— Ace When any other sort of company screws up, that is part of its one-paragraph description forever. If the media writes about, say, Dow Corning, they'll mention the lawsuits against them over the allegedly unsafe silicone breast implant device. And so on.
For some crazy reason, that never seems to happen with the media, huh? Even their natural competitors, other media outlets, observe the Rules of the Cartel and never mention each other's legal problems in later capsule mentions of each other. This Washington Post piece doesn't note the fact that NBC rigged cars to blow up for a Dateline special. And it discusses the suit in terms of humorous derision.
Zimmerman thus didn’t volunteer a racial profile of Martin; he was asked to provide it, a point that the lawsuit makes in colorful fashion: “NBC created this false and defamatory misimpression using the oldest form of yellow journalism: manipulating Zimmerman’s own words, splicing together disparate parts of the recording to create illusions of statements that Zimmerman never actually made.”...
Following a public uproar over the tape-doctoring, NBC News issued a statement on the matter saying this: “During our investigation it became evident that there was an error made in the production process that we deeply regret. We will be taking the necessary steps to prevent this from happening in the future and apologize to our viewers.”
Such contrition didn’t impress the Zimmerman camp. “Only after the defendants’ malicious acts were uncovered and exposed by other media outlets … did defendant NBC ‘apologize’ and terminate some of those in its employ responsible for the yellow journalism identified in this Complaint.” Zimmerman himself never received an apology from the defendants, according to the suit.
The suit doesn’t specify a dollar amount of damages that Zimmerman is seeking. “That’s showmanship,” says James Beasley, the Philadelphia-based lawyer representing Zimmerman in the suit.
It's so funny to think that citizens can hold media organizations accountable for their malicious slanders. What sillyheads! All this "showmanship" and "colorful" filings! Why this man must be some sort of crazy Tea Partier.
And also, a racist.

Posted by: Vic at December 07, 2012 06:33 AM (YdQQY)
Probably not, but my (admittedly rather shaky) logic would go like this:
The Washington Post is a nationally known newspaper with an online webs presence. It is not unreasonable to assume that some percentage of the jury pool for this case would read the Washington Post, and therefore be prejudiced against the plaintiff. By taking the tone of an editorial, rather than a "straight" news story, the Washington Post made it a) more likely that people in the jury pool would have read the article and b) given themselves a thin veneer to say "it's just opinion."
Whether or not you could hit them, legally, for such a thing, I think they should be taken to task for doing it.

Call it an attempt to poison the jury pool. Say they were aiming to get Zimmermann convicted by any means...or, failing that, to so incense public opinion that someone would try to kill him.
Someone like, say, the New Black Panther Party that put a bounty on him in violation of various state and federal laws?

This blatant up front manipulation shatters that.
Prosecutor misconduct like this should be considered a major felony with a mandatory 20-life sentence. When the penalty is so harsh, and the risk so high for little gain, people won't do it.

The Zimmerman case is yet one more symptom of the problem.
Life Worth Living
I used to keep an index card with a short list of items on it so that every day I remembered what is important. It read: Wife Work Weimaraner
It was before we had kids. It reminded me that my purpose was to be a good husband, employer, and person in general. It worked for me. I was successful and I felt good about giving of my time, talent, and resources. I helped family and friends whenever I could. I had been a good man, attended church, was involved in my community, and was a good employer. Trying to do for others first was my priority. As I said it was working very well. It worked well after kids too. I was living for those around me. I felt good.
Sometime about six years ago our church, where I was an elder and active session member, went through an upheaval and the problems were exacerbated by liberals who simply were takers who wanted control. We ended up leaving that church, ironically it was Presbyterian and they like to think of themselves as the frozen chosen – they were supposed to be anchored fairly well abstaining from upheaval. I knew that had I stayed, my gifts would only be used to perpetuate the bad status quo. In good conscious I knew that for the church to mend, that I had to let it fail. (I had been the second most contributor for a number of years. The top contributor also left). I and my family began attending a different Presby church, but I have yet to regain that connectivity and am fearful to join as a member.
I have been narrowing my friends and family to only those with like minds. I have become less tolerant of idiots and liberals BIRM. At work I care less about my employees. I have become ambivalent about othersÂ’ hardships. I barely get upset even over a friendÂ’s terminal illness. I have become unfeeling toward those outside my most immediate family and friends.
Why?
I know why. But I no longer can afford to expend anymore of my efforts to try to change it. A while back I actually calculated what the government takes from me. Adding all the taxes and fees came to over 50% of my gross earnings. I also calculated that a quarter of my work effort was spent fulfilling government regulations. So I determined that over 75% of my work effort was being taken with little to no benefit to me. I have felt enslaved since. I think of the communist countries that had and have soul crushing taxes and laws. This is where we have come. Our current society and culture are soul crushing. There simply is no more capacity to care about others when it takes all your efforts to take care of yourself and yours.
Yes, Life is worth living. However, given the current state, it is not worth trying to help others. The government has placed itself in the roll of nanny, father, big brother, caregiver, and mother. There is no longer a need to help your fellow man when that roll is filled by government.
The worst aspect of it all is that I have been robbed of my gift of giving. The joy of selflessly helping others can be no longer until we regain our liberty and independence. I am becoming a hollow shell of what I had once been.
I have not given up. I have however resigned myself that until the current state of things changes for the better I cannot help a single person outside my immediate sphere. If a good employee, close friend, or immediate family member needs a hand through no fault of their own, I will be there for them. Outside of that, everyone else is on their own. I wish it were different but it is what it has become.
Until our society hits bottom, any effort to change it will only be wasted on those that are the takerrs, the ones that are the crux of the problem.
Our president knows that in order to fundamentally transform this nation it must be first destroyed. The forces at play right now clearly indicate that, as Monty always said, we are doomed. Indeed we are. The takers figured out that they can vote themselves other peoples efforts. But, this only works in the near term. Eventually the bill comes due and must be paid. So, in certain regards, I agree with our president. The nation must be destroyed before it can be transformed. Now here is the good part.
Since the country will be destroyed and we will indeed hit bottom we will have a new opportunity. It is then that we can say: Look what the liberals have done; they have destroyed what was once good. No, we will not rebuild another house of cards supported by debt of future generations; we will not take from those of means and give it to those of wants. We shall instead rebuild our country in the image of the greatness it had been, in the image that had been our foundersÂ’ dream.
LIB is our only course, unfortunate as it may be. Tinkering around the edges is only prolonging and deepening the eventual pain.

It all boils down to the judges, now.
Not really. In a state court action (which this almost certainly would be, joining the local affiliate and the NBC HQ) a judge isn't going to give two shits and a holler about NBC and their army of Skadden Arps clones.
In fact, all the NBC legal muscle will probably be counterproductive. A Local judge never likes being intimidated, and there's no reason for a local judge to care if NBC gets whacked for a massive judgment.
I'd also hazard a guess that the judges in that locale are fairly plaintiff friendly.

>>No, walkers, he doesn't. Not for a;ll torts. He does have to be alive for a defamation suit, though.
Actually, it depends and varies from state to state. At common law, a tort action died ("abated") with the death of the plaintiff. However, many states enacted "survival" statutes which provided that a cause of action possessed by the deceased at the time of his death survived the death, and could be maintained by a personal representative of the decedent's estate.
The practical problem is that once the plaintiff dies, the amount of damages a jury is likely to award plummets, making the settlement value of the case minimal.

Hey guys, is there any sex and dick jokes on tv tonight?
How about sex? Is there any sex, as well as gay sex, on tv tonight? I am really in the mood for base shitty humor about fat people having sex, and som tit jokes.
If there were more sex on tv, I'd be happy, because I like my humor entirely about sex, be it gay sex. Well, just gay sex. I think jokes about how uptight people are about unprotected anal sex are GREAT!
You know, if we could go back and replace all the great SNLs with Bill Murray being funny with black transgendered people making gay sex jokes, about how fat white people are uptight about it, it would be a good thing.

. Subtract 40% plus expenses for the lawyer and divide it over 10 years. Maybe he wouldn't have had such poor health if he had not been treated so poorly?
Oh, stop. Why would you divide it over years except to cover a poorly thought-out statement. Admit it; you just hadn't looked. He probably ended up with at least a mil in his pocket. That's plenty.
And the dude was the size of a house when he was a broke security guard. After becoming a high roller, you think he started eating healthy?
Sure the stress probably hurt him, but really, he made out OK, and his death wasn't more than tangentially related to the public crucifixion he endured.

Normally I'd just let this go, but I can't with this one.
Tell me, which "other media outlets," exactly, "uncovered and exposed" NBC's slander?
Hmm? Which ones?
See, it was mostly blogs and a few right-ish leaning newspapers that hit it first. As I recall, CBS and ABC, along with the major national papers, never even mentioned the situation until after NBC had been forced to retract.
And, no, they're not held to account. Blogs, while growing in popularity and reach, aren't able to challenge the Big Media outlets, yet. If they'd really been held accountable by their peers, they'd already be out of business, because everyone would remember them as the network that deliberately defamed a private citizen.

Not sure what happened to the nobody, but Spike Lee's twitter feed was the more visible one that reached many people. He already settled with the poor people living at that address. He should settle with Zimmerman too.

You're right about common law, but I'm pretty certain all states have a survival statute for filed cases. That doesn't really vary, and yeah, you usually just substitute the estate & PR for the person in the caption. If you're filing after the death of the plaintiff, that does vary a lot state to state.
So thinking about it, I'm probably incorrect about the case being dismissed b/c of death, since the defamation suit would still be part of the estate. You can't defame an already dead person, but a defamation claim likely doesn't abate on the death of the victim.

So what if they ran with the "public figure" defense against defamation.
And then what if it worked?
"Actual malice" just means you know it's false. Bob Guccione sued Larry Flynt for saying he lived with his mistress before he was divorced. Guccione didn't, he only moved in with her after the divorce. So even though Guccione was a public figure, and had in fact lived with his mistress, the information about the timing was known to be false and published anyway.
Verdict: Guccione.

The article is quoting from the complaint; thus, the 'malicious' adjective was provided by Zimmerman's legal team, not from other media outlets. Since mainstream media outlets protect their own, the Washpo article did try to diminish the suit by referring to it as, among other things, 'colorful'. Secondly, we're not Freepers. I don't think that would be hard to do in this case. Just the picture of a young Tyvek shown alongside the far more recent pic of the "white Hispanic" would be enough to start with. I'm going to disagree with others. I don't think this is a question of number of zeroes. I bet it's a question of "no fault" or whatever they call it. I bet NBC wants to claim they never admitted to charges (so they can say, "those charges were never proven" or "those charges were dropped"). Anyone know how Florida courts handle electronic discovery or discovery in general? NY's standard is "material and necessary" and, yeah, the courts view that expansively. The feds are similar. Don't have a clue how Florida state courts handle it, but i suspect it is similar.

Why not both? Bankrupt them, bring down NBC and MSNBC (which means no more Tingles or that Rachel Maddow fellow, then maybe we can have some honest reporting for once), to pave the way for a class action suit.

See Stephen Harper of Canada, and how he was able, over time (yes, it took time) to debunk, merge, purge two right leaning parties into one pretty successful new party.
End result, he won the election, and he's doing a great job (in a very liberal, right hating country). The country is doing better than most, although the libs won't let him get away with it for long.

Dude, anarchy is not real, any more than 'perfection' is. A direction, not a destination? It's an abstract ideal.
There is no such thing as anarchy (as envisioned by anarchists as a style of non-government, as opposed to just an adjective for chaos and disorder) in practice. It's a rhetorical distinction between anarchists and minarchists. Anarchists are just people who may as well refer to themselves as perfectionists.
In practical terms they want the same thing.

The issue is that there is no real category, save libertarian, for many folks like me.
I'm for rolling back to the origional Consitution and bill of rights (except for slavery).
I'm for a much smaller Government, with almost no INTERNAL US Fed Power.... but am Pro Military (although we are deployed in way too many places currently IMO).
I think its a shame that Fed Taxes are greater than my State Taxes, as its the State that does most of the things that support me as a Citizen (except for Defense)...
So I sure dont fit the GOP (too Statist)....
But... the Libertarian 'brand' has been tainted by BOTH parties and the media... they don't talk to non whacko libertarians... just the extreme ones... and then harp on the 'nutty' position, not the postion that a lot of Americans would agree with.... in an effort to maintian the Power Stranglehold the Status Quo provides for the Two party System....

This is excellent advice. It's a pain in the ass to go through and edit the comments that contain quoted material that, for obvious reasons, I want off the blog. It is much easier to simply delete those comments too. So if you don't want your stuff deleted, don't quote comments that are obvious banhammer potential.

I don't believe they had cocaine in the colonies in 1776. As for the hemp that was for rope, which, among other things, were called "naval stores" then. They were a huge money crop for the colonies.
But you were right about one thing, there were VERY few laws on the books then. But they also had a lot of "unwritten" laws that were enforced by the public.

This is why I think that Homosexuality is linked with other mental disorders, due to the high suicide rate, even in cities like San Fran. Also the high alchoholism rate, the binge drinking, the drug use, the prostitution, and the high domestic abuse rate (higher than in muslim countries)

Welcome to the club. Lots of people left their local Presby church in the past 15 years. I don't understand why some of the libs didn't just become Unitarians or something, rather than insisting on watering down the Presby until it stood for nothing but "hippy Jesus, hatred for the conservative members, and polo shirts"

As a rule, it is best not to quote comments that need a good banning or cleanup. It's better to refer to them by hash and timestamp. That way the mods know who you're talking about, but you don't cause confusion once the offending comment is deleted.

Yup.... I think the real libertarian (small L) defense policy is Pro Strong Military... but with a different standard for use....
First... Congress would have to declare war... then using your mobile military, you hit their economic infrastructure, and destroy their military, until they surrender.... then after a VERY short tranisition period... you go home.
If they get Froggy again? and attack you? Rinse... repeat...
But part of the Libertarian position is the idea that people MUST take responsibility for their Government... thus when you wage war, its against the WHOLE country, citizens included.... not just the 'modern' US thing where we can somehow bomb the government , but 'like' the people?

Cocaine wasn't around then idiot, it was a synthetic invented in Germany in the 1850's
Whichever drugs were around, they were legal. That's the point.
Prostitution needed no laws because people cared about morality, unlike todays amoral Atheists

Its not going to be the current Libertarian party which gains ground.... it will have to be somthing like Perot's Reform Party.... which did get 15% or so?
Republican brand is tainted by their history, and whats going on in Congress now.... Libertarian brand is tainted by Press and Both partys (just as they have tainted the TEA party into ineffectivness, note, no TEA party rallys in the news the last year or so?)....
But there are a LOT of disaffected folks out there.....

The question is damages.
The link has another link that discusses it. Might be difficult for Zimmerman to claim he suffered greatly as a sole result of the NBC malfeasance after he had already been demonized on every other MSM outlet.
Those weeping over St. Treyvon had characterized Zimmerman as a racist psychopathic murderer well before the NBC broadcast was ever aired.

Yes. Community enforcement of cultural norms reduced the need (real or perceived - I think the former) for a lot of government regulation. That is one reason why I am increasingly convinced that the modern libertarian dream of freedom from both other peoples' morality and from government control is unrealistic.

One would hope but even a doubling of their voters at the national level gets them to, what, 2%?
There are a lot of libertarians that don't vote, because they aren't crazy.
There is a cascade effect like there is with most things. If you could somehow show a libertarian candidate was actually viable, he'd get more than 2%.

Fairly limited Military Operation to rescue Hostages.... no problem with that in my view.... but when you are overthrowing Governments of UN Member States, and 10 year long occupations without any Declaration? Thats not even pretending to follow the Constitution...

Read the link. Augustine and Thomas both WERE sainted, and both advocated for legal prostitution as the lesser evil.
All that shunning back before the law had the same effect it the law has today - it still happened, it just happened in the shadows, or 2 miles outside town limits.

Washington, Washington
Six foot eight
Weighs a fucking ton
Opponents beware
Opponents beware
He's coming
He's coming
He's coming
Let me lay it on the line
He had two on the vine
I mean two sets of testicles
So divine
On a horse made of crystal
He patrolled the land
With the mason ring and schnauzer
And his perfect hands
Here comes George
In control
Women dug his snuff
And his gallant stroll
Ate opponents' brains
And invented cocaine
He's coming
He's coming
He's coming
Washington, Washington
Six foot twenty
Fucking killing for fun
Spread, spread
The Delaware
He's coming
He's coming
He's coming
Sue me if I go too fast
But the sons of his opponents
Wished that he was their dad
Got a wig for his wig
Got a brain for his heart
He'll kick you apart
He'll kick you apart
Ooh!
He'll save children
But not the British children
He'll save children
But not the British children
He'll save children
But not the British children
He'll save children
But not the British children
(drum sounds)
He had a pocket full of horses
Fucked the shit out of bears
Threw a knife into heaven
And could kill with a stare
He made love like an eagle
Falling out of the sky
Killed his sensei in a duel
And he never said why
Washington, Washington
Twelve stories high
Made of radiation
The present beware,
The future beware
He's coming
He's coming
He's coming
Did I mention his four nuts?
Well he also had four dicks
If you took off his boot
You'd see the dicks growing off his feet
I heard that motherfucker had like thirty god damn dicks
He once held an opponent's wife's hand
In a jar of acid at a party

They're the same thing. You're just saying freedom is unrealistic. Economic redistribution is a moral thing, based on the morality of egalitarianism. It's a different and larger group at the federal level, but the same thing.
If you think freedom is unrealistic, I guess you're entitled to your views.
There's 1 major distinction between an amish village and the government - the amish village isn't imperialistic and expansionist. They let Vegas be Vegas over in Vegas, so long as it leaves them alone back.
If you're arguing against drugs and prostitution in your local city hall meeting, guess what, I won't oppose you, because I won't even be there. If I was there, and I didn't like it, I have the option of leaving the town and getting freaky down the street.
Arguing against drugs and prostitution at the federal level is something very different. You're basically just being a shadow government of statists then. If you want to be free you need to leave the village down the way the hell alone, regardless of what moral perversion they foster. Otherwise don't bitch when the Washington D.C. community comes along and 'enforces it's cultural norms' on you from 6000 miles away.
