— Gabriel Malor Happy Tuesday.
Yesterday, the 9th Circuit upheld California Prop 209, the anti-affirmative action amendment, from an equal protection challenge brought by minority students. Lawgeeks, the decision is here (PDF).
The latest Q-poll out of Pennsylvania still has Sen. Santorum in the lead in his home state. Santorum polls at 41%; Romney has 35%; Ron Paul crazies along at 10%; and Gingrich trails at 7%. Key number: 37% of likely primary voters say they might change their minds. Pennsylvania votes April 24.
Here's a fun little story (with video) on a morning news anchor in the UK who did an Irish jig during the newscast.

NYT article.
I only highlight this article for two reasons. One, the dude that actually goes into the science of puberty is buried in the back and derided as a bomb thrower (it's the sugar is toxic guy mentioned in one of Vic's links above). The second thing is the one thing never ever mentioned in the entire story and that's birth control. Stuff is known to have a serious affect on ecosystems and it's polluting the drinking water n a lot of places but God forbid a lefty sacred cow is ever gored.

Looks like Ann Romney needs to work some magic, because Willard's boyish charm and "touch of gray" pompadour 'ain't cutting it:
Swing States Poll: A shift by women puts Obama in lead
President Obama has opened the first significant lead of the 2012 campaign in the nation's dozen top battleground states, a USA TODAY/Gallup Poll finds, boosted by a huge shift of women to his side.
In the fifth Swing States survey taken since last fall, Obama leads Republican front-runner Mitt Romney 51%-42% among registered voters just a month after the president had trailed him by two percentage points.
The biggest change came among women under 50.

Enough to hide the fact that Mittens is losing the "war on women" badly.
Willard got badly flustered yesterday when he was asked about the tenants of his Mormon faith (which disallows miscegenation) affected his views on interracial marriage. He cut off the mic and refused to reply to the question.
For a guy who has been running for president for six years, Romney is making a lot of rookie errors.

Ed,
I am not a Romney supporter but this was the exchange:
I guess my question is do you believe it's a sin for a white man to marry and procreate with a black?" asked Hatch.
"No," Romney responded sternly, before turning to face the other side of the room.

My personal opinion is that religious questions have no place in town hall meetings, unless we all want to discuss the historic faults of our respective faiths. I do not want Romney proselytizing or denying his faith in a press conference. And it seems odd to me that at this late date a Paul supporter would show up to do this odd questioning; I tend to think it was a plant and not really a Paul voter.

“I guess a lot of people say that, you know, your Mormon faith may not be a concern in the election. But I think, it might be,” said Bret Hatch, a 28-year-old from Green Bay who is unemployed.
He began reading a verse he said was from Mormon scripture, prompting Mr. Romney to cut him off.
“I’m sorry, we’re just not going to have a discussion about religion in my view, but if you have a question, I’ll be happy to answer your question,” Mr. Romney said.
“I guess my question is, do you believe it’s a sin for a white man to marry and procreate with a black?” Mr. Hatch said.
“No,” Mr. Romney said tersely, “Next question.”
<snip>
After the town hall, Mr. Hatch showed members of the media a printout of the verses he was referring to and said he believes the Mormon church views blacks as an inferior race.
“I think that’s an important issue,” said Mr. Hatch, a Ron Paul supporter. “He’s going against Obama. This is a racial issue.”
--------------
Not being a Mittens guy (I'm pretty much an I don't give a shit guy at this point) I thought he handled it well. There was no mention of the mic getting cut and he gave that little race baiting turd a better answer than he deserved (I think "go fuck yourself" would have been appropriate in this case).

Your doctor is nuts. Statins are very hard on the liver and should never be prescribed unless your numbers indicate it;s necessary. And even then, only after diet and exercise have been proven inadequate in controlling your elevated cholesterol levels.
Get a new doctor.

Four Democratic officials in Indiana have been charged with election fraud in connection with the 2008 campaign. The scheme is said to have had the backing of the local Democratic Party.
Prosecutors in South Bend, Ind., filed charges Monday against four St. Joseph County Democratic officials and deputies as part of a multiple-felony case involving the alleged forging of Democratic presidential primary petitions in the 2008 election, which put then-candidates Barack Obama and Hillary Clinton on the Indiana ballot

Vic: it must suck to be you right now. You have my deepest sympathy for you and your wife's medical conditions.
Luckily, with some tolerable diet changes I've brought my cholesterol levels down to the "elevated" level -- doc says they're high but nothing to freak over right now. He wants more blood work done soon so I'm on a daily regime of morning oatmeal and Metamucil 3x. On the wagon, too, to lower my triglycerides. Last time I did the oatmeal thing for a month it dropped my numbers by 40%. With some more permanent diet changes I think I can keep my numbers in the acceptable range.
Just remember: porch rocker sitting and statins don't mix well, so get your liver functions tested frequently.
Blew out my back this morning. Thankfully, I'm off to see my sister who is the victim of several botched back surgeries. She has a mini-pharmacy of back medications and pain killers that really work. Hopefully she'll have a few extra to help me through today and tomorrow.

Well, it could be, but why? With Florida's "Stand Your Ground" law, he wasn't even required to flee, let alone call for help. Once he was on the ground being beaten, it's not even a "Stand Your Ground" case, it's good, old-fashioned, self-defense: and, again, he's not required to request assistance.
I don't think Zimmerman was thinking anything, at that point. He was quite possibly (probably?) in shock. I think he said it because he did it; maybe it was also to help assuage his own feelings of guilt- which I'm pretty sure I, at least, would feel even if I killed someone to defend myself.

The Daily Caller got an advance copy of a new book co-authored by Politico writer Mike Allen. In the book, readers learn that the pro-longed GOP primary was a deliberate plan of former RNC chair Michael Steele to bring on a brokered convention. TheDC's Alex Pappas reports:
Michael Steele irked fellow GOPers while serving as chairman of the Republican National Committee by speaking excitedly about the possibility of a brokered convention. 'You know, weÂ’re going to end up with a brokered convention, a convention thatÂ’s going to mean something!' Steele reportedly told big money donors while chairman, according to the soon-to-be released book 'Inside the Circus'"

I just pulled out that recipe and it's kinda complicated, makes four gallons and requires bottling equipment.
You'd need to find Sassafras Root, Hops, Dandelion Root, Juniper berries
Several companies make a Root Beer extract that makes as small a batch as you wish. It's all the stuff from Grandma's recipe only concentrated. I worked at A'n'W fifty years ago and we made it daily with company root beer concentrate, water and champagne yeast. Try to find a seller by searching those terms

I noticed that, too: and that's not just "old school," that's still how Irish Step is taught. Scottish Step (one is set to 3/4 time, the other 4/4, and I can never remember which is which) allows for moving the arms.
Obviously, both have been bastardized for "better" performances.

Did any of the UK team bother go back to campus this morning, or have they already left for NBA camp?
They can join the UNC players there.
'sup jackwagons. I've been pondering something that's mentioned in the 9th Circuit decision as well as an issue last week where students in Detroit went on strike demanding an actual education. Part of the rationale being used by the minority students in the CA challenge was that they were unable to obtain places via merit as they received such a mediocre education in their schools. The kids in Detroit went on strike because they claimed they were not being taught anything. What I'm wondering is if there's going to be a rise of attempted claims against the states for gross educational malpractice. I'm taking no position on whether those suits should be filed or should win, I'm just interested in the process itself. Given that sovereign immunity exists at a fairly high level in most states, it would be nearly impossible to go after the teachers individually. That leaves attacking the state itself. I have only the most passing of acquaintances with educational law (as in I know it exists and there's the sum total of my knowledge), but I would think this would be the next step. I would also think those suits would be tossed nearly immediately but I can see people starting to make an attempt to put forth a claim.
Well, okay, I think the next stop should be actual tarring and feathering of those in the various school districts who seem to think it is somehow just fine and dandy to let kids get through high school while illiterate but since that's not on the table, this may be a possible next step.

Didn't work for me, granted High Cholesterol has been in my family for generations. Was up over 200 or something for a while (I forget the numbers but they were well over the "High."
Lost about 30lbs, numbers went up. (Also cut back considerably on my drinking as part of the diet.) Tried more exercise, numbers moved barely. Doc put me on Crestor and my numbers are now on the "High Side" of normal. (I lost another 10 lbs after that too, still on the diet.)
I'm still young, but I've watched several members of my family bite it due to heart attacks, and the Statins numbers (from my reading of the primary literature) appear to mostly be a problem with high doses (I'm on 10mg.) So I'll risk it.
Looking at the primarly literature I'm wondering if that's going to be the actual direction it goes, try to get people at risk on low doses early rather than higher doses later.

Actually, he does.
This morning on Fox and Friends, Simmons said that Americans tend to vote on issues and not the party, but sometimes they are wrong. “I have some real issues with the economy and how it’s being done. America should be a business and it should be run by a businessman, that’s my philosophy.”
Simmons said he is zeroing on AmericaÂ’s economy as the big issue in the next election. He revealed to Fox and Friends that his presidential pick for 2012 is Mitt Romney.
On a separate note, heÂ’s introducing a new global franchise called Rock & Brews that is hiring Vets and giving back to America.Posted by: mama winger at April 03, 2012 05:45 AM (P6QsQ)

I guess I'm viewing this as the nuke it from space option. Nothing else seems to work. In a follow-up, Simmons explained his position and wrote about his love and support for the United States: "I wasn't born here. But I have a love for this country and its people that knows no bounds. I will forever be grateful to America for going into World War II, when it had nothing to gain, in a country that was far away... and rescued my mother from the Nazi German concentration camps. The NAACP tried their old dodge of "unequal financing" in the predominantly black counties in SC. The federal judge ruled against them but the School system decided that the school tax needed reform on their own.
Yeah, unequal financing has been the proxy under which these types of suits have been filed. The thing is that it is stunningly obvious to everyone with firing synapses that throwing more money at education does not work. Thus, it may be time to go after it under some type of malpractice rubric.
I freely admit that this is all theoretical and there are some very significant real world drawbacks, such as where the hell is the money going to come from to a. defend the suits and b. pay if there's some type of award. I'm just trying to think of some way to make the individual administrators and teachers be held accountable in a manner that would get the attention of the educational establishment writ large.

I think there are a lot of people who, for whatever reason, gave the benefit of the doubt to Obama in the last election. I have to always remind myself that most people aren't political junkies like I am, and don't really pay very much attention. Some of my family members and co-workers, good people all, took a very naive look at Obama last time around and voted for him. I think much of it boiled down to "let's give the black guy a chance". I try not to harbor ill will, as I really believe the people I know who voted for Obama simply made a grave error in judgement. They aren't evil, just kind of superficial. I don't know a single person out of that group who are going to vote for him again. I try not to call them stupid, and say I told you so. I just smile and say, Yeah, that didn't go very well. Well, you can correct that this time.

My husband has high blood pressure. .....He found a non-prescription alternative to taking Statins....it's called 'FruitFlow'. It is made from tomato seeds. .....You can get it online, from Swanson Vitamins.
It works great for him. His bp is way down now, since he's been taking it. .....You can do a search on FruitFlow and read for yourself, like he did, to know more about how it works.

That was the old Republican party. Not this KKK inspired incarnation. This is one of the saner Conservative blogs. Hence why I come here. The rest of them like my old stomping ground Hot Air is practically Neo-Nazi.

OT: I keep looking through the ONTs for updates on Stuck on Stupid's workplace retaliation story, but I haven't seen anything since he started gettin' all kissyface with Hummingbird.
I want to know what card was up IT's sleeve when they replaced his soda-vandalized workstation with a new top-of-the-line one. I want to know about the gnashing of teeth and wailing of the che-leader and his denzion of loser friends.
I. Must. Know.

Heh. "People." Saw their cover in the grocery store while checking out yesterday. They have one of the pics of Trayvon as a 10-year-old.
I'd like to know when we'll get to see George's baby pics? I mean, c'mon. He wasn't even 30.

I'm a bit unclear how the GOP "demonizes Non-Whites" (why the caps?).....
can you offer a few examples?

Sitting around drinking coffee with my democrat neighbor this morn and she makes the mistake of remarking on Sarah Palin. So I looked up the Broderick testimony of the rape incident and read it to her, in between her screaming "I'm not listening, I'm not listening!" .
Got my dig in for the day.

Nice set of delusions you've got there. Make them yourself or buy them wholesale?
The idea that the 'GOP started demonizing Latinos' makes it clear you are either a troll or just stupid. Taking a stand on illegal immigration is not demonizing Latinos. Legal residency is not a function of ethnicity. I would be dead set against a flood of unregulated immigration from my own ancestral homeland in northern Europe. The problem set would be little different. Just a different language and a few different unacceptable behaviors than what we get now. The broader issue would be exactly the same.

Yup, simvistatin, same stuff. As soon as I told my doc about the muscle ache, he took me off. I was on it for many years, low dosage, till that happened.

Jimmah,
I've been text messaging with a friend/fellow golf geek who is one of those wishy-washy types who trends liberal just to fit in with his family, for the most part. Even though his grandparents (only living family members who aren't in jail) are stout conservatives who fled Europe in the late 30's. It's the passive acceptance of the narrative that is hard to get around, and frustrates the hell out of me. I point out exactly why I define myself as conservative (not necessarily Republican), and give examples that support my positions on any topic. Sometimes I just feel like saying, as I have to other lib acquaintances that 'you don't have the brains or the balls to endorse an idea that other liberals consider unpopular'....
Posted by: model_1066 at April 03, 2012 07:26 AM (YbQJm)
You are full of it. If there was a wave of illegals from Northern Europe, most of you would support amnesty. This goes beyond illegal immigration. The Republican party demonizes Latinos for everything. You are using the illegal issue to beat up on what your side sees as an inferior people.
If the issue was just illegal immigration, why were many Republicans paranoid about Puerto Rico becoming s state? Why all this talk that Rubio is not a natural born citizen? Why the demonization of Susana Martinez, by calling her an anchor baby and saying her parents are illegals? When a German illegal was setting cars on fire in LA, why was there no Republican outrage like there would be if it was a Latino?
Actions speak louder than words.

Current TV's new host Client #9 Eliot Spitzer bombed on his initial outing. To make an impact, I would suggest AlGork employ the very unlikeable and bitch kitty Randi Rhodes. Meow!
Posted by: Doctor Fish at April 03, 2012 07:37 AM (TkGkA)
Randi Rhodes has cankles like Hillary, and a very annoying voice like Gloria Allred. The last time Allred was laid was in the TSA groping line, and Rhodes hasn't seen a cock since 1984.
