Filner Pleads Guilty to False Imprisonment and Battery
— Ace

Ah, now I understand why they didn't charge him with sexual battery, of which he is clearly guilty.

Answer: They probably did, but he refused to plead guilty to anything involving "sexual" in the charge. So they probably negotiated this false imprisonment/battery plea with him as something that would hurt, but that he would agree to, because he still claims he Never Touched Nobody and If He Did It Was On Accident.

Stuff about the headlocks and "making people uncomfortable" is all but admitted; he claims, though, that he never had any intention of Touching The Boobies.

So there's the answer to that crazy mystery.

Filner could have been sentenced to three years in prison for the felony false imprisonment charge. The technical term refers to restraining or otherwise detaining someone against their will -- it reaches a "felony" level when violence and other factors come into play.

Under the agreement, Filner will serve probation for three years and "home confinement" for three months. He will be barred from public office, prohibited from voting while on probation, and forced to surrender part of his pension.

He'll also be compelled to undergo treatment, under threat of jail time. Fines and other fees will be determined at his sentencing hearing, set for Dec. 9.

Thanks to @johnekdahl.

48 Slightly OT: So, day 30 at crack house. Was kicked out yesterday for a couple minutes for telling her she needs medication, and to shut the fuck up bitch. About the time I put something outside the door she backed off, then started bitching about me leaving just before the bills were due. I said what bills? My bill is paid. Bought all the food since been here, and GOOD food and meat. Always the best meats. There's a damn 6 inch round, 2 foot long piece in the freezer right now. Gave her couple hundred cash, filled up her car anytime of the about 5 times I needed to use it. Didn't replace the gas, topped the bitch off and its always less than a quarter tank whenever I did it. And I take up the floor space of a bag of clothes, and myself. Plus help her with her kids dance thing. Told her that her kid hates it here because of her, and tells me every couple days. Then got yelled at for telling her how to raise her kid. Asked for an example. Just one example, because I purposely DON'T tell her how to raise her kid. She had no answer. Her kids friends have now told Randi it's obvious your moms on crack, so now she believes it, since one of her own kind has told her. Got new keyboard (yay!) She can do nothing without forgetting stuff. Spends literally the largest portion of the day looking for something she had in her hands seconds before. Told Randi last night to take her pill, then brought it to her and said give me the packet of pills back cause I gotta treat you like a baby and handle it for you. That was the last anyone saw it. After looking and raging for a half hour this morning and not finding them, she blamed Randi, first for losing it. Then after it was proven without a reasonable doubt the exact sequence of events, blamed her for herself losing it. Because it shouldn't be her job to handle them. Picked up a piece of paper yesterday - lost it 5 seconds later. Looked all over and couldn't find it. Kind of made me think that she thought I took it even though I hadn't moved from my chair the whole time of watching this spectacle. Was cooking Randi breakfast this morning. Ham and egg sandwich (I think). Got the ham out of the refrigerator to put on the egg. Lost the ham in that time period. Spent five minutes looking for the ham, and burnt the sandwich. She's gone now till 6. Thanks for letting me vent.

92 Thirty seconds ago I had a defense attorney tell me that defendant would plead to a non-sex offense. (In Colorado it is a misdemeanor to bang as fifteen or sixteen year old if you are ten years older.) Defendant doesn't want all that sex offender therapy and registration that goes along with sex offense. I almost always turn that deal down unless there is some circumstance that truly makes it non-sexual.

101 From the very last comment (at this time) in the Kos story:

Learn from history. The progressive income tax started off as a means of redistributing unearned wealth, and ended up financing two world wars, the expansion of American Empire, and the rape of the middle class.  Nothing divides society more.  Nothing gives more power to the state to intrude.  No law is more filled with corruption and special-interest influence.
Beware the unintended consequences of using govt power to achieve social goals.

In our particular case, my wife and I, age 60 and 62: health insurance is rising 129% on Jan 1, 2014.  So much for affordable care for all Americans and "keeping your doctors."
The Blame goes to us for complacence, to Obama for  lying, to Kaiser for greed and corruption, and to modern progressives in general for using fascist means to achieve social goals.

153 I skimmed the Daily Kos thing. Here are the top three responses to the post, summarized: * Kaiser must be lying; they just jacked the rates, blamed Obamacare, and lied about it. If you believe Obamacare is really the problem, then you are a credulous dupe of corporate tools. * Your previous insurance must have been substandard. It must have had unacceptable limits on payout and/or too high of a deductible. Change your thinking and embrace the better insurance... you should want this (implied: if you don't want it there is something wrong with you). * What's wrong with you, fella, even bringing this up? You are probably a sleeper agent of the right wing. You say you have a rate paper in your hand, but I have no reason to believe you. I read an article that predicted that Obamacare would lead to lower rates for all, your claim contradict this, therefore I believe the article and I call you a liar. If there is a collision between reality and loyalty to the "progressive" cause, reality must lose with these guys.

One of the reasons he wanted to avoid a "sexual" battery conviction is that in California "good behavior" credit for sexual offendors is limited to 15% - one must serve 85% of the sentence, and are not eligible for any other reduction programs. Other prisoners can earn 50% "good behavior" time off and are eligible for other reduction programs.
