Zimmerman Bond Hearing Going on Now

UPDATED 11:11AM Zimmerman was granted $150,000 bail with GPS and electronic monitoring.

This gave the most in-depth look we've had at the prosecution's case so far. It does not look strong at all.

A little late for this, but George Zimmerman's bond hearing is going on right now. (Some background here.) The question at these things is whether the defendant would be either a danger to the community or a flight risk. Zimmerman, clearly, is neither.

His attorney, Mark OÂ’Mara, is expected to argue for bond for Zimmerman -- who has spent the past nine days as an inmate in Seminole CountyÂ’s John E. Polk Correctional Facility -- during a 9 a.m. hearing before Seminole County Circuit Judge Kenneth Lester Jr. OÂ’Mara is likely to argue that ZimmermanÂ’s behavior since the shooting nearly two months ago justifies a bond: Though in hiding, Zimmerman stayed in touch with law enforcement, and turned himself in once charges were filed. He also has family ties to the area.

AS IF WE DIDN'T ALREADY KNOW the "Zimmerman wasn't injured" claim was utter BS. You could see the wounds on the video and now, ABC News, of the "exclusive" story claiming Zimmerman wasn't injured, has "exclusive" photos of the bloody back of Zimmerman's head. I won't post it here because it's quite bloody---almost as if it was smashed into the ground several times---but the link is here.

Is that really such a bloody picture?  I checked it out this morning and it doesn't seem THAT bad to me in terms of blood.  It's what you'd expect from a head wound.  

 

I guess if you really can't stomach blood it might be difficult, so there's that.

Glad the pictures have surfaced. .....Something to consider, about the 'amount' of blood on the back of Z's head, is that this happened from smashing action.....not from a knife or something that would break the skin. 

 

So the damage to his head wass probably more than the amount of blood depicts.

We hit a speed bump, I wasn't holding on tightly, so I was launched into the air, slamming the back of my head on the ground hard enough to briefly lose consciousness. It opened up a wound that bled a fair amount, but a friend there had some EMT training. I really did not want to make a trip to the ER at that point although I probably should have. The friend put me in some sort of modified sleeper hold which eventually stopped the bleeding.

So the family's lawyer's claims about Zimmerman not having to go to the hospital so his head wound couldn't have come from a traumatic experience are irrelevant. But we all knew that already.

I suspect they have no "narrative dissonance" at all.  I think (really) that this was never about "Racism" or "Justice for Trayvon."  It was about ratings.  And at first, until Zimmerman was on trial (okay, he isn't yet, but you know what I mean), the Narrative that sold the best was "The poor, unarmed, defenseless teenage snowflake was gunned-down in cold blood by that racist, profiling white (hispanic) guy."

Now, however, that doesn't sell.  They sold the first one so well, that people think his conviction is just a matter of time.  So now they have to sell a different narrative.  Expect a lot of the the evidence they completely ignored (if not tried to cover up) to "surface" "unexpectedly" over the next few weeks.

A young woman in our community died a few years ago falling out of a golf cart, while holding her toddler in her lap.  A friend of ours arrived on the scene and said she was killed instantly after hitting her head on the curb.

ABC? Not really. Being complete idiots who are completely wrong is protected speech. It would be hard to show actual malice and even reckless indifference wouldn't really be met.  That's not to say they aren't idiots, but it's pretty likely an case would be thrown out on a motion for the pleadings.

 

NBC is a world of hurt for editing the 911 call.  It's an interesting question as to the liability of the affiliates who aired the edited tape but did not have a hand in the editing since they can claim reliance upon the network to get it right.

Of course we did, we call them "Emergency Medical Technicians" instead of "Paramedics" now for a reason.  An EMT is probably as competent (especially when it comes to minor trauma) as your local Care Now or other Urgent Care provider.  They would have treated at the scene, and probably done a basic concussion screen as well.

Just because you didn't suffer enough trauma to need hospitalization does not mean you weren't being attacked.

But, again, we already knew that.

She should be tried for abuse of power and convicted, just as should have happened to Nifong, who never should have seen another day of freedom after he tried to put 4 totally innocent (and everyone knew this from the start) kids in jail for decades each.  Nifong needed to serve out the max sentences he tried to illegally force on others through his abuse of power - plus extra time for his criminality.  The same is true for this piece of shit prosecutor in Florida.

If you don't arrest and jail out-of-control insane prosecutors like this, then this shit keeps happening over and over at increasing frequency.

75 My dad died 17 years ago this Mother's Day from tripping and hitting his head on the bedroom floor.  He was on interferon for kidney cancer, which had made him weak.  My mom heard him fall.  He said, "Wow, this sure is a hard floor" and a few minutes later began complaining of his head hurting badly.  By the time the ambulance got him to the hospital and he made it into surgery, it was too late.  The subdural hematoma had rendered him brain-dead.

The skin on his head wasn't broken when he fell, either.

My sister and I made it to the hospital in SC that night to take him off life support.  I've hated Mother's Day ever since.

There was that interview with Zimmerman's dad, the retired judge, who said that Trayvon was yelling "I'm gonna kill you!" while he was sitting on Z, smashing his head on the ground.

It might not be probative.  That is, in a scuffle with neither of them wearing gloves, it would be very possible that the gun was covered in prints, but that the prints were too smudged to be recoverable.

Head injuries are scary.  I worked on multiple cases where there were no or very minor cuts and/or bruising and the person had a massive hematoma.  If you fall and hit your head, take it very seriously.

Insty has a fantastic idea to curb the practice of overcharging defendants.  The state pays the proportionate share of the defendant's attorney fees for the charges that were dismissed or dropped.  Charge 20 counts and only go to court on 1?  State pays 95% of the attorney fees.   I also totally agree that prosecutorial immunity should be by statute not by judicial fiat.  If we want prosecutors to have immunity, and there are good reasons to give some limited immunity, pass a law and let's hash out the exact parameters of it.

The problem of course is that if the prosecution actually tries for a case, they'll try obfuscation and it's could be described as not that "bad" of a head injury.

I don't agree with this line of reasoning however, I'm merely suggesting the direction I think will go.  (Similarly, if, in a different hypothetical case Person X were being kicked repeatedly by person Y, it shouldn't really count against X's right to self-defense that Y has really bad aim and keeps missing the sweet spots so the brusing isn't that bad.)

The flip side of this (that the defense could counter with)is there are really 2 types of head injuries.  There's the literal skull splitting ones (this does not appear to be that) dangerous because, well your skull is open.

Then there are the ones where your skull is intact, but your brain's been sloshed around so much you suffer severe damage. Unlike my hypthetical kicking case, there's no physical indicator (e.g. brusing) of this.  To a certain extent pain makes a really aweful indicator of concussive damage as well. (You will usually get pain with concussions, but not always.)

168 I read through the article at the link and one of the things mentioned was that there was gunpowder residue on TM's sweatshirt.  I've suspected from the beginning that there was probably a struggle for the weapon once it was drawn, and I'd be very surprised if the powder pattern on the shirt isn't a huge piece of this case.  Also, I can't remember where i read it but several weeks ago I read an account of the condition of the weapon after the shooting, and it described the weapon as having been fired (chamber empty) but with a full magazine.  I wondered at the time how that could be the case.  Assuming GZ carried it with a round in the chamber and a full magazine, why didn't the next round in the magazine get stripped into the chamber after the first round was fired?  Jammed weapon?  Or were there multiple hands on the top of weapon preventing the slide from operating correctly and stripping the next round from the clip?  We don't really know, and I haven't seen anything else mentioned on that subject since then, so I don't know if that description was even based on fact, but when I read it, it seemed like it pointed to a struggle for control of the gun, and the sweatshirt evidence might confirm this.  It also seems unlikely that TM could have seen the weapon prior to GZ being on his back with TM on top of him, because who repeatedly beats someone's head on the ground while the other person is waving a firearm in your face?  Wouldn't both hands be occupied trying to gain access to GZ's gun rather than bashing his head on the pavement?  It seems likely that GZ didn't draw his weapon until the physical fight had already started.  Obviously, rank speculation here at this point but this has bugged me ever since I read that account of the condition of the weapon.

No shit.  I got a whopper of a concussion playing basketball by getting upended and going head-first into a basket support (I know that only from finding out about it from the other guys later) over 30 years ago.  I was knocked out for at least 5 minutes and the guys called the cops because they were afraid I'd die; the cop took me to the closest hospital where they checked me out and told me to come back the next day and for my wife to keep waking me up through the night.  I was out of work for a week; I tried to go back but they sent me home because I was still out of it.  All I wanted to do was sleep to recover from it; my I/Os were fucked up too because I was having a hard time speaking for a short period which scared the shit out of me but I figured it would come back.


I've been extremely sympathetic to people with head injuries since then; to the point where I'm wary about taking people off life support because they may still be alive just very deeply buried in their grey matter.

Used to practice criminal law.  Prosecuter.  Prosecutors typically charge the highest level that can colorably be justified by the facts as they know them.  Oftentimes the hope is to get the defendant to plead to a LIO (lesser included offense).  It gets a conviction, speeds up the process, saves the state money and sometimes spares the victims further emotional harm.  It isn't always a bad thing.

 

That being said, you have to have a colorable claim for the charge "(no that isn't an allusion to race). Proscutor here over charged.  Doesn't look like anything more than manslaughter.  She charged as she did, when she did, and with as little evidence supporting the charge as she did, for political and personal reasons.

Don't forget to add in to the mix that this was the second go-round on charging, unlike your usual case.  That makes the analysis of the prosecutor's case a bit different - requiring more scrutiny than usual.  But this isn't even up to snuff for a normal case.  That puts this into some sort of legal "abuse of power" territory, by my lay estimation.

How is this even going to get past the self defence hearing????  The state must prove beyond a reasonable doubt that Z started the fight (threw the first punch or used "fighting words").  The investigator just stated, under oath, the state had no case.

IMO this is simply Corey trying to give the Martins  some sort of satisfaction that Z was punished and spent some time in jail.  "No Bail" would have meant spending upwards of a year in jail regardless of outcome.

Seein' I have zero experience with courtrooms, this was very interesting.  I thought the prosecutor didn't hit as hard as he could (or had nuthin'), and the cop on the stand was laconic but his testimony supported the defense.

I got a shock when GZ took the stand and was hit with cross...but apparently the rules limited cross related to his statement on the stand.

Which, is clever, and true. Although he is being charged with second degree murder, the first thing that will be established is whether he was acting in self-defense and whether his actions are protected by the "Stand Your Ground" law. Although charged as the aggressor, Zimmerman has the law and self-defense on his side. They have to prove that he not only exceeded his right to self-protection, but then went so far as to murder a man in cold blood.


I think it's gonna be a tough case for the state.

281 The investigators themselves probably don't even believe in the prosecution's case. Remember they originally investigated the shooting and found no reason to file charges against Zimmerman, but they are compelled to testify.

From all the information we have there is only 2 factions that believe Zimmerman is guilty: 1) the Martin family/attorneys; and 2) the special prosecutor brought in from another city to file the charge. The investigators and police did their job and are now forced to testify for the state. It sounds to me like he told the truth and it didn't help the states case at all. $150,000 is small potatoes in a murder trial.

Actually, I have, though I'm only a commentator.  Anyhow, this appears to be the story...

 

The kid made the whole thing up. He was playing with fire, and somehow got burned. So a tall tale was told. Unfortunately, it got out.

 

Now it took a while to dig into this, and even the KCStar was kind of holding it back, but it seems the police never believed the story, and I don't know if the kid 'fessed up or not, but nothing ever happened. I think that the whole thing was dropped just hoping it would go away.

 

And if you think about it, notice there was no "Outraged Parents" on the news night after night.

My understanding is if the five separate statements did not have any contradictions at all the cops would get suspicious. Some level of contradiction is normal because the questions vary and are worded differently. the suspect may characterize and word answers differently, and when things happen very quickly some memories may be fuzzy and unclear.

The prosecution appears to have no case at all.

The parents, frankly, have been reasonable. They have not been calling for violence and no matter what, they did lose their son. They have to be allowed a bit of latitude in their grieving.

290 Haven't read all the comments but I caught part of the hearing on tv.  The prosecutor is a jerk, unnecessarily hostile.  Zimmerman was a model defendant on the stand, polite, yes sir, no sir, etc.  And he isn't an idiot, seemed to be aware the prosecutor was trying to trip him up by asking repetitive and confusing questions in an attempt to get a "gotcha" out of Z.  Finally the defense attorney started to object and things settled down. 

The judge seemed reasonable to me too.  They had some discussion about how to get info out to the media asap but protect the identities and addresses of Z and his family and the witnesses.  Both sides seem to be concerned about safety, although between the media hounds and race baiters I wonder if confidential info will leak.

I read somewhere over the weekend that Z didn't pull his gun out until Trayvon saw it (while smashing his head to the ground).  It wasn't clear on whether or not Z thought Trayvon might try to grab the gun first.

Also Jane D'oh, I feel the same way about Father's Day.  My dad died just a couple days before that day almost 14 years ago and I couldn't even walk down the card aisle of a grocery store around FD for the first few years.

I would not be a good defendant on the stand, no poker face at all and would not be able to conceal my frustration if I thought I was being railroaded.

The sad thing is that even if he does win the trial, his life (as he knew it) is over. He'll have to change his name, move his family, find a new life somewhere completely different.

What about GZ's clothes or TM's clothes? That much blood there should be some bloodstains on them.  Was there?

Have you seen any pictures with enough detail to say that he didn't have some kind of tape to close a wound?  Has there been anything published from the paramedics saying what treatment was administered?  Until then, on you knees.
