30 Congressmen Sponsor Resolution Directing Lawsuit Against Obama Alleging Failure to Execute the Law Faithfully
— Ace

Particularly with respect to Obamacare, but it also cites Obama's executive lawmaking in the case of nonenforcement of immigration laws.

"President Obama has adopted a practice of picking and choosing which laws he wants to enforce. In most cases, his laws of choice conveniently coincide with his AdministrationÂ’s political agenda. Our Founding Fathers created the Executive Branch to implement and enforce the laws written by Congress and vested this power in the President. However, President Obama has chosen to ignore some of the laws written by Congress and implemented by preceding Presidents," [South Carolina Congressman Tom] Rice wrote in a letter to fellow House members to ask them to co-sponsor this resolution.

"This resolution allows the House of Representatives to bring legal action against the Executive Branch and challenge recent actions, inactions, and policies."

Given Boehner's moves lately, I have a feeling that the leadership will squelch this much-needed effort. After all, there's an election coming up. We mustn't do anything that any progressive anywhere can criticize.

If the idea is to run on "Obamacare is the suck" in 2014, and we're selling everything else we got to fund that bid, this seems like a worthwhile thing to keep. He might refocus it on ObamaCare only, but I doubt he'll axe it entirely.

The IRS thing is certainly impeachment-worthy if they can find evidence that POTUS knew about it and authorized it.  But the other stuff is really a Separation of Powers thing and is probably better suited to litigation.  It's arguably not a "high crime or misdemeanor" for a President to just ignore Congress.  I think in this case the House could file a "writ of mandamus" asking the Supreme Court to order the President to uphold the laws in question.  They would not need the Senate to join this suit, while impeachment obviously requires a trial in the Senate which would not happen in this Senate.

61 Since the genetic code was deciphered in the 1960s, scientists have assumed that it was used exclusively to write information about proteins. UW scientists were stunned to discover that genomes use the genetic code to write two separate languages. One describes how proteins are made, and the other instructs the cell on how genes are controlled. One language is written on top of the other, which is why the second language remained hidden for so long.

“For over 40 years we have assumed that DNA changes affecting the genetic code solely impact how proteins are made,” said Stamatoyannopoulos. “Now we know that this basic assumption about reading the human genome missed half of the picture. These new findings highlight that DNA is an incredibly powerful information storage device, which nature has fully exploited in unexpected ways.”

The genetic code uses a 64-letter alphabet called codons. The UW team discovered that some codons, which they called duons, can have two meanings, one related to protein sequence, and one related to gene control. These two meanings seem to have evolved in concert with each other. The gene control instructions appear to help stabilize certain beneficial features of proteins and how they are made.

89 "So, how are these Hollywood assholes going to shill for obammycare?"

Actually, it's useful to have these various vacuous athletes and actors and singers out there pushing Obamacare, because the hypocrisy is easily demonstrated, and hypocrisy is a powerful tool of ridicule. (Remember your Alinisky.) The ads for 2014 and 2016 write themselves.

*snippet of cheery celebutard proclaiming the wonders of Obamacare*

followed by

"One question, Mr. Celebutard. Your own personal health care. You HAVE signed up for an insurance policy yourself via the exchange Web site?"

"Um, er, no. I have health insurance through the Screen Actors Guild."

Repeat over and over with different Hollyweird types. The point will speedily get across even to the most airheaded, low-information TMZ fans.

"They say Obamacare is great. For _you_. But they don't want anything to do with Obamacare for themselves. Wonder why not?"

Gentlemen:

Are we all now warmed up to who the problem is?  Luckily for us, it is those who are running the party.

All we have to do is outwit them.  I have no particular ill will towards Boehner or Ryan, for now, and I understand that this was a political strategic move on their part.

But it is awful strategy.  This is why we keep losing elections.  Not only that, but the fucking guy trashes the base while he's serving us this shit sandwich.

If he had just said this was their political calculation, and it's not a good deal, that would be on thing.  I'd disagree and think he'd still need to be replaced with someone who has a better strategy, but I would respect that.

But to sell this as any kind of real "deal" and then trash the very people who do the heavy lifting to get the GOP elected across the country?

The Republican leadership, like the Democrat leadership, tends to come from the leftest parts of the coalition making up the party. This is then exacerbated by the isolation from normal people that DC brings as that also pushes politicians further to the left.

145 So far as the lawsuit on "faithfully executed" is concerned, bravo, long since past time, let's round up more co-sponsors and make it happen.

I had originally said that Obama should be impeached, on several grounds, one of them being his failure to faithfully execute. Another being his IRS abuse.

So here's a thought. Lawfare the jugeared fuck until he can't see straight. Not only proceed with the lawsuit, but also keep on with the impeachment regarding the IRS issue. Which is hugely difficult for Democrats to deal with since they themselves insisted on an article of impeachment against Nixon for precisely that.

Make him have to deal with impeachment proceedings AND a separate civil lawsuit both simultaneously.

If the guy is having to spend most or all of every working day in a frantic huddle with his attorneys, that's a whole lot of damage he won't be getting around to doing.

Of course, Reid's Senate won't vote to remove him. That's not the point here. The point is to use the impeachment proceedings to turn over wet rocks and shine bright lights. To use subpoena powers to get Obama's worst Nixonian crap permanently read into the public record.

His polls on "trustworthiness" and similar metrics are sinking fast. Throw him an anvil.

AmishDude,

Yep.  That's why Levin was so dead on.  This whole thing is a kabuki theater fucking joke. $2B a year in "cuts" on a $4T annual budget?

Romeo,

I understand that, but I would think that a Pres. has some pull w/ his own party in congress...

I hate to say it, but the only proper procedural action by the House against a president is impeachment. An ordinary suit by another political branch against the president is procedurally improper as it constitutes a political issue.

The House should instead bring a suit solely against the administrative personnel who are following executive orders rather than the written law.    In a suit against the agency personnel, the court would have to rule whether the executive orders were illegal in the first place.  That would address the issue, and the suit would not get dismissed, but admittedly lacks the PR quality of a suit against the president.

172 Private communications between parties is not usually seen as public domain information. It gets really complicated with tech. Your plaintext email is sitting on any number of email servers in between you and the recipient. Most (if not all) of those disclaimers on emails that say "delete if you're not the intended recipient" have no force of law. If you want it to be private, look into PGP. Otherwise, you're Obama-d.

185 Why sue this Adm.?  Draw up The Articles of Impeachment and let 'er rip!  How many impeachable offenses does this dumbass have to commit before the repukes in the house wake up?  The public is very rapidly tiring of this whole mess and those people who have firing synapsis have lost ALL faith we ever had in government and it's institutions.  It is a very dangerous situation that, at this point, I am not so sure can be fixed.  We are burning our tomorrows.

Won't happen even if President Obama appoints his dog Bo to the Supreme Court. Or barbeques Bo over an open spit on live television. Or takes a selfie of himself performing an unnatural act on Bo and propagates it across the Internet.  Or drop-kicks Bo from Air Force One. Poor Bo.

Just like if I told you a secret and you told someone else. Not much that can be legally actionable there (MAYBE common law copyright, MAYBE, but good luck.) Well the Dear Congressman is relying on --

"He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; <strong>he shall take Care that the Laws be faithfully executed,</strong> and shall Commission all the Officers of the United States." -- Article II Section III

But the resident Marxist will rely and execute this --

He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in <strong>Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper;</strong> he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.

That marxist can create a disagreement ("Leave no crisis unused") then invoke the adjournment provision so provided. Another words he could manafacture a situation to shut congress down permanently.

195 It's baloney.  Congress can't sue over that.

The Courts will not intervene in what amounts to a political dispute.  Congress has impeachment, which is worse than useless with a Senate under Reid and populated with at least 34 Democrats who will defend Obama to the last.

Elections matter.  The goal is to change policy, not get revenge on Obama.
