BREAKING: Judge Dismisses Some Charges Against Gosnell
— DrewM

The prosecution wrapped up their case last week and before starting the defense, Gosnell's lawyer asked for the judge to dismiss the charges.

He dropped some but left others.

GosnellÂ’s defense attorney asked the judge to drop three of the charges for killing the babies and the judge agreed with the contention there was not enough evidence to convict Gosnell on those charges. He still faces the other charges the prosecution has brought and the murder trial will continue on them.

The judge also dropped five counts of corpse abuse at the request of his defense attorney Jack McMahon.

Nothing to see here, move along citizen.

Update:

[Gosnell] still faces a third-degree murder charge in the death of Nepalese immigrant Karnamaya Mongar, 41, and four counts of first-degree murder for the baby deaths.

Despite my first reaction, while this isn't good for the case (or humanity) it's not the end either. It's not like prosecutors haven't overreached in charging people before and there are still 5 capital murder counts on the table.

16 I've said it before.  We're going to be really angry over the outcome of this trial.   Gosnell has most of the law, R v. W on his side.  I'm not even ruling out not-guilty verdicts on any charges connected to the actual abortions, late-term or otherwise.  He'll be found guilty on illegal distribution of perscriptions.

Maybe the judge is thinking there are no records of the babies size themselves and therefore not enough information if the baby was a baby or a fetus and thats why. Liberal logic there, yes.

 

Still, it seems like the testimony would/should go to a jury. It seems like a question of fact.

Point of clarity, please.  The twitter statement says he was "acquitted."  That's not technically true, is it?  Dropping charges for lack of evidence does not mean anything regarding the rest of the case, and presumably if further evidence could be provided, the prosecution could retry on those charges...

As for the three dropped charges, I suppose it's like if you were in a shootout, and seven people died.  You have witnesses that see you shooting 4 of them while they were standing, but the other three  you were seen shooting into their bodies as they lay on the ground.  Did you kill them?  Maybe, but there's not enough evidence that they weren't already dead.  Maybe they had a heart attack or something.

 

Yeah, it makes no sense, but  most of what lawyers do doesn't make sense to me.

A "persuasive precedent," not the regular kind.

Some future courts' and juries' knowledge of a guilty verdict on those charges might have freed them (psychologically more than legally) to make similar findings, and that could snowball. Roe wouldn't be threatened, but every specific instance of somebody getting away with murdering Loser babies by claiming it's a Roe-covered medical procedure could be.

And that's not allowed.

This is absolutely normal, people.   The state put on its case.   Each count has to have evidence supporting each element of each crime.   They prosecute multiple crimes precisely because, when the evidence comes in, it might or might not end up being sufficient on some of the elements of some of the charges.   Gosnell still has five murder raps against him that are going to go to the jury that's heard all of these horrors.   He's not going to walk.

229 This sort of motion is normal for a trial.  The standard is whether or not there was sufficient evidence presented to the jury to find in favor of the charge.  From the way it was split, it seems likely that there simply wasn't any testimony about the babies in the charges that were dropped.  There was testimony about the SPECIFIC babies that remained in the charges.

I don't know the evidence presented, but that's the normal course of these sorts of thing.  Let's face it -- four convictions of capital murder is the same as four thousand when he ends up with life or the death penalty.

Yeah, I got that.  I was only considering the ones that were dismissed.

 

As I understand it (and I'm sure AtC can school me here), if the charges are dismissed, then they're never considered- meaning the judge is essentially saying "Nope, go back and try again."  Which may mean the judge thinks the prosecution needs (on those specific charges) to go shore up the case and try again.  That is: he might be afraid that if those charges go to the jury, the jury would acquit on those charges- dismissing them prevents that.

Yes, and no.  If the evidence doesn't meet certain basic legal minimums, then a judge can dismiss a charge.  The issue in such instances isn't whether facts are in dispute.  It's that the facts as presented by the prosecution don't amount to a crime.  As a minor example, if a guy was being prosecuted for trespassing, and the prosecution (i.e. not the defense) established that the defendent was on the other side of the city when the trespassing incident took place, then obviously the prosecution has no case and the judge can dismiss the charges before the jury goes into deliberation.  There's literally nothing for the jury to deliberate because the prosecution failed to present any evidence that the defendent actually trespassed.

Usually it means that the prosecution either got overzealous in the charges that it brought (something that the Grand Jury is supposed to catch, but doesn't always), or that the prosecution screwed up somehow.

Usually when i feel I have something genuine and needed to contribute I am plain.  Last election season I imploded because I figured out in June we were probably fucked and quit sleeping, then when Ryan was given the nod I leapt because I had faith in people between 18-40 being able to grasp the math case for the plan I was certain Paul Ryan would champion and didn't sleep.  I screwed up because the Paul Ryan who showed up or was allowed to show up was not the Paul Ryan I had seen on C-Span.

Anyway I differentiate between "dancing shoes" posts and zany posts internally.

When I let my hair down and post what i feel i tend to go 'zany" because well.

What I see coming and what I fear I feel about it are on the border area of being damn near oath breakers.  Not always pleasant for me to face, and not really a source of "joy."

Real world example, over the weekend I was invited by a Secretary of  a Fraternal Order to join.

I take oaths seriously and Item 2 was "have you ever been or are you now a member of the Communist party?' Okay, no problem.  Item 3 was "have you ever or could you ever advocate violent overthrow of the US government?'  Problem.

There *are* in fact conditions under which I am duty bound to try to destroy the US government and return the body back to the US Constitution.  That ideal and its precedentary roots in the Magna Carta are where our civilizations' ideals on ther ole of government spring from and I feel no shame in holding them.

Long story short I demurred, if it comes to that I'll join the Masons.

I don't.  I think the vast majority of Americans have been drugged, bought off, coddled, made impotent or isolated enough that there can be no major rebellion.  Small pockets of resistance, perhaps, but those will be tamped down in ways that will make Waco and Ruby Ridge look like walks in the park.  And the thought of a true dissolution of the states would terrify the "movers and shakers" so much that they will never attempt it, all Rick Perry's swagger to the contrary.

 

We're very nearly Soviet America.  Give us ten years, say, and we'll have gulags and televised trials of "enemies of the state."

 

But as I said, I'm a nihilist.  I don't expect happiness or goodness.

I don't know anything about this judge, but Philadelphia Common Pleas Court judges are notoriously liberal and pro-criminal.  Prosecutors have complained for years, and many heinous crimes have been committed by repeat offenders who were let off completely or given ridiculously light sentences by these liberal judges.

 

BTW, the Philadelphia DA who brought these charges is black, a Democrat, and very ambitious.  And he seemed genuinely revolted and angry when he announced the indictments of Gosnell and his clinic staff.

419 PurpAv - electrical question, I've lost 24 light bulbs since XMas in my house. WTF should I be looking at?

I can almost guarantee there's a loose service neutral wire or a flaky splice on a what's known as a "milti-wire" branch circuit.  When that happens, perceived voltage on each 120v leg of the 240v drifts around depending on the load on each leg.

If the burnouts happen all over the house on different breakers, look to the meter and main panel neutral connections.

If they seem isolated to particular fixtures or lamps, and others aren't affected, look the the multi-wire.

Remote possibility, which I have seen -- poco's transformer is whacked and hitting you with more than 240v at the meter. 

You can check this by taking a VOM and checking phase to phase at the panel (or a dryer/range receptacle as they're 240v too) and looking for 220/240 (you may also see 208v if you're in a large building with 3-phase coming in)

Then check phase to neutral on each leg looking for 110/120v

When a poco xformer went wack on me years ago I measured 140v at 120v receptacles, and my UPS's were screaming about overvoltage

He should be.  At the very minimum, even if he's not outraged by the deaths, there's also the better care that Gosnell provided for white women who visited his clinic as opposed to minorities.

He was more worried about white women filing a complaint, but it's an obvious racism angle for anyone who cares to play it up (even though Gosnell himself is black).

#453 You are exactly right.  This SHOULD produce some very uncomfortable conversations with the pro-abortion crowd.  For example, even if Gosnell was right and he was just speeding up the deaths of babies that had been given deadly drugs, and they were younger than 24 weeks, doesn't that still show that these babies were strong enough to survive longer than Gosnell thought they should after he administered the drugs?  They basically survived a euthanasia attempt, at least for a while and for longer than expected.  At what point does society say that it is still OK to euthanize a baby that is viable and capable of breathing on its own? 

 

Maybe we should stop calling this abortion altogether and call it infant euthanasia.  Human euthanasia is not legal anywhere that I know of.  We are treating human babies like puppies and kittens.

Some bores are partial to 5.56 or .223.  In the garden variety firearms that get less than 500 rounds a year put through them, it doesn't matter.  totally interchangeable.  Match and precision shooting I'll offer this:  5.56 through most AR clones, .223 through varmint critters.

Bottom line is you need to contact the manufacturer and find out what the bore was designed for.  If you're going to spend $7K tricking out a rifle, then you need to deal closely with the manufacturer to reduce barrel wear.  Here's a book rec:  Navy Seal Sniper by Brandon Webb and Glen Dogherty, fwd by Chris Kyle.  It's the bible.

#477 In Philly some of the judges truly are insane liberals who believe the criminal justice system is racist and stacked against poor people.  They let people go all the time on these grounds.  I remember reading about one white female judge who would not ever convict a poor black woman for anything short of capital murder.  Prosecutors basically threw up their hands and sought plea agreements when they drew her for a trial.  Philly also has a terrible problem with witness intimidation, which some judges also seem to tacitly approve.  Many trials end when key witnesses fail to show up or are killed. 

 

It would not surprise me at all if this judge is a liberal idologue who believes in abortion on demand, and also believes Gosnell was doing a service to the poor black community with his clinic and that the conditions there were just a result of him trying to operate on the small amounts of cash all those poor women could pay him.

depends on your barrel specifically the throat .   The 5.56 sets different and because it has higher pressure it could cause a problem.  No problem firing a .223 in a 556 barrel but not always the other way around.

Aye the lake city 885 and 855 are pretty decent ammo, reliable to the 1/5-700 round range.

The steel core AP rounds aren't great on soft targets:  tend to just pass right through them leaving a .22 sized hole.  NOT a deer hunting round for sure!  I have some 193 ball.  Having not shot at a soft target in years, I'd prefer that.  If the Jihadi has body armor then you want green tip but we rarely got that choice, right?
