— Open Blogger Drudge and Memorandum both had links to an executive order issued by Pres. Obama on Friday. It appears to have to do with delineating responsibilities among Cabinet members during times of emergency, so I chuckled in light of the mocking of the MSM over the efforts of various states (such as Wyoming) to do the same thing.
But then I read the following paragraph and wondered if there might be more to this directive than meets the eye. Note the highlighted language:
PART II - PRIORITIES AND ALLOCATIONSSec. 201. Priorities and Allocations Authorities. (a) The authority of the President conferred by section 101 of the Act, 50 U.S.C. App. 2071, to require acceptance and priority performance of contracts or orders (other than contracts of employment) to promote the national defense over performance of any other contracts or orders, and to allocate materials, services, and facilities as deemed necessary or appropriate to promote the national defense, is delegated to the following agency heads:
(1) the Secretary of Agriculture with respect to food resources, food resource facilities, livestock resources, veterinary resources, plant health resources, and the domestic distribution of farm equipment and commercial fertilizer;
(2) the Secretary of Energy with respect to all forms of energy;
(3) the Secretary of Health and Human Services with respect to health resources;
(4) the Secretary of Transportation with respect to all forms of civil transportation;
(5) the Secretary of Defense with respect to water resources; and
(6) the Secretary of Commerce with respect to all other materials, services, and facilities, including construction materials.
(b) The Secretary of each agency delegated authority under subsection (a) of this section (resource departments) shall plan for and issue regulations to prioritize and allocate resources and establish standards and procedures by which the authority shall be used to promote the national defense, under both emergency and non-emergency conditions. Each Secretary shall authorize the heads of other agencies, as appropriate, to place priority ratings on contracts and orders for materials, services, and facilities needed in support of programs approved under section 202 of this order.
Haven't had time to analyze the whole thing yet, but that II.b clause gives me a bit of pause for thought, particularly talking about Cabinet secretaries issuing "regulations to prioritize resources" under "non-emergency conditions" in the name of "national defense".
For those of you who don't have the time or willpower to read Atlas Shrugged, let me give you a few quotes from that all-too-prescient novel. First, in response to the invention of "Rearden Metal", the creation of the John Galt railroad line between the East Coast and Colorado, and the subsequent relocation of businesses from the East Coast to Colorado:
The Union of Locomotive Engineers was demanding that the maximum speed of all trains on the John Galt Line be reduced to sixty miles per hour. The Union of Railway Conductors and Breakmen was demanding that the length of all freight trains on the John Galt Line be reduced to sixty cars.The states of Wyoming, New Mexico, Utah and Arizona were demanding that the number of trains run in Colorado not exceed the number of trains run in each of those neighboring states.
A group headed by Orren Boyle was demanding the passage of a Preservation of Livelihood Law, which would limit the production of Rearden Metal to an amount equal to the output of any other steel mill of equal plant capacity.
A group headed by Mr. Mowen was demanding the passage of a Fair Share Law to give every customer who wanted it an equal supply of Rearden Metal.
A group headed by Bertram Scudder was demanding the passage of a Public Stability Law, forbidding Eastern business firms to move out of their states.
Wesley Mouch, Top Co-Ordinator of the [Federal] Bureau of Economic Planning and National Resources [think: Tim Geithner at Treasury], was issuing a great many statements, the content and purpose of which could not be defined, except that the words “emergency powers” and “unbalanced economy” kept appearing in the text every few lines. (p. 299)
And as the country is falling apart later on:
Six weeks ago, Train Number 193 had been sent with a load of steel, not to Faulkton, Nebraska, where the Spencer Machine Tool Company, the best machine tool concern still in existence, had been idle for two weeks, waiting for the shipment — but to Sand Creek, Illinois, where Confederated Machines had been wallowing in debt for over a year, producing unreliable goods at unpredictable times. The steel had been allocated by a directive which explained that the Spencer Machine Tool Company was a rich concern, able to wait, while Confederate Machines was bankrupt and could not be allowed to collapse, being the sole source of livelihood of the community of Sand Creek, Illlinois. The Spencer Machine Tool Company had closed a month ago. Confederated Machines had closed two weeks later.The people of Sand Creek, Illinois, had been placed on national relief, but no food could be found for them in the empty granaries of the nation at the frantic call of the moment — so the seed grain of the farmers of Nebraska had been seized by order of the Unification Board — and Train Number 194 had carried the unplanted harvest and the future of the people of Nebraska to be consumed by the people of Illinois. “In this enlightened age,” Eugene Lawson had said in a radio broadcast, “we have come, at last, to realize that each of of us is his brother’s keeper.” (p. 911)
I am not a paranoid man by nature, and I firmly believe in checks and balances and in the Syrup of Ipecac theory of political dynamics. But I think this executive order -- part of a Friday night document dump (and pre-St. Paddy's day, at that) -- is worthy of more careful scrutiny. ..fritz..

The reason for the law was fear of a Soviet nuclear attack and the ability to keep government functioning after the attack. We no longer need this law and it is time for congress to repeal it.
But as long as they hold the Senate and Obama is in office that will never happen.

Sheik Abdul Aziz bin Needagoat Abdullah Cocksuckenstein, the grand mufti of Saudi Arabia, declared that it is “necessary to destroy all the churches of the region.” The ruling came in response to a query from a Kuwaiti delegation over proposed legislation to prevent construction of churches in the emirate. The mufti based his decision on a story that on his deathbed, Muhammad declared, “There are not to be two religions in the [Arabian] Peninsula.”

I don't understand how this is legal. Even in Atlas Shrugged they had to get congress to pass it.

Frankly, I have been coming here for going on 10 years now and for the most part I avoid the comments section anymore because of the constant birther/truther/"tenther"/obama is a sleeper agent for evil agency x bullshit. Grow up you stupid fucks. If Obama destroys the republic it's not going to be because he was some sort of supersecret Muslim/Communist bred from the start of the 60's to be president (a time when Blacks couldn't even share a bathroom with Whites in many states). It will be because he and his supporters/subordinates subscribe to a disproven political and economic theory. THAT'S what you should be concentrating on. Not making up bullshit like this and running around chanting Obama is a SCOAMF or Obama is a SCOAMT. I don't know why Ace won't just come out and say it , but there I have.

Chad,
In case you haven't noticed Ace has beaten down the birther issue on several occasions, to the extent of banning people that persisted in it. As for the the constitution I beleive Ace has been for all of it, including the 10th amendment.
What failed political and economic model does Obama subscribe to? To me it borders on communism and so does this document. The document doesn't just say wartime, it also says any peacetime emergency. The president is the only one who can declare a national emergency, there are no guidelines or law saying what an emergency is. You may trust the guy, I don't.

Dear Members Of The Republican Leadership Of The United States Senate And The United States House Of Representatives,
Obama acts like a dictator because you are weak. He does as he pleases because dictators don't need to be concerned with pesky trifles like feckless legislators or the Constitution of the United States of America. He moves forward with his tyrannical usurpations because he believes you won't lift a finger to stop him.
When are you going to wake up? It's not Mr. Obama's first drink from the well of tyranny. He declared you "irrelevant" long ago. He essentially told you, long ago, that your services are no longer needed or required.
And guess what? Your weakness and fecklessness is proving him right. Unless you assert your constitutional duty and authority, and remove this disease that is afflicting this great country from office, you will remain irrelevant and, as far as the American people are concerned... your services will no longer be required.
Fuck You.

That's why I've come to think that a well done miniseries is the best format. There is time for character and plot development, with each episode being more or less standalone, yet you know that there will be a climax and denouement, unlike an open-ended series.

If the dems maintain control, expect "emergencies" every few weeks until all the federal agencies trump the state laws recently implemented to keep this exact thing from happening.
Obama has already declared more natural disasters than any president in history. He plans on turning America into his personal chessboard, where he controls both the blacks and whites.

Yeah we should give Obama the benefit of the the doubt. As evidenced by the last three years of his administration we've see nothing but the utmost respect for the Rule of Law and the Constitution.
Here's a great example.
Did everyone see Panetta's testimony last week? He was asked about Congressional authority in going to war
Q from Sessions: As you go forward, will you consult with the United States Congress?" Sessions asked Defense Secretary Leon Panetta Wednesday.
Panetta: "You know, our goal would be to seek international permission. And we would come to the Congress and inform you and determine how best to approach this, whether or not we would want to get permission from Congress," Panetta said.

A few years ago, at the California college I work for, we were all required to attend SIMS training which put us into compliance with some similar federal law and allows us to continue to suck on the federal teat for funds.
SIMS allows some vague authority...governor, college president, POTUS....that seriously was never made clear....to declare an 'Emergency' and because we are all gubberment employees at the college we would be required to show up to work and perform emergency services (never specified) for some unspecified entity for no pay. For no specified period of time either. Presumably you would leave your home and family to the mercies of nature while you were away serving the needs of the state.
Failure to appear at your workplace under a SIMS Emergency declaration will result in your employment termination.Call me paranoid but the gubberment has been working towards a dictatorship since they crushed the Whiskey Rebellion.

"A group headed by Bertram Scudder was demanding the passage of a Public Stability Law, forbidding Eastern business firms to move out of their states.
Wesely Mouch is sort of a Tim Geithner-Barney Frank hybrid cylon.

The Army Corps of Engineers has authority to control "navigable" inland waterways. The supervise most levee and dam building on major (and minor) rivers, etc.
And the Corps of Engineers frequently misuse that power in a tyrannical (and incompetent) way, and have done so for many years.

About a year or two ago the New York Times ran a series of articles suggesting that Climate Change was the #1 national security threat facing the US. Since then, the CIA spokesperson regurgitated the same nonsense. Sporadically, the White House has said the same thing. Up until now, I've held the opinion that the very concept was so far to the left that it would show a negative response in the electorate.
Now, I wonder if the groundwork was laid to add teeth to this new executive order. In other words...no need to vote on "Cap and Tax"...just pass it under this executive order via the EPA's secretary.
Cheers,

This man lies so much I doubt he's able to tell the truth. How can anyone... ANYONE say that by increasing a companies expenses that they would lower their prices? Anyone who believes that should immediately be executed for stupidity.
Its got to be some bad dream. The 'President' cannot be this crazy. He's made people like Debbie Was-a-man Shultz seem sane. If we came across people like her 10 years ago she'd be laughed off the TV. Now? Well with Obama telling big ones so often, it seems we're in some pretend world of 'don't contradict the black president! You'll get that guilty feeling!! Just go along with it and we might get through this without being called a racist.

1. it does not matter, update or not, the EO simply should not exist in any form, a prez could call marshall law in a true emergency anyway, this EO just gives them the ability to meddle in non-emergency situations.
2. this administration has shown a propensity to use this type of crap to violate and limit freedoms.

The so-called "subsidies" for "oil companies" (which would cover everything from wildcat exploratory oil drillers to the big integrated refinery corporations) are nothing more than the tax rules that allow deductions for the amortization of equipment, etc. , since the oil "bidness" is extremely capital and equipment intensive.
How much does it cost to build an off-shore oil platform that has to drill down 10,000 ft to hit oil? And how do you pay for that when the return on your investment may take years?
How does this capitalism thing work, anyways?

Over 200K but under 1 million = rich
Between 1 million and 20 million = part of the great 99 percent of the "working class" consisting of athletes, actors, singers, pundits, and network news anchors
Over 20 million = rich

Friend --
Once the Republicans settle for -- sorry, settle on -- their nominee, the dynamics of the race will transform, and the election will kick into high gear.
That means this Dinner with Barack could very well be the last before we know our opponent -- and there are just two seats left at the table.
Donate $3 or whatever you can by midnight tonight to be automatically entered for a chance to sit in one of them.
What a bargain! $3 for a chance to have dinner with the POTUS. Then again, when you count in bail money and the cost of an attorney, perhaps not.

It's a bullshit argument to say that one is close-minded if they don't embrace diversity in their circle of friends, although that argument has been made. I, like you, have no desire to have friends who are liberals. It only invites frustration and bitter feelings and is ultimately designed to fail. In essence, I consider liberalism a character flaw, worse, a mental defect. I have no compulsion to willingly surround myself with those people.

I agree with this post more than Gabriel's.
Everything this President does is about government control. He signed legislation permitting the indefinite detention of American citizens. He favors government control of the internet. He is trying to force the largest faith in the country to violate a 2000-year-old religious belief so that the Catholic Church will be forced to close its hospitals and schools, increasing the government monopoly. Now he has renewed the framework for a command economy.
Nope, nothing to see here. This President is just like all the rest.
