I do not like Bark Obama, Congress or "Justice" Roberts.
You think this has been a irritating day? As Ronald Reagan said in a different context, "you ain't seen anything yet!"
Between the gutless, politically motivated eunuchs whining about the treatment of poooor race-victim Eric Holder, the crowing from the left over the shredding of the Constitution and the events in Egypt -- all aided and abetted by the Choomer-in-Chief -- this may well go down in history as the day America's death throes really began.
I know what I believe must happen, but will not say, as the very words I would use are filtered/banned at Tepid Air.
But I know that will not come to pass anyway, and the end of a once-magnificent country will come quietly, with much suffering.

Someone in the comments the other day was pessimistic about the upcoming ruling.
They wrote something to the effect that ever since Kelo the Court cannot be counted on to rule wisely on Constitutional matters.
Whoever you were, you were right. This decision today is Son of Kelo, but much much bigger.

So....Chief Fuckwit Roberts waves a wand....and voila! ...it's a tax.
And, Roberts states that Congress, by calling the tax a "penalty" and not a tax, clearly(!) didn't mean for it to be a tax subject to the restrictions of the anti_Injunction Act. (which would have required that no suit could be filed until a new tax is actually collected)
So....what's to prevent anyone from challenging the APA on the basis of it not originating in the House?
I'm sure Mark Levin will be discussing this tonight!

I am tiring of the post-rationalizing comparison of Roberts to John Marshall as some genius strategic chief justice who handed the other branches a small victory but at the same time has diminished their power and elevated the power of the judiciary. John Marshall was presiding over the weakest branch of the government at the beginning of our republic. Marshall's genius was his manuevering to elevate the power of the Court to the other branches of government by stating that the other branches cannot encroach on the government.
From this judicial review we are now presently at the point, where most people believe in judicial supremecy - that something is only constitutional or uncsontitutional until the Court declares it as such. There is no doubt that today the Court is as powerful as the other two branches, if not more powerful (I would argue it is certainly more powerful than Congress). So the rationalization goes that Roberts gave Obama a victory for what purpose - to save respect for the Court and take it out of politics. Everything is political. The Court is as political as any other branch. Why is that a bad thing? We have checks and balances to guard against this. Roberts abdicated one of those checks and balances. At this point, I don't see Roberts as a master genius on par with Marshall, I see him as someone who punted and tried to give everyone something.

The fact that Ezra Klein wrote that Roberts is some political genius only affirms my belief that Roberts is being given way to much credit by way too many people who are trying to rationalize a victory out of a huge defeat. I understand looking at the bright side of life, but let's not get carried away. At least temper it with some caveat such as ... "Hopefully in retrospect Roberts will look smart ..."
Anyway, my favorite line from Ezra's piece on Roberts: "By voting with the liberals to uphold the Affordable Care Act, Roberts has put himself above partisan reproach. No one can accuse Roberts of ruling as a movement conservative. HeÂ’s made himself bulletproof against insinuations that heÂ’s animated by party allegiances."
So we now know that the left will never accuse Roberts of being a partisan again. Ha.

"I'm surprised that the no one heard what Pelosi said. Issa is a hypocrite" for expressing the Terry family's frustration with the Dingell Dean, refusing to take/respond to the family call to him regarding their family member murdered because of Holder's Fast and Furious ATF government enterprise to ENFORCE the brainwashing of Americans to force forfeiture of the right to bear arms in the USA.

"Construing the Commerce Clause to permit Congress to regulate individuals precisely because they are doing nothing would open a new and potentially vast domain to congressional authority. Congress already possesses expansive power to regulate what people do. Upholding the Affordable Care Act under the Commerce Clause would give Congress the same license to regulate what people do not do. The Framers knew the difference between doing something and doing nothing. They gave Congress the power to regulate commerce, not to compel it. Ignoring that distinction would undermine the principle that the Federal Government is a government of limited and enumerated powers. The individual mandate thus cannot be sustained under CongressÂ’s power to 'regulate Commerce.'"
This is weak sauce even if the commerce clause is no longer the Kryptonite clause of the constitution if any regulation that can be deemed a tax allows the same outcome.

Enjoy Jake Tapper's take down of Aaron "West Wing" Sorkin's latest liberal claptrap, The Newsroom:
…in another episode Sorkin pats [anchor] McAvoy on the back for limiting his coverage of the failed Times Square bomber and resisting the temptation to “hype” a terrorist threat that fizzled. (With no apparent sense of sarcasm, Skinner repeats praise for their restraint from Media Matters and Think Progress, as if those explicitly liberal websites are nonideological arbiters of Edward R. Murrow’s legacy.) And what are the important issues “News Night” covers instead of the piffle of Faisal Shahzad, a homegrown terrorist funded and trained by the Pakistani Taliban? McAvoy instead devotes at least a week of his broadcast to showcasing what a horribly inept and dangerous bunch Tea Party Republicans are as they—gasp!—defeat establishment Republicans in free and fair primaries and elections. It’s all well and good to follow the Koch brothers’ money, but at a time when Democrats controlled the White House and both houses of Congress, it’s telling that McAvoy and Sorkin aim their sights at conservatives seeking power—not moderates and liberals wielding it.

708, re 706: resolution authorization to intervene re: subpoenas
Seek a court's injunction to subpoena the AG Holder.
Constitutional obligation to provide OVERSIGHT of the Executive Branch!
Constitutional Rights of Americans will not be trampled upon.
Representing Americans, oversight of Executive Branch, in this case the Dept. of Justice, to subpoena because The House was misled by the Justice Dept. and not corrected for 10 months, attempting to "slow walk" the Congress to prevent Congress from performing its constitutional duty.
Requesting AUTHORIZATION to see that the Committee resolutions are carried out in full.

I think you underestimate the importance of the contempt proceedings. If Holder wasn't found in contempt *after being the essence of contemptuous* there would be little point in congress claiming to have an oversight role in government. They *still* may screw this up and essentially cause the loss of 1/3 of government, but the proceedings *had* to happen and Holder *had* to be found in contempt (given that he was treating their supeonas like some big game).

I'm fairly certain McCaskill's done, since she voted for ObamaCare and is running tied with a couple of the R candidates no one's heard of before this, which is a pretty bad sign for her.
