The most delicious part of this is that if the Connecticut school shooting suit is approved (and that has yet to be decided), the plaintiff's attorney may very well call a representative of the NRA to explain how the presence of a $600 tool and the minimal training required to operate it may have been able to prevent this massacre.

1 Bet the local and state will settle out of court without admitting any responsibility.

Go to a jury trial with a a child.  Even just video of the girl with a therapist.  Even if you show the rest of her family are heroin smoking demons from an Islamic hell out for money.  The jury will still award for damages.

They will also settle because its not their personal money.  They can get more by raising taxes.

The main attraction of Gun Free Zones in schools for state and local government is that they cost almost nothing, and the liberals, who are the biggest pain in the ass for administrators, are the very airheads who will be impressed by this shit. Win-win... well, except for those parents with an IQ above room temperature, and all the children.

So maybe it is time to disabuse state and local governments of the fantasy that declaring gun-free zones in some way protects the occupants thereof, and there is no more effective disabuser of fantasies than getting your ass sued off.

First of all, contract actions and tort actions are separate. Some torts touch contract matters (tortious interference, etc.), but they are different causes of action.

But also stupid for a different reason. Medical malpractice? That's a tort. Negligence. If your doctor cuts off the wrong leg, or accidentally sterilizes you, or uses tainted instruments and gives you gangrene, 'oops, so sorry, kindly go die so I can see the next patient.'

Neighbor sets your house on fire with fireworks? Suck it up.

Rich drunk kills your kid with his car? No wrongful death compensation for you. He gets probation and you get an emptier house.

49 One must be very careful in trying to interpret that infamous court ruling that the State does not have a duty to "protect" its citizens.


The case was DeShaney v. Winnebago County Department of Social Services.  The ruling was no duty to protect except in the case of special circumstances because the claimants had sued under the due process clause of the 14th amendment. The ruling was narrow in that the 14th amendment due process clause did to "require" the State to act in the cases of bad private actions.  It only limited gov actions.


In this case all the lawyer has to do is convince a jury that the school was "negligent" in some manner that gave them at least partial cause of the the injury. For example in this case the asshole shooter is 99% responsible and the school is 1% responsible.


Under joint and several liability laws they can then be held for 100% of the damages even though they only were adjudicated 1% of the fault.


With a jury empaneled from a county full of the FSA this would be very easy to do.

I'm sure the local pols would rather settle for a small amount because there's a political component. Sure the state can deny the suit because of lack of duty but how will that look if the lawyer starts holding press conferences in order to intimidate the pols?

The higher courts would probably back the rejection of the suit but the crowds must be obeyed by the pols. There are no adults in politics, only finger-in-the-wind narcissists.

That is BS CBD.  It is only in modern USA that tort law has been allowed to run amuck the way it has here.  Only in the USA would there even be a possibility that some jackass lawyer and a plaintiff could sue a school for what some 20 year old shithead did.

The system has been subverted, but that doesn't mean that the original system was fatally flawed.

Tort law is necessary. Lawsuits are necessary. Finding fault is necessary.

We just let it get out of hand.

And while I agree that the legislatures are responsible, if we had a few more judges who looked at these suits, and the scumbags who bring them, and say, "Get the fuck out of my courtroom with this shit, and enjoy your 10 days in jail for contempt," less of it would happen.

87 I'm skeptical in the extreme of this suit,  mainly because of all the hoaxing and hoaxers who have attached themselves to the situation.  The plaintiff is "Jill Doe" - and the suit itself may be originated by a hoaxer who has found a willing dupe in the attorney - or the suit may be a publicity stunt,  formed around a "do something" mission,  and even (beyond unethical, worthy of disbarrment) client fishing.   These things have happened before  in other cases, and many fakers and glommers-on have already pounced on the opportunity of Newtown.

For example, the  Newtown hoax Uncle "Fanapt" is known for suing under other peoples names.There is the hideous woman, Nouel Alba, who  was arrested Thursday after making up stories about having to identify her
nephew's body in order to raise money for a "funeral fund" for the victims.

A hoaxer even pretended to be Adam Lanza's brother, and gave an interview to the NY Post.

I would not be shocked to find that "Jill Doe" is a faker, a hoaxer, or even non-existent.

Loser pays by itself is not enough.  You must also get rid of joint and several liability. If I read the statute right, CT has a modified joint and several liability.  It is joint liability unless the defendant can not pay after 1 year.  Since the defendant is dead in this case that point is moot.

The lawsuit should go to the REALLY deep pockets.  This poor Jane Doe was traumatized by the television networks!  Cameras in her face, making her relive the incident, camping outside her home with big trucks and large lights, shouting at her whenever she left the house.

On top of that they reported incorrect information which made her think that there were more dead people than actually were,  that there might be another killer on the loose,  and incorrectly identified a friend's house as that of the shooter.

Major lawsuit against the networks,  that is what I would advise.  Haul all of those people into court!

Hmmm.  I think I'll disagree with you somewhat.  The selective service qualifications had something to do with it, that's for sure.  But I don't think we really saw the explosion of lawyers until the tv series "LA Law" came out.  If you noticed, most of the lawyers  are relatively young.

'LA Law' was started in the 80's...about baby boomer lawyers.

And yeah, it probably helped proliferate the number of more lawyers...

 

But the law industry had already been expanded by the baby boomer lawyers, into a 'target rich' environment for new lawyers to take advantage of.

They're called suppressors, properly, not silencers, because they're not silent. In fact they're really fucking loud, just not as really fucking loud as without. You can make a really quiet shot or two with a custom-made, carefully-engineered and very large muffler-looking thing that involves disposable liquid and other perishable things, but that's really not available in general or even worth worrying about. The primary purpose of the things in real life is to not blow out your eardrums, and for the noise to not carry a whole mile.

Generally speaking for commercial ammo the less the bullet wt (115 gr is bullet wt) the higher the velocity of the bullet.  If it is FMJ (ball ammo) this is not always good because the bullet will simply go all the way through the target and impart a lot less of the energy to the target.


A heavier bullet does usually result in more recoil, but it is not that noticeable. As a practical matter if you are dealing with ball ammunition it is better to go with higher weight and less velocity. With partially jacketed or hollow points higher velocity and lower weights are more appropriate. 



All military ammunition is FMJ ammo because that is the Geneva Convention requirement.

Reloading manuals will list many recipies on types of powder, amount of powder that is safe to use and what bullets work with each recipie

281 The grains listed on the box are going to be bullet weight (as some have very correctly pointed out). The powder is also measured in grains, but that will vary depending on what kind of powder is being used. Commercial loads generally use blended powders not available for purchase, not because they are better but because they are cheap and fulfill other mundane requirements of the manufacturers, like filling the space inside the case for theoretical improvements in reliability, resistance to vibration, etc. Typical amounts of powder for a 9mm would be 5-7 grains, you cannot compare that between loads or calibers because different powders have very different characteristics - the same velocity achieved by 5 grains of one powder may require 7 of another, but the second may burn cleaner or produce less pressure. Rifle cartridges hold much more powder, generally, obviously because the case is larger but pressure limits tend to be higher as well. That is a whole 'nother ball of wax. Bullet weight: 115 is the most common and cheapest weight for 9mm, so it will be what is left over. Generally as bullet weight goes up, velocity goes down (but there are exceptions). Generally a fast, small bullet will carry more energy and penetrate less than a slow, heavy bullet. The reason the 147-grain bullets became popular was the belief that deeper penetration will stop someone faster. That is kind of true, but reality is much more complicated than that, and they have proven somewhat less effective than fast 115-124 grain loads in real life. Bullet *design*, when matched with velocity, is far more important than bullet weight. 115 FMJ can certainly stop someone but is far less ideal for self-defense than hollwopoints (at similar velocities). Hollowpoints, depending on design, are most effective at a certain velocity. None of them are perfect or best in all circumstances.

287 Geneva convention does not address ammunition. Hague accords. We're not a signatory. We can use hollowpoints but in rifle calibers it hardly matters. Special ops troops can and have used them. Also high-end suppressors can last many thousands of rounds, but the really quiet heavy-engineering ones are (or were) almost disposable. Not quite that bad. There are certainly new ones I don't know about.

And it's not because their powder is "more powerful," handloaders can almost always "beat" commercial loads, it's cheap and safe and reliable and works well in big commercial loading machines and resists vibration and etc.
