— Ace It's very simple: In his warrant application, Holder claimed to be interested in investigating James Rosen as a coconspirator in an espionage case. In addition, he claimed Rosen was a "flight risk," which would justify even closer monitoring (to make sure he wasn't buying plane tickets on Kayak, I suppose).
Now he says he never had any intention of prosecuting Rosen. In other words: He now says he lied when he told the judge these things, in order to secure his license to snoop on Rosen.
Well, which is it? If he never had any intention of prosecuting Rosen, the warrant application is a fraud on the court.
If he did have such an intention... that raises some additional questions.

I've been screaming about this for days. This whole investigation of Rosen was merely a ruse to check out his phone calls and email records, to see who else he was talking to in the administration.
They already had Kim nailed. They didn't need Rosen. The Justice Department was merely trying to figure out where to go next.
Holder is guilty of both things, by the way-- it isn't an either/or situation. He lied to the judge when he claimed he was seriously considering prosecuting Rosen, because he wasn't, but he lied to Congress when he said "I never would consider prosecuting" a reporter, becuase he obviusly did exactly that.

Be careful what you wish for, you who want Holder in jail. I prefer him right where he is - causing problems for his boss. It's over a year until the next election - toss him now and Deval Patrick goes into the slot instead - no one will remember Holder's name. Never help the other side's bench. A scandal-plagued AG is much better than a successful reformer who is then better positioned for 2016.Since Valerie Jarrett controls all the power anyway, it won't make any difference to actual policy. Keep the damaged figurehead AG in place.

Basically: a warrant for evidence is not necessarily related to prosecution and there is good reason in this case to believe it was not intended to be a step toward any prosecution of Rosen.
For Holder to be honest on both fronts, it boils down to Holder showing probable cause that Rosen was engaged in illegal activity and yet had absolutely no desire to prosecute him for it. Orin says it's a valid use of discretion...because resources. Or as I joked, because sequester. It actually is a strong argument. Holder was going after the government leaker. In order to get the evidence allegedly passed to Rosen, Holder had to make a showing of criminality (required by the statute). Like a good lawyer, Holder was able to make that showing in supposedly good faith.
Still, I say an argument can be made - though perhaps not a very strong argument - that the assertion of Rosen's criminality CAN also be a step toward prosecution. And if Holder was considering such a prosecution, then that to me is being involved in "potential prosecution." The problem is that it requires us to speculate as to Holder's intent...because criminality, alleged or not, does not necessarily = potential prosecution. But, unfortunately, we cannot categorically say that the warrant was part of a "potential prosecution."
I know it's terrible legalistic but it's not quite as murky as it sounds if given fair consideration. I agree with Orin that a perjury charge is likely a loser. But ask Holder, under oath, if he believed Rosen was involved in criminal activity, then ask if he had any intent to prosecute. While not strictly at odds, it certainly would look that way to all us plebians.

Holder et al guilded the lily by claiming he was a flight risk. If they had no intension to prosecute then the flight risk claim was a lie. No if's and's or but's. A fucking lie.
Further as Kraut points out, there has never been a successful prosecution of a journalist for publishing facts from a leak. They know that. This isn't a unique situation.
This was a fishing expedition, and Holder lied to the judge regarding the investigation of Rosen.

If he wasn't going to prosecute Rosen, then why spy on him at all? To intimidate him? That wouldn't be good, either, and the fact that they didn't tell him they were spying on him wouldn't have made that very effective.
As the lies keep getting more elaborate, a situation is actually created where the conclusions point to things that are EVEN WORSE than what they're being accused of!

A sane, intelligent person in Holder's situation would know they were in an inescapable trap and at least attempt to resign with some dignity.

Specifically the sentence in para. 45 that begins......

weft is touching on this too...and it's the legal argument that sticks with me making me not entirely convinced by Kerr. An agressive prosecutor would make the case that the warrant - while not categorically prosecutorial - should be considered evidence of "potential prosecution." Flimsier cases have been pursued by Holder.
Orin is literally saying that a warrant can attribute any manner of criminality, flight risk, etc...but the warrant is to be considered entirely apart from prosecution. Hermetically sealed off from it. Since a warrant need not be done for purposes of prosecution of the targeted individual (but merely to obtain evidence), that is okay. It is powerful logic. Our rebuttal I think is that while they CAN be entirely separable, doesn't mean that they ARE in this case.

Some years ago, I was very peripherally involved in a civil matter. The attorneys on one side entered sworn depositions from two experts. While the experts did not disagree with the contents, they had in fact never seen the depositions except as rough drafts. Instead of being sanctioned, the two attorneys were told they would be well advised not to practice in that particular judge's courtroom again.

1. Holder lied to a Judge, in writing, to get a secret warrant approved, or
2. Holder lied to Congress when he said he 'had no knowledge of . . . and couldn't see himself involved in' abusing journalists as a 'plumber' (leak fixer) . . .
3. He lied to both, casually and with apparent contempt.
