15 "Now that the individual mandate has acquired the official constitutional status of a “tax”, there is no longer any doubt that the Congress, and more specifically the Senate, can repeal it pursuant to the simple majority vote threshold available under the Budget Act’s reconciliation process. Some Senate insiders were concerned that the reconciliation process would leave too much of Obamacare intact, including the individual mandate. But today’s decision, while alarming in so many other ways, dispels with that concern. The mandate is now a revenue provision. Therefore, it is germane and not subject to a Senate parliamentary point of order to strike it from a repeal bill. The Senate’s filibuster process that would require a supermajority of 60 Senate votes to approve repeal is now irrelevant." -- Mike Franc, Heritage’s Vice President of Government Studies

38 I like cute baby puffins.

I do not like Bark Obama, Congress or "Justice" Roberts.

You think this has been a irritating day? As Ronald Reagan said in a different context, "you ain't seen anything yet!"

Between the gutless, politically motivated eunuchs whining about the treatment of poooor race-victim Eric Holder, the crowing from the left over the shredding of the Constitution and the events in Egypt -- all aided and abetted by the Choomer-in-Chief -- this may well go down in history as the day America's death throes really began.

I know what I believe must happen, but will not say, as the very words I would use are filtered/banned at Tepid Air.

But I know that will not come to pass anyway, and the end of a once-magnificent country will come quietly, with much suffering.

40 Since the Congress can now command citizens to do anything the Congress wants, since America as a republic under a government of limited powers is now officially dead, therefore conservatism, which if it means anything means support for that republic of limited powers, is now also dead. For conservatives to continue to support the constitution means supporting a leftist government with unlimited powers. Therefore the only meaningful form that conservatism can now take is counterrevolution, which means: opposition to the lawless regime that America now is, and the declared intent to overthrow it. Any “conservatism” short of counterrevolution is simply subscription to, loyalty to, patriotism to, obedience to, a leftist unlimited state.

Operation Fast and Furious was a highly irresponsible operation that should never have happened. I find this to be most troubling. This is not a 2nd Amendment question. 132 If the APA mandate is a tax, it would have to have originated in the House.  It didn't.  That issue was actually spoken of in the blogosphere back when the thing was passed.

So....Chief Fuckwit Roberts waves a wand....and voila!  ...it's a tax.

And,  Roberts states that Congress, by calling the tax a "penalty" and not a tax, clearly(!) didn't mean for it to be a tax subject to the restrictions of the anti_Injunction Act. (which would have required that no suit could be filed until a new tax is actually collected)

So....what's to prevent anyone from challenging the APA on the basis of it not originating in the House?

I'm sure Mark Levin will be discussing this tonight!

137

I am tiring of the post-rationalizing comparison of Roberts to John Marshall as some genius strategic chief justice who handed the other branches a small victory but at the same time has diminished their power and elevated the power of the judiciary.  John Marshall was presiding over the weakest branch of the government at the beginning of our republic.  Marshall's genius was his manuevering to elevate the power of the Court to the other branches of government by stating that the other branches cannot encroach on the government.

From this judicial review we are now presently at the point, where most people believe in judicial supremecy - that something is only constitutional or uncsontitutional until the Court declares it as such.  There is no doubt that today the Court is as powerful as the other two branches, if not more powerful (I would argue it is certainly more powerful than Congress).  So the rationalization goes that Roberts gave Obama a victory for what purpose - to save respect for the Court and take it out of politics.  Everything is political.  The Court is as political as any other branch.  Why is that a bad thing?  We have checks and balances to guard against this.  Roberts abdicated one of those checks and balances.   At this point, I don't see Roberts as a master genius on par with Marshall, I see him as someone who punted and tried to give everyone something.

The fact that Ezra Klein wrote that Roberts is some political genius only affirms my belief that Roberts is being given way to much credit by way too many people who are trying to rationalize a victory out of a huge defeat.  I understand looking at the bright side of life, but let's not get carried away.  At least temper it with some caveat such as ... "Hopefully in retrospect Roberts will look smart ..."

Anyway, my favorite line from Ezra's piece on Roberts:  "By voting with the liberals to uphold the Affordable Care Act, Roberts has put himself above partisan reproach. No one can accuse Roberts of ruling as a movement conservative. HeÂ’s made himself bulletproof against insinuations that heÂ’s animated by party allegiances."

So we now know that the left will never accuse Roberts of being a partisan again.  Ha.

Cause the MSM is portraying this as "he won" and "he'll win in November" so just give up now...."

254 The commies over at Slate say that Roberts' decision is a Trojan horse that guts the commerce clause and reduces the power of big government.  That is based upon this paragraph.

"Construing the Commerce Clause to permit Congress to regulate individuals precisely because they are doing nothing would open a new and potentially vast domain to congressional authority. Congress already possesses expansive power to regulate what people do. Upholding the Affordable Care Act under the Commerce Clause would give Congress the same license to regulate what people do not do. The Framers knew the difference between doing something and doing nothing. They gave Congress the power to regulate commerce, not to compel it. Ignoring that distinction would undermine the principle that the Federal Government is a government of limited and enumerated powers. The individual mandate thus cannot be sustained under CongressÂ’s power to 'regulate Commerce.'"

This is weak sauce even if the commerce clause is no longer the Kryptonite clause of the constitution if any regulation that can be deemed a tax allows the same outcome.

257 It could have been worse. Roberts could have said that the MANDATE was constitutional. On the plus side, future congresses can no longer pretend that a mandate isn't a tax. I would also suspect that come 2014 there will be lawsuits once against the tax. Yeah, the liberals got what they wanted today, but hopefully it will be pyrrhic and the libtards will find it difficult to say that the Supreme Court is a right leaning political entity. We lost this battle; but don't retreat, reload.

Enjoy Jake Tapper's take down of Aaron "West Wing" Sorkin's latest liberal claptrap, The Newsroom:

…in another episode Sorkin pats [anchor] McAvoy on the back for limiting his coverage of the failed Times Square bomber and resisting the temptation to “hype” a terrorist threat that fizzled. (With no apparent sense of sarcasm, Skinner repeats praise for their restraint from Media Matters and Think Progress, as if those explicitly liberal websites are nonideological arbiters of Edward R. Murrow’s legacy.) And what are the important issues “News Night” covers instead of the piffle of Faisal Shahzad, a homegrown terrorist funded and trained by the Pakistani Taliban? McAvoy instead devotes at least a week of his broadcast to showcasing what a horribly inept and dangerous bunch Tea Party Republicans are as they—gasp!—defeat establishment Republicans in free and fair primaries and elections. It’s all well and good to follow the Koch brothers’ money, but at a time when Democrats controlled the White House and both houses of Congress, it’s telling that McAvoy and Sorkin aim their sights at conservatives seeking power—not moderates and liberals wielding it.

Following a contempt citation, the presiding officer of the chamber is instructed to refer the matter to the U.S. Attorney for the District of Columbia;[9] according to the law it is the "duty" of the U.S. Attorney to refer the matter to a grand jury for action.

The criminal offense of "contempt of Congress" sets the penalty at not less than one month nor more than twelve months in jail and a fine of not less than $100 nor more than $1,000.[10]

440 Order in the House!

CA Lundgren is up.

708, re 706: resolution authorization to intervene re: subpoenas
Seek a court's injunction to subpoena the AG Holder.
Constitutional obligation to provide OVERSIGHT of the Executive Branch!

Constitutional Rights of Americans will not be trampled upon.

Representing Americans, oversight of Executive Branch, in this case the Dept. of Justice, to subpoena because The House was misled by the Justice Dept. and not corrected for 10 months, attempting to "slow walk" the Congress to prevent Congress from performing its constitutional duty.

Requesting AUTHORIZATION to see that the Committee resolutions are carried out in full.

441 Thanks M80s. Mia Love is currently mayor of Saratoga Springs, one of the Utah towns hit by wildfires. Unfortunately, she was unable to attend the fundraiser with Paul Ryan last weekend b/c of the fire. She needs money. Matheson is an incumbent, even though the district is new. And I believe the district is purple. This would represent a pickup for Rs. What I'd like is a list of Senate races. I'm so fucking angry about the Hatch thing, but I need to channel that to some race where we can improve the senate (and to Love, to whom I've already donated and for whom I'll be working).

I think you underestimate the importance of the contempt proceedings. If Holder wasn't found in contempt *after being the essence of contemptuous* there would be little point in congress claiming to have an oversight role in government.  They *still* may screw this up and essentially cause the loss of 1/3 of government, but the proceedings *had* to happen and Holder *had* to be found in contempt (given that he was treating their supeonas like some big game).

543 The NBPP Tampa chapter was going on at twitter this week about "killing crackas!" and claimed they were going "underground" to plot for the GOP convention. Now their website is gone.

Did they go "underground" or did someone take it down for them?

Either way, a huge THANK YOU to Governor Scott for refusing to disarm law-abiding citizens during the convention, despite the best efforts of the Tampa mayor to do otherwise.

Hashes aren't soda cans, they are based on an algorithm off of a static IP.

It's an IP that CBD used, and hence, it is CBD.

548 Question about the medicaid aspect of the ruling. If states do not form an exchange in their state to expand coverage and the federal government cannot penalize them for not doing so, then what is the purpose of this act? What is the purpose of the tax then? Most of us already have insurance in one form or another. Just trying to think this through and it is making no sense.

We've still got something like 4 Rs running for McCaskill's spot. I'm inclined to like Akin from what he's done with F&F, the "SWATing" stuff, and the fact he's pushing #FullRepeal, but don't know who we'll replace him  as representative  with here in my district.

I'm fairly certain McCaskill's done, since she voted for ObamaCare and is running tied with a couple of the R candidates no one's heard of before this, which is a pretty bad sign for her.

CBD, seriously.  Glad it wasn't you.  But I ask you to go and look at a bunch of those CBD posts with the proxy hash.

Now, I don't think we'll be sing Paulie much more, for whatever it's worth.  But look at what one sees with a little + in front of the hash, and tell me what you would think.
