Deal Reached on Nuclear Option

As I mentioned yesterday, I thought the GOP's highest priority was to keep off the unconstitutionally-appointed members of the NRLB. It looks like the GOP did in fact fight hardest to keep those unconstitutional members off the NRLB, because the deal says they're out.

At the moment, it appears that the deal involves agreeing to hold a confirmation vote for Richard Cordray as the head of the Consumer Financial Protection Bureau, which was created by Dodd-Frank in 2010 but has yet to have a confirmed executive. Barack Obama gave Cordray a recess appointment while the Senate wasnÂ’t actually in recess, angering Republicans who vowed to block Cordray in the next session.

In return, Democrats will only get two confirmation votes for the NLRB, whose recess appointments have been overturned by the 11th Circuit Court of Appeals. It appears that Reid will ask the White House to choose new appointees rather than try to restore the overturned appointments.

The deal apparently requires the GOP to stipulate, in writing, that they'll confirm Obama's next two NLRB appointments, whoever they are.

Did the GOP cave? Well, they certainly gave a bunch. I guess it depends on if you think Harry Reid was bluffing on the nuclear option -- I sort of think he was. But I don't know that.

I think I agree with Drew's take earlier:

Personally, I don't care if Reid pulls the trigger. In fact I kind of hope he does. The filibuster is not ordained by God nor is required by the Constitution. The republic shall endure without it.

And let's face it, the Republicans aren't going to have a filibuster proof majority in the Senate anytime soon. If you want to dismantle major programs, it's going to be a lot easier to get 50 or 51 votes than 60 ever will be. Sure it will be easier for Democrats to make mischief and put them back in or worse. But honestly, a federal government that alternates between growth and repeal of programs is a lot better than one that grows and...grows.

Yeah I don't know how much I want to fight to keep something I sort of want wiped off the books.

I think Drew might have nailed something interesting and important about this-- the filibuster, by supposedly encouraging moderation and supermajority support on important votes, may actually lock-in the inexorable growth of the state.

Maybe we shouldn't fear the "wild swings" in the Senate the filibuster is designed to ameliorate. The only thing that can really slow down the growth of government is a wild swing to the right.

The problem is, the Dems in the Senate have different priorities from the Rs.  Dems want to win on issues, and are actively working to get their agenda passed.  Rs want to be able to engage in reacharounds across the aisle, and will give up nearly anything in order to be able to continue doing that.

 

So whenever I hear "nuclear option" regarding the Senate, I keep hoping they're  talking about actual nuclear bombs.  Maybe small ones.  Just maim everybody, we don't necessarily need them to die.

33 I'll also point out: you don't need the filibuster. Anyone in the Senate can place a "hold" on any nominee which will prevent them from being brought forward for a vote. Which is what Senate Democrats did many, many times with GW appointees.

You know, if you're going to follow this logic, (not that I entirely disagree) except your premise is a bit wrong.

The bicameral legislature and regular order are supposed to prevent wild swings.  And by and large they do.

The filibuster is supposed to prevent a majority party from running roughshod over the minority.  And this is tricky, because in some respects it fails since you can just threaten to do away with it at whim. OTOH, nobody likes doing away with it, so some sort of soft compromise usually results.

I pimp Walker all the time. But lets use Wisconsin as an example. Walker got everything he wanted through the legislature because he had an outright majority of 100% ACU conservative Republicans in both houses. We don't even have 80% of that among our current Republican senate body. Assuming we barely scored 51 seats, we'd really only have 42-44 reliably R senators to work with, and that's assuming we hold our majority through 2016 (Toomey, Kirk, Rubio's seat, etc). So until the mindset changes and the GOP acts like it wants to win, fuck it.

57 If Reid threatened to end the filibuster why didn't the GOPers just point at the map of open Senate seats and say... yeah, so what?  Have you noticed the Dems are acting like they will be in power forever?  All of these employees at the IRS, FEC etc... think they have gotten away with what they did but the next administration could spend an entire 4 your term just prosecuting these people and not run out of legitimate targets.  And that is exactly what needs to be done.

The Pubbies should have traded for something more valuable though.  Frankly, it doesn't matter who is appointed to run these bureaucracies.  The little apparatchiks who work there know who the enemy is and will go after them regardless.  Obama will also ignore, selectively enforce and create laws as he sees fit anyway.  NLRB is just a special case for legal reasons and that is the one you don't want to give on.

But there were more valuable things outside of appointments to be haggled over in trade for a vote on the appointments.

The problem is, the Dems in the Senate have different priorities from the Rs. Dems want to win on issues, and are actively working to get their agenda passed. Rs want to be able to engage in reacharounds across the aisle, and will give up nearly anything in order to be able to continue doing that.

 

It's all part of the poisonous Beltway attitude.  You could sit Boehner and McConnell down in front of the HQ for a week, actually show them how weak and ineffectual they are and how utterly evil the Dems are, but they'd never change.  They have their snouts in the trough and want to keep them there.

I mean, we say that so much, but let's consider that assumption. Advise and Consent means that the Senate (which, at least potentially, means the Opposition Party) gets a say on those nominees. The entire point of that was to keep the Executive from running rough-shod over the People and the Legislative branch. That becomes even more important once we start talking about all the extra-constitutional offices which have come into existence. Which is something apparently only Republican Presidents have to live by. The Democrats weren't saying "elections have consequences" when it was GW in the White House. They weren't saying that when it was GHW or Ronald Reagan. So why is it that these "consequences" only exist when Democrats are elected? I suggest that it's not because this was ever an intended consequence of the Founders. I suspect many of them suspected that Presidents would nominate people that the Senate would reject- often on political grounds.

I don't think anyone fully understands what a fucking disaster the Consumer Financial Protection Board is going to be for business in this country.

 

They  will have absolutely NO Congressional oversight.  None.  Their funding will come from the Federal  Reserve  System, which is self-funded.  And by "self-funded", I mean they can print up as many dollars as they feel like.

Keep in mind that Reid wasn't threatening to do away with the filibuster completely.  His proposed change would only apply to presidential nominees.

It would have been a fairly low cost, low risk ploy if Reid carried out his threat.  It's not farfetched to suggest that he was ready to go through with it.

If you want to talk seriously about it you are going to have to figure out how to get hold of a couple of dozen deliverable nuclear warheads.  A non nuclear break away will not last six hours.  A nuclear armed secession possesses an asymmetric weapon.  Every city that is nuked makes that area less blue and more red, including in Texas.



My thinking is that the Iranians would probably provide nuclear weapons to a breakaway Texas Republic because it would weaken the United States to have a rebellion going on in North America, especially if it looked like the rebellion might spread north all the way to include Alberta.  If Obama is not willing to halt the Iranian nuclear program to keep the Ayatollahs from having nuclear weapons, perhaps he would get more serious about it to keep Texans from having nuclear weapons.

I mean, if McCain et al can freelance and avoid party discipline for doing so, it obviously isn't a party in any real sense.  There isn't an ideology, just a dedication to the status quo (even a Democrat status quo!!), and there is (obviously) no way to rein in the crapheads.

 

If the GOP isn't a party, it's just a way to funnel contributions to politicians and preserve office holdings.  That doesn't do it for me as, you know, just a citizen.

Hey, we figured out how to do the one thing that is worse than a full-on elimination of the filibuster, an all-out abandonment of our minority rights now so that they can be used against any future non-Rat President.

 

Not that we're ever going to be in the majority, or Devil-willing, have the White House, but we have to guard against having what happened in the House and to St. Bob of Utah in 2010 replicated on a larger scale.

You forgot my two ratfuckers, Corker and Alexander (TN). Both voted with gang of 8.  Corkscrew got re-elected last year for a 2nd term even though he has a miserable voting record. Alexander will be re-elected next year (he even voted for Sotomayor). 

I also have a ratfucker governor whose family owns the 6th largest privately held company in the US. They provide financial support to both senators - no way to beat them.  Time to move to TX.

260 Filibuster benefits the GOP. Most of the government reforms they want can be be done w budget rec (50 votes + VP), it's the Ds that benefit from no filibuster. Also, since things don't look good in 2016 it's our only chance to try to moderate or block O's and Hilary's Fed Judges and Justces. On the other hand, if Reid uses the nuke, and we take the Senate in 2014 (Satan has already informed Nate Silver it's a toss-up), we could then change the rules back to their original...67 votes to break a filibuster. Or even one better to 75 votes. This would enable us to stop ALL of O's scotus appointees. And Reid and O know this. It's only stupid Ds (and sorry to say stupid Rs) who want the nuke used. Usually the sort of poorly thought out people who want actual nukes used.

That's a plan.  State parties are where you train the people to go on to the national stage.  Having them trained and seasoned in local and state politics first.  So that they learn the ropes.  So that they can be taught not to make idiotic statements like Akin did.  It is a long march, and it will take a long time.  But if you never begin you  will never get there.

What if Harry Reid and his Senate majority said they would no longer seat or recognize any elected Republican Senator?  If you think the Senate has a blank check with the "makes its own rules" clause, it would be fine.

Not allowing a bill to pass or nominee to proceed with 50+1 Senate votes is subverting both the will of the people and the Constitution.

I'm all for hardball and not falling on my sword over principle, I'm not trying to make the case that Republicans should fold and stop filibustering, I'm just saying the modern application of the filibuster is not Constitutional.  Are conservatives Constitutionalists or are they slaves to tradition, in this case, a tradition that started in order to subvert Civil Rights legislation in the 1960's.  Our nation had something like 2 filibusters in 150 years before "Sheets" Byrd started using it.
