— Dave in Texas Perhaps the most perfect rant, from commenter Voluble in Andy's earlier Preference Cascade post. Me and a few other morons talked about it some today.
Presented without additional commentary, because it needs none.
129 As a small business owner all I can say is that I think the current sentiment in the small business community is that we didn't sign up for this shit. Y'all can vote for whatever the hell you want but we are not going to be a part of it.
I have seen more owners get out of the business or retire in the past couple of years than ever before and with the ACA on the horizon the jobs these businesses produced will not be replaced. The economics no longer work. This is why unemployment is always so high in socialist countries. What you have to go through to have employees is just brutal.
But here's the thing about what Obama said --- he has it exactly backwards. The government didn't build any of that shit he is talking about --- we built it. We are the ones who paid for it. Not only did we build our businesses we built the schools and the roads and everything else he thinks was generated out of thin air. If you want to get technical about it the businesses and taxpayers that came along before we did built it all and now we are building what comes next.
And not only that, but we did it with the albatross of a predatory, corrupt and overbearing government hanging around our necks at every juncture.
And now we have had enough.
I haven't made more than $50k from my business but one or two years of the past 15. But now that it is time to cash out after providing literally hundreds of jobs I get the stink eye and get castigated for being a member of the 1%. Even though I can remember sitting on the edge of the bed and holding my head in my hands wondering what I had done risking everything I had to create a business and wondering how it would all work out when I had just finished working several days in a row with no sleep... I am the enemy. Even though I didn't take a paycheck for the first year of the business and later skipped other paychecks to meet payroll or to pay taxes I am somehow at fault for the fact that all of these people sitting on their asses or working their cushy government jobs with the large pensions funded by armies of tax collectors and regulators may have to go without.
Well, I already went without so they can bloody well shut the fuck up and take their turn in the barrel! If they want to risk everything they have or work their asses off with no guarantee of success only to be told at the end that they were not responsible for their own success and don't deserve their rewards then they are welcome to go down that path and see what it is like. But the number of people who will pursue the American dream and build the economy from the roots up will be greatly decreased in the current atmosphere and all of these self-entitled idiots will sit around wondering why the government is still going broke and why no one is hiring.
No country can survive socialism. It just doesn't happen. Sooner or later the bill comes due. But before it does you always get demagogic idiots like Obama, or Chavez who try to blame their failures on the only people who are keeping everything afloat. It is not enough they sank the damn ship... they have to come after the people in the life boats too.
That is the sort of mentality we are dealing with.

I'm pretty sure she was hearing it from somewhere in her network, which as a Paulian has *very* little overlap with my own. I was nearly shocked speechless when she made the claim since it's *SCoaMF* who's been getting the big Goldman-Sachs payouts.
If I'd seen the thread just below this, which I managed to completely miss, I'd have posted the question there since I realize it's pretty OT here.

You mean this:
The Lanterman–Petris–Short (LPS) Act (Cal. Welf & Inst. Code, sec. 5000 et seq.) concerns the involuntary civil commitment to a mental health institution in the State of California. The act set the precedent for modern mental health commitment procedures in the United States. It was co-authored by California State Assemblyman Frank Lanterman (R) and California State Senators Nicholas C. Petris (D) and Alan Short (D), and signed into law in 1967 by Governor Ronald Reagan. The Act went into full effect on July 1, 1972.
The Act in effect ended all hospital commitments by the judiciary system, except in the case of criminal sentencing, e.g., convicted sexual offenders, and those who were "gravely disabled", defined as unable to obtain food, clothing, or housing It did not, however, impede the right of voluntary commitments. It expanded the evaluative power of psychiatrists and created provisions and criteria for holds.
///
And this from the L.A. Times in 2000:
“Three decades ago, the Lanterman-Petris-Short Act was hailed as an advance in the humane care of mentally ill people.”
Ok, so you basically were referring to a *1972* (he was not President) *state* law, which was a bipartisan product of collaboration between both the Assembly and Senate, authored by men from both parties and “hailed as a [fucking] advance in the humane care of mentally ill people” and yet you blame *Reagan* *alone* for the effects, which not a single governor or president in the next 40 fucking years couldn’t fix? WTF is *that* logic? Enlighten me.
///

Since preazy occupied 1600 PA Ave, I knew he leaned socialist but refrained from naming him a Marxist or commie because that is a serious charge. The "You didn't build that!" remark removed my rose colored glasses. My first thought was: this is the rhetoric that a Chavez or a Castro engages before they start to appropriate and seize the private property of their citizens.
Now I have no illusions about that man's character or designs.

I manage real estate. Two properties, 5 commercial tenants. 2 apartments. A Florist, Caterer, liquor store, specialy light bulbs, and a bar.
All are having problems. I haven't raised the rent in two years and they are still having problems paying the rent. Properties assessed for taxes at $500K each.
ROI at that 'value' is 3 percent. Currently, real estate taxes and insurance takes over 52% of gross rents. It is no longer worth having a small piece of property. Every time the tenants turn around, they have a new fee or permit charge.
If the owners sell, they would likely get no more than $300K, if that.

This is quite a respectable complaint here in this post, but I wonder if it would matter to some degree which state a small-business owner is in. New York, to name one utterly random example, probably makes it harder for small-business people than, say, Texas. Certainly the feds aren't helping, so everywhere in the Union there's going to be an annoying baseline of hardship for small businesses, but in certain states that are more generally business-friendly on their own account, the overall burden on the business climate might not be as hard to bear. Is this possible?

Voluble is exactly right. Its not just the taxes, its the regulations. I'm a business attorney, and would love to spend my days helping small businesses structure deals, and working between two companies on the best way to allocate risks between two commercial parties. But instead I spend most of my days helping businesses not run afoul with the government.
Whether it is advising employers on the difference between an employee and an independent contractor, because the IRS wants to make sure that everyone is treated as an employee thus the business is responsible for paying their taxes, or telling those same business owners who have spent their lifetime building a successful business that they must now spend thousands of dollars on an appraisal because the federal government has basically told them that they can only give so much to their sons and daugthers and must pay tax on the rest. Or even worse, even if you sell your company to your sons or daughters, the IRS will deem the sales price too low and treat it as a disguised sale.
This is madness and lunancy. What do we require the small business to pay the withold and pay the income and payroll taxes for its employees. Why can't a person gift their entire business to their son or daughter, if that is their choice. It is their business.
This must end.

Well lets say they favor statist and cronyist economic policies, not out of some personal conviction, but because that favors the powerful and wealthy. If you are set, if you have made your way and have a mega corporation, then the first thing you want to do is make damn sure no competitors can show up and mess up your good thing.
An effective way to do that is to have the government burden new companies so much they can barely make it, make innovation so costly and difficult it isn't likely to challenge you, and to rig the system so heavily that you have to be a mega corporation to survive.
As a matter of personal life, they probably are more libertarian, but this is business.

One thing that is annoying,, the MSM never says that most businesses in America are small businesses, the Microsofts, Googles, etc, those don't comprise that big of a percentage of total businesses in America, and when they are that big, they basically lobby congress to get the upper hand on any upstart so that they themselves can stay dominant in the industry.
Google bitched and moaned about Microsoft, now Google is doing it to other smaller companies, so much for "Do no evil".

This post is by someone that clearly needs our help. We have extensive retraining programs and facilities prepared for everyone that feels oppressed by our fearless leader. Please provide the poster's IP, name, all phone numbers, SSID, Passport ID and fingerprints by no later than noon today to avoid a penalty for harboring a 'John Galt'.
Know in advance that the taint spreads extremely quickly, and everyone exposed is similarly considered an 'at risk' individual. So, first, consider this an official Digital Millennium Copyright Act (DMCA) takedown notice. It is clearly copied from a thread below this one, making it a violation. And the thread below this one is clearly a copy of -this- one. So remove it too. Both shall be removed immediately or you will face a modest fine of $10,000 per viewer, per instance.
Further, we'll need -you- to provide a complete itemized list of every IP, real name, and all of the other pertinent information for every single viewer - don't make this case worse for yourself.
Plus this behavior is considered illegal in Sealand. Since it is illegal in Sealand, under the Lacey Act, it's illegal here too. After you've compiled the lists and paid the fines, we're still going to be going after you personally as well ... unless you can file this non-disclosure form and agree to make -all- of your future postings Title IX compliant, ADA compliant, and take you talking points from Journolist.
We'd normally say we hope you respond promptly, but the penalties actually accrue -much- faster if you miss this message, so we sent it in as a comment. Hey, even we know Ace doesn't read his comments regularly.
PS: We got all of these hollowpoints. What's a good gun to put them in?

Then then can all get the police state government they deserve and starve in the dark while the rest of can be free.

Look for it to happen when Bark if reelected tries to use Federal authority to enforce "Regional Tax Authority" from the suburbs to the cities...
The next "white flight" will be "conservative" and "small business" flight to the sunbelt and middle America.
Bark may not have been able to unify a nation that's the bad news, the good news is he has unified two nations......well not really good news but "news"....
if things get too out of hand win or loose it may be time for all Americans to ponder parting company from their ideological dopplegangers.

OTOH, Texas has three, and soon to be four, ports that can handle the new PanaMax ships. If you ship through the blue states, you are funding evil. Go Texas.

In this administration we see it 65% or so revealed: Massive subsidies to unproductive allies, no accountability for failure, and contempt for constitutional procedures. In a second Obama administration, we would see the mask completely removed. I genuinely fear for the Republic in a way that I have not on political grounds, even in the days of Jimmy Carter or the Watergate imbroglio. Staring down the Soviets never really bothered me. Listening to the left denigrate work and stoke racial, economic, and regional hatreds leaves me aghast. This is America, not Hugo Chavez's Venezuela.
I know there are many among us that were not and are not thrilled with Mitt Romney. To them, I can only ask this question--if Ronald Reagan were here today, what would he ask us to do? Yes, that kind of rhetoric is cliche if you allow cynicism to creep in, but if you take it straight and look at the condition of the country, the path before us is clear. We have to win this.

Polli, my go-to first step is to question the premise. If GS or any other contributor chooses to donate to a given campaign, is the campaign supposed to turn it down? All campaigns want as many contributions from as many sources as possible. The campaigns don't control who donates to them, what with free will and all.
If the real concern is cronyism, there's simply no way anyone could be worse than the dog eater.

what did make Kerry a legend with the brown water navy though was 3PHs 30 minutes dispensary time....

I've been told by government hacks that tax increases on businesses are just passed on to consumers...The point they miss is that price increases at the point of sale have consequences. In the rental business, high prices drive people to get roomates rather than living on their own. Or, they stay home at mom and dads rather than paying for an apartment. Everything has a price point. When you price above that point, people do without. In a rising tax environment, businesses without pricing power lose margin. When they lose too much, they fail. Democrats have a tough time understanding this basic math.

Yeah, there's absolutely no fear that Romney could be as corrupt as SCoaMF, much less worse. My understanding was that she wasn't just claiming that Romney got donations from G-S, I'd be shocked if he didn't, but that the *majority* of it was coming from them. I'm positive that's wrong, and G-d knows Gerg's showed us all the ways numbers can be tortured to say almost anything, but wish that I'd had a better answer than "He's doing a lot of self funding and I *know* he's getting a lot of small donations."

My agrument was and still is that we had roads, bridges, cities, schools, businesses and a military in this country long before the words United States Government were ever thought about. Our forefathers came to this country because we didn't have a central government taking our shit. Eventually a group of sucsessful BUSINESSMEN created The United States Government.

Good luck with the cat. Be sure and check all the screwy places it could've gone. My outside cat went into an open storage closet at a building 3 over some electricians had opened. Got stuck in there 6 days. Came home hungry as hell and stayed in for 3 days. I was looking in storm drains the other side of the complex. A neighbor in the building actually heard her.

Someone else posted earlier today about the unknowable costs to the country represented by businesses that were never opened. I'd like to hire someone to create the designs that I don't have the time or physical stamina to execute myself. As it is, I'm not going to even try because of the regulatory nightmare that hiring even one worker could create. Without the *guarantee* that my products would have more value than the cost of compliance (and of course there is no such guarantee) we'll never know what could have been.

Speaking of THISes...
some choice THISes from Mark Steyn
"...Floyd Corkins shot another man called Leo Johnson, the security guard at the Family Research Council, a “conservative” group, according to the muted media coverage, or a “hate group,” according to the Southern Poverty Law Center, who spray that term around like champagne on a NASCAR podium.
and
"I’m not blaming Floyd Corkins’s actions on the bullying twerps at the Southern Poverty Law Center or those thug Democrat mayors who tried to run Chick-fil-A out of Boston and Chicago. But I do think he’s the apotheosis of narcissistic leftist myopia. He symbolizes that exhaustion of the other possibilities — the dwindling down of latter-day liberalism to ever more self-indulgent distractions from the hard truths of a broke and ruined landscape. Our elites have sunk into a boutique decadence of moral preening entirely disconnected from reality: A non-homophobic chicken in every pot, an abortifacient dispenser in every Catholic university, a high-speed-rail corridor between every two bankrupt California municipalities..."

Their vicious stupid persistence. So much of their personal identity is bound up with worship of Obama that when he loses, their fragile egos will simply implode. They know that their own lives are pathetic and worthless, but by investing themselves in the glow of the One, they can imagine they are important and their actions have meaning. When we talk about Obama losing, it shakes the entire foundation of their miserable existence. Naturally they lash out with lies, cut-and-paste insults, and half-remembered bullshit they heard on Colbert. It's a matter of emotional survival for them.
This psychic dependence Obama has fostered is a powerful weapon we cannot ignore. He appeals to the stupid, the mad, the broken -- everyone who hates America as it is and prefers to live in the fantasy of Obama's promised wonderland. They won't give up their sick codependence easily.

This post is basically what I'm hearing from a LOT of small business owners. I do delivery work for a small business and most are waiting on the results of November 6th,2012 to make a very important decision.....stay in business or close the doors.
The scary part? No in between. No middle ground. They know that if Obama is re-elected the economic climate for small business will be even worse than it is now. ObamCare,EPA,OSHA and the rest will put them out of business in spite of their best efforts.
There is no doubt in my mind that we are living under an administration that is determined to destroy the Capitalist System in America. The evidence points in that direction and small businesses see the writing on the wall. God help this nation if Obama is successful in his re-election bid. Individual freedoms will continue to disappear right along with jobs. The economy will tank and another Great Depression will arrive almost overnight.

I'm on the ground here in California, and Voluble is quite correct. I'm looking at other state to relocate my company, and Texas has been looking real good for a few years.
In other news, I'm not certain that California is a solid 55 EVs for Teh JEF.
The liberal elites, unions and politicians, and their clients professional government check-cashers will likely vote for Teh JEF.
But a large number of Californians are waking up to the stupidity of Jerry Brown. The High Speed Rail Line From Where No One Is To Where No One Goes seems to be the trigger.
There are quite a few people who are getting state retirements, yet are not particularly pro-union. A very few are starting to relaize that they made a bargain with the devil, and that something will have to be done ... to their pensions.
Electing a bunch of "R"s to state offices might result in a painful change, but nothing like the colonoscopy prep and procedure a Federal (read: other-state reps who have better solutions for inflated pensions) bail-out and restructuring would entail.
I expect Romney to win, possibly by 15 points in the national popular vote. I think rioting will be minimal: Occupy Oakland, maybe some NBPP actions, MSM sniveling and meltdowns, the demand for Birkenstocks plummets ... soap and personal hygiene product futures look good, though ...
I see November 2012 as another Prop 13 moment, or one like the few millionaires threatening Berkeley (about their anti-USMC policies); the nation, and possibly Californians, start de-electing fools ...
... professional government check-cashers who desire to continue living indoors and eating food-food will change career paths ... something involving work and a paycheck, I strongly suspect ...

1. sued by a customer who wanted her entire job refunded, meaning she kept all the work done and didn't pay for it. had to hire an attorney. we showed up in court with documented proof that we had done everything to appease her multiple times and had documented proof that her story was false. seems relevant that judge was female and sided with her. we will probably survive, but thousands of dollars in profit was lost (read thousands of dollars of capital that was risked by investment cannot be returned to the entrepreneurs/owners or thousands of dollars of ordinary pass-through income was simply not available to the owner). with customers like this, i don't know how you make any money.
2. often worked hours before and after my career job to make this work. with hours like this, it's hard to see it being worth doing.
3. often couldn't sleep at night because we weren't sure about making payroll. see above.
4. established business in a somewhat distant county to avoid the regulatory regime of the counties in which we do a bit of our business.
5. difficult to keep/employ workers even if highly skilled and motivated as they routinely ask for raises, get them, then leave or refuse to show up, or poison the rest of the employees with their constant whining and demoralizing attitudes. with employees like this, it's hard to see ever hiring more than a skeleton crew.
6. unlike most businesses, we, the owners have been able to return to ourselves about 12% of the 6 figure investment we've made. you know what that means? we have about 90% of our money still at risk after 18 months. at this rate, we would be repaid in 10 years or so. what a great investment. and i would say that our business is very successful.
7. luckily, i have a career on top of this, or i'd be eating ramen for every meal.
8. wages, taxes, worker's compensation, other insurance, followed distantly by rent are our largest expenses in order. absolutely everything else is peanuts.
9. was fortunate enough to be invited to an intimate political event for a successful republican politician. while there, explained to some other alleged republicans about the onerous regulatory environment. the couple sniffed that we'd dare complain that some of the regulations are completely unwarranted and accomplish nothing (absolutely the truth because the requirements would force us to outlay 50% more capital for equipment to comply with environmental regulation, when our business doesn't have any environmental impact in the first place). how can we succeed with attitudes like this among people who are supposed to share our goals?
one thing i am unapologetic about is that if i can get to 50% of my initial capital risked i will start reinvesting in automating absolutely every facet of the business if i can.

Note the part in the ad that says Mitt Romney made 20 million dollars and only paid 14% in taxes, and then the narrator says, "probably less than you".
Really?
Just exactly how many people in the target audience of that commercial paid over 2.8 million dollars in taxes?
Oh, right, my bad, they just assume we can't do simple math.

My whole life I've lived in the same liberal la la land as the President where everything good built by those before was scoffed at, mocked and ridiculed in the media, books and the movies. I'm just fortunate that I actually had to work for a living and to struggle with out some limousine liberal smoothing my path at every turn because it stroked their jollies to help a "disadvantaged black man-child". It forced me to see the world as it really is and that the community my grandparents built had real values at the core that had nothing to do with envy or arrogance or Ivory tower marxism.

As for Mitt's tax rate, if they want to be stupid and compare it to income tax rates, I think it's worth mentioning that the money he gets in return for investments has already gone through the 35% corporate tax rate. So you could say he pays almost 50% in taxes, indirectly.

It looks like if I work open to close every day in the remaining store I might be profitable in a few months. These are lean times indeed. I live in Texas and voted in the promary here. Actually, I think its great Jimbo can do this. If I'm ever in PHX, I'll have one of them there specials and give a toast to Paladin and Jimbo!

My two business partners and I each put $2500 into our business and said when the money was gone so were we. That was January 4th, 1977. Still here. The government bastards haven't laid us low yet. Not for want of trying. We haven't gone Galt on purpose, but the past few years have been rough. Tonight I was pretty disheartened when my 30 YO son told me I should just start collecting SS right now before it gets fixed. He and his friends are pretty cynical. His future SIL and her guy are moving to Texas from MA - guess why?

This, sir, was fucking brilliant.
(I normally don't swear in public forums either.)
FUCKING. BRILLIANT.

I woke up and went to do some more work since I couldn't sleep and see all of this when I try to wind down for bed.
In all sincerity it is very touching... mostly because of the respect I have for the people here and the knowledge that all of you write things I appreciate every bit as much.
Don't worry about me BTW. My personal situation is good as I saw the way things were going but some of my former employees are still looking for jobs and I am trying to help them where I can. If you take anything away from all of this just remember that Obama has it backwards. Business owners and tax payers built and paid for everything... and they all earned what they have. Obama and the rest serve at our leisure and it is not the other way around.
Apologies to Ace for the profanity but who knew where it was all going to end up. And to Dave in Texas please let everyone know my appreciation for the sentiments they have expressed. It is overwhelming.
And every small business guy out there appreciates it. All we ask for is an even playing field and the possibility of success. We haven't had the former since I can remember and the latter is getting harder and harder to come by. It doesn't have to be that way.

@599 "Apologies to Ace for the profanity but who knew where it was all going to end up."
Um. Apologizing to Ace for profanity? Hrmmmm. It may take me a while to wrap my brain around that one.
Voluble,
Thanks for the rant. It better summed up my thoughts on owning a small business than I ever could figure out how to say on my own. I sold mine for a pittance back in '05 and thank God I did. I like to think that I smelled the shit we're presently in coming around the bend.
Even back then, what I had to deal with in terms of regulation, taxes, worker's fucking comp, employee BS, etc. pushed me as close as I ever want to get to a complete mental breakdown. I literally don't think I could have survived much more of it. My hat's off to anyone who can suffer this and thrive as a business and a person.
Small business owners have been the punching bags for lawyers enabled by government drones, insurance carriers enabled by government drones, and of course government drones themselves for a long long time. This has to change. It just does. Owners put up with it all because we had to - it was just a cost of doing business. But now it's just too much. For most, there is simply no upside to trying to live the dream.

The catchphrase was "care in the community."
Involuntary commitment became extremely difficult nation-wide after a Supreme Court ruling in 1975 (IIRC) that prohibited it unless the person were shown to be an imminent threat to himself or others.
Thanks, Supremes!

I have absolutely had it with this stupid idiot. I didn't build my business? my ass! Who cranks a chain hoist 6 times for every inch of a 20 foot chain? OH is that you Mr. Prez? Who lifts 73 pounds with every click? You? Who drives for hours and hours a day just to deliver a trash container? You? Who drives for more hours to empty them? You? Whose arms and shoulders hurt so bad they often can't sleep? You? Who comes home with their clothes black with grease, oil and dust? You? WHo still has to find a way to laugh and joke about life to remain sane? WHo has to put up with countless amounts of BS red tape just to haul trash to the damn dump? WHo doesn't hire help because gov't rules make the risk too great and the hassles ridiculous? WHo is paying three times as much for diesel since you have been in office? WHo cannot raise their prices to cover the increased costs because we are in a never ending recession and people can't afford it? Who maintains my truck and trailer, changes my oil, shocks, alternator, starter, tires, paints over the rust, cleans the grime, greases the zerts, oils the chain... who does all for that you dip shit? WHo pays the road taxes that are supposed to pay for the roads I drive on... YOU? damn right it ain't you, you skinny candy assed pontificating fake. C'mon shoot me with another of your facile, oh so clean and nice Drone Strikes you dip shit I dare you!
