Happy Tuesday.

NRO's Robert Costa has your definitive debate prep post. The short version: he's gonna try real hard and keep humanizing and be aggressive, but statesmanlike and try and talk in complete sentences while not letting Obama's smarm or the moderator's half-truths get under his skin. Okaaaaaay.

The Weather Channel has decided to start naming blizzards and big snowstorms. Because they're bored over there, or something.

Jerry Doyle will take over Michael Savage's time slot on talk radio. If you listen to the radio this might matter to you.

The Romney campaign has a new TV ad out today: "Already Has."

I liked Jerry Doyle's book.  He went into radio after he stopped getting work in Hollywood after running for Congress as a Republican. (No, I'm not going to throw away my TV, I need it to watch Paul Ryan next week.)

13 Amazing how biased and misleading this article on ObamaÂ’s illegal call to stop layoff notices is from the Hill.  It is so bad it constitutes lying by omission and intent.

Lockheed Martin and other defense contractors backed down from issuing layoff notices to employees on Monday after the Obama administration promised to pick up the tab for severance costs resulting from sequestration.
OK they “backed down” hinting that they were in a confrontation with Obama when in fact they were complying with a law PASSED by Democrats that requires notice in advance on layoffs.

The news provided welcome relief for President Obama, who faced the prospect of mass layoff notices in battleground states just days before the election, and outraged Republicans, who accused the administration of bending the law to hide job losses from the public.

So Republicans “accused” of “bending” the law.  How about this scvrunts, he told the to break the law.  The law says you will do this with regard to layoffs.  He told them NOT to do that.  Could it not be planer?

The White House issued guidance on Friday that said the government would cover the costs if contracts are canceled and layoffs occur due to the automatic spending cuts set for 2013. But that offer would be null and void for any contractor that issues job-loss warnings before sequestration begins.

What Obama did was say that he would illegally use tax payer money to reimburse companies for fines they would incur for intentionally violating the law. In legal parlance he is aiding and abetting a crime using government resources.  What used to be called corruption and graft and he is doing it for pure political purposes.  Yes, the press has become the enemy of the State.  Note that Obama always has been.

61 What's funny about presidential debates at this stage of the country's political disintegration -- in the vein of a tragic farce -- is that if you're the Republican you can't win for losing, and that's largely because of your own "base." So not only do you have to overcome the biased liberal media coverage, the slanted and loaded questioning, the Democrat plants in the audience, etc., you then have to deal with the perpetual malcontent brigades of the right, who'll nitpick, criticize and browbeat your performance to death, to a material extent before you even step out onto the stage. No worries, he is.  That comes across in spades and is what will ultimately convince people to vote for him.

As to terminal velocity, I assume that is usually in reference to sea level.  Air pressure is what limits your speed.  At 23 miles up, there isn't nearly as much air, hence less pressure.

75

Good morning, ‘rons and ‘ronettes.  Thanks for the news roundup, and all good wishes for you tomorrow, Vic.

Not much comes to mind today.  Since Drew Barrymore had her first child, I was thinking of a Barrymore story, but none of the ones I know are all that interesting.  Today is also the anniversary of one of ChaplinÂ’s funniest shorts, The Pawnshop (1916), which you should really try to see; thereÂ’s a scene where he examines a clock thatÂ’s being pawned – if you donÂ’t laugh yourself silly, IÂ’d be very surprised.

But Chaplin took himself very seriously, and while there are stories about him, none of them are really funny, unless you consider how his appetite for barely pubescent girls kept getting him in trouble to be funny.

So apropos of nothing else, hereÂ’s a story from 1948:

On the set of That Lady in Ermine, leading man Douglas Fairbanks, Jr. had a birthday.  The famous director Ernst Lubitsch decided to make an occasion of it, so when filming came to a stop at five that afternoon, champagne and a cake were brought out.  After the cake was sliced and bubbly poured, co-star Betty Grable came forward with a gift.  In keeping with the filmÂ’s title, she presented Fairbanks with an ermine-lined jockstrap.

Later on during filming, it was GrableÂ’s birthday.  Fairbanks gave her an ermine-lined chastity belt.

Sorry for the rather limp entry today.  I do know a couple of rather risqué stories about Fairbanks and Grable, but IÂ’ll save those for Friday; just make sure to keep the junior morons out of the room.

But if you canÂ’t wait until Friday, hereÂ’s a little hint: for Fairbanks, look up the Duchess of Argyll.  GrableÂ’s a little harder, but take a Paul Ryan hint and search under “stench.”

Hope you all have a wonderful day.

78 Here's an interesting rub to what we "taxpayers" will be liable for under Obama Law.

An employer who violates the WARN provisions by ordering a plant closing or mass layoff without providing appropriate notice is liable to each aggrieved employee for an amount including back pay and benefits for the period of violation, up to 60 days. 80 15 The wedding party was attacked, and when they went to report their complaint at the police station, the offensive protesting mullah with violent students were there with the police filing charges against the wedding party.

There are plenty of youtube Sehra's for viewing. The mullah prohibits any sung poetry praising the groom. And the police backed that prohibition enforced by violence. Note well the purging from their Muslim culture of any shared customs with the Hindi. Wahhabi at play?

http://tinyurl.com/9oo23w7

A Sehra (Hindi: सेहरा, (Urdu: سہرا is a headdress worn by the groom during Indian and Pakistani weddings. It has garlands hanging that covers the face of the groom. The word also refers to an Urdu poem.
Sehra in poetry

In South Asian Muslim traditions, especially in Uttar Pradesh and Hyderabad (Deccan), there is a social ritual where the sisters of the groom sing a Sehra, a poem in praise of the groom and pray to God for his future wedded life. The groom follows this by giving cash to his sisters.

It is a genre of Urdu poetry, though there are no specifications for a Sehra except that it should rhyme and be of the same meter. Sehras are generally written by individuals praising their brothers, so they are very varied in style and nature. A good sehra appears in the Urdu film, Razia Sultana; however, this particular sehra was sung by males, quite contrary to the current tradition.

An employer who fails to provide notice as required to a unit of local government is subject to a civil penalty not to exceed $500 for each day of violation. This penalty may be avoided if the employer satisfies the liability to each aggrieved employee within 3 weeks after the closing or layoff is ordered by the employer.

85 Lockheed-Martin's complicity with Obama over the WARN act is not difficult to fix: Romney needs to announce that under his administration, he will assiduously pursue maximum fines for WARN act violations. Fight lawlessness with laws. And further, Romney should announce that a defense contractor's recent record of compliance with federal labor laws will be a major factor in determining where sequestration will cut deepest should it come to that. Fight lawlessness with applications of the law that border on lawlessness.

135 Normally, when there are massive defense cuts, like we had in the 1990s, DoD steps up for a year or two to help communities adjust with things like business diversification, promotion of dual use technologies, etc. etc.  DoD had a fair number of success stories like that from the last time it cut procurement dollars.

I sat in a meeting in the Pentagon last week where someone asked, "Why is that our job?"

I said, "Because it's in law?  Go check out 10 USC section 2391."

Has no one else lost the conservative talk show hosts?  I realize some of them you can hear on your computer, but the public airwaves in MA have almost been wiped clean of ANY conservative voice.

171 I still want to know if there's a single person on the planet who knows how sequestration works. On the lawfare front, Lockheed has a non-trivial defense that it was in compliance with a request from the executive to not issue the notices and therefore violation of that request would, in and of itself, be a violation. Random guess is that this may end up before different districts and then circuits, there will be contradictory rulings and SCOTUS will punt on accepting cert. Don't forget, there are also state versions of the WARN Act, some of which require 90 day notices which should go out today (maybe yesterday) iirc. That brings up preemption issues and I have no idea if those have even been addressed in the past. tl;dr version - Full Attorney Employment Act situation on top of utterly lawless attempt to repeal a law via executive order. On the set of That Lady in Ermine, Dude. I was watching that last night. No lie.

173 Although the best I see for Romney is 321-217 --- It really depends on how cooked the polls are and how badly Obama is flailing in some states that aren't on the radar. The Ulsterman Insider is claiming that Oregon is really close but isn't getting a lot of attention, for instance. It is also being claimed that Barry could lose Illinois because he is unwilling or unable to pay the "walking around money" to the poverty pimps necessary to get votes turned out in Chicago. Not sure I believe that one, but I'll laugh my ass off if it happens.

My impression is that general officers do not like the game of chicken when they are tied to the front bumpers. There is also great reluctance to identify the actual cuts and mission changes that would be the most effective, as they expect any thing identified as at risk now will be tied around their necks later during future cuts and reprogramming.

More to the concept of what the Constitution says and America was (at one time) all about: where's the impeachment?

But I guess if being an accessory to hundreds of cases of Murder One (F 'n' F) doesn't get you so much as a sternly worded letter, a simple thing like encouraging the commission of a crime doesn't mean anything.

Besides, Poppin' Fresh wouldn't find holding Choom Boy accountable for his high crimes and misdemeanors (gee, where does that phrase come from?) "fair" or something.

231 My problem with the defense cuts is two-fold.  One we are still spending at stimulus levels with a $1T deficit so there have been no cuts because we are still doing CRs. Two, military spending is not the largest category of budget.  How about we get rid of some socialism? And the worst thing about it is congress will not let them cut the shit they really want to cut to save money.  Like more unneeded bases to be closed.

There it is the same as the damn post office. Congress tells them to cut billions but when hey propose what they want to cut to maintain a fighting edge congress says no.

This is insane.

232 @210 Yes entitlements will become the thing that ate the US but to say that entitlements are a factor of 5 bigger than everything else is just false. How big is the budget? How big is the Defense spend? Do the math. And, no, you didn't say end of the world, but you did describe it as ugly. I still say, its 6% of the budget (yes, on top of another 6%, I know). DoD wants to paint a picture that is the end of the world - they are bureaucrats just like the ones over at DHS.

Next Monday a skydiver plans on setting two records. First a jump for new record height of 23 miles then he also wants to be the first to break the sound barrier in freefall. Awesome or crazy, you decide.

Someone may have already covered this, but just in case....

This guy will not be the first to break Mach 1 in free fall, since it was already done years ago by Col. Joseph Kittinger, USAF, during Project Manhigh in 1957.  He jumped from a helium balloon from 107,000 feet and exceeded Mach 1 (speed of sound) during his fall.  Bear in mind that the speed of sound varies with air density.

2012 US Budget from CR is 3.5 Trillion
2012 DOD Budget is 707 Billion

So 81% of the US Budget is spent on things other than military.

Now your asking for a 6% reduction that would fall mainly on the military without tackling what is really the driver of deficits -- Entitlement spending.

What we are doing is unaffordable and unsustainable!

Another problem is that DoD accounting is tight, and competition for funds is cutthroat. 307 About the free-falling through Mach 1. I don't work as a rocket scientist, but I did get the degree. Sometimes, it hurts as I watch people talk about stuff they don't really understand. "Terminal Velocity" is a generic term, and it's not some fixed value like "120 miles per hour". It's when the aerodynamic drag equals the weight of the object moving vertically downwards. The aerodynamic drag depends on the density of the air, the square of the speed through the air, and a mysterious quantity called the "equivalent flat plate area" which, if you're playing at home, is the drag coefficient of an object multiplied by the reference area used to determine the drag coefficient of that object. (It is worth noting that this "equivalent flat plate area" is not the area of the equivalent flat plate, but simply the area that you multiply by the dynamic pressure to get the proper force. I digress.) The upshot of this is that the terminal velocity of any object will vary. For a skydiver, the terminal velocity under canopy is a lot lower than during the "free fall" (it isn't) part of the dive, and will be lower in the arch than when the skydiver is falling head first. The terminal velocity of any object in a particular orientation will increase with increasing altitude in a fairly well-defined way because the density uniformly decreases with altitude. The mach number is, of course, the ratio of the airspeed to the speed of sound. Assuming that the object falls at terminal velocity (a good assumption) the airspeed will increase with increasing altitude. The speed of sound varies as the square root of the absolute temperature. The temperature of the air varies with altitude by decreasing in the lowest layer (the "troposphere" where all the weather happens) and then starting to increase slightly when it gets into the next layer (the "stratosphere".) So, in summary, the "terminal velocity" of an object depends on a bunch of things and whether or not the fellow can go supersonic depends on how wildly he flails on the way down.
