— Ace Great column.
Just so the various know-nothings in the media, such as Howard Kurtz, understand this:
Some laws punish people strictly for possessing a thing declared contraband. There is no mental state required to be thrown in jail, apart from voluntarily possessing the contraband. You might be able to get off if you can prove someone sneaked the prohibited item into your luggage without your awareness. But the police have heard that an awful lot, and tend not to believe it.
There is no additional criminal intent required -- voluntarily possessing the prohibited item is all the criminal intent that's required.
Now, some laws do require an additional criminal intent. With drugs, you can get hit with the lesser charge of possession, or the more serious charge possession with intent to distribute.
But there is no "with intent to [x]" attached to most gun laws. With most gun laws, simple possession is enough to constitute a breach of the law.
Now, there are additional laws for using a gun in the commission of a crime. But straight up possession? Requires no additional crime beyond possession, just as a straight-up drug possession charge requires no additional crime beyond possessing the contraband.
So yes -- David Gregory is innocent of having any additional criminal intent -- just like 90% of all people arrested for gun violations are themselves guilty of no additional criminal intent beyond simple possession.
David Gregory is precisely as innocent as most people arrested for a gun infraction-- and just as guilty, too.
Now, the idea being put forth by the media -- that you should only be arrested for possessing a gun (or part of a gun, like a magazine) if you have the additional criminal state of intending to commit a crime with that gun (or gun part), is, how can I say this? A radical gun-nut rightwing notion. I think Ted Nugent might very well agree that gun laws should always be limited to situations where guns are used in the commission of the crime or possessed with the future intent of committing a crime.
Does Howard Kurtz embrace that understanding of gun laws? Does Glenn Thrush? Do the various other know-nothings in the media -- who know both nothing about law and nothing about guns, but opine with great force and velocity on gun laws -- embrace this conception of gun laws, that gun laws should never target simple possession but only possession during the commission of a crime or possession with intent to commit a crime?
If not -- if they are less the right-wing gun nut than Ted Nugent (and even the Nuge might find this position too "extremist" for his taste -- then they are duty-bound to demand David Gregory's prosecution, as they would demand that any other Citizen Not On Television would be prosecuted.
They are endeavoring to explicitly create a High Caste with greater privileges than the lower castes, and immunities to the laws the lower castes suffer under, and that is a blood anathema to any real American -- and will be treated as such.

White House petition to press charges against David Gregory for possession of a 30-round, high capacity assault rifle magazine in Washington D.C at half-way mark to 25,000 threshold to get presidential response. Please tell all your friends to sign the petition.

Somewhere, lurking in the shadows of Washington DC, David Gregory is still bitterly clinging to his “assault magazine”. We must take this dangerous nut off the streets.

My suggestion if the left really wants to reduce the number of guns in the country is this: for every thousand guns that are destroyed (so as not to be forwarded to south-of-the-border gangs), one highly visible gun control advocate (politicians, academics and media figures at the front of the line) would be deported to Iran or the Saudi occupied territories. IÂ’d pitch in to a telethon to send, for instance, Barney Frank.

Liberals have a simple legal model. One set of rules for them, and another set of rules for everyone else.
About halfway through Obama's first term, the perennially fatuous Andrew Sullivan, one of Obama's most devoted cheerleaders and stenographers, got himself busted for smoking dope on the beach.
Well, no biggie. Except it turned out it was a biggie. Sullivan was on federal property at the time, and it's still a felony to consume marijuana while on federal property. And, since Sullivan wasn't yet a U.S. citizen at that point, for him to be convicted would have meant that his green card would be revoked and he'd be deported back to Blighty, something he was apparently desperate to avoid.
The federal charges were then dropped without comment. You can imagine why.
Meanwhile, a different guy who was arrested the same week in the same place for the same crime, who was just an ordinary schmuck with no liberal political connections, was informed that he was going to trial on his federal weed charge while Sullivan walked free.

Even worse, they are charter members of a caste of people who can say things in public that are subsequently proven to be utter lies, and never be held accountable for it, unlike us schlubs that woiuld lose our jobs or our reputation for the same.

Unintentional being the key word. Intentional harm - i.e. homicide - wouldn't be on that list.
In 2009 there were ~1,900 firearm homicides of people under 19. About 1,500 or those were age 15-19. FWIW.

I have a fantasy of turning "ignorance of the law is no excuse" on its head by bringing in the printed, bound text of every single fucking local, state, and federal law and regulation which the American citizen is supposed to obey in his or her daily life.
No jury is going to convict someone when faced with the contents of a medium-sized public library an a plea of "I honestly had no idea that letting my dog take a whiz on the tree in the park was illegal!"

"No Title of Nobility shall be granted by the United States:..." [Article I, Section 9, Clause 8]
At the time of the founding and into the 19th century, the primary reason a rich European would purchase a title of nobility was for preferential treatment on their taxes and in the courts, as much for the notoriety.
Even though USG doesn't actually go around knighting folks and officially granting titles, every time that the law is enforced arbitrarily in favor of the rich and powerful this clause is violated in spirit.
Is there really not a national movement based around this?

That's a procedural defense, and regular dudes are almost never truly allowed those.
But Gregory could use it.
In the absolutely impossible event that he gets prosecuted like a regular dude for the crime we all saw him commit on television, his lawyer can point to some prominent non-Democrat who said Gregory should be prosecuted like any regular dude would, claim that makes his prosecution selective ("pressure," etc.), and there's about a 99-point-everything percent chance that would be the end of the case.
"Real Law."
(I'm also not a lawyer, but I'm related to some, and I'm really good at getting mad at the TV when there's bullshit TV lawyering on it.)

We passed that "all your citizens are belong to us" police state threshold with regard to the numbers of arcane poorly written catch-all laws at the local, state, and federal level some time ago. What's worse is that the police state has at least two tiers, so the plebes face one arbitrary justice system (with SWAT teams and well funded government lawyers and a guilty until proven innocent theme) and the elite ruling class face a different arbitrary justice system (with high priced corporate defense lawyers -- whose firms will, coincidentally, be hiring the most promising government prosecutors in a few years and judges that know how to be 'flexible' with their Harvard and Yale buddies and their friends).

But just like the inner city youths in Chi Town that get regularly rousted and no longer care about the law. It will spread to the rest of our society and they will lose their control. I already see this hapening with all the no tolerance policies (like bringing a butter knife in your lunch bag getting punished the same as a switchblade pulled on a classmate) making good kids throw up their hands an say fuck it.

I couldn't agree more. I got lectured how bad the republicans and tea party and Boehner are the problem from my coworker the other day. And there are only 2 of us in the office.
