In an interview with ABC, Bernie de la Rionda suggests when a defendant doesn't take the stand there is something wrong with the defendant and that he must be a coward. This is absurd, and the presumption of innocence in this country is part of the bedrock of the criminal justice system. It's outrageous that a prosecutor would do that. And think about it: have you ever seen a prosecutor suggest such a thing? It never happens.
Angela Corey says, "Nobody just gets a gun out and shoots, even trained police officers. When theyÂ’re on the ground, with a suspect on top of them, they canÂ’t get their guns out that quickly." I thought the evidence was that Zimmerman was being beaten for about 45 seconds prior to firing his weapon. One witness, for example, talked about Martin doing a "ground pound," repeatedly punching Zimmerman while straddling him. A cop wouldn't have been able to get his gun out in 45 seconds? Not only is that silly, it also makes it clear Corey rejects the jury's decision. In fact, yesterday she called Zimmerman a "murderer." (Video below the fold.) This is reckless and unintelligent, since we know that Zimmerman is not a murderer, and it appears to be an instance of defamation per se. The case is over, and there is no prosecutorial privilege. Most importantly, as in the case with de la Rionda, it's an attack on the fabric of our criminal justice system. It's terrible for a prosecutor to do this, and I have never seen anything like it. The proper response is to say "the jury has spoken" and maybe even "now we must move on," but it's clear Corey has no respect for the jury, despite her frequent statements to the contrary.
Prosecutor John Guy said he thinks there was a struggle and that Martin saw the gun "and was backing up." No evidence was presented in court that Martin backed up. Guy just makes this up from nothing. It's unconvincing, and it's disingenuous in that it contributes to the appearance the prosecutors are simply butthurt and that there is no ethical or moral limitation on what they will do or say when going after someone and/or trying to save their own skins. They will stop at nothing. And recall there was evidence presented in court Martin reached for the gun (Zimmerman's recorded statements). There was also evidence Martin had the opportunity to go for the gun (during the "ground pound").
I've never seen behavior like this. I expect it from civil lawyers, but not people with the backing of the state when someone's life and freedom are on the line. You give the other side all the exculpatory evidence; you try your best case, and if you lose you say "the jury has spoken." That's it. These prosecutors are something else.
Thomas Sowell from the sidebar link:
More important than the fate of George Zimmerman, however, is the fate of the American justice system and of the public’s faith in that system and in their country. People who have increasingly asked during the lawlessness of the Obama administration, “Is this still America?” may feel some measure of relief.ABC interview:But the very fact that this case was brought in the first place, in the absence of serious evidence — which became ever more painfully obvious as the prosecution strained to try to come up with anything worthy of a murder trial — will be of limited encouragement as to how long this will remain America.

And exactly what they--in your hometown--will do to you if you cross them.
See, BDLR and Guy are the rule--not the exception--today.
At the end of the night, the prosecutor always goes home to his family; he's got nothing to lose. The defendant? Not so much.
Unless the prosecutor wants bucked down to misdemeanor pleas court forever, he damned well better get a winning record. At all costs.
As TennisLaw said, "you don't get a record like BDLR's by playing by the rules." And you could tell by the shady shit he pulled he was used to getting away with cheating to win.

You know.
Something lost in this is what a mess Zimmerman's neighborhood had become.
Set aside the break in for a moment. At least one person directly saw the fight (not just heard it) and...simply did nothing. They called the police, shouted "stop it." and...did nothing?
In all of this desire to blame Zimmerman directly for Martin's death, shouldn't we note that had any single one of them gone over and pulled Martin off, he'd still be alive? You simply cannot trust your fellow man to be there for you, ever, these days.
(and for the Mother fucking crazies who still think Zimmerman was on top because...well crazy, the same logic applies probably in triple.)

And there was actually evidence that indicates he did not back up. If Martin was backing up then it would not be likely that he would have been close enough for his shirt to be in contact with the gun when it was fired.

They're the prosecutorial vanguard of the future in America. This is how you redeem yourself and become a hero on the Left. You never admit failure and show grace. The Left despises shame and humility. These prosecutors understand. You double-down. This is how you show strength. The belief is that the quality of resistant decency and sanity in a society is a baseline which can be eroded by vicious tenacity. There is solid reason to believe this is true.

When I was on a jury, the judge, the defense attorney, and I even think the prosecutor mentioned that the defendent has no duty to testify and that we could draw 0 conclusions if they chose not to do so.
The guy did testify, which is what earned him a "guilty" verdict.

As a career prosecutor I usually hate to agree with defense attorneys but I'm in complete agreement here; these four lawyers are a disgrace to the profession. Like it or not, states' attorneys MUST adhere to a higher standard of behavior precisely because we have the power of the state behind us. You are NOT allowed to simply make up theories without any supporting evidence (Zimmerman "racially profiled" Martin). You are NOT allowed to advance ignorant opinion as proven fact (Zimmerman could not have pulled his gun out during a 45 second beating). You MUST NOT state as fact something for which there not a scintilla of evidence (Martin was FINISHED beating Zimmerman and was shot only after he was getting off him). How in the hell could ANYONE say as a proven fact Martin was "finished" beating Zimmerman? Where's the evidence to support that?
I've been involved with numerous cases where victims were assaulted by "unarmed" attackers, some of which resulted in very serious, permanent injuries and in one case I personally handled, it resulted in the victim's death after several months in a coma.
Now how's this for advancing personal opinion; I believe each one of these "prosecutors" would have shot Martin if they'd been in Zimmerman's position.
Here are the facts: No one is obligated to simply take a beating at the hands of another. The law does NOT require beating victims to wait to see if their vicious attacker is going to stop. Martin had already broken Zimmerman's nose and banged his head against the sidewalk. EVEN IF there was some evidence (of any kind) that suggested Martin was getting off Zimmerman when he was shot, was Zimmerman supposed to gamble that Martin wasn't going to resume the attack by stomping him? I've seen a security camera video of a man being knocked down outside a bar, beaten and THEN brutally stomped by assailants. Was Zimmerman supposed to simply hope Martin was finished? The law does NOT obligate him to do so.
These four state's attorneys are filth.

This trial should not make you oppose the death penalty. Are you glad Massachusetts doesn't have it and Dzokhar Tsarnaev can't be executed? How about Timothy McVeigh? You want people like him to live? Or Ted Bundy? I'm sure glad that cocksucker is dead.
First degree murder with special circumstances is pretty hard to prove, but when it can be proved, I have no problem offing the murderer. After all, he/she gave the death penalty to the victim(s), usually in a horrible way, and the victims committed no crime and got no trial at all.

This is just like Harry Reid and the other OFA turds who said Romney was guilty of tax evasion and the only way to prove it was to release his tax returns.
Allow me to refresh my memory on this. Harry Greid, (D, Pedo), came up with this accusation at about the same time the IRS was caught leaking documents to the left. Harry claimed that an ex investor in one of Romney's business ventures provided him the documents that proved Romney was a tax cheat...but always refused to make those docs public.
I'm of the opinion that Reid is a lying sack of festering shit, and that someone friendly to the leftist cause in the IRS illegally 'leaked' him some private documents. Just enough to whet his interest, and to give him enough ammo to go public with his accusations.

For the record (pun intended) I have no record.
The fact of the matter is the bulk of DA’s and local prosecutors are flat out despicable people. Before you start in, I said: “the bulk” not all. Their end does not justify their means. Sure, they deal with the scum of the earth; day in and day out. That still doesn’t excuse the “get a conviction at any cost” mentality that exists at many of these little fiefdoms. Real water walkers many of them are, at least in their minds. I was not surprised to see this attitude applied to the GZ/TM trial. Especially since the cause celebre was a liberal one.
Does it sicken me that these people prostituted our principals? Absolutely. Does it surprise me? Not in the least. Once you have had someone who works for City Government get on a stand and flat out lie in their testimony against you, it sort of changes your perspective on things. Many of these people are liars who are only out to make a name for themselves. Often, it isnÂ’t about the truth and what is right with these people. It is all about political posturing and public perception.
Heck, just look at Elliot Spitnswallow up in NY. Need I say more? What a despicable disgrace of a person. I think he used to be a DA didnÂ’t he?
I have never considered myself a paranoid person. I have not seen any black helicopters hovering above my house and I do not wear a tin foil hat. Still, considering the current scandals at the DOJ, IRS, NSA and whatever other acronyms you care to come up with, I have started to wonder just how deep it goes? How long can these people keep burying things? I think more than anything, a very bright light needs to illuminate the true behavior of these people.
Occupoopers, Code Pinkos, Manless manning/Snowbird fans and all the other pond scum aside, I still choose to believe that the majority of our great country is made up of decent people. I think once they finally take note of the stench from the festering sewage that is accumulating in DC, there will be a great flushing? One can only hope.

Ace, rdbrewer, and everybody,
The situation is so much worse than we imagine.
It's worse than our revered Thomas Sowell imagines.
There are MILLIONS of delusional Americans who glance at the basic facts of the Martin-Zimmerman case and conclude that day is night.
I have multiple liberal friends with advanced degrees who are insane over this trial. Incidentally, they are all white, and they are all successful at what they do. Somehow, their highly capable minds are utterly warped on this (and all similar issues). They have not bought into the narrative: THEY ARE PART OF IT.
There is only one hope of eventually defeating this lunacy:
Insistently point out that Trayvon Martin was conducting a thug-attack when he died. - That it was Trayvon's thugery that caused Trayvon's death.
The lunatics MUST be put on the defensive - until they are embarrassed by their indefensible position. They have no idea how insane their position is. NONE. They have no idea that they are obsessed with glorifying the actions of a thug.
Once upon a time it was necessary to call out black-hating or Jew-hating bigots. Those indefensible positions had to be put to shame publicly until those who held them hid them became personae non gratae. Hard to believe, but way back when there such bigots that insanely had no clue that their positions were sick and poisonous. They had to be shut down with public shaming.
We are in a similar age now in regards to the shameless race hustling and race baiting that leads MILLIONS of Americans to glorify a thug and condemn a good and decent citizen who saved his own life in an act of self-defense.
As long as there is fear to call Trayvon Martin the vicious thug he obviously was, the mass insanity will continue. - And not just regarding this particular case.
- We will see countless and endless permutations of this horrifying insanity again and again and again...
Even Fox News has downplayed violence of the "mostly peaceful" demonstrations.

In the post-verdict briefing, Prosecutor Bernie said that this is just the second murder case he has lost in 80 trials.
So, Bernie is good at his job. Makes the case that the evidence was weak.

Let me add to my comment #263:
Ted Nugent. Ted Nugent. Ted Nugent. Ted Nugent.
If you haven't read Ted Nugent's piece at Rare.us, please go read it now.
It's unapologetic, and it is spot on correct.
Nugent's piece is still linked at Drudge.

Once again, you see the fascist mind of Leftists on display. The goal is always to get what they want, regardless of the Constitution or the individual rights of Americans. Theirs really is the ideology of children, fascists, and morons that are unable to see the problem of taking such an unconstitutional action.

Everyone who has ever been charged by her might want to get their lawyers together for a powwow and see if she is abusing her authority as policy. Maybe start putting the evidence out in public to get her unelected. And then try to get her indicted.

Will the attorney general file charges against Trayvon to prosecute him posthumously for a hate crime? Or are they fine with black "kids" beating the crap out of Hispanics because they think they may be gay?

State missed. Double jeopardy in play.

BlueStateRebel,
You cite excellent examples of the sort of paradigmatic expanded liberal lunacy I'm talking about.
However, I do believe people can come around. When reality smacks them in the face, they sometimes wake up.
I have several liberal friends who when they became parents began to HATE the public school system and now advocate a voucher system.

Conservatives lose: we are used to it. Complain. Go back to work and hope and pray there will be another day.

If we actually had a rule of law and a government that abided by it, BDLR, Guy, and Corey would be picking up their last paychecks and would be looking at disbarment
Don Lemon must be devastated that "McDreamy" Guy couldn't charm the ladies on the jury

Prosecutors are nothing but spoiled little rich kids who love the power. They are the cowards. Never saw a crime in any of their lives. Hide behind armed court personnel. Just like many Judges(who are all lawyers!). None the less, the insist on calling out GZ because they could sell the lie.
Corey makes both the All Ugly & All Tonnage Teams for the Prosecutors Hall of FAME.

This is like a team that has the refs give them all the calls, get to start on their opponent's 20 yard line, are playing at home, and shut down the instant replay when it benefits the other team, and they still lose

Zimmerman should go after Corey with a vengeance for intentionally trying to harm him and his name. She knows she's doing damage to him (as she knows the law) and is putting him in danger yet she persists with an explicit smear.
Corey really needs to be removed from legal practice. She is dangerous.

When Alan Dershowitz slammed her and said she should be disbarred, she called Harvard to scream at the administration that if they didn't fire Dershowitz she was going to sue them for libel
Apparently there are still enough sane people at Harvard that they told her that she had nothing and to get over it

CJOffermann said LetÂ’s all band together and Alinsky the Alinsky Crew.
Civil Rights Prosecution of Angela Corey by United States Department of Justice for She Deliberately Withheld Evidence
Civil Rights Prosecution of Angela Corey by United States Department of Justice for the unlawful Prosecution of George Zimmerman for depriving him of his Constitutional Rights of Life and Liberty by the United States Department of Justice, Eric Holder, United States Attorney General in United States District Court as swiftly and expeditiously as is possible.
Angela Corey is alleged to have omitted material exculpatory facts, such as photographs of the wounds on George Zimmerman's head, which go to his defense of "self defense."
She was aware when she submitted an affidavit that it did not contain the truth, the whole truth and nothing but the truth. She deliberately withheld evidence that supported ZimmermanÂ’s claim of self-defense.
I couldn't figure out how to get this comments section a accept the link.
