— Ace Oh let's put off the video metaphor for now, because it's a real closer.
New Mexico's Supreme Court rules that people must set aside their religion in order to avoid creating the slightest inconvenience for gay people. It calls this "the price of citizenship."
The court said that Elaine Huguenin, the photographer, had discriminated against gay customers for not photographing their weddings, even though she had said she would be happy to take their pictures in different contexts. The court also refused any differentiation whatsoever between homosexual and heterosexual conduct under the law, despite the fact that same-sex marriage is not licensed in the state of New Mexico. Justice Edward Chavez wrote, “The difficulty in distinguishing between status and conduct in the context of sexual orientation discrimination is that people may base their judgment about an individual's sexual orientation on the individual's conduct. To allow discrimination based on conduct so closely correlated with sexual orientation would severely undermine the purpose of the NMHRA." In other words, orientation and conduct are so intertwined that to discriminate against activity would be to discriminate against the person -- an odd line of logic, given that it would then follow that discriminating against religious activity would constitute discrimination on the basis of religion, making the court's logic self-defeating.Justice Richard Bosson wrote, in concurrence, that the Huguenins are “compelled by law to compromise the very religious beliefs that inspire their lives.” He concluded, “The Huguenins are free to think, to say, to believe, as they wish; they may pray to the God of their choice and follow those commandments in their personal lives wherever they lead. The Constitution protects the Huguenins in that respect and much more. But there is a price, one that we all have to pay somewhere in our civic life.” That “compromise,” he wrote, “is part of the glue that holds us together as a nation, the tolerance that lubricates the varied moving parts of us as a people. That sense of respect we owe others, whether or not we believe as they do, illuminates this country, setting it apart from the discord that afflicts much of the rest of the world. In short, I would say to the Huguenins, with the utmost respect: it is the price of citizenship.”
Yeah, they could compromise their religious beliefs, or, you know, the gay couple could simply find another photographer. No, by all means, let's use the power of the state to reach as deeply as possible into people's lives instead of just telling the gay couple to "Look online for ten minutes and find someone else."

I mean, anyone not in the media, Democratic Party, or New Class.

I'm a longtime supporter of gay marriage. Count me among those who argue that the Fourteenth Amendment requires that option.
Count me also among those who say that marriage is an intrinsically conservative institution. (As some liberals in the first wave of gay marriages are now learning to their horror, leading promptly to a wave of gay divorces. What? It's not all about fabulous receptions? You mean I can't casually fuck whomever I want at the drop of a hat any longer without busting up my marriage? Waaaaaah!)
But, while I find that I have to uphold gay marriage rights, I'm also uncomfortably aware that I'm ending up in the ranks with people who I find otherwise repugnant. To include those who Will. Not. Ever. Stop. trying to use government to force everyone else in society to bend a respectful knee to their sexuality.
At that point, Fourteenth Amendment rights start to run afoul of the First Amendment rights of the religious in particular, and as far as I'm concerned, there is a priority scale operating here.
Freedom of association, that often overlooked principle, is also at risk. One cannot have freedom of association without a corresponding freedom of disassociation.

Back in 2008 when Proposition 8 (marriage solely between one man and one woman) was passed in CA, the usual suspects came out (no pun intended) and protested in front of several Mormon churches. Here's the thing: there are several megachurches in South Central LA with mostly black congregations. These churches actively asked that their congregants vote yes on Prop 8. And roughly 70% of black CA voters voted yes. One could argue that it was (black and Hispanic) voters who got the proposition passed.
But were there any Leftists protesting in the hood? Don't make me laugh. Cowards.

As much as we may want to fight the battle on class and economics, right now the Dems have been very effective at dividing us up by race (mainly because they've been able to get away with no push back I think) and unless you can get a really charismatic populist leader that can cut across those racial lines and realign people's thinking that is going to continue to be the battleground. With 'air rights' you have to buy the right to sunlight and air flow from someone who has it and not using it. Because buildings in NYC have a 'right' to air and sunlight, so if you are going to take that away from someone else, you have to negotiate a price for it.

Heaven knows I don't know NYC building laws, at all, but my understanding is that in order to get a huge amount of tax breaks and variances on height, etc., they are going to build five stories worth of subsidized housing and then the expensive ones above them. I am purely guessing here but I assume that the cheaper places are on the lower levels due to a combination of accessibility and because the higher you go the more expensive the units are.
Basically, they are building two completely separate buildings but all in the same footprint. Thus, two separate doors.
I read somewhere that this builder has received tens if not hundreds of millions in tax breaks for doing similar things in the past.

To explain it a bit further, the low income housing units are subsidized units. The city pays the developer to build them. They are in 'the back of the building' away from the view of the river and will have a separate entrance off the 'back alley'.
Quite possibly being walled off from the rest of the building. There is also some kind of deal with other buildings.
This is the next step from Obama's zip code data, or the data base his administration is building to catalog the characteristics of any one particular neighborhood to see it a certain demographic is being denied the opportunity to reside at that location. It's his 'regionalism' initiative because White Flight Destroyed Detroit.
So if you people won't go to the grittier parts of your community, Obama's administration will bring those parts of your city to your neighborhood because that's the only way to make it fair for everyone.

- Insist on full payment up front.
- Take pictures of the event, but ensure that they are all out of focus or poorly composed.
- Declare an equipment malfunction, but refuse to reimburse the clients due to expenses you incurred during the shoot.

If I'm reading Ken at Popehat right, the answer is "no" because binge drinkers aren't a protected class.

OMG Victoria should be drop kicked. So what has happened is first people were lured away from religion. They were kept from prayer at school, kept from participating in religious exercises at school, saw religion mocked on TV, etc. etc. Church membership and attendance dropped.
Now we have a state which is so secular that religious freedom doesn't enter into most people's minds. On Sundays they do yard work or go shopping. Even soccer leagues and Little League baseball schedule stuff on Sundays, so you are forced to either skip church, find a Saturday mass/service, or skip the game.
Now that we are so secular (or, as I like to call it, pagan) this won't bother a great many people. They will say "What's the big deal?" and shrug their shoulders.
