— Gabriel Malor FRIDAY!!
A judge in Florida has blocked Gov. Scott's order that state workers get drug tested. The judge found that there was no evidence of a drug problem at state agencies and so no basis for the testing.
Lava spirals spotted on Mars, and they're much larger than lava spirals here on Earth. I'm assuming that gravity plays a role.
At least three bombs have gone off in eastern Ukrainian city Dnipropetrovsk. Twitter reports say there's been a fourth bomb. At least 15 are injured.
Judge rejects request to order Obama to release the Osama bin Laden photos. The CIA, which is apparently in possession of the photos (DOD said it didn't have them), says it cannot release them for reasons of national security. The judge won't second-guess the CIA.
The only legal bright spots yesterday were a judge in Illinois, who found the state's tax on internet sales to be unconstitutional and preempted by federal law. Also, the Army judge overseeing the Bradley Manning court martial refused to throw out the charge of aiding the enemy. BONUS FRIDAY MUSIC VIDEO:
9 hours and then the weekend. It's all about tonight.

Hey Vic, speaking of the Post Office...
I read an article a couple of weeks ago about how the Feds are going to stop mailing checks for SS, Welfare, etc. Instead they will send out debit cards or something.
Anyhow, the article pointed out that the hardest hit will be the P.O., since it won't be handeling millions of pieces of mail from the Feds.
I thought that was hilarious...
Posted by: HH at April 27, 2012 03:00 AM (KB0hv)
Wouldn't they still have to send them via the post office?
Morning all!

Anyway, I saw something on that on TV where black activists were complaining that poor people w/o bank accounts would not be able to get their money or would have to pay "ATM" fees. The first thing I thought of ws how are they cashing the paper checks now?
Check cashing shops that charge an exorbitant fee is how.

The article stated that the cards are mailed out, but I guess you get your monthly allotment through an ATM or something. So the cards are not mailed out monthly, which reduces the mailings by millions.
Dang, I should have copied that article.

Food stamps and unemployment, they mail you the debit card once if you apply online or over the phone, then just add money to the account every month, until you "lose" (read: sell) it and request another one.

Bigger problem than branch offices: workers getting two, three times the going rate for the work they do, when benefits and pension are included. Same problem public schools in WI were having before Scott Walker reformed the benefits.

However, if I go to the next post office north of me it's like I am in the world of cartoon government workers. Long lines, rudeness, inefficient operations.
The guy at the UPS store goes nuts trying to deal with some of the stuff the post office does. We were talking the other day and he said he didn't understand why they didn't have a packing service, where people could bring something in and for a fee the post office would pack it in a box for them prior to shipping. The UPS store makes a lot of money from doing that.
Posted by: Miss Marple at April 27, 2012 03:14 AM (GoIUi)
I don't think postal employees get those big retirement plans like some gov workers do. And wages are excessive either. The problem really is too many useless local offices. They want to close 3,700 offices which means there is probably 5,000 that need closing but the Senate plan doesn't let them close ANY.

On the topic covered yesterday about the press turning on Obama, I saw two local stories about people living in homeless shelters and under bridges who were middle class families who lost everything including their homes due to the economy.
Sort of undercuts the "happy days are here again" line the administration is pushing.

Yep. The voters are buying the person as much as the policies (if not more). They want calm competence. Angry railing against the other guys doesn't convey that. It's fine to point out the problems with the other guy's policies, just do it in a way that projects confidence and control. Let the underlings handle the rough stuff.

What difference does it make that they will be mailing debit cards instead of checks?
Instead of monthly checks you'll have a card mailed to you only once. Cash will then be credited to the card monthly.
It's already how most welfare payments are made. I've read of Wal-Marts that are monthly jammed with shoppers filling their carts, just waiting for the stroke of midnight when their accounts are credited.

They're paying out huge pensions now, and workers who started more than a few years ago...I can't remember when the last "reform" was...are scheduled to get them. 80% of their costs are labor.
Meanwhile, the PO I used to go to in MKE had three of those automated machines where you could weigh and ship a package, plus a stamp machine--and they ripped them all out, because customers preferred them over standing in line to get huffed at.
There's no post office in my ZIP code, which I think is ridiculous. If I need to mail a package, I can drive six miles to the county seat, six miles to the town to the south, six miles to the town to the north, or ten miles into the city (into a shitty neighborhood). Or I can drop by Meijer on the way home from work, where a Meijer employee weighs my package and takes my money. I assume there's a branch at the airport, three miles from my office, but I'd have to pay for parking. The branch two miles northwest of my office (five miles from my home) got closed last summer. The postmistress was nice; spent way too much time on lunch listening to her explain to stupid people why they can't mail oil and fireworks; she didn't get laid off, btw--she got transferred to the branch in the shitty neighborhood. No savings on labor by closing branches....
I'm just not seeing "too many places where patrons can hand over money" as the problem, sorry.

They do have one thing going for them, they are listed as a service in the Constitution. But they are already 12 billion in debt, and this bill of course is offering up another 11 billion line of credit -- in other words, punt the problem until past the election. Oh, and there is no pay as you go offset for this either. Sigh.
Posted by: GnuBreed at April 27, 2012 03:39 AM (cHZB7)
True, but the question in my mind is whether that means the government has to run it, or that it can simply ensure the service is available, for example by paying UPS to provide the service. It also doesn't mean we have to subsidize junk mail? Make them pay the true cost.
Posted by: pep at April 27, 2012 03:44 AM (YXmuI)
Sorry, if someone else mentioned this. They will only have to mail the debit cards once. No more monthly mail outs through the post office thereby reducing post office traffic.

"We're talking about a multi-billion dollar fraud scheme here that's taking place and no one is talking about it," he said.
The scheme involves illegal immigrants -- illegal immigrants who are filing tax returns.

Nope. It's just like a debit card except you can't use it to buy stuff like ciggies, booze and lottery tickets. It makes it marginally more difficult to abuse than plain old food stamps which were easy to sell for cash.
When I first started drawing unemployment it was in the form of a state issued debit card.

That sounds about right, but that isn't the purview of the courts to decide whether or not the test is needed. The supremes ruled long ago that employers could do random drug testing as a condition for employment. Evidently the ACLU went judge shopping here and the State will now have to take it to higher courts.

Yes they do but you can't stop stupid. With stamps, lots of people would sell a portion of their stamps to get cash for booze, etc. But some (like a guy I knew) would sell them all. Those are the kind who sell their cards.
The thing is you only get 40 to 60 cents on the dollar for food stamps, so if you want to get the most out of the program the old stamp system allowed you to sell what you needed for your vices and use the rest legitimately. With the new system you have to either sell or barter food for vices (kinda difficult) or sell the whole card. So it does discourage abuse to a degree.

WASHINGTON (Reuters) - Economic growth cooled in the first quarter as businesses cut back on investment and restocked shelves at a moderate pace, but stronger demand for automobiles softened the blow.
Gross domestic product expanded at a 2.2 percent annual rate, the Commerce Department said on Friday in its advance estimate, moderating from the fourth quarter's 3 percent rate.
While that was below economists' expectations for a 2.5 percent pace, a surge in consumer spending took some of the sting from the report. However, growth was still stronger than analysts' predictions early in the quarter for an expansion below 1.5 percent.

On the subject of pot...
If smoking dope is so much better than Marinol, then why is it that when we have minor pain, we don't go scrape bark off a tree, boil it down, and drink the sludge that's left? I mean, based on the medical pot argument, that has to be better than taking an aspirin.

Lots of people react his way. Too bad.
I've known this guy about 30 years and he just likes smoking pot more than taking benzodiazepams. Benzos are powerful, addictive meds and you can use them while working if you have a prescription for them. Is that better than a guy who likes to get stoned at night? Smoking pot isn't as effective as the percocet he's prescribed, but it does make his sciatica more bearable.
The guy can go to work taking a combo of benzos and percocet, or tough out his eight hours and chill out at night with a couple glasses of wine and some pot. He'd rather do the latter. As an employer, which would you prefer?

The manufacturing facility I work in had to do a 100% drug test for insurance purposes...we have an older, more stable workforce, so we didn't expect to snare anyone...in the end, we did get one hot test--the deputy plant manager. In retrospect, he was spacing out and nearly ran us out of raw material, so with him out of the picture we've actually improved our performance. I don't know what you could do in state government to improve it aside from nuking the state capitol, but I suspect that someone high up in the administration (NPI) didn't want to get his ass nailed and peddled influence on this judge.
I hate drugs and I hate the human weakness that causes people to abuse drugs--I had zero sympathy for the assholes we kicked out of the military for this, and as taxpayers, we have every right to ensure the public workforce is operated by coherent, law-abiding individuals.

A federal judge has ruled that Florida Gov. Rick Scott (R) violated the Constitution last year when he ordered drug testing for state government workers.
U.S. District Judge Ursula Ungaro ruled on Wednesday that suspicionless drug testing testing for state workers violated the Constitution's Fourth Amendment ban on unreasonable search and seizure.
Posted by: Jimmah at April 27, 2012 05:33 AM (UpwlP)
The reason employers make it a condition of employment that they can drug-test employees at any time is so they can do it if they have a suspicion of drug use. No employer is going to do random tests if they don't have to because they cost money. Truckers, et al have to participate in random drug-testing programs because of safety issues; the rest of us have to actually act stupid before your average employer is going to do anything.

Oh yes he "claimed" it was unconstitutional. The problem is that he is in conflict with a previous Supreme Court ruling which local judges can NOT do.
SCOTUS ruled long ago that employers can do drug tests of employees as a condition of employment. What the constitution protects you against is "unreasonable search and seizure" by the government on private citizens.
So police can not stop you and do random drug and alcohol checks (although many States are still doing that) but they can require their employees to get random drug and alcohol checks.

Benzodiazepines are for ACUTE anxiety, meaning you only take them when needed. They're fast-acting relief for panic or anxiety that sneaks past the antidepressant goalie.
As for pain, it is either debilitating enough to effect your work or it isn't. If he is able to "tough it out" for eight hours without medication, and without ANY degradation of his job performance, then perhaps his pain isn't that bad.
Or maybe he just likes to get drunk and stoned.

After 2013 most everyone receiving a Federal government benefit check must receive it electronically through direct deposit to a bank account.
For those without a bank account, a debit card from Direct Express will be issued and the payment will be deposited with them. It has some fees but less than say a Walmart debit card.
Some people who already receive checks MAY request and receive permission to continue to do so on a case by case basis. (elderly, location problems, use of card problems)
This was mandated about 2006 or so to finalize in 2013.
The cost of printing and mailing the checks is enormous and yes, it's ironic that it's helping put another government bureaucracy out of business.

WRONG. There are more than a dozen varieties of them. Some are fast acting while others are far more long term.

FWIW, I've always wondered if this is just fall out from the fact that we don't have a good test for "currently high" for most drugs, the best we can do is "drugs in system within the last X hours" (or in the case of hair "X days/months.")
Consider that for Alcohol tests they just make you blow and see what your current EtOH level is, there's no equivalent for most other drugs.
(Blood tests for other commonly used drugs are far less accurate than EtOH tests from my understanding due to route of adminstration among other things.)
Posted by: tsrblke at April 27, 2012 06:06 AM (22rSN)
That is exactly what it is. "unreasonable search by the government on private citizens".
They aren't private citizens Jimmah, they are employee's of the entity giving the test.
----
Yes, but that entity is the state, and the state is subject to the constitution. Just because private companies get away with something, doesn't mean the state does.
BTW - when I worked for someone else I was all for drug testing. The more the better. It just moved people above me out of my way.

Interesting. Did you use anything to help you stop smoking?
The reason I ask, is when I was first in college and away from home I gained a lot of weight, for all the wrong reasons.
So I went on a strict diet, did away with carbs and sugar, using Sweet and Low instead. It worked, and I lost the pounds.
Weird thing is, I also lost all craving or want for sugar. To this day I don't want sweets. Cake, candy, you name it. It's kind of like my brain was re-wired. So I'm just wondering if you had any kind of substitute for smokes.

(Reuters) - More than 1 million Americans who have taken out mortgages in the past two years now owe more on their loans than their homes are worth, and Federal Housing Administration loans that require only a tiny down payment are partly to blame.
That figure, provided to Reuters by tracking firm CoreLogic, represents about one out of 10 home loans made during that period.
"The overwhelming majority of the U.S. is still seeing home prices decline," said CoreLogic senior economist Sam Khater. "Many borrowers continue to be quickly wiped out."
And the number of homeowners falling under
water each month has decreased significantly since the peak of the
financial crisis in 2008 and early 2009. Still,
Khater said, since October 2010 average home prices have fallen 7.4
percent. Overall, CoreLogic data shows that 11.1 million, or 22.8
percent, of U.S. residential properties with a mortgage are in negative
equity, unchanged from the summer of 2010. Comrades the economy has never been better. The recovery is moving full steam ahead.

NASA has been enjoying mission creep for far too long. They were the ones that investigated stuck Toyota accelerator pedals...and lets not forget about Hansen, and his climate alarmism. NASA should focus it's efforts, and limited budgets on things that fly, and things that go into space, (but mostly things that go into space). Nothing else. If the EPA wants a damned satellite to stare at the earth, fine, they budget for it, and pay for it. NASA can do the heavy lifting, but they should operate as a supplier, and money to fund such programs should come from the requesting agencies.

It's good to know that sleeping on the job isn't tolerated at an operating nuke.
But during their construction -- well, that was a different story. I knew a welder at Berwick who said people regularly slept in the toolboxes. I also knew a guy who worked there for 10 years building it. He'd clock in every morning, leave and work at his private contracting business and return to clock out. In 10 years he was never caught.
I'm glad they do a stringent quality analysis on them before they start them up.

Second, they need to put the simpletons that came up with mooooslim outreach on the same Sun-bound rocket as Glenn, along with that fossilized dogshit in Mecca that the rock worshipers hold in such high regard.

He is convinced OBL is alive. Why, he say, do all that training (with the mock up, etc.), send in more men than needed for a simple kill, and take the extra risk to carry back a dead body? When the same amount of effort would bring him back alive. Especially given the huge amount of information he will give up.
He also points out that all SEALs are well-qualified medics and any one on the team would have the necessary knowledge to accurately drug OBL enough to knock him out for the time needed to transport. Meaning there is at most 20 guys in the whole world who would know the truth and real mission.
He says there are a lot of other holes in the story as a guy who was privy to a lot of classified information.

"That's like a Vulcan grip," offered his bandmate Redfoo.
"Like a Vulcan grip," Blu concurred. "I'm not your prey. I'm not a salmon going upstream. You're not going to grip me up."
