— Ace MKH recaps the saga.
A few points.
First:
There should be a equity between the type of infraction alleged and the punishment sought. By which I mean: Something alleged to be a social transgression should have social consequences (if any consequences at all).
The game should not be rigged that such that a social consequence has economic consequences, that is, ad hoc privately enforced fines and penalties.
The punishment should fit the "crime" (if there is some crime at all). If Phil Robertson said something "mean," then mean things should be said back to him. If he made people uncomfortable, then people can use their Adult Words to make him feel uncomfortable in return.
We have evolved a repellent system in which thought and belief are punished by tangible economic penalties. And this is not something that happens occasionally; this now happens every week or month.
A firing or a suspension or a forced term in a Thought Rehab institution is now expected when someone Says a Dirty Word.
Second:
I'm weary of the statement "This isn't about the First Amendment because it's a private corporate decision."
For one thing, no one is arguing otherwise. It's tiresome to hear this chestnut trotted out every five minutes. Yes, we get it.
It's also untrue. Yes, the First Amendment, strictly speaking, applies only to the government. But there is a spirit of the First Amendment too, not just a restriction on government action.
And that spirit is this:
That we should have, to the extent compatible with ordered liberty, the maximum possible right to think and say and believe what we choose, and anyone who attempts to use force to coerce someone to think and say and believe something that is alien to them is acting contrary to the spirt of the First Amendment.
I've said this a dozen times:
The real, tangible threat to our right to think and speak as we will, as conscience, faith, or reason (or all three together) might impel us, is not from the government, but from our employers, and from the massively corporate media institutions that impose real penalties on people -- fines, really, imposed by firings, suspensions, mandatory Thought Rehab and so forth -- for daring to utter words other than the Officially Approved Institutional Corporate Slogans.
Yes, A&E has the right to suspend Phil Robinson. A&E also has the right to stand up for a broad and generous principle of Freedom of Thought and Expression.
Why does no one speak of that right? Sure, they have the right to act hostilely towards the spirit of the First Amendment and use coercive power to hammer people into only speaking the Officially Approved Institutional Corporate Slogans.
They also have the right to stick up for people's right to dissent, to be "weird," to have unpopular thoughts and heterodox beliefs. And as a media company, they really ought to have an interest in doing so.
Why does no one ever mention this? Why does no one ever push companies to recognize that right, rather than the other one?
It is well-conceded that an employer has the right to fire you for some heterodox belief or some oddball sexual habit, but an employer similarly has the right to foster an environment of self-expression and freedom, and yet no one seems to talk about a company's capacity to be a Good Actor in the realm of free expression.
There should be pushback against this idea that of course the people with direct authority over us -- our employers -- can and should fire us or otherwise inflict serious economic consequences of it for daring to live as Free Americans.
This is obvious, but apparently it's not obvious enough: We do not need a freedom to express popular or polite thought. Thoughts which are popular and polite (and approved by the state and its supporting institutions) have never been in jeopardy.
Not even in Nazi Germany. The popular, state-approved thought -- that Hitler would bring "Greater Germany" (i.e., Nazi-dominated Europe) back to greatness -- was never forbidden by the Nazis.
Unpopular thoughts were threatened-- such as anti-Naziism.
On both right and left, people interested in sharing their beliefs and arguing for principles should, out of simple self-interest, agree that there should be a broad and generous latitude given to impolite, impolitic, and unpopular thought, granted by not only the formal apparatus of the government but also by other institutions of direct authority and control, such as large media corporations (which tend to reinforce and perpetuate the State Party line, especially when the State has been captured by the Left) and employers generally.
Yes, we can indulge the Left's favorite past-time ourselves and go scalp-hunting with relish.
And what happens when the next scalp sought is our own?
I agree that the Right must not unilaterally disarm in this disgusting sport. Tit for Tat, as Steven den Beste has pointed out, is a logical and effective strategy for dealing with an opponent, even when you disagree with the rules your opponent is operating by. If the Left is never forced to suffer under their own Speech Code regime, they'll never be forced to reconsider.
That said, those on the right, and Friends of Freedom generally, should take pains to point out the sport of scalp-hunting is in fact vile, practiced with vigor by broken people with voids in their souls that can only be filled by inflicting pain on other people.
And we should always point out: We are willing to abandon this head-fucked system of Mutually Assured Terror for Daring to Speak One's Mind the moment the Left is willing to do so.
Which, frankly, will be never.
They secondary boycott, therefore they exist. They have achieved nothing in their own lives, but if they can bring down a Mighty Foe, then they're important.
But we must always offer that Treaty. At every opportunity. Because this War on Individuality hurts everyone who considers himself an individual.
It is time to tell these people, with no politeness whatsoever, to Shut the Fuck Up and stop making life awful for everyone else.
They are enemies of freedom -- of freedom of conscience, of freedom of thought, of freedom of expression; of freedom, generally -- and should be hectored, harassed, and humiliated as such.
They are retrograde simpleton bullies, and bullies requiring the bracing lesson of a punch to the face.

Agreed. My guess is Phil is taking his stand.
I would add a sentiment often heard in Christian circles, which seems appropriate when discussing people of faith in the media:
"We play to an audience of One."

Not often do you find morals and comedy rolled into the same show.
And don't make the mistake of thinking that Phil is some backwoods country uneducated idiot.
Chances are, if Phil had wished to seek the glory, instead of duck hunting, Terry Bradshaw would not have risen to the level he did.
And if I am not mistaken, most of the family holds Masters Degrees, and the employees are encouraged to continue their formal education as well.

Because the current state of "civil rights" laws has our government allowing--and encouraging--the use of government resources to punish others for mere speech, beliefs or association.

But I would love to see this litigated.
And I wonder what the suspension really means. Are they filming now? What real effect does it have, other than to prove A and E's bona fides to the homo mafia?

And yet. And yet...sometimes I feel like they actually do need to be fought. This is one of those instances. I don't give two flying fucks about "Duck Dynasty" or Phil Robertson or whatever Southern/evangelical flag his supporters are waving per se, but A&E's behavior is just so revolting and toxic.
Ann Althouse (and the fact that it's her is significant, as she has a gay son) actually said it best: the guy was only expressing Christian doctrine as found in the Bible regarding sin. He wasn't railing about "damn faggots" or expressing anger or hatred. It was just "here is what Christians like me believe is sin." And she points out that you can't even accuse him of only focusing on homosexuality, because he also included fornication, sex outside of marriage, adultery, etc. etc. Not the sorts of issues my worldview centers around, but still totally legitimate.
I'm sick of this shit. And everyone knows that I'm the farthest thing from a Culture Warrior around here.

There is no 'spirit of the First Amendment' that would impel a company to lean one way or the other when making a commercial judgment as to whether the speech in question would hamper business.
Uh huh. There's no "spirit of the First Amendment" that might compell a media company whose very essence is supported and sustained by the constitutional first amendment to think twice about squelching unpopular speech.

And the answer is yes, RARELY. Rights conflict with each other all the time. When the speech is legitimately damaging, you have a right to compensation if the speaker represents you.

The difference is in what gets categorized as having no redeeming value. Here, it would be the kind of stuff that gets published at Stormfront (I have to rely on others descriptions about what gets published there, since I have no interest in reading that stuff myself). The left and its allied media outlets want to create an environment in which any negative views about homosexuality are treated the same as speech advocating "White Power".
What is the right response to this? The only thing that I think would be effective is boycotts. That includes both primary and secondary boycotts. If A&E is going to shut down speech that reflects our views, then don't watch or pay for that channel. And if Ford (to make up an example with no specific evidence) is willing to advertise on some shows with content we find offensive, but pulls their advertising from shows that we believe are simpatico with our beliefs, then Ford should also be boycotted.

21 has it right--Phil Robertson doesn't care. He didn't care what the world in general thought of him BEFORE he was famous, he doesn't care NOW. The difference is, now he's got a bigger piece of the world's pie in the bank.
He's got his wife, his sons, his land, and ammo. Everything else can shove off.
What sucks for me and Steve the Pirate is, we're going to have to find some reason to tell the little Pirates about why Phil isn't on the show anymore. The Boy v1.0 is already confused about why he's not going to be a Boy Scout, the Sin That Can't Shut Up is permeating EVERYTHING.
All this for 3% of the population.

Just got out of an epic Facebook brawl with some guy talking about how "Xians" should be all about loving people and tolerance and Skittles and Rainbows.... and that Phil was a "H8TER"!!!
And .... get this..... his previous frickin post was about how when some TEABAGGERS were in a courthouse together, the doors should have been locked trapping them inside and then set afire...... like Vlad Dacul would have done. Easy .... quick .... and effective.
It must be so blissful to go thru life with the absolute conviction that you have all the correct answers to all the correct questions.

How come bigotry still exists in more enlightened places? I don't know, maybe because by punishing faux pas, people never really learn why bigotry is bad, just not to say certain things. (That and every new person has to relearn the lessons of the past, which is something the Left has a problem getting in its thick skull.)
We're not children anymore. You tell a child what he or she can't do, and you can get away with "Because I said so!" By the time people are adults, we deserve more than that. The discussions that will take place are going to have many, many uncomfortable directions, for both sides of the political spectrum and for all races, sexes, etc.

Beck said he'd sign these guys before A&E suits got to the letter 'r' of 'fired'. Talk about a coup.
I say let the market speak. A&E can exercise editorial control of its content and its participants can say "FYNQ" while moving to another entity that wants to a) make money and b) make a stand. As long as the government doesn't step in, I'm still OK with the "spirit" of Free Speech getting tested. I'm still in the camp of free speech and freedom of association even if "society" decides some comments won't be carried/permitted on the job. It's clearly a grey area of individual versus corporate (technically another individual) rights. Speech has costs even if it's free. As long as the speech can continue without government censor, then that's the trade-off we pretty much must accept. Maybe not you, Ace, but I think I have to accept the downside. Thoughtful argument on your part, though.

There's a large group within the gay community that's driving 99% of this furor and they don't just want acceptance and tolerance to live their lives in peace, they want to be praised and celebrated for being gay as well.

In fact, they don't happen in this country, outside of a minuscule, deeply disturbed minority.
The converse happens constantly, is reinforced by government, big business and all of the major media companies, and is rapidly being inserted into the public schools as truth on par with the earth is round.

"It is well-conceded that an employer has the right to fire you for some heterodox belief or some oddball sexual habit, but an employer similarly has the right to foster an environment of self-expression and freedom, and yet no one seems to talk about a company's capacity to be a Good Actor in the realm of free expression."
Not really accurate. Employers cannot fire you for your religious beliefs or for your sexual orientation (or for your race or ethnicity), and would subject themselves to claims of wrongful termination if they did so. The problem is that this proscription is never applied consistently. We are bombarded with claims that person X has been wrongfully terminated because of racism, or that person Y has been wrongfully terminated because she's a woman, or that person Z has been wrongfully terminated because he's gay, or that Abdul Rahman Mohammed was wrongfully terminated because he was Moslem. But we never test the proposition that it is wrong to terminate someone because they are Catholic or Southern Evangelical and believe (and have the temerity to express their beliefs) in traditional morality. Which is odd, because Christian believers in traditional morality are now a minority.

What's more, I have no particular issue with people who enjoy sex using The Other Vagina. It's no business of mine.
The problem isn't that people are up in arms about these statements, either: They can be up in arms about any damn thing they want.
The other part of me, however, keeps saying "When tolerance is no longer sufficient then coercion is close behind." Robertson isn't saying that all the gays should die; he's saying that his religion considers it a sin. What's more, even just saying, as I do, "It's no business of mine" is no longer sufficient. Tolerance is not the same thing as acceptance. One should not be required to accept.

I accept that homosexuality exists, although I don't approve of it.
That's stoopid. It doesn't need your approval. Gay guys don't want to have sex with you and you don't want to have it with them.
I had never heard of Phil Robertson until yesterday. I don't need to "approve" of his deeply held religious convictions. I would say that he probably doesn't give a good goddam about my lack of convictions, but as a thoughtful Christian he probably wishes me well and thinks I'd be better off if I shared his.
He has a legitimate point of view and expressed it in accordance with his true self. If teh gheys want to express that their true selves crave intimacy with their own gender that's cut from the same cloth.

Caring about something, and demanding that something be done to change it are two different things. Ace,
When I was in NY, some guy jumped out in front of me and proclaimed "I'm gay!" Bully for him and all, but why exactly am I supposed to care one way or the other about who does what to whom? Would it make any more sense for me to start jumping in front of people in SF and yelling "I'M STRAIGHT!!"? Because I'm not really seeing the difference. I'll wager that I might get arrested for the latter action, and that that possibility is far more likely than every getting arrested for the former action. Yeah, this is something that I definitely get, because it speaks to ME as well. And I'm obviously one of the more pro-gay members of the Horde. But man, I absolutely DO understand that get-your-back-up "aw, FUCK YOU" reaction to the relentless, never-ending culture war aspect of the gay rights movement. I have my political principles on this matter (which are essentially libertarian, albeit with certain qualms about the necessity of maintaining a healthy State), but my emotional reactions sometime trump them when I feel like I see people (traditional Christian values-types, in this case) just getting bullied outright.

A&E could simply have said "his views are not necessarily ours" and 99% of the population would have understood and they would have still had the most popular show on cable, but the velvet mafia was going to make sure it got a chance to make an example and thump their chest.
I love that society has gotten to the point where somebody espousing a Bible verse means they should have their life (potentially) ruined. Had some reality star said something like "Christians are homophobic bigots" do you really think A&E would have fired him?
PS I hope this stays a cultural issue and doesn't become a political one. The idea of Republican politicians talking about homosexuality being a sin doesn't seem like a winner to me, even in the face of this heavy handed jihad against Christians. I genuinely think people pushing back on this is far more effective than legislators weighing in.

Well, on the one hand, they have a RIGHT to do that sort of stuff. But on the other hand, yeah, you have a point: that's definitely pushing it, assuming your account is accurate. Really does seem like transparently 'baiting' behavior, and I just can't stand that sort of shit. Gets to the point I made in #388. I want the same standards of behavior from EVERYONE: I wouldn't want a man and a woman to be french-kissing in front of my second-grader, with their tongues all waggling about, and I wouldn't want two men or two women to be doing it either. But I wouldn't care if a guy and a girl were holding hands or hugging each other so I'm okay with people of the same sex doing it too.

The question to me is why Robertson's comments got such flack when they are essentially mainstream Christianity and identical, for instance, to what the Catholic Catechism teaches (men and women are sexually complementary, gay sex is unnatural and a sin, but the Church calls us to love the sinner and pray for his salvation). To me it's obvious... he had the honesty to use the word "anus." He called attention to what actually happens in male-on-male sex. And the gay lobby can't have that... can't have people noticing that we're talking about things that some people might think are, well, gross. (And things that the Centers for Disease Control consider to be a risk factor for hepatitis, AIDS, etc.)
In short, he called attention to the fact that homosexuality is not all about sipping cocoa in your PJs.

Missing in all of this is the fact that Phil, in his blunt and special way, pointed out the BIOLOGY involved here - he prefers a vagina to an ass. Which requires you to, like, think about it and notice the actual physical differences between the two. That requires thought which leads to the inevitable discrimination, that one of these things is NOT like the other.
And we can't have discrimination. Or thought for that matter. So let's arm-flail and attack him to distract from that.
I use the same line - you claim that hetero and homo sex are "the same", "no different"? OK, let's bust out the anatomy and biology textbooks and YOU can explain how this is so.
Another issue is the gays have to, cough, "get straight" on WHAT exactly causes homosexuality in each case. Until that happens, ya get no special privilege or protection. Sorry.
Unlike race or gender, which are protected classes because they are clearly IMMUTABLE characteristics from birth, sexual attraction or orientation is NOT immutable, and the gays greatest trick is convincing people that it is, in all cases. I give you Exhibit A in rebuttal - Anne Heche (Ellen's ex), who bounces from cootch to cock on alternating weeks.
Frankly, I think some are born that way, others choose it for fun, others are made to do it, or turn to it out of abuse by the opposite sex, others do it as a result of personality or mental issue. See, since it's an ACT, people can perform an ACT for many reasons.
Sex is primarily an ACT - this is how it was historically regarded. Hetero sex was held higher than others because it is the one and only sex act that follows through on the purpose of sex - procreation. All of the others are recreational only. Sex IS primarily for procreation. That doesn't mean that's the only reason, only that it is the MAIN one.
And when gays DEMAND that their actions be considered to have ONE and ONLY ONE cause, with no hard proof to show that, to the point that they want the behavior TAUGHT, and ACCEPTED, and FUNDED and ACTIVELY SUPPORTED, without any contest, lest you lose your job, your reputation or your finances, you better damn well believe I, and most rational people, have an "issue" of our own with that.
If it was just a private matter, I wouldn't even know about it. But they can't feel accepted unless they wear it like a badge 24/7 - call it a Scarlett G.
So spare me the "War on Gays" crap. Take a jaunt to the tolerant Muslim world for a true look at THAT bloody front line.

I remember when A&E had the Metropolitan Opera, or the Boston Pops. It was like PBS with better production values. Now it's full of horrible reality shows, and these Louisiana rednecks are the worst of all.
It would have been worth ending the Civil War with a peace treaty just not to have to live in the same country with them. Or most of you stupid cousin-fuckers in red state trailer parks.
If only our wise and multiracial President, Barack Obama, would do something.

This is an adverse employment decision in contravention of Phil Robertson's right not to be fired for religious beliefs. He should sue A&E, Disney and everybody on up the chain of command. He should force them into discovery, refuse to settle and show them for exactly what they are: spineless shits.
He should (a la Jayne) get the chain of command and beat A&E with it until they understand who's in ruttin' command.
The right needs to aggressively pursue lawfare in every context it can. Conservatives need to leverage the courts against the Self-Annointed Thought Leaders.

I cannot imagine Phil's sons and brother would stand for his being suspended for stating his mainstream Christian beliefs, even if inartfully phrased.
One report said they aren't suspending him for the upcoming season because that is already "in the can" and editing him out would be almost impossible. But by the following season, won't the Professionally Offended have moved on to more recent outrages?
It is possible A&E can claim they will put him on "hiatus," then "enforce" the suspension between seasons, gaining cred with the Complaining Class but not losing a dime - or a star.

the 'reporter" called what Phil said a "Rant." Please. If you want to see full-bodied, spittle-flecked, balls to the wall ranting, visit any LGBT website.

It's a hobby, like crochet or badminton, one's own business. If one gets PO'd because somebody else thinks their religion doesn't accept crochet or badminton, then that one has the problem.

God bless them (but I think He already has).
"We want to thank all of you for your prayers and support. The family has spent much time in prayer since learning of A&EÂ’s decision. We want you to know that first and foremost we are a family rooted in our faith in God and our belief that the Bible is His word. While some of PhilÂ’s unfiltered comments to the reporter were coarse, his beliefs are grounded in the teachings of the Bible.
"Phil is a Godly man who follows what the Bible says are the greatest commandments: “Love the Lord your God with all your heart” and “Love your neighbor as yourself.” Phil would never incite or encourage hate.We are disappointed that Phil has been placed on hiatus for expressing his faith, which is his constitutionally protected right.
"We have had a successful working relationship with A&E but, as a family, we cannot imagine the show going forward without our patriarch at the helm. [Yay!!!] We are in discussions with A&E to see what that means for the future of Duck Dynasty. Again, thank you for your continued support of our family."

Anyway. Glad the family is standing on their principles.

How are you? I mean, how are you aside from being a complete dumb ass?
I'm arguing the type of discrimination Phil Robertson is experiencing is banned not by the Constitution, but rather the laws that Congress has duly passed.
Again, please tell me the difference in the following statements and why one is ok under the law and the other is not:
Statement A: I'm going to fire that employee (or independent contractor) because of their race.
Statement B: I'm going to fire that employee (or independent contractor) because of their religion.
I know this is a dead thread and you're an idiot so I won't expect an answer. Schmuck.

You're free to believe whatever you want.
You're free to say whatever you want.
But any combination of the two neither implicates the Constitution nor any of the laws that protect people from adverse employment decisions based on religion.
In the world Alex, aka BronzeNotSilver, occupies employers are free to fire people for expressing their religious views and that in no way implicates protections against religious discrimination.
This is a fun game. Now, if you can provide any case law on point, I'll be more than happy to read it. Good luck with Lexis/Nexis.
