2 Congress wants some new regulations on IPOs following the Facebook debacle. What we need is fewer congressional and bureaucrat noses in Wall Street, not more.  There doesnÂ’t need to be a new damned law or regulation every time something happens. The only laws we need for Wall Street are simple fraud laws.  Most of the current problems we have are CAUSED by all the stupid regulations (which are unevenly enforced and 99% paper).

Recall on Monday the lawyers at SCOTUSBLOG said it is likely that that case will not be released until next Thursday which is the end of the term.  The other case the Morons are interested in dealing with AZ immigration is likely to be announced next Monday. I will look at the live blogging just to make sure though.

10 Panetta wants to set up a new round of BRAC for closing some bases to save money.  Congress says no.  This is one time I agree with Panetta.  Trhe “deal” they made last year includes huge cuts in the military budget which I believe can be done if done wisely.

Unfortunately this demonstrates very well that it will not be done wisely.  The two major things that can be cut to save money without reducing the effectiveness of the military are closing extra bases and streamlining the new equipment procurement process. Unfortunately Congress has its collective nose firmly imbedded in both of those which is why it is so screwed up to begin with.

11 VDH looks at the upcoming campaign and a possible October surprise.  He thinks the election will be close.  If things continue the way they have for the past few months I think it will be lopsided. And that is rare.  I think the election is now RomneyÂ’s to lose so all he has to do is avoid stepping on his dick.  Obama doesnÂ’t have one left.

Mornin', Vic. Sadly, we need to beat those same damn topics "to death" today as well, and EVERY day until the geldings in Congress actually do something to save the sinking ship. They will not do it unless what is now occasional discontented muttering becomes a constant roar in their ears.

After watching a little of the C-Span coverage yesterday, I have to think that, in the end, Weepy Boner and the rest of the squishes will end up caving to calm the Democrats and not look so "partisan" (as if upholding the law is a partisan issue).

And finally, just because everything pisses me off this morning, I am thinking the ramping-up of racial rhetoric by the darker Democrats -- including that Bonaparte creep in the Traytable Martin case -- is leading to something dangerous down the road. As in: two-three months down the road.

Anyway. . .good morning, 'rons and 'ronettes.  Hope you've all cleaned up after yesterday's pudding fest.  On this day in 1913, the Lillian Gish short The Mothering Heart premiered.  Directed by D.W. Griffith, it tells the story of "The Young Wife," whose husband has left her for another woman, leaving her to give birth alone.  The husband's mistress leaves him for another man, and he goes back home only to find his child dying.

 

It's a fairly typical Griffith short, but it bears watching for Gish's astonishing performance.  After her child dies, she wanders out to their garden, a blank look on her face.  Suddenly, as she walks by a rose bush, her smothered anger explodes, and she whips the bush in a frightening frenzy - an expression of grief made more powerful in that she never cries, nor screams, simply lashes out in the only way she is allowed to, by society's dictates.  I recommend it.

 

And now for today's Hollywood story:  Fox Studios liked John Wayne's screen tests.  They didn't like his name - Marion Morrison.  "What is he, a fairy or something? asked Winfield Sheehan, the head of production.  "That's no name for a leading man!"  The director Raoul Walsh suggested "Anthony Wayne," a hat tip to the Revolutionary War general "Mad" Anthony Wayne.  "Too Italian," was the reply.  "OK," Walsh shrugged.  "We'll make it more American.  Tony Wayne."  Sheehan hated it.  "Now he sounds like a goddamn fairy again."  Finally, Walsh said, "How about just plain John?"

 

And so The Duke was born.

SCOTUS agreed to hear the case last year.

63 Regarding the SCOTUS, if non-voting conservatives manage not to reelect Obama then the odds favor a fundamental turning point, the positive ripple effects of which would be felt for several decades. Ginsburg could go at any moment. Breyer is no spring chicken. Kennedy is at the point where retirement is a reasonable option. Even within only one term Romney could replace all three of them. Granted, with a Republican president there always is the chance of an O'Connor or Souter-style error. But even if Romney makes one mistake he nevertheless could leave office with a solid and lasting arch-conservative majority. In that event, over the ensuing decade or so, the Court would have the opportunity and more importantly the ability pretty much to erase from the law books all major traces of leftism as legal policy. Domestically speaking, that's really what's at stake this November.

It's not impossible for Michigan to go the right way.  I know it's hard to remember, but Michigan is NOT Detroit.  Thankfully that festering pile is withering away, population is draining off, and the gutterspawn are largely demoralized and will probably not be putting down the crack pipe to go do something like vote. 

 

If we could just kick that city out into the lake and let it sink Michigan would be a decent state.

 

And really - I think most states can say something similar.  It's the massive urban areas that are a blight on America.  Urbanites are the ones dragging us down.  Not that I blame those people for being miserable and wanting to share that misery.  They live on top of each other in the human equivalent of a rabbit warren.  The constant close proximity of humanity, the noise, the stink, the traffic, the horrendously bad government - it all taxes the mind.  Since they can't get away from, or lash out at, their fellow citizens, they expect the State (which drains them with onerous taxes) to get those other people around them to straighten up and fly right.

No.  The either house can vote for contempt separately. Once the full House votes for contempt it goes to a federal attorney who takes it to a Grand Jury for criminal contempt charges. It is not a civil case at that point. Conviction carries a $1,000 fine (meaningless) and 1 year in jail, which is good as impeachment.  Note that this should also result in disbarment.

Deep Space Nine was, IMO, the only one of the Star Trek franchises to ever actually touch on    what reality would be like    in an interstellar society.   There were wars.     There were turncoats and spies and acts of valor and acts of cowardice.   It was a much grittier, and therefore more realistic, view of the future.   I love TNG and TOS (and Enterprise could have been SO good), but they were all about everyone getting along and making friends.   DS9 pretty much took that framework and said, "Okay, but what happens when you try to make people get along and they say, 'Screw you?'"

 

Also?  Bashir was hot.

DS9 got better and better as it went along, and they also had the best series finale of all the Treks. Voyager was more of a flatline with an occasional atrial fibrillation with some high points ("Timeless", "The Year Of Hell"). Enterprise hit its high point with "In A Mirror Darkly". That was friggin' genius, putting the entire show into the mirror universe, even changing the show's theme music and opening credit sequence.

My enduring memory of Voyager is the episode where Paris and Janeway managed to make a shuttlecraft travel faster than Warp 10.  For some convoluted reason this caused them to de-volve into lizards or something    while they were stranded on    some planet.  While they were there,    they got their   intergalactic gecko freak on and had little lizard babies,   which they then abandoned when they were rescued.

This is why they've GOT to strike down the whole thing.  I'm sorry, they do.  The lack of a severability clause should make that automatic anyway.   You can't just say, "Oh, whoops!        We kind of forgot to put one in.      Can we take a mulligan on that one?    Next time we'll do it.   Pinky swear!"     The very purpose of a severability clause is    to have the ability to remove one part of a piece of legislation without having to scrap the whole thing.      If you "forgot" it (or, as the case may be, deliberately left it out because you knew the entire bill was built    on a dodgy, potentially unconstitutional premise), then boohoo for you.

Amidst the book collection is a book that I found at a used bookstore.  I frequently use to browbeat the Trek true-believers.  From the second season of TOS there was a book published called The Making of Star Trek.  Co-written by Gene Roddenberry.  Even when using such holy relics, the true believing Trek fan is not disabused from such heresies.

And after J.J. Abrams destroyed the Star Trek universe in the reboot, I have stopped trying to discuss such.  Its like trying to explain the concept of private ownership to an OWS drone.

I thought that's what the food stamp program was for. If we are giving all this money to them for food then why are they starving?

 

I had a summer job one time in one of those federal programs, it may have been the same one that sponsored midnight basketball. Anyway, we supervised kids at a gym that was next to the projects and open all day so that kids could come and play basketball or games or other stuff. Free bag lunches were provided. You would not believe (or maybe you would) how many more kids showed up just in time for lunch and then left right afterwards. My point is that these programs already exist and have existed for a loooong time, so making that claim that kids are starving because the taxpayers aren't doing enough for them is a lie.

It was to feed her three year old brother. Her Dad had split and her Mom was fucked up on something. She was a doll. I went grocery shopping after school and dropped some staples off at her trailer. Hunger is very real to many children in this country. What to do? A thriving economy with jobs would certainly help. Her dad left after he lost his job at a corrugated factory. I don't have the answers but I certainly don't poo poo the hungry children. It's very real.

LOL.  What silly BS, stirring up folks to worry about "THE CHILDREN."  It's absurd.  Just this morning I heard a variant of the same thing - "25% of Americans depend on food assistance."  It's silly.  Getting food assistance doesn't mean you need it.  If Uncle Sugar wanted to drop some cash in my lap, or goods in kind, every month I'd not say "no."  But I don't NEED it. 

 

However, if the slum parents starve their children, so be it.  Fewer to burden me with onerous school taxes.  It's not like there will be any shortage.  If there's on thing the American underclass excels at, it's making more babies they can't afford.

There are two clear problems here.  For one, the father is probably not being made to support his spawn.  For another, the "mother" should not be in custody of the children at all. 

 

More fundamentally, the American underclass is not the same as it once was.  Once upon a time they were not all doped and VD-infested and generally degraded as they have now become.  Once upon a time they even knew how to keep their legs together.  The old virtues of thrift, sobriety, and cleanliness that used to be so very American are dying off among the poorer folks, thanks to the thrice damned Liberals.  May all Liberals die in a fire. 

 

At this point the best possible social program is one to provide free sterilization.  I still strongly prefer that it be mandatory for getting any kind of long term welfare.  It would have huge near term payback, and the cultural improvement that would result would be vast.  It would even cut down on the damn noise pollution from those who ride by late Saturday night with their vile ghetto "music" (really nothing more than a collection of swear-words put to a rhythm) blasting at high volume, thumping the earth with reverberating bass.

Won't end up in counseling.  You only end up in counselingK if you are perceived as different, not the norm.  They are the norm.  The kid who would have stepped up to defend the woman, that kid would be referred to counseling, which is why no one stood up to defend her.  They might not have contributed but they weren't going to single themselves out and then be referred for behavior not the norm.

It's kind of like a microcosm.  If you are with a bunch of libs/dems you aren't going to speak up if you disagree, you're going to keep quiet and keep your head down and just not contribute, just listen.  You'd be afraid to go against the pack and be singled out.  That is the problem.

My brother in law -- who only likes sci-fi if it's being punked by MST3K or Rifftrax -- was deadset against watching "Farscape" when my    sister and I gave   my father the full series     a couple Christmases ago.    He ended up getting dragged into the living room by my sister so that we could all sit down and have a marathon of the first season.

 

By episode three, BIL was hooked.   

 

He and my sister went home to PA shortly thereafter, bought their own copy of the series, and    he proceeded to mainline the whole thing like a heroin addict jonesing for some horse.

299 Gran, I have not read that book.  But at the same time with so many now dead, it is harder to refute if they are shading things unless there are memos or other primary sources like Gerrold's The Making of Star Trek from 1973. 

Case in point is Takei now saying he broached the subject of having a homosexual character on TOS with Gene privately and Gene turning him down.  Though ST:TNG evidence suggests Gene would have turned it down - case being David Gerrold wanted to write in a homosexual character and was turned down.  This was during the first season of ST:TNG.  Soon after Gerrold and D.C. Fontana penned an article accusing ST:TNG of boldly going nowhere. All because Gene decided in the 24th Century he wont have as many Kirk style fist fights, things will be more cerebral.  And after Roddenberry died, Berman and Braga kept that mantra which stifled creativity and made most shows a bit bland.

So yes I know the Great Bird of the Galaxy did and could shat some really bad bloopers.

335 Mary Poppins, that book of Gerrold's pretty much is the foundation of my writing.  It was the first book I got a hold of that talked of the various conflicts: man vs nature, man vs man, man vs himself, or a mixture.  Oh yes, the transporter was invented to save money in their non-existent budget and save time in the episode for more story.  However it created other problems of how can the hero be in danger if he can be whisked away so quickly so that prompted various tricks to short circuit the transporter circuits.

304 In looking at that SCOTUS blog I noticed a case with SEIU as a defendant, the case having to do with unions being able to take money from anemployee and assign it to political uses without the employee's consent. I thought that issue was resolved years ago. What am I missing?

Willow, I agree.  You should definitely try writing a book.  It's something to get out of your system and, who knows, you might be very good at it.  I don't know what else to say except think of a story and write it.  Be careful on feedback, too.  A lot of friends won't really critique because they don't want to hurt your feelings, so you have to find the right person / s who can give it to you straight.  OSP and Anna, hope to hear from you soon.

381 AllenG, write what you know.  I know an author, three books published, who got his big break writing comics first.  Because he was already known from the comic book world, he got his first novel published.  It was science fiction but it was only so-so.  Friends sat him down said write what you know.  So his two follow on books are super hero books that have had more success because the reader can sense these books are good.  The author is really engaged.  As opposed to oh I don't know writing a Twilight type e-book because that seems to pay money, but all that is is chasing fads since it was Harry Potter clones before that sold well.

And never ever sign with a vanity press to get your stuff published.  If they ask you to pay them money to print your book, that is a vanity press.

Once I get short stories finished up and hopefully sorted out, I am planning to go Amazon e-publish.  For the screenwriters out there, Amazon Studios is having a competition this year.

 The opinion is by Breyer. The Seventh Circuit is vacated and remanded. The vote is 5-4. Justice Scalia dissents, joined by the Chief and Alito and Thomas.


The Court holds that the FSA's new mandatory minimums applies to sentences for crack cocaine imposed after the Act for pre-Act crimes.

AND    I LOVE IT.    As I always say, the only reasons    I agreed to join SEIU    are:

 

1) It was between paying    for membership dues or    for "collective bargaining" representation,   and the    cost    difference was minimal; and

2) Because as a member, I can vote for or against    union-related measures.   And I also get to be on their mailing list to see all their breathless cries of progressive outrage, which are always fun for a laugh.

 

And yes, cajun - I'm pretty sure my money goes to political causes.   That's why I try to donate to MY favored candidates and causes, too,    as a way to balance things out a bit.

IANAL, but my guess is "no" provided the union can cook the books to make it look like they aren't using money for political purposes.

That's the way it's been in MO since I had to join the Meatcutter's union to sell fish part time at a Grocery store.  They could autodeduct my "dues" (which I was told would not go to political spending, but I don't trust them) however I had to "opt in" to the political spending.  And I had to sit there while they told me how great it was the "union had their back" during the last strike, running ads (coming from this second fund) criticizing the stores to get public pressure on their side.

I asked if I put in a negative number could I get some money back.  I also told them I remembered that strike and the contract was more than fair.

The government can't force you to buy anything!"  Me: "Well, the President argues that they can. Are you sure you're not more of a libertarian?"  Her: "Maybe...but Romney makes my stomach turn." I told her that I get that too, but that I'm not voting FOR Romney, but rather AGAINST Obama.  I could see the wheels turning a bit as she walked away.

I think that might be the way to reach these voters.  Focus on the compulsion aspect of the progressive agenda.  Most of these types of folks are live and let live types.  Forcing people to do things really hits a nerve with them.  Pointing out how the bedrock of the prog agenda is authoritarianism and none of it works without compulsion of the individual might just swing a few of them or at least keep them home on election day.

About a decade or so ago the Old Boss was being pressured by a client to file for certiorari with SCOTUS.  He was trying to talk the guy out of it because there was no chance in hell of it being granted.  I was given the job of getting this ready since the client was adamant.  IIRC, at that time SCOTUS was still requiring that all submissions be typeset professionally on 6 x 9 paper of a certain weight.   You also had to send in multiple copies of everything.  The printing costs alone were going to be in the low five figures just for the writ.  We told the client hey sure we'll do it but you have to pony that up in advance.  Annnnd that put the end to the only time I've ever worked on a petition to SCOTUS.

It usually is less of a hassle (no need for anything really) AND they have no idea who is driving the car.  I have never had a problem until I bought a $800 boat trailer in a little town.  They wanted to see the articles of incorporation, didn't believe the LLC existed even though I had six cars listed with the same name.  We send the papers and the assholes had to resend them and fill out three more forms to get them back.

Tami, I'm so pissed on behalf of your son that I had to go check out the CT DMV's website for myself.  Here's what they say:

There has been some recent confusion on the DMV web site regarding the proper identification needed for registering a vehicle in Connecticut. Identification is required when registering a vehicle in the state.  Acceptable forms of identification for registration purposes are as follows:

 

Connecticut Residents.    A Connecticut resident must present his or her valid Connecticut license or ID card with photo as his or her form of identification. Any Connecticut resident without a Connecticut license or ID card, must obtain one to be eligible to register a vehicle. Within 30 days of moving to Connecticut, new residents must obtain a Connecticut license or ID card for transacting registration business at the DMV. The Connecticut license is required to legally operate a vehicle in the state.

 

 

Out-of-State Residents/Military.     If someone is an out-of-state resident with a valid out-of state (or Canadian) license or ID card with photo, or possesses a U.S. Military ID (either active or dependant), those documents can be used when the vehicle will be kept in Connecticut. This documentation is needed to verify that a person is not a Connecticut resident and has residency elsewhere.

 

 

All Others - Special Review. If someone does not have any of the required forms of identification, he or she can request an administrative review to determine eligibility to register a vehicle. You must complete and submit A Request for Administrative Review (form B-360).  Review process may take up to 30 days. The review process:

 

* Determines whether you are a Connecticut resident and subject to state law regarding residency for registration requirements.

*Determines a need to register the vehicle in Connecticut.

*Determines who will operate the vehicle and is properly licensed.

 

(Please Note: The use of passport is primarily associated with obtaining a license. It is not used as a form of identification for registering a vehicle. )

524 Oh and if you can, NEVER register a car in your name.  Most states now put your driver's license number on the registration, so they can charge you with red light photo tickets.  The cops can also see your tag and see if you have a Concealed Carry.  Not with my tags.

Just saying it doesn't cost much to have an LLC with your assets in it.  It also is another layer of liability protection.

He went back in.....showed them their own website and what it says about acceptable forms of ID, primary and secondary and that he had one from each list. Nope....'Must have SS' card...no exceptions'.

 

He said, F*ck it....I'm not registering the car in this f*cking state.

 

 

I just checked their website. For the DL they require two forms of ID, at least one of which must be from their primary list. SS card is listed as a secondary ID and is therefore acceptable BUT NOT REQUIRED. For the vehicle registration he only needs a valid CT driver's license. Why is it that a moron can figure this out in two minutes but a DMV employee can't?

 

My advice to him is to go to a different office. I've been in a similar situation with idiot DMV employees before and just went to a different office and it was as though the situation never occurred.

When I applied for my driver's license at sixteen, I was turned away, reason being that my surname was Hispanic, but I certainly don't look Hispanic.


They told me to get a copy of my birth certificate.  I had no idea how to do so, but fortunately, my parents had kept their original copy on hand, and so I got my license the next week.


I chuckle to myself sometimes, remembering how the DMV told a white kid that they suspected he had stolen a Mexican's I.D.  Glory days, those.

548 The reason the nazi's want your ss is because they are basically building a national data base of drivers licenses.  Most states forbid the use of a SS as a DL number, but Homeland security has gotten around that by adding the data to your record.  They then scan all DL's in the country to make sure you do not have more than one DL.

When I was in college, I had three DL's.  That is not possible now.  When you renew, they have to scan the entire national data base to see if you have any outstanding warrants.

1984 is here only a few years late.

587 So I looked at the CT DMV site again and while you don't need a SS card to prove your identity you do need to prove your SS number, and it appears that the only documentation they will accept is either your SS card or an original W-2 from your employer. And yet I was always told that the SS number is not to be used for identification, which I suppose is technically true in the case of driver's licenses. They don't require you to present your SS card to prove your identity, they just require you to present your SS card to prove the validity of your SS number. OK.

599 587 So I looked at the CT DMV site again and while you don't need a SS card to prove your identity you do need to prove your SS number, and it appears that the only documentation they will accept is either your SS card or an original W-2 from your employer. --- That's the way it was in the past few states I've lived in. I've always thought it was a truly bizarre requirement that merely serves to encourage the generation of extra SS cards. My card has a signature on it that is from when I was young, so it really doesn't look like my signature. Really foolish.

We adopted out two daughters after a DHS involuntary termination of parental rights procedure.  Bio-mom, cementing her status as a member in good standing of the dirtbag American community, then used my infant daughter's SS number to get credit for such things as cable TV.  We went down and changed my daughter's SS number.  Then she turned sixteen and we went down to get a learner's permit and the shit hit the fan.  Huge mess because DMV couldn't handle it that she had a new SS number.  We spent the day going back and forth between the DMV and SSA.

God times.  Good times.

I'm not sure it's that.  I think they don't realize exactly how bad it will be for insurance companies to keep those provisions.  Even something that seems fairly benign- like extending coverage to "dependents" up to age 26 has a lot of far-reaching implications that industry insiders could tell them.

Either they're not listening, or the industry insiders have been bought off in some way (likely the coverage mandate, but then what will they do when the mandate is struck down?)
