to all employees. **But**, if everybody acts in good faith then there is no violation of the law and no paying for somebody to violate the law.

But are they setting new precedents? The question I had to do with the offer to pay for the lawsuits arising from the civil liability of not sending out the notices. Did existing FAR/DFAR regulations already say that type of cost could be covered or did the admin make up new law/regulations? If they did - that would be pretty huge - but really no more than the crap that the EPA or HHS has been doing. (But what's congress going to do about it?)
Anyway, the OMB stated that the offer does "not alter existing rights, responsibilities, obligations, or limitations under individual contract provisions or the governing cost principles set forth in the Federal Acquisition Regulation (FAR) and other applicable law." Thus, "agencies may treat as allowable other costs potentially associated with sequestration, including WARN Act-related costs arising under circumstances not specified in th[e memorandum], based on the usual cost principles of allocability, allowability, and reasonableness as set forth in the FAR."
So I they're saying there's latitude in the FAR to already allow those costs based on the fact it would've have been the governments breach that caused the costs.

Even so, I'm sure that Lockheed could delay the layoffs to comply with the law even if it ate into their profits. They could lay off 499 people for two months and then the rest after 60 days and still be in compliance of the law regardless of what cuts the government decides on - or when.

The only way that Lockheed would even get reimbursed for the WARN fines would be if (a) the government cut programs without giving them enough time to send out notices; (b) Lockheed decided to actually lay off enough people in 60 days to qualify for fines. Everybody seems to be assuming that Lockheed is going to intentionally violate the law just so they can be reimbursed for fines that they wouldn't get if they followed the law. Makes no sense.

Companies do not like warning employees about such becuse their best folks all jump ship early.
So, yes, there is quid pro quo here ... Lockheed avoids having to comply with the WARN act, and Obama does not have to have a bunch of folks that are effected by his decisions get layoff notices before an election.
