OK, so I didn't have time to put together a chess thread for tonight, so there's not going to be one. I know that this will come as a huge disappointment to thousands of you, but there you are.

So, this is an open thread. Zero content.

And since this is a non-chess open thread, talking about chess is strictly forbidden. 'Chest' jokes are OK, though. God knows we don't get enough of those on the chess threads.

Also, longbows.

10 Apparently there's been a large blackout around DC and other areas here on the east coast and Amazon Cloud and some other sites are down.

This may be why anyone can't get certain sites. I assume that that's why Daily Caller is also down.

Had a great gig last night. Good music made with good friends, and copious amounts of Guinness. I feel much better today than I have since we became slaves on Thursday. Today is more music and friends: my drummer buddy (who passed away last summer)'s widow compiled a "greatest hits" CD and the release party is this afternoon over on the coast, right on the water.

All is right with the universe again, or as right as it can get. Still can't get motivated to write anything for my blog tho'. I will probably retire it. Ain't much reason to beat my head against the wall any more.

To the cheers of what we call the MFM but in reality what we have is nothing but propaganda. Really it's not even news that you see on the main networks and print news, it is straight propaganda. They use propaganda techniques like bandwagoning to make it look like every loves Obama when meanwhile they would be calling an R president with 40% approval ratings unpopular at every opportunity. They use cardstacking, to highlight anything "good" Obama does, and bury any bad things about to while highlighting anything negative about everything Republican. Really think about it, this fucker was in charge of a justice department that allowed guns to be shipped to a foreign country and has the first AG in history to be held in contempt of Congress. What do you see on the news? Crickets about it. fucking crickets. David Axelrod steers goverment money to his PR firms...more crickets. Solyndra gets a fastrack loan so Obama can use it in commercials as a success and then it goes bankrupt less than a year later...more crickets in our news. If any of those stories had happended when the President had an R in front of their name they would have gotten the attention they deserve and his approval numbers would be sitting at 32%. But no thats not happening nothing negative about this cocksucking asshole in office will be aired. Hell NBC edits fucking tapes to advance left wing bullshit. They edit....their own tapes. There is a general observation that the worst moments in a Tom Cruise movie are those when he is supposed to be displaying some passion for the female lead. One of the reasons 'Eyes Wide Shut' was a turkey is that Cruise came across as such a cold fish throughout.

But even so anyone with half a brain can see through this ruse easily. First, if it was a tax then the court had no jurisdiction to rule on it and none of the people bringing the case before the court would have standing to do so thanks to the Anti Injunction Act. You can't oppose a tax until it's actually opposed on someone. Since the "tax" doesn't go into effect until 2015, by law the Court would have had to set it aside until then. It gets worse, of course. The 16th Amendment gives Congress the power to levy a tax "on income". Obviously this is not a tax on income. It also cannot pass muster as either a direct or excise tax either. As an excise tax it would have to be the same for every state. It isn't, it varies by location. As a direct tax it would have to be appropriated to the states evenly. It isn't. So even if you accept Robert's completely ridiculous assertion that this is a tax, Congress doesn't have the power to levy it. It's still unconstitutional.

From what I heard, the first wife decision came down to a coin toss between Mimi Rodgers and Kirstie Alley. They were roommates and notorious party monsters in the early 80s.

I'm sure the Cruise handlers in the church have a short list of names already under discussion for the next Cruise arm candy unit. They'll probably bump up the age a bit this time, which is kind of funny since Mimi was a bit on the old side back then but would be perfect now if she were still that age. There is no longer much of a fecundity requirement as Cruise moves into roles where his character has adult children. He'll probably be cast as a grandparent before 2020.

The Tax Anti Injunction Act stipulates that a tax rule is immune to estoppel via injunctive relief prior to effective implementation. Standing is not vacated in that Act, nor is any question of tax law required to be set aside. The ruling didn't stop the tax in advance of implementation, it clarified what it was, therefore the ruling is valid.

116 Ok, this may be obvious to everyone but I was going around on the tax/penalty nomeclature and whether all monies going to government are a 'tax'. Then a blinding flash of the obvious hit me:

A tax is levied on something legal (buying a car).

A penalty is levied on something illegal (speeding).

Therefore, how do you frame the question? What is the (in)action?

It's illegal to not get a building permit, therefore penalty. If it's illegal to not get a health insurance policy, therefore penalty (and ACA falls).

Or, if it's legal to be inactive and not buy a health insurance policy, this is a tax (and the mandate stands).

Holy crap, this makes the most sense if I was an alien that just learned English and was talking to earthling Roberts for the first time. For it to be a penalty, the court would have to agree that it is illegal to not get health insurance.

I'm going in circles so much I could be a SC justice. :-( (PS, the ruling sucked.)
