— Open Blogger There's a fascinating article in the NYT Friday about the cyberattacks on Iranian nuclear facilities. It's really good and you should Read The Whole Thing... but not right now.Short version, the STUXNET worm (and maybe the newer FLAME) are weapons in a joint US/Israeli cyberwar against Iran. Wow, what a scoop!
This account of the American and Israeli effort to undermine the Iranian nuclear program is based on interviews over the past 18 months with current and former American, European and Israeli officials involved in the program, as well as a range of outside experts. None would allow their names to be used because the effort remains highly classified, and parts of it continue to this day.
Not a scoop. Not investigative journalism. You might get 1 or 2 insiders to breach security and tell stories. But this was Full Cooperation. NYT didn't have to find these people - these people must have been told to tell NYT everything they needed for the story.
So, unusually, I'm not blaming NYT for breaking US security. This had to come from the White House. President Obama.

The story is a campaign ad. And it reveals a bunch of Top Secret stuff. National Security info.You think, "Well Iran must know we did this." No they didn't. I've been following Stuxnet since the story broke - there've been rumors about the Chinese and even antagonistic internal Iranian elements.You think, "Iran knows how many centrifuges went down." Yeah, and now they know that we know. They know if our damage assessment is working. In a war, it's not enough to bomb a target - you have to know if the bomb HIT the target. The enemy delights in erecting fake targets and fake bomb damage. They want to know if their spoofs are successful. This article tells Iran what we think we accomplished. If they were spoofing, they'd know if it worked.There's other info you don't want to give away in the article but I don't need to list all of them.You don't give this information away! And President Obama did.Why?Look at some quotes from NYT.

There’s one last point meriting consideration. Note how eager Obama officials are to use leaks to tout his militaristic aggression. He ended bin Laden and Awlaki’s lives.
Why is Obama eager to get lefties (like Greenwald) to condemn him for this stuff?
It’s because, aside from the tried-and-true strategy of Democratic politicians benefiting politically from provoking criticism from the "Left," Obama officials are eager to depict him as a violence-wielding aggressor.That’s because huge numbers of America’s independents, "moderates" and Good Progressives are extremely aroused by these sort of displays of manly presidential "toughness": witness the stiffened spines and puffed-out chests as they hail their leader for dumping bin Laden’s bullet-riddled body into the ocean or creating piles of other corpses throughout the Muslim world. The more objections from liberals and others, the better.That’s all repellent enough. But that they use national security leaks to accomplish these political goals - at the very same time they exploit secrecy claims to persecute whistleblowers and shield themselves from judicial review - makes it just grotesque.
Ok, so President Obama is a jerk. But hey, that's the way politics are done. Actually, when it comes to National Security, it's not. Forget that this cyberwar was a Bush43 program that Obama inherited... Let's go back a little further.
Cold War. Nixon vs. JFK. Very Close Race. JFK is hammering Nixon (and Eisenhower) on National Defense over the Missile Gap.In the 1950s there was a dispute in the intelligence community over how many ICBMs the Soviets had pointed at us. Estimates ranged from a dozen to almost a thousand. After Sputnik (Oct. 1957) a near panic set in among the public. JFK received leaked estimates on the higher ranges and used those in his campaign against Nixon. Said Nixon and Eisenhower were weak on defense!But Eisenhower, with the benefit of recent U-2 photos, knew the low estimates were correct. Not willing to tell the Soviets how well the U-2 performed... He Kept His Mouth Shut. And JFK* won a very close election.
*JFK got a classified briefing in July 1960 that told him the missile gap didn't exist. Don't know if he kept campaigning on it afterwards.
One more example.
Breaking the German Enigma machine cipher was a pretty big deal during WW2. It was a well kept secret until the mid-1970s. What's the point? We were happy to help many 3rd world countries obtain mint-condition Enigma machines for their cryptographic needs. That was probably pretty useful.
So even if the Iranians know every single detail of the cyberwar we're waging... not every other possible future target does! At least, they didn't until Obama got in a difficult election campaign... (and it's only June!)And It Gets Worse.
(NYT again)
(Obama) repeatedly expressed concerns that any American acknowledgment that it was using cyberweapons ... could enable other countries, terrorists or hackers to justify their own attacks.
The NYT article counts as an American acknowledgment. In Obama's opinion, that makes us fair game. Good luck in your (hypothetical) 2nd term.

It is. I'm tempted to say "no", or at least "no for almost any case that could possibly happen." His position means that any decision to leak becomes automatic declassification. Likewise, his position as commander in chief would give him wide latitude when it comes to military decision making.
This is why we have to be wary of "internationalists" when it comes to the highest levels of government. There is simply too much damage that they can do legally.

The more accurate question, dear alexthechick, is "can/will he be tried and convicted for it?" The Dog-Eater-in-Chief definitely HAS committed treason (IMO, anyway) and, in an honest political climate (and with his Blackdemocratium armor stripped away) would, at a minimum, lose his job.
If he were a soldier or government employee, he would spend the rest of his life in prison for this and other misdeeds. If punishment guidelines were adhered to, he would fare worse.
I know what the Constitution says, and am therefore certain he will (again) skate on this, just as he will for revealing Seal Team Six. No other U.S. citizen would get off so easily.
OTOH, I know what I think should happen, and the SCoaMF wouldn't like it a bit.

That's my thought as well. If the President decides to release the info, well, it's declassified. Short of actually telling one branch of the military to start shooting at another, I can't think (or well don't want to think is more accurate) of any actions that would suffice.

I'm also pretty sure there's no court in the country that wouldn't deem that the President as CiC and head of the Executive branch can make a determination that information should be released in the interests of national security blah blah blah.

I don't know all the laws regarding declassification, but I'm fairly sure there are laws on the subject, and they don't say "well, whatever the fuck this one guy wants is the way it is."
When that one guy is the President, then he pretty much can. Roughly speaking, classification level is determined by policies set in place by various agencies. As the Chief Executive, the President can order a change in those policies. Thus, any decision to release information is a de facto policy change.

Wouldn't work. There are too many people in the government who would simply refuse to follow orders. They don't have to take sides, simply refuse to get off their asses.
Any attempt would likely end up in the Supreme Court very quickly, with a ruling against the Administration. Romney would still be sworn in on Jan 20th, and US Marshals would be sent to arrest Obama if he refused to vacate the WH.

The point being that Obama has wagged his finger disapprovingly at the SCOTUS. He has challenged their authority. What makes you think for a second he would respect any other authority?
It doesn't matter if he respects it or not if he doesn't have support. If they rule that Romney is the legitimate President, then there are plenty of men with guns who will enforce that.
Even more relevant, lefties *always* want a revolution. *Always*. This would be theirs.
They'd lose very quickly. The military wouldn't support them, the police wouldn't support them, and most of the citizenry wouldn't support them.

The vast majority are going to do whatever keeps their bread buttered. Kicking off a civil war in the country is high on the list of things that won't do that. If given the option, the majority will choose a peaceful transition of power over propping up a corrupt narcissist.

Sure. And the drone (when did we quit calling them UAVs?) miraculously landed totally intact and no attempt was made to destroy it. So, China AND Russia not have sample of our stealth tech. I guess Russia put up more money to get an undamaged sample.

The decision to not destroy the UAV is a military decision. It may suck, but it's still a legitimate military decision. If he was briefed on the risks and benefits of various courses of action and decided on that one, then yes the military will follow through.
Most people don't seem to understand that there is a difference between lawful orders and good orders. The military leadership will ask "is this order lawful", but if the answer is yes then they will follow through even if it may seem to be harmful to the interests of the US. They have to give the President the respect and trust that his decisions are made with the best information available and with the best interests of the US in mind. The President can order the US Army to conduct all combat operations in Afghanistan with nothing but butter knives and slingshots and it would be a lawful order. It would be suicidal but lawful and it would be followed.
The alternative is one in which the military questions every order from the WH and actively undermines it. Nothing good can come of that.
In your scenario, the military would have plenty of room to decide that any order given by the President in order to block a legitimate transfer of power is illegal, and they would refuse. The may not actively take part in removing him from power, in fact that would be for the best, but they could very well order troops to stay home and not get involved. Especially if the Supreme Court declared any attempt to undermine the election as illegal.
Could some support Obama? Certainly. However, like LEOs, they'd likely know it was a losing cause, and few would want to plunge the country into a civil war for that narcissist. Better to let there be a peaceful transfer of power.

Lawful? Probably. Obeyed? Possibly. A refusal would constitute a coup against the government. The military would likely try every trick to delay and get congress involved, but if Congress refused to get involved then yes. You would almost certainly see a high probability of "engine failures" over the Pacific and such, but nothing outright defying such an order.

The govt intentionally caused this thing. Professional due diligence was clearly lacking it its design/implementation/testing. People were harmed by it. Obama has confessed to ordering it.

Thanks for the feedback, Alex. I know you were an O ganger, so I figure the idea of civilian control is more a religion than just a good idea.
I don't see where we disagree much. Someone in the military will follow orders even if the result is treason, and the best we can hope, if there is ever any domestic unpleasantness is that local commanders will keep their troops in barracks.
I'd just like to finally knock in the head any thoughts people might have that the military is gonna save them. It is annoying. It isn't their job.
