When he showed it around, he got immediate buy in from the Gang of 8 (and other Democrats, too, I'll bet) and immediate pushback (of the: "well, you might want to change X" sort) from most Republicans. He then did what most people do- hung out with the people who agreed with him. As that happened, and he started getting more forceful push-back (especially from constituents), he "bent his neck" and refused to yield- losing all sight of reason.

I'll be less kind.  Rubio wanted his big bone to hispanics to be the DREAM Act.  Then Obama pulled an end around on him by implementing it via EO.  So with that out of his hands he went desperately flailing for anything he could appease Hispanics with.

 

And you know its not even just that he's full on the amnesty train.  Its that everything he's claimed that the bill would do has been shown to be absolute bullshit yet he continues to deceive.  Not to mention his willful ignorance in refusing to believe any evidence to the contrary to his fantasy that Hispanics are natural conservatives.

That is what you need the convening authority flag officer for. He does. In short, take away the convening and overturning authority if one wishes, but in that case, take it out of the military system too. Otherwise, folks like Gillibrand just want to make it easier for unsupported charges a civilian DA would never bother with to result in convictions in a military system, via use of charges that have no civilian equivalent. In for a penny, in for a pound. You want to use the military system's ability to bring charges based upon "failure to be an angel", then honor the *entire* system, which means flag officer convening power.

On the other hand, an activist court that is impossible for the military combat line to counter can so disrupt good order and discipline as to render the military mission impossible to execute, and that is just a fact.
