American Legion Approves Resolutions To Correct IRS Overreach
— Gabriel Malor

I mentioned the other day that the American Legion and other veterans organizations are concerned about IRS targeting. Kansas Sen. Moran got the ball rolling on this issue and now the American Legion convention has approved resolutions to respond.

It's like this. As a tax-exempt veterans patriotic organization, the American Legion has to demonstrate to IRS upon request that its membership complies with statutory limits. For example, at least 75% of members have to be past or present members of the Armed Forces with the rest being "cadets or. . . spouses, widows, widowers, ancestors, or lineal descendants." That last part is from statute.

According to the IRS manual that Lois Lerner's Office of Tax Exempt Organizations uses, this "other members" group that includes lineal descendants is limited to two degrees of consanguinity. IOW, IRS says only sons and grandsons count and that Legion posts can be fined if, for example, their membership includes great-grandsons, stepsons, and adopted sons. The Legion wants IRS to abide by statute, and one of the resolutions that passed yesterday was to seek congressional action on that point.

To give you another example, IRS is using a different set of dates to determine whether an individual is a wartime veteran than have been approved by Congress for the American Legion and the Veterans of Foreign Wars. Because of this manipulation, Legion posts that have been audited have faced the threat of fines from IRS officials who say the posts aren't complying with the IRS manual.

It should go without saying that to the extent the IRS manual deviates from statute no Legion post (or any other veterans patriotic organization) should have to comply. The Legion is working to get IRS to correct its manual or, failing that, asking Congress to step in.

Member of AL Auxiliary--this crap angers me sooooo much.  Since when does an org. like the AL need targeting by ANY gov't agency?  I don't think my dad, uncles, g-father, etc., signed up so this petty, invasive, vicious "oversight" by IRS could be used as a weapon against averagely patriotic Americans.

The American Legion is a large organization and its members vote.  And they know how to contact their members of congress.

 

So yes, I do advise the IRS to go ahead and attack the American Legion because I believe the IRS cannot have too many enemies at once.

But you see, the IRS can issue regulations (like the EPA), and regulations have the force of law, and can even be tried in special regulatory court, and so on. This means that even when a regulation or internal document contradicts a real law or statute passed by Congress and signed by a President, you have to convince a federal court that this isn't a matter for the regulatory court, that you have standing, and the matter is ripe for consideration.

 

By the time this all happens, you've either spent tons of money to defend yourself or give in and negotiate some sort of settlement to limit your damages.

 

One hell of a racket.

141 Oh, just got back from McDonald's. The owner was there. Service was fine, didn't see anyone actually "striking" per se. I did chat with the owner a bit and asked him how things were doing. He said he had enough people on call who wouldn't mind making more dollars to come in and cover anyone who didn't report for work. He also said that the people who would be "striking" would be those he wouldn't mind seeing go anyway, since their job performances are typically in the lower percentiles. Main lesson here...strikes are a more credible threat when you aren't unskilled labor.

I've been a member of the American Legion for years.  I always wondered why we were "non-partisan" when one side supports us and the other mocks us. It never made sense to me that Optimus Prime turns into something that helps him deliver milk to the supermarket and the Decepticons turn into instruments of war. Maybe it's supposed to be symbolic of Autobots' "Purity of Heart."

Look, I'll admit sometimes life happens. We can say "they shouldn't have kids" all we want. But life isn't always that easy- life is messy sometimes. That said, you can't go to work as a cashier at McDonald's and expect that to be your career. Even if you love the fast food industry, you have to hustle your way up the chain. Store managers get paid decently, for instance. Beyond that, simply the experience of getting in to work on time and being reliable can open doors to other opportunities that *are* capable of supporting you.

184 Actually, I kind of love Transformers from the 80s. The oil industry is shown to be good and necessary (the two main human characters both work on an off-shore oil rig) and honorable. The military is shown as good and upstanding (though badly outclassed because alien robots). It's even better than the old GI Joe in some ways.

If "life" happens, and you happen to have a kid as a single parent, than morally, you have an obligation to strive for something more. I realize that this is an unrealistic and idealistic view, but why should unskilled workers be paid $15/hour or more for no other reason than to provide a living wage to support a family? These jobs are ENTRY level positions! I refuse to pay $10 for a hamburger at a Fast Food restaurant just so someone who has no business having children needs to support their family.

197 Wrong on both counts ... The IRS Audit Manual requirement to maintain documentation on membership eligibility has been around since the late 1990's and is nothing new. It came into being after a number of VFW and TAL Posts got caught abusing the income tax laws some 20 years ago. Second, the Sons own charter specifically allows for only sons and grandsons (2 degrees of consanguinuity) of veterans eligible to join the Legion - and includes step and adopted relationships. I believe that resolution was to lobby to allow additional degrees of consanguinuity. You also neglected to mention that The American Legion - which touts itself as a "family oriented organization" - once again voted against allowing the male spouses of female veterans to become part of the Sons organization.
