— DrewM And we have a new city atop the list of Largest US Municipal Bankruptcies. Congratulations Detroit!
BREAKING: Judge Steven Rhodes rules #Detroit is eligible for bankruptcy and the Chapter 9 case can proceed toward debt-cutting phase.
— Chad Livengood (@ChadLivengood) December 3, 2013$18 BILLION in debt. One city.
U.S. Bankruptcy Judge Steven Rhodes determined the city meets the criteria for bankruptcy, ruling the city is financially insolvent and that the filing was properly authorized. He dismissed challenges to Michigan’s emergency manager law and ruled that pensions are not protected by the state Constitution.“The case was filed in good faith and should not be dismissed,” Rhodes said.
Rhodes also ruled the city negotiated in good faith with its creditors, a key point of contention in the eligibility fight. The judge was sympathetic to creditors’ complaints that they did not get a reasonable chance to respond to the city’s proposals, but he noted that the sheer number of creditors — more than 100,000 — made it “impracticable” for Detroit to negotiate with them all.
Earlier the judge ruled that municipal worker pensions were not immune from the bankruptcy process. So it looks like the people who helped bleed the city dry with get to live with the results of their greed.
It takes awhile but eventually this is where Democratic rule leads.
Of course it's not just Detroit. No this is going to be the first in some mega-municipal bankruptcies across the country.
Illinois is starting to try and deal with their out of control pension plan.
[Update - Andy] The left is reacting about as calmly and rationally as you'd expect to a judge's mainstream interpretation of Chapter 9 of the U.S. Bankruptcy Code.
Judge Rhodes, if you ever show your face in #Detroit, please expect to either be beaten or run over. You have betrayed this city. #uniteblue
— Dominic Nanni (dpn) (@dominicnanni) December 3, 2013Honestly, the bankruptcy process provides Detroit its only (slim) chance for survival as a major city. Without it, the years and years of decline will just continue as it withers away.
The whole idea of the bankruptcy process is to provide an opportunity for a fresh start, and I find it highly instructive that the left would rather see the city's last dollar used to pay a union pension benefit than for it to have a chance at rebirth.

The fact of the matter is pensions are never possible in the long run because the paying entity, public or private, is going to be paying people for working as much as they can manage, and you get an increasing number of pensioneers who you're paying for doing nothing.
Detroit has reached the end of that scam as there simply is no money to pay current workers, much less useless pension bills.
Eat it, union goons.

I loled. I'm reminded of a conversation I had back in 2008 with a former friend in which he asserted that the shitty state or urban finances nationwide were equally the responsibility of both parties, and naturally didn't have an answer for how the GOP has had any influence among them.
We actually had a race in Chicago run about that time on the premise that 'Chicago doesn't need a second Republican on the city council.'

Youknow, I feel for the (few) Detroit municipal employees who saw this coming and will be genuinely hurt by this. But I suspect if they saw this coming, they hopefully saved up a reasonable nest egg.
Now, if only we could dig up Coleman Young, reanimate his corpse, and then kill him again. Because I don't care what the Detroit Free Press says -- Coleman Young's fingerprints are all over the city's downfall. Who was in office when these collective bargaining agreements were drawn up and approved, huh?

There's also the fact that judges do occasionally interact with reality in their rulings and reality demands that the pensions be cut. There is simply nothing else to do. In that case, you start with the outcome and work your way backwards to justify your conclusion. I, for one, cannot wait to hear the screeching by the Left about the trampling of state's rights in this area. Cannot. Wait. I'm going to od on popcorn tout suite.

atc, I only know from what coverage I've seen on Fox and blogs the last few weeks and months, but I was under the impression that was the specific issue this case was about. Not the bankruptcy filing itself, but which has precedence.
Most of the opinions I've seen is that bankruptcy has to be handled under federal law because otherwise you have union goons and their party writing protections for their theft schemes at city and state levels.
Posted by: Methos at December 03, 2013 07:55 AM (hO9ad)
Expect for this one to be litigated all the way up to the SCOTUS.
Public sector unions and their pensions are a massive bulwark of the institutional left. If those pensions aren't sacrosanct any longer? Katy bar the door.
Also, there is a second elephant in the room for public sector unions.
Detroit's emergency manager has proposed to discontinue retiree health benefits and dump all of the municipal retirees into the Obamacare exchanges. If that holds up as well, expect MASSIVE fissures to open up between various leftist blocs.
The unions know perfectly well that Obamacare is a shit sandwich and have no intention of taking a bite. But if it looks as though they may be forced into Obamacare anyway, their only alternative is to side with repeal. Which will be most unpopular elsewhere on the left. Oh boy! Is someone bringing popcorn?

NH did, for at least a while. I don't know the state of it now.
But that still leaves two questions:
1) Why should the rest of Michigan pay for Detroit's failure to practice basic fiscal responsibility? Will Flint be far behind?
AND
2) Is bailing out a single city a proper use of state rainy day funds? I would argue no.

What's needed are laws to make all defined-benefit pension plans illegal, since they are in fact nothing but legalized Ponzi schemes, and all existing pension plans converted to defined-contribution plans, in which retirees get paid an annuity based upon their contributions over their working career. Didn't contribute, you special snowflake you? Too bad, so sad, you can go on welfare.

To give you an idea at how untenable all public sector pensions arr all one has to do is look at thr nypd.
Nyc pays 8.7 billion dollars for policing per year.
They pay 4.3 billion dollars for 36k active duty police officers and 4.7 billion for 43k retired police officers. If nothing is done to address this they will be paying over 5.5 billion dollars for these retirees.
Oh and the mayor elect has made it one of his top priorites to give retroacrive raises to the municpal unions.

Current, but not forever into the future. These public pensions are all underfunded, and even if they were being funded as planned, part of the plan is to get 8% annual interest (forever). How does that work when the Fed has being doing what it can to keep 'safe' interest rates below 3% and GDP growth has been around or short of 2% for the last five years (before that, neither were near 8% anyway)?

The really frightening thing about Detroit and places like it is what is NOT on the police radio. The sheer amount of crime and evil that's never reported or detected.
It's routine in Detroit to find dead bodies just lying around in vacant buildings and weedy lots. Bodies that have been there for a while.

Thanks. Yeah, I don't know if they would be "better" than having individuals saving and investing on their own. I'm sure a savvy and dedicated saver and investor could easily beat the rate of return on a public (or corporate/union) plan. But managing one's money in such detail takes skill, and time. A mandatory defined-contribution plan would provide at least some security for its members, and perhaps keep retirees off the welfare rolls.
I think a mix of public and private is the way to go, and pensions should be made portable, i.e., if you change employers, you can either continue in the pension plan you have, or have the net present value credited to the plan with your new employer.

Private pensions just hide the inevitability of defined benefit plans' collapse better because companies can grow much faster than city and state governments (which start big and due to their parasitic effect, fast growth over any period impedes future growth). The problem will still come once they saturate their available market (or someone not wasting money on pensions undercuts their prices). This will always happen at some point because there are a finite number of people on the planet, much less whatever smaller portion of us are relevant to the company in question.

However, if you venture a street or two away, it's effing barter town, and if the rabid wild dogs don't get you, the crack addicts will.

Gut reaction is full field preemption which would be the best case scenario as that's fairly well established precedent. Further gut reaction is reality. That which cannot be repaid will not be.

The problem with McCain is that he is not discerning about his hawkishness. He was all gung-ho for storming into Syria, too. It's not so much principle as habit. He seems to feel that there's nothing our military shouldn't be involved in on the world stage. That's incredibly stupid.

Teachers' pensions are protected in the MI state constitution. Still, as has been said, if it can't be paid, it won't be.
It's unlikely teachers' pensions are fully funded. The dance is the argument between the district and the union is full of fire. In reality, since the district isn't going to have to pony up any money while the clowns doing the negotiating are still around, the pension and retirement bennies go up. But actually funding it is hard. Math is hard.

I've said it before - if you really want to see the Detroit mindset, watch Hardcore Pawn. Yes, it's a "reality" show, and yes, some of it is scripted, but the sense of victimization and entitlement oozes out of the people who come in to pawn things. Every Klan stereotype of the shiftless black is reinforced by that show. And these people vote! Detroit is what it is in no small part because of them.
What I wouldn't give for the ability to strip the electoral franchise from about 50% of this country.

Surviving being a POW is a testament to a person's character but I don't know if I would label that as heroic. Its not that its less than being heroic , just different. Doing something heroic while being a POW would change that which many did . I don't know if McCain did anything that would qualify. And in regard to the surge, it was McCain's ego I believe that had him stand up for the surge based on his criticism when they did not implement it as he wanted. That said it all.

However, when the PBGC takes over, all pensions get CUT to PBGC levels, which are quite minimalist in comparison to typical union pension plans. Just cutting Detroit's pension plan levels to PBGC standards might actually make Detroit somewhat viable. Along with massive layoffs, tax cuts, etc.

And then those benefits cease entirely by law of necessity rather than curtail and sustain. Yes this has been very instructive. Progressivism won't relent until everything is destroyed, the stones are scattered, and the Earth is salted where prosperity once stood. That is the only end for them. All things after all must end. That is what progressivism means, more speedy progress toward that end of all things.

OT, but what the hell is wrong with drivers in Europe? I mean, can they not drive? Is that it? Why are they always having these massive pile-ups?
The story's linked at Drudge, over at Fox News, but here's the gist:
1 Dead, 54 Injured in foggy 100-car pile-up in Belgium
BRUSSELS – About 100 cars and trucks were involved in three pile-ups at a highway in western Belgium in a dense morning fog Tuesday, leaving at least one dead and 54 injured.
Medical workers were working to free injured passengers from the twisted metal of their vehicles hours after the crash, and the fog is making the emergency rescue by helicopter impossible.
The provincial governor, Carl Decaluwe, said one person had died, and that among the 54 injured, five were in life-threatening condition, 11 suffered serious injured while 38 walked away with minor injuries...
I mean, I get it. Dense fog sucks to drive in. But we get dense fog over here all the time, too, and while we do get the occasional serious multi-car accident here in the States, it doesn't happen EVERY TIME we have bad weather. WTF?

No doubt. And to be clear, I think its just a matter of what people believe the definition of heroic is. Not that his actions are not as commendable but they are reactive instead of proactive, which is how I discern what is defined as heroic.

And I think Lorelei's parents died while exploring some archaeological dig in Peruvia. She's not wealthy, and is rather quiet and modest. {eople are often surprised when she just up and wastes zombies using the pencil she's got stowed behind her ear, which she otehrwise uses to scribble notes about interesting bits of flora and fauna she sees during their travels.

Texas has a RainyDayFund that the rinos in Austin want their grubby paws on just as much as the demo squad does. We ain't quite as bad as Michigan, but if the politicorapists have their way for a few years, yeah, it could happen.

Bankruptcy cannot "save" Detroit. It can only set the stage for Detroit to eventually rebuild and save itself. It is difficult to feel sorry for any of the creditors, from the union pensioners to the Wall Street bondholders. The signs have been clear for decades to anyone willing to look.
As Obama is discovering, math be hard, but it cannot be wished away.

Ruh-roh. With the BKs of many California cities and the cities not paying their Calpers payments, I sense danger ahead for Calpers. Oh well, they are managed by a bunch of union hacks and Dems, so they will fix it, I'm sure.
