NBC's Deceptive Edit of Sandusky May Serve as Grounds for Appeal

First -- of course Jerry Sandusky is guilty.

That's not the point here. The point is that the prosecutors relied upon NBC to provide an accurate edit of the Jerry Sandusky interview.

They were burned on that.

Lawyers for Jerry Sandusky sought a mistrial before his conviction for child sex abuse on the grounds that prosecutors showed jurors an inaccurate version of a bombshell NBC News interview with the former football coach, and the mistake may now form part of the basis for an appeal.

In response to a subpoena, NBC News turned over three versions of Bob Costas' NBC News interview with Sandusky, which aired last November on different NBC shows.

One of those versions, which was broadcast on the 'Today' show, contained an erroneous repetition of a key question and answer - about whether Sandusky was sexually attracted to young boys, Nils Frederiksen, a spokesman for the Pennsylvania attorney general said on Sunday.

The repetition, Sandusky's lawyers contend, made it appear to jurors that he was stonewalling.

"It wasn't noticed by (NBC News), it wasn't noticed by us, but it became obvious when it played in court," Frederiksen told Reuters.

Sandusky attorney Joe Amendola said NBC's error would form part of the basis for an appeal. "Oh my goodness, yes," he said, when asked about whether it could be used in an appeal.

I can't quote the whole thing, but they apparently knitted together two parts of the interview that were not actually connected. Bob Costas asked him if he was sexually attracted to young boys, and then Sandusky answered (according to NBC's edit) "Am I sexually attracted to young boys?" as if he was stonewalling, or attempting to delay answering, the way people do when hiding guilt.

The article doesn't say in what context those two statements actually appeared, but it appears they were not actually connected.

Big Journalism wants to know how many deliberately deceptive edits NBC's chief is comfortable with.

Apparently the answer is "at least five, and counting."

Sounds like a strong ineffective assistance of counsel claim is in the making.  I don't know what 6 additional months of preparation time for the defense would have hurt.  (keep in mind, the Attorney General's office built its case over a course of years).

94 Sandusky's attorney is blowing smoke.  He allowed his client to be interviewed on TV.  He had to know the tape would be used as evidence.  He also had to know that the tape had been edited, yet he never bothered to obtain the raw footage from NBC.  He just fucked up, and no appellate court is going to overturn a verdict because the attorney was too lazy to do his job.

And the "ineffective assistance of counsel" strategy isn't going anywhere.  Those claims win only when the representation was egregious.  Like, counsel was sleeping through parts of the trial or was seriously impaired by drugs, alcohol or a true mental disability.  Run-of-the-mill attorney negligence doesn't cut it.

Both sides would be entitled to the complete material. Typically, both sides would know that the tape is edited and the defense would file a MIL or seek suppression of the edited tape. Of course, a prosecutor wouldn't (shouldn't) knowingly offer an edited tape if the edits are misleading because a defense lawyer could then blow up the prosecutor's credibility.

It's a HUGE error on the defense's part.  The prosecution didn't make up those statements.  Sandusky said them.  If there are other parts of the tape that are needed to put them in proper context, it's the job of the defense to show that to the jury.

100 Actually, it was in context but they looped it twice.  It made it appear as if he didn't answer the question, so it was asked again.  It then appeared he refused to answer a second time.

The prosecutors realized the error at trial and the judge instructed the jury to only consider the transcript which was accurate.  I don't see this going anywhere.

To be fair, I don't know tat it is a strategy.  Sandusky's lawyers basically told the highest Court in the Commonwealth before the trial that they were not prepared to try the case.  The Attorney General's office built its case over a course of years (beginning in 2009) and Amendola had only 8 months to get up to speed.  That's a gross disparity.  I think he's guilty as sin but I still believe that the defense should have had adequate time to prepare in a complex case where the punishment is essentially life in prison.  The facts and evidence were strong enough that 6 additional months for Amendola with Sandusky under house arrest wouldn't have affected the outcome, and would have removed or greatly diminished an appealable issue.

217 This issue came to light during the trial.  Defense lawyers could have insisted that the "correct" version of the interview be played for the jury, but I'm sure they didn't want that bell rung a second time.  According to the coverage in the Patriot-News, the judge decided against replaying the interview, but the coverage doesn't mention what position the defense lawyers took.  I have to assume that they would not have wanted that damaging interview played a second time.

This is important because an appeal will generally be denied if the trial court's action is deemed "invited error," or if the complaining (appealing) party didn't ask for, and be refused, the proper corrective steps at the time of trial. 

In due time, it won't matter, because jurors will understand that as soon as they hear that NBC is involved in editing something, they'll just assume it has been doctored to be misleading.
