Another Day, Another Scandal

Hundreds of federal employees were given advance word of a Medicare decision worth billions of dollars to private insurers in the weeks before the official announcement, a period when trading in the shares of those firms spiked.

The surge of trading in HumanaÂ’s and other private health insurersÂ’ stock before the April 1 announcement already has prompted the Justice Department and the Securities and Exchange Commission to investigate whether Wall Street investors had advance access to inside information about the then-confidential Medicare funding plan.

Oh, good. Eric Holder is on the case. I feel better already.

If only because it's been going on FOREVER, and no one ever seems to care.  I think it's because the average American assumes insider trading is the norm.

FWIW, this is why I do mutual funds.  Someone else's ass is on the line and no one can ever accuse me of knowing anything. (And I get to blame someone else when it loses but say "see I chose the right fund" when it wins.)

Combining info from the linked WaPo story and an earlier WaPo story, here's what happened:

 

- In mid-March, a decision was made to bribe Sen. Orrin Hatch (Not Exactly R-UT) into supporting an as-yet-unidentified Obama appointee by increasing Medicare Advantage funding by $8 billion.

- At least 446 employees of HHS were made aware of at least the MA decision.

- On April 1, shortly before the close of the markets and before CMS made the announcement, a DC-based brokerage firm leaked the MA decision.  That caused a spike in trading on several health insurance firms involved in Medicare Advantage.

- CMS appears to have moved up the announcement of the decision to give cover.

Let me fire up SCOTUSblog.  They're already done for the day and ruled on a couple of items:

 

- They unanimously ruled that arbitrators can authorize class arbitration essentially out of whole cloth when the parties agree that the only recourse is arbitration and the agreement is silent on the issue of class arbitration.

- The liberals (original definition) plus Kennedy ruled that criminals have to be sentenced based on guidelines that were in place when they committed their crimes instead of stiffer guidelines in place at the time of sentencing.  That is an overturning of a 7th Circuit ruling.

- They unanimously ruled the raisin producers challenging the federal "must waste part of the crop or be fined" regulation may pursue a takings case.

Try calling her office...often times on high-boil legislation, there will be a staffer logging calls, with a simple count of FOR vs. AGAINST.
