Out of 100 Americans, how many know it was upheld by the SCOTUS b/c it was a tax? I'd say 5.

I watched the networks last night. They all said Obamacare was upheld, none went into details. So you average low information voter simply knows Obamacare was upheld.

If the media were telling everyone it is now a tax, then more people might know, but as of right now nothing changed.

Obamacare is still a law and if we start bitching about it being a tax, then we're just refighting a battle we lost (in the view of a low information voter).

 

This was a complete rout. Either we win the Senate and White House next year or Obamacare is law of the land until our fiscal collapse.

1.  If you do have insurance, but it doesn't meet the levels of the Obama plan, will you have to pony up the difference?  Or just get moved over to Medicaid?  Will IRS wage garnishment take the difference?

2.  If you have a BETTER plan, will you have to pay a fine for a "Cadillac" plan?

3.  Predictions on job losses throughout the country, as employers calculate the cost/benefit analysis on this. 

4.  If you lose your job and can't afford the COBRA, what then?  Automatic Medicaid?  Or an IRS fine?

I want to try to win over some hearts and minds here, folks.  Links in nics would be great.

I don't like relying on the court to fix my political losses.

 

Keep in mind that if the court had overturned Obamacare, the political fight against Obamacare II would have begun immediately. The Left won't stop on this and other government expansion. Ever. It's why they exist. A ruling against Obamacare would not be a gamechanger. It would have just set up the next political battle.

 

The good news is, the Right is better at creating a limited government narrative than it's ever been - better than in 2008, for sure. The liberal media gatekeepers are dying off. America's fate will ultimately be decided our culture and politics, as always, not the courts.

Wondering the same  thing myself.  I'm about to try something different in my business with only a handful of employees and if I can make it work I can see my LLC getting to that dreaded 50 mark within a few years. 

 

This has always struck me as not only a backdoor for single payer, but as a way to stick it to large corporations that don't effectively pay taxes.  A midcap company can probably split up into different entities, but a large company can't.

 

Just another example of how fucked up this whole thing is - no one really seems to know.

What do you think the definition of a tax is?  A speeding ticket is a fine for breaking the law.  You can't really "choose" to break the speed limit and just pay the "tax."  If you do that enough times, you lose your driver's license. Obamacare does not make it against the law to not have health insurance.  It just taxes you if you don't.

It's going to take time to turn the ship around. The federal government has been expanding its reach pretty much continuously since...the nation's birth? Hyper-expanding for at least a century.

Obamacare DOES NOT MAKE IT ILLEGAL to not have health insurance.  It just taxes you if you don't.  If you don't pay the tax, you are not in violation of the Obamacare law, you are in violation of the Internal Revenue Code.  You pay the tax to the IRS.  It goes into the general fund of the Treasury.  That's why it's a tax.  Congress could have set it up as a fine to be paid into some new penalty fund that would be used to pay for specific health care costs.  That would have been unconstitutional as it is not a tax and Congress has no power under the Commerce Clause to levy such a fine for inactivity. 

 

This is what Nancy Pelosi was talking about when she said this thing was "ironclad" and laughed at people who thought it was unconstitutional.  She was right.  What we let her get away with was lying and not calling a tax a tax.

@162 As CJ Roberts explained, it is reasonably interpreted as a tax on behavior that the government wants to discourage.  Inactivity, i.e. not buying insurance, is NOT commerce, but it sure is behavior, and that is taxable.  Roberts also said there are limits to this power, but those need not be defined in this case to find the Obamatax constitutional.  It's certainly reasoning that is subject to fair criticism, but I'm getting a little tired of people just saying he pulled this out of his ass. 

 

What I would like to see, if the law is not repealed, is a challenge by an individual who self insures.  Someone who has a few hundred grand in the bank and assets that could give him/her millions if necessary to pay for any potential health care need.  I believe the government would be hard pressed as to why such a person should be taxed for not buying a completele unnecessary insurance policy.  In fact, I was puzzled why the plaintiffs did not use such an example in arguing that even a tax is unconstitutional if it is levied on such people.

There is nothing in the Constitution that prohibits Congress from applying such a tax, and the Constitution and precedent are what Roberts used to make his ruling.  It is a political question as to whether a tax is wise or unwise.  Roberts properly ruled only whether it was permissible under the Constitution, which it is.  As Roberts stated in the decision, it is not the job of the court to protect us from the consequences of our political decisions.
