Even though Erick Erickson is a CNN contributor, I think there's a good chance they won't cover the story. If they do, you can bet your bottom dollar it will be a "balanced" piece including lots of supposed harassments of liberals.
They'll reach back ten years for "balance."
There are only two media storylines: Conservatives are doing bad things, and "a broken system permits both sides to do bad things."
There is never the third type of story: Leftists are doing bad things.
Incidentally, I'm okay, nothing to report.

It's on the phone, it is a Federal crime. Our whole communications system is under Federal regulation, so, it is Federal Pound In The Ass Prison.
The states can have some regulations, but even if the call was spoofed by Eriscons next door neighbor, the Feds should get involved.

That depends on how muc Erick loves the CNN limelight I suppose. If he just went off topic they'd likely just not ask him back (even if he is reporting legitimate news.) Consider that this guy is willing to piss away his time because he finds it valuable to do so (i.e. he has no life and a charity to siphon income so he doesn't have to work.) My Personal Legal Theory:
SWATting is equivalent to pointing a loaded gun at another person.
Effectively, the caller is causing armed men (the police, who, in this sort of case, arrive with guns locked and loaded and are authorized to shoot) to forceably enter, i.e., assault, with one or more guns, another person's house with the intent of seizing that person (and apparently everyone else at that location).
If you ge SWATted, run this legal theory past your personal lawyer ... see if he will lean on the DA to get serious action aginst the caller.

Defend, counter when applicable, and focus our energy on putting the people in power to change the system.
Kimberlin has already found the loophole for which to drive a truck through. He has no law license to lose, which gives him incredible leverage against Worthing and Patterico whose income is mostly dependent on said license (it is after all their marketable skill.) Frankly he's playing Mutually Assured Destruction, knowing we're not stupid enough to cut off our noses to spite our face. Should we devolve to said level of stupid?
No, of course not. Does this mean we have to merely shut up and take it? Also no. Frankly we could tie him up in court until he dies of old age (which is really the only option I see if we opt not to change the system) but it really just puts us back at square 1. Alternatively we can focus our efforts on closing said truck sized loophole (among others) and end it for a much longer period of time.

I think that we do not know for certain who the SWATter is, but with enough paper (warrants, subpoenas, etc.) we can at least narrow down the list of possibles. We might even be able to narrow it down to 1. We should at least try; these calls and actions are public, not provate.
And even if we know who he is, how would we "force" the DA to act, especially if he didn't want to?
Publicize this case, and those like it. Never let up. Start filing motions to discover all relevant imformation; after all, someone is sending the police, with guns drawn, to apprehend ... you ... I view this as Attempted Murder, the flip side of Death-by-Cop (is it only me?). Start filing motions to force the DA to act, if necessary; DAs have respsonibilities to the public too.

My dad (banker) used to say the Capture and convict rate for Bank Robberies was upwards of 95%. In part, he claimed, because they just wanted to make sure very few people got it in their mind to rob a bank. It helps that they're so rare to begin with, then resources get poored into solving them. Sometimes resources far in excess of the robbery itself (actually, on certain holidays when I worked at a fast food joint we'd have more money in our safe than the average bank robber got away with.).
Perhaps SWAT-ing should be viewed the same way. Although rare already we don't want people getting it in their mind that this is something you can do and get away with. So resources get poured in to ensure a high capature/convict rate.

I can't agree. I think this is inadequate. You don't win against terrorists by playing defense. In fact, I would argue that what you describe is pretty much how Kimberlin has been dealt with so far, and it hasn't worked out too well. Advocating for more of the same isn't going to work.

IMO, one of the most productive routes of attack in terms of generating provable evidence, is insertion of a long term mole into his organization. It would take probably 5 years or so between initial contact and burning him, and that person would need to spend a couple of years before making initial contact creating an impenetrable legend and track record.
Yea, its a very long term lifestyle change with a lot of sacrifice...and you'd have to be willing to do some pretty unpleasant things to establish bonafides.

I'd argue by and large until now he's really just been to low on the radar of crazy to actually mount an offense against him. There's lots of crazy out there. Sometimes, perhaps stupidly, we ignore things we shouldn't. He adaquately diffused his crazy such that we didn't think and mobilize against him. That much has changed. Also, one of the double edged swords of the system is that it takes time to catch up with an effectively novel abuse of it.
Additionally I'm not arguing we merely defend, just that we don't engage in Lawfare per se. I'm arguing we change the rules of the game. Think of it in more meta terms. Take away his parcheesi board and he can long longer beat you in parcheesi.

Remember how how he strung people along with the claim he had some kidn of scoop that proved Nikki Haley's accuser was lying and then turns out he didn't have anything and it was just some kind of political theatre? Even so I'm saying your theory barely holds water if I give it an incredibly wide berth. If his goal is to get it to the national media level, even if CNN decides to run with it on his word, MSNBC won't let that stand without some sort of rebuttle and it's easy enough to check (for a media organization at least.) I'd imagine any news organization looking to bust the story (and there will be at least one I'm sure.) will also want the phone call recordings and any other records they can get their hands on. If Macon can't produce that Erikson would look foolish.
So it's one of 3 options. Either a) Erikson (familar with the media) is completely unaware of what I (an amateur) just said. b) A vast conspiracy between Erikson and his friend including manipulated phone calls and documents or c) He's being level.

It can be anything depending on how eager the local police are. Bogus 911 calls are fairly common, but a gunshot report will usually, but not always get their attention.
I called 911 last year about an obvious gunfight that happened in my neighborhood (multiple shots, two distinct calibres, clearly not fireworks), and gave them a general compass heading and rough distance they came from. I don't know if they sent a car or not to look for bodies in the street. They never got back to me.

The caller (the other dancer, not Mangum) said that after they "escaped" the house, they were "so scared" that they "drove back by" a couple times IIRC to "see what was going on." If that is not a complete bullshit story I don't know what is.

Can a 911 tape be requested because a SWAT team came to a targetted person's house at a certain time, by a targetted person's lawyer, even if there is no case at the time?

One can get a card or an account that changes his/her caller ID to a fictional caller ID. All the perp needs to do get the area code and the local 3 digit code close to his victim and fake a call to the police. The police see the fake caller ID and the "SWAT" trick is then put in motion.

The real question is Kimberlin ...
1. Did he do the things that he was convicted of doing, and does he do the things that several others accuse him of doing? It seems clear that the answers are "yes" and "yes" ... unless you have information ... not an opinion, information ... a link or 5 would be good.
2. Why would he SWAT people? Why does he sue so many times? Some people are ... crazy ... real headcases.
Some of his family are quite successful; maybe , because he's a failure, he has a persecution complex. Talk about him at all and risk his wrath ... speak (or print) the truth, and he goes berserk ... ever meet anyone like this? They aren't all that rare ... fortunately, many of them do not do what Kimberlin does.
What about this is tough to understand? What is part is unblieveable?

My father was in the Stationary Engineer's union.. He was in charge of commercial building's HVAC and other systems.. a fairly specialized trade, but not one needing any college, for sure.

We can buy it here in OH. I'm just too lazy to go get it. There's a third of a bottle of Jim Beam here, but the other 2/3rds were consumed during the ONT a few days ago. Not quite ready to hit that again yet.

President Obama continues to hammer presumptive Republican nominee Mitt Romney on his record with Bain Capital. In a fundraiser on Wednesday in Denver, the President continued to push the "Venture Capital Vampire" theme saying, "What Gov. Romney doesnÂ’t seem to get is that a healthy economy doesnÂ’t just mean a few folks maximizing their profits through massive layoffs or busting unions."
We wonder if former Denver Mayor and Clinton Transportation and Energy Secretary Federico Peña happened to be in the audience, and if he agreed.
Peña has been a partner at private equity firm Vestar Capital since 2000. And while President Obama has been giving private equity a bad name, both Peña and Vestar managing director James Kelley have made recent contributions to Obama’s re-election efforts.
Furthermore, Peña’s record as a venture capital investor dates even back to his 2008 days, when he also served as an Obama National Campaign Co-Chair…
So letÂ’s examine the recent "humanitarian" record of Vestar Capital.
In March of 2011, Vestar acquired 100% of Del Monte Foods through a leveraged buyout.
Just two weeks ago, Del Monte announced the closure of a plant in Kingsburg, Califoria, effectively slashing 1,000 jobs. "I am extraordinarily disappointed by Del Monte to make this decision," Kingsburg Mayor Bruce Blayney told the Kingsburg Recorder. "This is a major blow to the local economy."
Roughly eight years ago, Vestar purchased the Solo Cup Company.
According to this 2007 report, Solo Cup Co. (with Vestar as a parent firm) shuttered three U.S. factories. As early as 2010, with Vestar still as the parent company, Solo Cup announced plans to shut an eighty year old factory, ending more than 540 jobs.
In 2002, Vestar acquired frozen food giant BirdsEye Foods.
Roughly four years later, Vestar laid off approximately 500 workers at BirdsEye. "Some of them were employed at Birdseye for 15 to 30 years," according to KGO Ch. 7 in San FransicoÂ…

Strangely enough until they have their eyes opened by some occurrence, they'll defend to the death their "Beau" as being worth it and not using her etc. etc.
We've all seen that movie.
If they're lucky they wake up before they've got a bun in the oven and he's in Harvard or Yale or in rookie camp somewhere shacking up with the cheerleaders.
The MSM? Most of these people will be forced to retire soon so I think they're already screwed.

I never have trusted cops of any kind. I have seen and heard way too many instances of civilians getting shot, mauled, and killed by cops of one stripe or another, usually based on false or bad information.
SWAT teams have just made it worse. Consider that young former Marine that got gunned down in is own home and was left to bleed out while his wife cried for them to give medical aid.
Ace, I suggest you get a lawyer to send 'lawyer letters' to all cop shops in your area outlining the issue and what evil is being done. It probably still won't keep some jackass with a badge and a gun from trying to kill you, but it just might give you a small edge towards coming out alive.

Yeah well, he managed Allied victory over Germany and a couple presidential elections following that, so, sometimes, shit does happen.
That, and he didn't feel the need to throw it in everyone's faces about how "He Won". Mind you he didn't personally execute the world most dangerous terrorist with his bare hands, and he never "slow jammed the news" and he never was the "twoosh master".
