And He Spake That They Should Be Deemed To Be Covered, And It Was So. And It Was Good.
— Ace

On the podcast over the past few weeks, we've been talking about what happens on January 1st, when people start showing up in emergency rooms due to car accidents or sudden medical crises, and discover they're not actually covered, either because they couldn't sign up at all, or didn't get the check to the insurer in time, or thought, erroneously, that health care was "free."

@johnekdahl ventured a guess: Maybe Obama would just create New Law once again and demand that insurers deem the uninsured to be insured.

It seemed to only be on the outermost fringes of the possible... and yet, as the Day of Catastrophe and Crisis approaches, the Administration seems to be thinking more and more about the Unthinkable Solution.

During the Obamacare rollout, stories have spread about millions of Americans losing their current health insurance coverage, preferred doctors and hospitals as plans restrict networks to comply with the law, and losing their prescription drug coverage.

On Thursday afternoon, the Department of Health and Human Services said it was “strongly encouraging” insurers to help the department fix a raft of problems created by the rocky rollout of President Obama’s health care law.

Among the guidance the HHS announced:

— It is requiring insurers to accept payments until Dec. 31 for coverage starting on Jan. 1.

That's absurd and illegal. They need time to actually have the check clear the bank to actually be paid. But Obama has spoken, and it shall be so.

It is also “urging” insurers to give individuals more time beyond that to pay for coverage.

If you want insurance to begin January 1st, you can pay, like, whenever.

In other words, if somebody pays for coverage in the middle of January, HHS is asking insurers to retroactively make that person's coverage effective as of Jan. 1. HHS is also asking insurers to cover individuals who offer a "down payment," even if that payment only covers part of the first month's premiums.

They go further-- after having imposed "skinny network" coverage on America, the HHS is now "strongly encouraging" (again) insurers to pay for doctors outside of the network. That is, pay for non-network doctors.

So that people don't realize (at least at first) that they will not be keeping their doctor at all.

On a conference call, an HHS spokeswoman emphasized: “We are just proposing it as an option and we’re encouraging issuers. There is no requirement.”

Translation: HHS has a huge mess on its hands and it hopes that by getting ahead of this news, it can foist the blame for the problems on insurers.

This is all very close to simply ordering insurers to "deem" that everyone is insured, as John speculated. It seems that way to Phillip Klein, anyway:

AllahPundit notes that many insurers are complying with the "strong encouragement" of the government shakedown artists, and are creating a special grace period for payment, until early January. Some states are ordering grace periods until January 7, 8, or even 15.

ThatÂ’ll avert lapses in coverage for people who see the doctor early next month, not realizing that their first payment was already due by New YearÂ’s Eve. Remember, though, according to one expert who spoke to Charles Ornstein about this, insurers can probably expect only half of their customers to have paid up by the December 31st deadline. Even if another 25 percent manage to make payment during the grace period, youÂ’re still looking at thousands of people whose coverage will lapse in January. ThatÂ’s a political disaster for HHS in the making. Uncle Sam will have to do something about it. But what?

Deem everyone covered. What else can he do?

Only about half of the people "covered" by Obamacare will have paid by January 1st -- this is largely Obama's fault, of course, because how the hell could they have bought insurance with a non-functioning site?

And there's still more work to be done -- all those fragged 834s will have to be corrected and reconciled by human intervention before tens of thousands of other people are even noted in an insurers' client list.

And Obama won't want to take the political hit for that. So just deem everyone covered.

Just like that. Just make a pronouncement. Just create law by kingly edict.

We are approaching the nation's Monarchical Moment.

98 At what point do the insurance companies just throw their hands in the air and say 'Ok, whatever'?

When the insurance company help desk gets a call from a customer can the help desk just say, "Call Health and Human Services."

When the insurance company gets an inquiry from a doctor or hospital who wants to be paid can the insurance company just say, "Call Health and Human Services"

What happens when an insurance company goes bankrupt and stops paying claims?

What happens if an insurance company says, "OK that's it we're done." and goes out of business, locks the office doors, and won't answer the 'phone?"

116 I have to say that I'm not especially sympathetic with the health insurance companies as they realize that this fustercluck is going to saddle them with absolutely enormous financial losses, for care delivered but not paid for.

I don't see them taking big financial losses.  The opposite is more likely.

Sure, they have to cover birth control pills and other stuff now, but does that really make up for the vastly higher premiums and deductibles?  I don't think so.

They also get some new, government subsidized enrollees and financial bailout guarantees.  Because Too Big To Fail.

Not if they decided to do a top-to-bottom full audit, and audit the executives as well.

If there's any hint of screwy behaviors, and there will be, it can get ugly.  People who had claims denied for BS reasons will come crawling out of the woodwork to tell their stories.

I've seen how BCBS south FL and Prudential Healthcare worked from the inside on contract jobs.  A full blown IRS audit would crush their staff trying to pull information together.

Okay, I know this  "single payer is the ultimate goal"  is a popular meme around here, but I'm going to make a prediction.  The American psyche will not accept single payer,  even if it is made the law of the land.   Whether on an intellectual level or an emotional level, it will not be accepted.   The British were just emerging from  WWII when the National Health Service was founded.  The populace was accustomed to obeying governmental mandates for "the greater good".  They were accustomed to shortages and waiting lists and doing without.  They were accustomed to deferring to experts or authority.  The United States  in 2013  is NOT Great Britain in the early 1950's.   Both consumers and providers will find ingenious work-arounds to single payer.    Mark my words.

The state news agency KCNA said a tribunal examined Jang's crimes, including "attempting to overthrow the state by all sorts of intrigues and despicable methods with a wild ambition to grab the supreme power of our party and state." Too funny. A friend sent me a pic of obama's head photo shopped onto Kirk's body sitting in his captains chair on the bridge of the enterprise, and he's looking at spock and says "Nooo, I think I'll stick with my plan and smash into the sun while firing all phaser banks"

277 And so it begins................From Rueters. Aetna Inc, which is selling health insurance on exchanges, or marketplaces, in more than a dozen states, will allow consumers to pay premiums as late as January 8. The Connecticut exchange, Access Health CT, said some shoppers can pay as late as January 7. The Vermont exchange and Covered California have announced similar extensions while Maryland requires payment by January 15.

278 "243 What happens? The liberal wet dream comes true. Single payer happens. ***** Okay, I know this"single payer is theultimate goal" is a popular meme around here, but I'm going to make a prediction. Posted by: Seamus Muldoon at December 12, 2013 05:55 PM (N/Sup)" There are two ways: 1. A Crisis. 2. 279 The announcement came only days after Pyongyang announced through state media that Jang Song Thaek -- long considered the country's No. 2 power -- had been removed from all his posts because of allegations of corruption, drug use, gambling, womanizing and leading a "dissolute and depraved life." Every part of that is true, except as a reason for his removal. You see this in China too. The CP members ALL keep eyes on each other. They know most of what's going on. They just don't care ... until that person pisses off the Party. Then they release all of that information, and they shoot him in the head.

281 HMO's depend on people getting so frustrated that they just give up and die. I had an HMO (BC/BS based) for a decade and a half. It also covered a couple dozen employees and their dependents. Number of complaints I received in that time? *crickets* None. Nada. Zip. People, in about 12 months or less, would kill for the affordable coverage we had at the premiums I paid. Jack Nicholson, in 'As Good As It Gets' (spit) did HMO's a disservice. Not for everyone, maybe not preferred by those who depend on them for remuneration for a lifestyle they desire, but cheap, affordable insurance for tens of millions.

I meant that people would not allow single payer to be enacted because no matter how many soothing speeches Obama gave on its behalf, it would be too risky to believe any of it. Despite Obama's foot-stomping declaration that Obamacare won't be repealed, I would bet that happens before we went to single payer.

Let's step through this, shall we?  Someone stated that HMOs work on a business plan of people getting so frustrated that they give up and die.

You reply that you had an HMO plan for a decade and a half with no complaints at all and then take a swipe at people not liking them because they don't pay to support a lifestyle that person would desire.

I then point out, none too subtly I should note, that my professional experience is rather the contrary to your stated position.

You were the one who tossed out there as fact that yours was happy super awesome.   I pointed out the contrary.

Let us move on to your new analogy.   Nope, not all internet vendors are bad.   But some are.   You had an excellent HMO.   Not all are.

You do comprehend that we are both discussing this matter from a  confirmation bias standpoint, yes?   You never heard complaints therefore you extrapolate out that all HMOs are good.   It is rather tautological to note that my old firm dealt with improperly handled claims.   I mean, if the claim wasn't handled improperly, there was no cognizable suit.   Therefore, I extrapolate out that most, if not all, HMOs are bad.

Confirmation bias.

292 At least as of earlier this week, if you paid on 1/15 in Maryland (anytime after 12/15 at one point), your coverage would be effective 2/1. This news undoubtedly will throw a wrench in that. Sigh.

294 Therefore, I extrapolate out that most, if not all, HMOs are bad. And based on my experience as a somewhat self-reporting savvy consumer of insurance products I think that 100% of HMO's are good. I have no experience to indicate otherwise. Arm wrestle for the win? With jello or baby oil? Small inflatable swimming pool?

297 Your lucky but that is just not the case. HMO's on;y make money by constricting networks and limiting treatment. There ain't no free lunch and never was My wife is covered by an HMO. I have compared the Drs available to her under the HMO vs a 'higher tier' plan. They are the same. The MAJOR difference is that an HMO will require a second opinion before permitting an expensive procedure. Now I can't speak for you, but I'm kinda comfortable with my wife seeing a second Dr before getting a bodily organ removed. Some people, of the more litigious variety, may see that as 'denial of coverage'. I see it as a protection of her health against unnecessary procedures. I don't see a single medical professional as some sort of infallible 'God'. I suspect that is why we are in the mess we are in. Some people do, I don't.

301 De facto single payer is here, I told you so. The time period of sending in the check to initiate your health insurance policy is sliding into the future, where that slide stops is up to Obama. Merely choosing a plan via the website is all you need do to establish your intent to purchase it. If it were up to Obama, and it is, the taxpayer will cover the bill until you settle up with them. Why? Because you can't in good conscience leave 5 million more people uninsured. When will that be? Depends on your ability to pay. Who determines that? Obama. It was all planned, just like 5 million people losing their insurance coverage. It was all planned. When the next 80 to 100 million people lose their employer sponsored plans, the same will be done for them. The doctors, nurses and the hospitals will be paid and the government will write the checks. The health insurance companies are merely the pass through agents receiving a fee to arrange the payments. The Law only failed IF you actually were stupid/gullible enough to believe the lie about keeping your existing plan. In fact, the Law is a success as it is doing exactly what was planned, to usher in single payer for a universal socialized healthcare system.

302 They'll have to pull the plug,on this mess at some point. You can see how many many middle class cannot afford Obamacare if you look on  the facebook Healthcare gov page. There are new complaints everyday. It's ridiculous. And, of course, those Obama followers are advising them to do things like,  move to a different state, for better rates, quit their jobs, so they can get on Medicaid and even lie about the amount of money they earn.  Anyone who supports this has to be either nuts or a criminal.
