Oral Arguments In Supreme Court Over Arizona Immigration Law
— Ace

Overall, the liveblogger says the Supreme Court "seems sympathetic to part of the Arizona Law. "

What is less clear is the fate of two sections of the Arizona law that create new state-law crimes based on violations of federal immigration law. Justices across the ideological spectrum at times asked skeptical questions of those latter provisions.
From the tenor of the oral argument, itÂ’s possible a ruling in the case may not fall strictly along ideological lines. Some of the courtÂ’s liberal justices, though expressing concerns about the Arizona law, wondered whether the state could be prohibited from checking the immigration status of individuals within its borders.

One of those provisions is making it a state-level crime for an illegal alien to seek employment in state. Chief Justice Roberts seemed skeptical about this provision. Sorry, I don't see what the other one is.

As earlier in the day, the justices remained fixed on Section 2(B), which requires Arizona police to check immigration status of people they stop when they reasonably suspect they may be present unlawfully.
All that section does is require state officers to notify the federal government that they picked up an illegal immigrant, Chief Justice Roberts said. ItÂ’s totally up to the federal government to decide whether to take any action against that person. He couldnÂ’t understand how that interferes with federal discretion over immigration enforcement.
Take those off the table, the chief justice said. Â“What could possibly be wrongÂ” with having an Arizona cop call the feds to check immigration status?

Mr. Verrilli said, it created an accountability problem. State employees were enforcing federal laws, but were not accountable to federal officials.
[Also] he said, the huge number of inquiries would overwhelm federal resources
But federal law already requires the government to respond to immigration inquires from state officials. No member of the court seemed to accept Mr. VerrilliÂ’s insistence that ad hoc inquiries from state cops were okay, but a statewide policy to do so systematically somehow undermined the federal immigration scheme.

Now the CW shifts to "the illegals are leaving on their own anyway, so let's get rid of all the laws and enforcement that have helped impel them to leave."

I would like to see a State Law, saying that only Residents of the State can recieve State Benefits... and that to BE a Resident of the State, you must be a US Citizen, or have an immigration Status.

This then pulls the issue out of Immigration, and US Citizenship, and into a States Jurisdiction, as States DO have the authority to Create Residency Requirments.

30 The SCOTUS is the prize of this year's election. If non-voting conservatives don't manage to reelect Obama then Romney would have a reasonable likelihood of replacing Ginsburg, Breyer and Kennedy. Even assuming he makes one mistake that still would result in a solid conservative majority that could serve together for a decade or more. If he manages not to make any mistakes (Allison Eid for Ginsburg, Neil Gorsuch or Paul Clement for Breyer, Jerome Holmes or Wallace Jefferson for Kennedy) then Katy bar the door because in that event the Court would have the ability to expunge from the lawbooks all major traces of leftism.

But that IS the actual basis of the feral government's case, that Arizona is breaking the law (LOL) by notifying the feral government in a way in which the feds know that someone is illegally in the US. I mean, that's what their whole case is, which is why this should have been tossed out of c ourt immediately. It is not a serious argument ... for a non-empathizing judiciary, of course.

I consider this suit by the feral government (especially in alliance with a foreign nation that has been actively helping millions of people breach our borders) to be impeachable, myself. Barky is using the feral government to attack an American state on behalf of a foreign invader.

They are not self deporting.

Is the LaRaza crowd deliberately hiding the fact that illegals can get a green card, already...IOW a path to citizenship already exists. They just have to go back to their home country, file an application and wait. It's a PITA, but it can be done. Provided said applicant does not have a warrant pending, or other unsavory details surfacing.

Ah yes, agree about the split. I just googled "SCOTUS tie" and saw the bad news. Bleah. Seems to me there should be a tie-breaking mechanism or that cases shouldn't be heard without nine justices (pull someone in from a feral court somewhere). We may lose that part of the law, but the good news is that in another case, the Supremes recently upheld an AZ law that punishes AZ businesses that hire illegal aliens. So AZ law enforcement may not be able to do anything other than notify the feds about the illegals (which feds will then ignore, as usual), but if AZ businesses are caught hiring illegals, they can get fined and lose their business licenses (which is strong incentive for them not to hire illegals in the first place). Fewer jobs for illegals means fewer illegals.

As for why the Obama DOJ brought this stupid lawsuit in the first place, its purpose was to give Obama another opportunity to demagogue on the illegal immigration issue, and also to make it very expensive for AZ (and serve as a warning to other states considering similar laws that he'll make it expensive for them too).
