— DrewM The prosecution wrapped up their case last week and before starting the defense, Gosnell's lawyer asked for the judge to dismiss the charges.
He dropped some but left others.
GosnellÂ’s defense attorney asked the judge to drop three of the charges for killing the babies and the judge agreed with the contention there was not enough evidence to convict Gosnell on those charges. He still faces the other charges the prosecution has brought and the murder trial will continue on them. The judge also dropped five counts of corpse abuse at the request of his defense attorney Jack McMahon.
Nothing to see here, move along citizen.
[Gosnell] still faces a third-degree murder charge in the death of Nepalese immigrant Karnamaya Mongar, 41, and four counts of first-degree murder for the baby deaths.

Gosnell acquittal on 3 murder counts came after defense argued DA couldn't prove babies were alive when necks severed. Via @jdmullane

Despite my first reaction, while this isn't good for the case (or humanity) it's not the end either. It's not like prosecutors haven't overreached in charging people before and there are still 5 capital murder counts on the table.

Granted, I haven't read exactly what the judge wrote, but isn't the question of whether evidence is sufficient a jury question?

Maybe the judge is thinking there are no records of the babies size themselves and therefore not enough information if the baby was a baby or a fetus and thats why. Liberal logic there, yes.
Still, it seems like the testimony would/should go to a jury. It seems like a question of fact.

Son, we live in a world that has uteruses, and those uteruses have to be guarded by men with forceps. Who's gonna do it? You? You, Lt. Weinburg? I have a greater responsibility than you could possibly fathom. You weep for black fetuses, and you curse the Abortionists. You have that luxury. You have the luxury of not knowing what I know. That a few mother's deaths, while tragic, probably saved some dude decades of child support payments. And my existence, while grotesque and incomprehensible to you, saves irresponsible people from a life without casual sex.
You don't want the truth because deep down in places you don't talk about at parties, you want me on that vagina, you need me on that vagina. We use words like clump-of-cells, pro-choice, late-term. We use these words as the backbone of a life spent denying the truth of something. You use them as a punchline. I have neither the time nor the inclination to explain myself to a man who rises and sleeps under the blanket of the very reproductive freedom that I provide, and then questions the manner in which I provide it. I would rather you just said thank you, and went on your way, Otherwise, I suggest you pick up a pair of scissors, and cut a few spinal cords. Either way, I don't give a damn what you think you are entitled to.

"Cervical dislocation" (and/or decapitation) is how we verify the animals (especially mice) are dead after we do our normal sacrifice method in the lab.
It's almost like Gosnell learned this entire procedure doing animal research then said "yeah sure, it'll work for humans." Which sadly may be the truth behind this.
It seems to me though that at the very least there should have been charges regarding the late term abortions. And yet...
These may have been the weakest 3 of the case though. Remember he was charged with 7. If you have 3 weak ones, you might as well tack them on in case you get lucky. (especially since there are rumors he destroyed records.)

Ok, thanks. I'm not sure what to think of that, as a general rule. I could see it being abused by prosecutors.
As for the three dropped charges, I suppose it's like if you were in a shootout, and seven people died. You have witnesses that see you shooting 4 of them while they were standing, but the other three you were seen shooting into their bodies as they lay on the ground. Did you kill them? Maybe, but there's not enough evidence that they weren't already dead. Maybe they had a heart attack or something.
Yeah, it makes no sense, but most of what lawyers do doesn't make sense to me.

Also you do realize that, in this case, jury nullification would mean that he's acquitted, right? I mean, of course you do, you cannot possibly be advocating something else. Not at all. Why, it would be unbelievably rude, not to mention totally idiotic, to make statements that tip toe right up to the line of advocacy for wrongful actions whilst in someone else's sandbox.
Why don't you save your ire for those who actually do find this fine and not for me? How about that?

If collecting baby feet in jars is not an act of corpse abuse I am Princess Diana.
But if aborted babies aren't HUMAN, then can their feet really be corpse feet? Wouldn't they just be "foot-shaped clumps of post-differentiated tissue?"
I hate these people. I HATE them. There is not a fire in Hell hot enough to burn away their profanity. I am heartbroken that those three little babies will not have justice done, and even MORE heartbroken that the only ones who will care are those of us right here, right now.

It's unmanly to not actively protect children. And it's inhuman for a woman to allow her child to be killed.
That's where I'm at anymore. I refuse to let my non-uterus-ness-ism be a factor in my defense of the defenseless. Every time I hear someone try to defend a "womyn's Right to Choose," I always ask, "What about the Child's Right to Live? Did you think about that?"
Yes, I'm Pro-Life and a man. Deal with it.

Alex I am not nor did i intend to imply you were taking the part or arguing those points.
And to erase the cryptic.
I am not discussing Jury nullifcation in the case of the People V Gosnell I am discussing nullifying the people versus God's Sword Arm.
I said twice and now thrice "not you" the entire "profession' and not on a personal but rather a structural level on this issue.
This asshole judge is using the worst circular logic in order to as baldi said walk on eggshells protecting the beloved R v W.
I will say again directly, I meant no insult to you or imputation of your condoning or deference to this mess and I value as I have ALWAYS valued your legal insight as in happier moments I hope you've enjoyed my analysis of the Tax code.
This is a hot button topic I usually try to avoid but this is quite literally infanticide so I hopped in and like the first round of the Akin wars I have been inelegant and harmed someone here I care about.
When nature takes its course and Gosnell faces the justice the liberal legal types will thwart I support every effort being made by pro lifers to exonerate the perp who exerts influence on Gosnell.
The "deal' I had made to not condone hard action was "no argument to first trimester and gaining in intensity as the baby becomes more viable."
The democrats can't even allow that deal to stand....and i am angrier at myself than I perhaps inelegantly seemed to cast at you because I caved on a personal belief to "keep the peace" as a boy.
Again Alex I am sorry and not a weak assed "you took it wrong".

Gosnell enjoyed his work. Robert Ressler, the pioneer FBI profiler, interviewed dozens of imprisoned serial killers, including the likes of Kemper, Gacy, and Berkowitz. As a result of his research, Ressler came to dislike the term 'serial killer', feeling that the term was inaccurate, even a misnomer. He preferred the terms 'sexual sadist' or 'sexual murderer' since, in every instance Ressler encountered, the men we call serial killers achieve sexual gratification through the act of murder--and that includes David Berkowitz, the Son of Sam .44 killer, who confided to Ressler that he made up all of that batshit crazy 'Son of Sam' nonsense beforehand so that he could go for an insanity defense if he was eventually caught.
So yeah, Gosnell gets off on murder. Those feet were trophies. So did Dr. Jack Kevorkian, who admitted to feeling a thrill when he watched the lights go out in his 'patient's' eyes.

A "persuasive precedent," not the regular kind.
Some future courts' and juries' knowledge of a guilty verdict on those charges might have freed them (psychologically more than legally) to make similar findings, and that could snowball. Roe wouldn't be threatened, but every specific instance of somebody getting away with murdering Loser babies by claiming it's a Roe-covered medical procedure could be.
And that's not allowed.
Must kill the babies.

This is absolutely normal, people. The state put on its case. Each count has to have evidence supporting each element of each crime. They prosecute multiple crimes precisely because, when the evidence comes in, it might or might not end up being sufficient on some of the elements of some of the charges. Gosnell still has five murder raps against him that are going to go to the jury that's heard all of these horrors. He's not going to walk.

The logic contortions and moral compromises one must embrace to be a liberal stagger the imagination.
For a conservative, it's just 'is this right, or wrong?'
That right there's the difference between Us and Them: we have a functioning conscience that we rely upon to tell us when something is wrong. There's no rationalization needed, no mental hoops to jump through, no moral preening and no pretentiousness or trying to impress others with our "superiority."
They have so such innate mechanism.

Your concerns are unwarranted. Comparing a dead Gosnell to a dead FDR (one of our greatest wartime presidents) and JFK and RFK is missing the mark. He would just be a dead Gosnell. The Left would like it very much, thank you, if the good doctor just disappeared, went away, faded out, never to be heard from again. He isn't a good candidate for martyrdom, dead or alive.

That is, if Gosnell is not guilty, then this means what he did is legal. If he didn't abuse a corpse, then it's okay to store severed babies' feet in jars.
When the police who beat Rodney King were acquitted, the left didn't go, "Oh. Well I guess we lose and that means it's okay." They said it showed police brutality was rampant in LA. And they said that was no longer acceptable to them.
Gosnell's defense is that what he did is normal abortion procedure. If he wins, make the pro-choicers own that.

only some of the charges were dismissed. He is still facing multiple murder charges
Yeah, I got that. I was only considering the ones that were dismissed.
As I understand it (and I'm sure AtC can school me here), if the charges are dismissed, then they're never considered- meaning the judge is essentially saying "Nope, go back and try again." Which may mean the judge thinks the prosecution needs (on those specific charges) to go shore up the case and try again. That is: he might be afraid that if those charges go to the jury, the jury would acquit on those charges- dismissing them prevents that.

@2 Granted, I haven't read exactly what the judge wrote, but isn't the question of whether evidence is sufficient a jury question?
-------------------------------------------
Yes, and no. If the evidence doesn't meet certain basic legal minimums, then a judge can dismiss a charge. The issue in such instances isn't whether facts are in dispute. It's that the facts as presented by the prosecution don't amount to a crime. As a minor example, if a guy was being prosecuted for trespassing, and the prosecution (i.e. not the defense) established that the defendent was on the other side of the city when the trespassing incident took place, then obviously the prosecution has no case and the judge can dismiss the charges before the jury goes into deliberation. There's literally nothing for the jury to deliberate because the prosecution failed to present any evidence that the defendent actually trespassed.
Usually it means that the prosecution either got overzealous in the charges that it brought (something that the Grand Jury is supposed to catch, but doesn't always), or that the prosecution screwed up somehow.

Usually when i feel I have something genuine and needed to contribute I am plain. Last election season I imploded because I figured out in June we were probably fucked and quit sleeping, then when Ryan was given the nod I leapt because I had faith in people between 18-40 being able to grasp the math case for the plan I was certain Paul Ryan would champion and didn't sleep. I screwed up because the Paul Ryan who showed up or was allowed to show up was not the Paul Ryan I had seen on C-Span.
Anyway I differentiate between "dancing shoes" posts and zany posts internally.
When I let my hair down and post what i feel i tend to go 'zany" because well.
What I see coming and what I fear I feel about it are on the border area of being damn near oath breakers. Not always pleasant for me to face, and not really a source of "joy."
Real world example, over the weekend I was invited by a Secretary of a Fraternal Order to join.
I take oaths seriously and Item 2 was "have you ever been or are you now a member of the Communist party?' Okay, no problem. Item 3 was "have you ever or could you ever advocate violent overthrow of the US government?' Problem.
There *are* in fact conditions under which I am duty bound to try to destroy the US government and return the body back to the US Constitution. That ideal and its precedentary roots in the Magna Carta are where our civilizations' ideals on ther ole of government spring from and I feel no shame in holding them.
Long story short I demurred, if it comes to that I'll join the Masons.

I don't. I think the vast majority of Americans have been drugged, bought off, coddled, made impotent or isolated enough that there can be no major rebellion. Small pockets of resistance, perhaps, but those will be tamped down in ways that will make Waco and Ruby Ridge look like walks in the park. And the thought of a true dissolution of the states would terrify the "movers and shakers" so much that they will never attempt it, all Rick Perry's swagger to the contrary.
We're very nearly Soviet America. Give us ten years, say, and we'll have gulags and televised trials of "enemies of the state."
But as I said, I'm a nihilist. I don't expect happiness or goodness.

I don't know anything about this judge, but Philadelphia Common Pleas Court judges are notoriously liberal and pro-criminal. Prosecutors have complained for years, and many heinous crimes have been committed by repeat offenders who were let off completely or given ridiculously light sentences by these liberal judges.
BTW, the Philadelphia DA who brought these charges is black, a Democrat, and very ambitious. And he seemed genuinely revolted and angry when he announced the indictments of Gosnell and his clinic staff.

But really, I am at peace with that knowledge. Really, I think it's overdue.
I have tried to make the people I know (outside my immediate family and gaming group, who feel as I do) understand the horror that is Gosnell, and the window it offers into the mind of the abortion crowd, but they will not see.
They won't even look. They simply do not care.

I can almost guarantee there's a loose service neutral wire or a flaky splice on a what's known as a "milti-wire" branch circuit. When that happens, perceived voltage on each 120v leg of the 240v drifts around depending on the load on each leg.
If the burnouts happen all over the house on different breakers, look to the meter and main panel neutral connections.
If they seem isolated to particular fixtures or lamps, and others aren't affected, look the the multi-wire.
Remote possibility, which I have seen -- poco's transformer is whacked and hitting you with more than 240v at the meter.
You can check this by taking a VOM and checking phase to phase at the panel (or a dryer/range receptacle as they're 240v too) and looking for 220/240 (you may also see 208v if you're in a large building with 3-phase coming in)
Then check phase to neutral on each leg looking for 110/120v
When a poco xformer went wack on me years ago I measured 140v at 120v receptacles, and my UPS's were screaming about overvoltage

---------------------------------
He should be. At the very minimum, even if he's not outraged by the deaths, there's also the better care that Gosnell provided for white women who visited his clinic as opposed to minorities.
He was more worried about white women filing a complaint, but it's an obvious racism angle for anyone who cares to play it up (even though Gosnell himself is black).

I know. No snark or disrespect at all, I understand what you are saying, and I agree. It is a foolish thing for a man (me) to say, and no one can know just how truly horrible that time will be.
But the alternative is this, a den of liars, murderers, thieves, and villains, laughing as they prosper off the labor and misery of others, where reprobates are celebrated, where duty, honor, and righteousness are dragged through the streets, mocked, reviled, and scorned.
A world where a man can butcher infants for a living, and 2/3 of the nation doesn't bat an eye.
Between the two choices, knowing full well that I have no idea how insane it would truly be to see it all come crashing down, I choose the crash. I have no power to effect change to that end, but I acknowledge that it is coming, and that we deserve it.
What else can be done? Sodom and Gomorrah were not spared, and to whom much is given, of him much shall be required.
Who has been given more than the United States, a land absolutely awash in honey and cream, iron and fuel, with freedoms and safety the rest of the world could only dream of as they lay in their cots at night. We had glory, we had riches, we had peace - and we have squandered it.

#453 You are exactly right. This SHOULD produce some very uncomfortable conversations with the pro-abortion crowd. For example, even if Gosnell was right and he was just speeding up the deaths of babies that had been given deadly drugs, and they were younger than 24 weeks, doesn't that still show that these babies were strong enough to survive longer than Gosnell thought they should after he administered the drugs? They basically survived a euthanasia attempt, at least for a while and for longer than expected. At what point does society say that it is still OK to euthanize a baby that is viable and capable of breathing on its own?
Maybe we should stop calling this abortion altogether and call it infant euthanasia. Human euthanasia is not legal anywhere that I know of. We are treating human babies like puppies and kittens.

Some bores are partial to 5.56 or .223. In the garden variety firearms that get less than 500 rounds a year put through them, it doesn't matter. totally interchangeable. Match and precision shooting I'll offer this: 5.56 through most AR clones, .223 through varmint critters.
Bottom line is you need to contact the manufacturer and find out what the bore was designed for. If you're going to spend $7K tricking out a rifle, then you need to deal closely with the manufacturer to reduce barrel wear. Here's a book rec: Navy Seal Sniper by Brandon Webb and Glen Dogherty, fwd by Chris Kyle. It's the bible.

5.56 nato comes in two flavors and frankly the older M193 Ammo and .223 are in some ways arguably better manstoppers than the M885 pound for pound because of tumble ballistics and definitely better than the SS109 against non armor wearing clients.

#477 In Philly some of the judges truly are insane liberals who believe the criminal justice system is racist and stacked against poor people. They let people go all the time on these grounds. I remember reading about one white female judge who would not ever convict a poor black woman for anything short of capital murder. Prosecutors basically threw up their hands and sought plea agreements when they drew her for a trial. Philly also has a terrible problem with witness intimidation, which some judges also seem to tacitly approve. Many trials end when key witnesses fail to show up or are killed.
It would not surprise me at all if this judge is a liberal idologue who believes in abortion on demand, and also believes Gosnell was doing a service to the poor black community with his clinic and that the conditions there were just a result of him trying to operate on the small amounts of cash all those poor women could pay him.

Civilizations come and go over the millenia. It's the way of things. That said, in all human history there has never been a country like ours, one that has enjoyed, celebrated and promoted individual human freedom. We have proved, once and for all, that such freedom is possible, even desirable, and that a nation of free men and women can thrive if its people can say, think, write, and do what they like.

I have a 5.56 barrel, so I'm good either way, it looks like.

5.56 nato comes in two flavors and frankly the older M193 Ammo and .223 are in some ways arguably better manstoppers than the M885 pound for pound because of tumble ballistics and definitely better than the SS109 against non armor wearing clients.

Aye the lake city 885 and 855 are pretty decent ammo, reliable to the 1/5-700 round range.
The steel core AP rounds aren't great on soft targets: tend to just pass right through them leaving a .22 sized hole. NOT a deer hunting round for sure! I have some 193 ball. Having not shot at a soft target in years, I'd prefer that. If the Jihadi has body armor then you want green tip but we rarely got that choice, right?

This doesn't surprise me. Did any followups actually come back conclusive for ricin?

The guy claims that he's been having arguments with people who he thinks set him up and that the government is harassing him.
Can't really say I disagree with the guy given the clusterfuck that has been the anthrax and ricin letter investigations since 9/11.
Guess he wasn't so dillusional after all. Although this incident will surely drive him over the edge. Think of it as Obama's new policy for dealing with the mentally ill. The quicker they go off the deep end, the quicker they're off the books.

Indeed. It's going to be a struggle to change the nomenclature, but this is indeed how the debate is reframed.
I don't know whether it is infuriating or hilarious that changing a person's mind can be reduced to something as simple as a choice in adjectives and verbs used in conversation. What ridiculous people we are...

just contact your barrel manufacturer and get the lifetime based on rounds through it. Have spares. Two is one, one is none.

Fatalism is an entirely good thing in some circumstances. I say embrace it and resolve to go out with verve, nerve and style.

What we have is a Pro Abortion Judge, A Pro Abortion DA and a Pro Abortion Jury in a Pro Abortion City and State.
It is sad to say that I will be shocked if he is found guilty on any of the significant charges.
