Now Erick Erickson of Redstate and CNN Gets SWATted
— Ace

Is anyone in the media going to cover this, or are they all going to continue giving the leftwing the Green Light for terrorizing people?

Even though Erick Erickson is a CNN contributor, I think there's a good chance they won't cover the story. If they do, you can bet your bottom dollar it will be a "balanced" piece including lots of supposed harassments of liberals.

They'll reach back ten years for "balance."

There are only two media storylines: Conservatives are doing bad things, and "a broken system permits both sides to do bad things."

There is never the third type of story: Leftists are doing bad things.

Incidentally, I'm okay, nothing to report.

21 A good use of all that wasted Stimulus money would have been to give local police departments the money they need to upgrade their 911 systems to prevent such attacks.  This vulnerability has been known since 2007 when a Washington state teen 'swatted' someone in California.

This does need more exposure, the malice of such people is sickening.  This is domestic terrorism, one either caves in and goes silent or risk being accidentally killed by a SWAT unit responding to a false call.

I imagine CNN will have to talk about this now, otherwise what is to stop Erick Erickson from bringing this up on live TV without their permission?

That depends on how muc Erick loves the CNN limelight I suppose.  If he just went off topic they'd likely just not ask him back (even if he is reporting legitimate news.)  That's how media rolls, and this is from someone who generally dosen't revert to a "biased media is biased" state.  (MSNBC, clearly leftist, CNN: Struggling for relevance in a new partisian media age, IMHO)

48 Crap  ike this is only going to continue. The only effective way to deal with terrorists is to take the battle to them.

Declaring a national "Everybody blog about..." day is useless. Screaming for law enforcement, or the state's A.G. office, or congress, to do something about this is also useless; they haven't done a damn thing yet, so what makes you think that more screaming is going to change anything?

You need to take the fight to the terrorists.

I think that Erickson, and Patterico, and Aaron Worthing, and whoever else has been victimized by these creeps need to start filing lawsuits against them, just like they do. Tie THEM up in court, force THEM into discovery, make THEM spend THEIR money on legal fees defending themselves, drown THEM in a blizzard of lawsuits.

Looking for injunctive relief is useless; it simply won't happen.

You need to take the fight to the terrorists. You need to inflict (legal) pain on them. As long as the terrorists aren't hurting, they're not going to stop doing what they do.

@OregonMuse,

No offense, but I just don't think that will work.  Consider that this guy is willing to piss away his time because he finds it valuable to do so (i.e. he has no life and a charity to siphon income so he doesn't have to work.)  As such you can't out crazy him because the rest of us have to work (e.g. our time is actually valuable.)

One of these nuts has kept Patterico and Worthing (two lawyers mind you) busy on his own.  If another crazy produces himself it might overwhelm even the best of us.

No, you can't fix a broken system by leverging the broken system against those who would abuse it or stated differently: Moral people can't go up against immoral people in a broken system because we moral people have limits.  (Wasn't there a Batman Begins quote about this?)  You need to fix the system or you're just treading water.

Posted by: cm9000 at May 27, 2012 07:50 PM (lzvtR)

57 Costs a LOT of money

You bet it will, there's no getting around it. But ultimately, it's a price that someone or some group is going to have to pay, otherwise we might just as well fold up our tents and cede the political playing field to the left.

I believe this is the beginning of a new phase of the left v. right war. The left has just upped the stakes. Now it's not just "shut up", it's "shut up or we will hurt you."

Patterico and AW and ace and other conservative bloggers are the first targets of this new strategy from the left. I believe a strong, active response is mandatory.

What do you suggest we do until the system gets fixed?

Posted by: OregonMuse at May 27, 2012 07:53 PM (fPBIw)

59

My Personal Legal Theory:

SWATting is equivalent to pointing a loaded gun at another person.

Effectively, the caller is causing armed men (the police, who, in this sort of case, arrive with guns locked and loaded and are authorized to shoot) to forceably enter, i.e., assault, with one or more guns, another person's house with the intent of seizing that person (and apparently everyone else at that location).

If you ge SWATted, run this legal theory past your personal lawyer ... see if he will lean on the DA to get serious action aginst the caller.

75 we have to live with the fact that they can do it, but we can't.

Righteous battles against evil are frequently fought using less than noble means.  The difference is that evil acts as it does by its nature and can't turn it off, because its who they are.  The righteous warrior recognizes the less than noble means are simply a temporary necessity and can turn them off when the battle is over, because that's NOT who they are.

A troubled conscience is often part of war.

What do you suggest we do until the system gets fixed?

Defend, counter when applicable, and focus our energy on putting the people in power to change the system.

Kimberlin has already found the loophole for which to drive a truck through.  He has no law license to lose, which gives him incredible leverage against Worthing and Patterico whose income is mostly dependent on said license (it is after all their marketable skill.)  Frankly he's playing Mutually Assured Destruction, knowing we're not stupid enough to cut off our noses to spite our face.  Should we devolve to said level of stupid?

No, of course not.  Does this mean we have to merely shut up and take it?  Also no.  Frankly we could tie him up in court until he dies of old age (which is really the only option I see if we opt not to change the system) but it really just puts us back at square 1.  Alternatively we can focus our efforts on closing said truck sized loophole (among others) and end it for a much longer period of time.

Fine; but who is the SWATer who made the call to Erickson? Do we even know who he is?

I think that we do not know for certain who the SWATter is, but with enough paper (warrants, subpoenas, etc.) we can at least narrow down the list of possibles. We might even be able to narrow it down to 1. We should at least try; these calls and actions are public, not provate.

And even if we know who he is, how would we "force" the DA to act, especially if he didn't want to?

Publicize this case, and those like it. Never let up. Start filing motions to discover all relevant imformation; after all, someone is sending the police, with guns drawn, to apprehend ... you ... I view this as Attempted Murder, the flip side of Death-by-Cop (is it only me?). Start filing motions to force the DA to act, if necessary; DAs have respsonibilities to the public too.

Nifong put four totally innocent boys at risk of decades in jail, each -intentionally - and suffered nothing serious for it.

It is also true that, initially, the public information of the case pointed to "guilty". It took some scary time and effort to explode the lies, but it happened.

Nifong lost his job, he was dis-barred. I'd like to have seen him do 10 years in addition, but I was not one of the victims. What does Nifong do for a living now?

This case is different. Even the police know they are being played. A DA who continues ignoring this is risking his career ... even if he's being extremely well paid ... and if he's being paid, he will likely do time.

My dad (banker) used to say the Capture and convict rate for Bank Robberies was upwards of 95%.  In part, he claimed, because they just wanted to make sure very few people got it in their mind to rob a bank.   It helps that they're so rare to begin with, then resources get poored into solving them.  Sometimes resources far in excess of the robbery itself (actually, on certain holidays when I worked at a fast food joint we'd have more money in our safe than the average bank robber got away with.).

Perhaps SWAT-ing should be viewed the same way.  Although rare already we don't want people getting it in their mind that this is something you can do and get away with.  So resources get poured in to ensure a high capature/convict rate.

93 bringing legal action against Kimberlin shouldn't be that difficult.

Obviously he's using untracable "burner" phones.

IMO, one of the most productive routes of attack in terms of generating provable evidence, is insertion of a long term mole into his organization.  It would take probably 5 years or so between initial contact and burning him, and that person would need to spend a couple of years before making initial contact creating an impenetrable legend and track record.

Yea, its a very long term lifestyle change with a lot of sacrifice...and you'd have to be willing to do some pretty unpleasant things to establish bonafides.

I'd argue by and large until now he's really just been to low on the radar of crazy to actually mount an offense against him.  There's lots of crazy out there. Sometimes, perhaps stupidly, we ignore things we shouldn't.  He adaquately diffused his crazy such that we didn't think and mobilize against him.  That much has changed.  Also, one of the double edged swords of the system is that it takes time to catch up with an effectively novel abuse of it.

Additionally I'm not arguing we merely defend, just that we don't engage in Lawfare per se.  I'm arguing we change the rules of the game.  Think of it in more meta terms.  Take away his parcheesi board and he can long longer beat you in parcheesi.

Oh. My bad.

I guess we should all stop talking about how he's doing it since we can't prove he's doing it then.

You don't need to be able to prove it's him. He just needs to be indicted. That requires no proof. Nobody can prove that George Zimmerman committed murder. In fact, we can pretty much, at this point, prove he didn't. But he's been indicted and he'll probably go to jail. Anyway, we're talking about a guy who routinely files phony-baloney lawsuits. What, someone couldn't file a suit against him? C'mon. Proof's beside the point.

It's never a bad idea to doubt Erick Erickson on his claims.  Remember how how he strung people along with the claim he had some kidn of scoop that proved Nikki Haley's accuser was lying and then turns out he didn't have anything and it was just some kind of political theatre?    I wouldn't doubt if he would lie about this in an effort to push the original story up into the national media.

I'm not saying he's lying, but I wouldn't be surprised if he did, based on the limelight seeking stunts he has done in the past.

Dunno much about EE, don't read Red State.  BUT, I will say this.  That'd be a pretty stupid gambit.  The situation with Nikki Haley you describe is classic political theatre, a bluff that (I guess) worked for a while.  Because no one can see your supposed cards.

If this is a bluff, it's a damned easy bluff to check.  Reporters could just call the Sheriff's office.  Bluff called.  So if he does elevate it to the national MSM level (arguably his goal) it's going to get vetted, because the left will want to prove it wrong (and he knows that, or he's stupid.  I'd like to think the former.)

Even so I'm saying your theory barely holds water if I give it an incredibly wide berth.  If his goal is to get it to the national media level, even if CNN decides to run with it on his word, MSNBC won't let that stand without some sort of rebuttle and it's easy enough to check (for a media organization at least.) I'd imagine any news organization looking to bust the story (and there will be at least one I'm sure.) will also want the phone call recordings and any other records they can get their hands on.  If Macon can't produce that Erikson would look foolish.

So it's one of 3 options.  Either a) Erikson (familar with the media) is completely unaware of what I (an amateur) just said.  b) A vast conspiracy between Erikson and his friend including manipulated phone calls and documents or c) He's being level.

Occam says c.

I don't consider losing a career to be commensurate with the risk he exposes others to. Not even close. But, that's me.

and

The punishment must be commensurate with the crime. Nifong should have had to serve the sum total of years that he exposed the boys to. That is the only fair response.

Agreed, but at the time Nifong may have faced a lot of racial and political (88 Duke Faculty) pressure, and figured that things would play out differently. In hindsight, he was completely wrong, but, being a man with power, he may not have seen things that way.

Unfortunately, we do not live in a Fair and Just World. Kimberlin is a Trust Fund Terrorist, who has apparently relied on his family to bail him out.

Put their money in jeopardy (they've been supporting him, they may be accomplices, or at least civilly liable), and K will be on his own.

Then stand up to K and he will fold, like most Leftists. Punish him severely, and make it clear that this punishment is standard, and many other Leftists will slink away ... it's their Draft Dodger Gene.

Maybe ... names? Anyone with a history of SWATting?

I think that's more liekly than than this idea that Kimberlin knows all these conservative bloggers and is targeting thems in a matter of a few days.

It can be anything depending on how eager the local police are.  Bogus 911 calls are fairly common, but a gunshot report will usually, but not always get their attention.

I called 911 last year about an obvious gunfight that happened in my neighborhood (multiple shots, two distinct calibres, clearly not fireworks), and gave them a general compass heading and rough distance they came from.   I don't know if they sent a car or not to look for bodies in the street.  They never got back to me.

Can targetted people make their phones record every call, or would that not help?  911 operators have to keep the tapes of every call, don't they?  Can a 911 tape be requested because a SWAT team came to a targetted person's house at a certain time, by a targetted person's lawyer, even if there is no case at the time?

194 Caller ID spoofing is a major problem.  It used by many people including bill collectors. Just google caller ID spoofing, or Spoofcard, Telespoof, Spooftel or the like.

One can get a card or an account that changes his/her caller ID to a fictional caller ID. All the perp needs to do get the area code and the local 3 digit code close to his victim and fake a call to the police. The police see the fake caller ID and the "SWAT" trick is then put in motion.

215 #199 Coward Robert Ford -

Did I say I was an authority on this Kimberlin matter? I did not, nor would I claim any such thing!

Second: It's very simple, if you keep to the main line of the tale. Sticking only to the provable, convicted or self-reported facts:

1) Brett Kimberlin was a drug dealer (self reported) who committed tax fraud (self reported).
2) Brett Kimberlin was convicted in federal court of perjury at the age of 19 (fact).
3) Brett Kimberlin was convicted of the Speedway Bombings (eight blasts in six days); the fraudulent use of Department of Defense ID and the Presidential Seal (procuring chemicals for the explosives) and some more drug offenses.
4) For reasons many of us find incredible - policy at the time - Kimberlin was released.
5) Kimberlin had his parole revoked for dodging paying a civil judgement.
6) Somehow, Kimberlin was released and now runs a couple 501 (c)'s, and spends a great deal of time and effort legally harassing unfortunates who notice his history and write about it.

It's all very, very simple in outline. Terribly tangled, complicated and nearly unreal in its details, but just sordid and sad and tired in the main thrust of the story.

Got it? good. Now go away.

You think a man with children at home is going to cause the cops to come to his home, guns drawn? Are you nuts, or just evil?

Erick Erickson may be a blowhard and a fool, for all I know. I read the Morning Briefing and find it useful, so I tend to have a positive impression. But to suggest such a mad, stupid and vile action by the father of the children in question is beyond the acceptable lines of civil discourse.

It's a smarmy, disgusting accusation, and if you're making it merely on a speculative basis, I suggest you take a long look at your character, because you have a problem.

Given that swatting seems to happen to anyone who writes too much about Kimberlin it's probably a prudent measure.

... but i think this story has a lot of stuff that is hard to believe. Some criminal thug dude is targeting RSM and Erick Erickson? Those guys aren't that well known even among conservatives.

What "stuff" is hard to believe? You should have little difficulty listing 10 separate items.

That someone SWATted Erickson seems clear; he's simply the latest victim ... unless something comes to light ...

The real question is Kimberlin ...

1. Did he do the things that he was convicted of doing, and does he do the things that several others accuse him of doing? It seems clear that the answers are "yes" and "yes" ... unless you have information ... not an opinion, information ... a link or 5 would be good.

2. Why would he SWAT people? Why does he sue so many times? Some people are ... crazy ... real headcases.

Some of his family are quite successful; maybe , because he's a failure, he has a persecution complex. Talk about him at all and risk his wrath ... speak (or print) the truth, and he goes berserk ... ever meet anyone like this? They aren't all that rare ... fortunately, many of them do not do what Kimberlin does.

What about this is tough to understand? What is part is unblieveable?

Convicted felon Brett Kimberlin is the nephew of a wealthy Maryland woman who has contributed to a foundation that helped fund a 501(c)3 organization of which Kimberlin is the director. KimberlinÂ’s activities have recently attracted widespread attention because of his attempts to intimidate and harass bloggers who wrote about his criminal history.

Harriet Crosby, 66, reportedly an heiress to the General Mills fortune, was one of the original donors to the Threshold Foundation, which contributed $20,000 to KimberlinÂ’s Justice Through Music Project in 2008, according to database research I reported May 19.

CRF: "You should major in mechanical engineering, it will humble you."

Yep, that's probably the same shiite-stain that used the 'Dr Tesla' tag. He probably is conservative, or thinks he is, i.e.: knows the lingo, but he's more prone to just haranguing and stirring up shiite, honestly. He constantly gets insulting about anyone not an engineer, and I think he is either a self important jack ass or a nobody in a big shop/company who thinks he's being overlooked.

He's an engineer, for cripe's sakes, can't we see that? It'd humble us to know how smart he is. He's a freaking genius. Just ask him.

Is he Dr Tesla, a-hole at large? Hard to say. But he sure shares that a-hole's personality traits. He's a troll, either way. And a shiite-stain.

So, he's a shiite-troll.

B/c Kimberlin is a bad dude and sues all the time and maybe even swatted one or two people, that must mean he also swatted RSM and Big Red.

I think a competent judge would toss that Logic.  You got to look at very case on a individual basis.

305 CRF: "Mechanical engineering school more intense than work in my view. it's a tough program, lot of smart people drop out fall semester sophomore year. It humbles most." Still odd that you would so readily recall your experience as a college student, when you have been out of school for 12 years. Maybe you just miss those days so much it is always on your mind? I am just asking questions here. Your story seems...doubtful. (And no, I am not being ironic/satirical.)

LOL.  Only smart by your estimation.  It's a tough concept for your to grasp but you should let it sink in, a bit.

And fall semester sophmore year?  Too funny.  If they're dropping out of anything at that point because they can't hack it, they're idiots.  Obviously.

321 Well, for the record, Clemson is an ag school, and turns out some good engineers, actually. But not the hardest SAT/CSAT/ Entry Boards school to get into. Our high school f*ck-queen got a Master's there.

And she was a Dullard, too.

So he might be trying to hack it there. But he would be a Clemson grad I'd overlook, personally. Or put on projects like dog runs, or fencing projects.

Without moving parts or electrical sub-systems.

You can't trust those to a Dullard.

For now, try mastering using the toilet and  paper towels. Use those engineering principles: flow mechanics and flushing toilets. Stick with it. One day you could design ramps for the restrooms on the interstate.

Out of wood. Without moving parts. Away from the power box.

On account of, well, you're slow. And dim. Dull.

As the Horde knows, I have a bit of A Thing about trading being dominated by algorithms, mainly because it turns the exchanges into trading the stock itself, separate from any type of valuation of the worth of the underlying company.  Mind you, I don't know what to do about that, but it is a problem.

353 Reading some of the overnight comments. I don't think that you can rationalize Ford's comments on a blog. Maybe he is an engineer. He might have said that he studied mechanical engineering because it can be a broad term. I worked for corporations where people were called a "mechanical engineer" or "Engineer" without any specific training. I have seen companies train an  employee in what they needed to know and called them a "mechanical engineer " or engineer etc.  I have worked for fortune 500 companies where they call janitors "engineers". Engineer can be used as a broad term. I have met some pretty stupid "Engineers"

354 are you a trader/investment person?

Ahahahaha. No. Very much no. I just have an amateur (very amateur) interest in the topic.   I consider this all part of the meta discussion as to what is it that the exchanges are trading, are they trading fractional shares in companies or are they trading the stocks themselves, unmoored from the underlying valuation of the company the stock allegedly represents.  This also speaks to the issue of the FB IPO (and other IPOs as well but FB is the most current), is the IPO designed to raise capital for the company or is it designed to be a mechanism for the founders and initial employees of the company to receive value for their previous invested work?

After all, its only the individualist bloggers who are the victims of these acts, and they're the ones who ruined the monopoly of the LSM...so I'm sure the executives at these dinosaurs are uninterested. More important, however, would be a legislative response, treating this as the serious crime it is , one presenting an extreme risk to life, not to mention police / prosecutors who actually pursue this to charges, rather than running away when the going gets tough. Maybe that's underway, but it sure seems quiet. That would take an America that was functioning, not degraded by years of Obamanomics and left wing engineered social and economic decline...

OBAMA NATIONAL CO-CHAIR ‘VENTURE CAPITAL VAMPIRE’

By Todd Shepherd
May 24, 2012

President Obama continues to hammer presumptive Republican nominee Mitt Romney on his record with Bain Capital. In a fundraiser on Wednesday in Denver, the President continued to push the "Venture Capital Vampire" theme saying, "What Gov. Romney doesnÂ’t seem to get is that a healthy economy doesnÂ’t just mean a few folks maximizing their profits through massive layoffs or busting unions."

We wonder if former Denver Mayor and Clinton Transportation and Energy Secretary Federico Peña happened to be in the audience, and if he agreed.

Peña has been a partner at private equity firm Vestar Capital since 2000. And while President Obama has been giving private equity a bad name, both Peña and Vestar managing director James Kelley have made recent contributions to Obama’s re-election efforts.

Furthermore, Peña’s record as a venture capital investor dates even back to his 2008 days, when he also served as an Obama National Campaign Co-Chair…

So letÂ’s examine the recent "humanitarian" record of Vestar Capital.

In March of 2011, Vestar acquired 100% of Del Monte Foods through a leveraged buyout.

Just two weeks ago, Del Monte announced the closure of a plant in Kingsburg, Califoria, effectively slashing 1,000 jobs. "I am extraordinarily disappointed by Del Monte to make this decision," Kingsburg Mayor Bruce Blayney told the Kingsburg Recorder. "This is a major blow to the local economy."

Roughly eight years ago, Vestar purchased the Solo Cup Company.

According to this 2007 report, Solo Cup Co. (with Vestar as a parent firm) shuttered three U.S. factories. As early as 2010, with Vestar still as the parent company, Solo Cup announced plans to shut an eighty year old factory, ending more than 540 jobs.

In 2002, Vestar acquired frozen food giant BirdsEye Foods.

Roughly four years later, Vestar laid off approximately 500 workers at BirdsEye. "Some of them were employed at Birdseye for 15 to 30 years," according to KGO Ch. 7 in San FransicoÂ…

386 The MSM is like the homely girl that the football jock smiles at to get his homework done. She keeps hoping she's not being played for a fool but in her heart she knows he's just using her.

Strangely enough until they have their eyes opened by some occurrence, they'll defend to the death their "Beau" as being worth it and not using her etc. etc.

We've all seen that movie.

If they're lucky they wake up before they've got a bun in the oven and he's in Harvard or Yale or in rookie camp somewhere shacking up with the cheerleaders.

The MSM? Most of these people will be forced to retire soon so I think they're already screwed.

390 Banner ads here at this site are trying to get me to vote against Scott Walker. Well click on 'em. That way you throw a little change toward the head ewok, you also force the anti-walker forces to spend some more money, and it's not like you're actually going to vote Barrett in the recall, so it's "win" all the way around for us.

According to the Patterico story they used Skype, and a bunch of proxies, and the  911 recording kind of sounded like Skype was being used.

Catoctin Mountain park is very nice assuming the JEF hasn't completely trashed the area.

I never have trusted cops of any kind. I have seen and heard way too many instances of civilians getting shot, mauled, and killed by cops of one stripe or another, usually based on false or bad information.

SWAT teams have just made it worse. Consider that young former Marine that got gunned down in is own home and was left to bleed out while his wife cried for them to give medical aid.

Ace, I suggest you get a lawyer to send 'lawyer letters' to all cop shops in your area outlining the issue and what evil is being done. It probably still won't keep some jackass with a badge and a gun from trying to kill you, but it just might give you a small edge towards coming out alive.

Yeah well, he managed Allied victory over Germany and a couple presidential elections following that, so, sometimes, shit does happen.

That, and he didn't feel the need to throw it in everyone's faces about how "He Won". Mind you he didn't personally execute the world most dangerous terrorist with his bare hands, and he never "slow jammed the news" and he never was the "twoosh master".

Come to think of it Eisenhower doesn't measure up. \sarc

400 Don't worry. Not only is the MSM silent on this, so is the Drudge Report. He couldn't even be bothered to link to any of the Conservative Blogs on Brett Kimberlin day.

So I'm not surprised when the Left won't defend us, when the biggest and most influential "Conservative" sites *still* refuse to get involved wholeheartedly.
