Final Farce: Closing Arguments In Zimmerman Case
— Ace

Right now the prosecutor is asking the jury to "hold Zimmerman accountable for his actions," not really specifying any particular crime. Just a general "we don't like what happened ergo you should convict him of something."

The judge, who is a monster, has at least rejected the 11th hour claim that Zimmerman should be charged with third-degree murder, predicated on the aggravated abuse of a child.

Plus I think he has opened the door to rebuttal evidence of TMs criminal past.  It will be interesting to see what the defense does when he stops.

Reason I had no desire to do criminal law

1) As a defense attorney you have to vigorously try and get people off for heinous crimes you know for certain are guilty

 

2) as a prosecutor you have to vigorously try and convict people you know are innocent

86 As for Judge Chris Farley, er, excuse me, Judge Debra Nelson, she has stacked up the reversible error so high that carpenters have had to be called in to temporarily raise the ceiling of the courtroom.

If after this enormous effort by the state (assisted by the feds) to railroad Zimmerman for murder eventually comes down to a manslaughter verdict that's promptly reversed, Nelson's further career is toast, and deservedly so.

100 True story, total time about ten seconds, everything that happened was instinctual: Was driving on a divided-lane road yesterday, no other traffic; came around the bend, saw two teenagers a few hundred feet ahead, no shirts, walking on my side of the lane in the middle-to-curb part, and not exactly rushing to get to the side of the road, just ambling. Plenty of time for both of us to avoid any issues, since I wasn't traveling that fast, but I started moving into the other lane to give them a wide berth, since they didn't seem to be skedaddling that much and I wasn't sure they would do so. Once I realized they were white, I instinctually realized instantly that if I accidentally ran them down no one would blame me in the slightest or say a thing, since they were in the middle of the lane, so I instinctually stopped intentionally going wide (I already had enough clearance), thinking "get off the road, son", now kinda irritated at a teenager thinking he owns the joint. He quickened his pace a tad and I reclaimed my lane, happy I was able to definitively do so. True story. Modern America. I hope the judge enjoys Zimmerman's conviction, in the way cowards always find relief in not having to stand for things.

The child abuse lesser 'included' would have been like no trial at all, much less a fair trial.   Isn't there some kind of presumed duty to the child in those statutes?  Only certain responsible people can "neglect" a child, and I sort of assumed that's the class of people the entire statute applies to.

Zimmerman should have stayed in his truck, shivering in fear, waiting for the cops to finally arrive, only to have them say "where is the suspect?" to which Zimmerman could have responded "I was too afraid to follow him."

The Defense wants to emasculate all of society and have us wait on our protecting nannies to save us all. That the jury consists of six women is very telling.

Would they retry him? The state's case isn't getting any stronger, the public has access to material - Trayvon's nose-punching texts for one - that the jurors didn't see. If they couldn't string him up this time, they're not gonna do any better next time. Unless: a) Corey and Holder manage to get the next jury impaneled by a judge who's prepared to let the prosecution completely rig things, or b) The state ratchets up the Lois Lerner 'process is punishment' to 11 in order to try to leave Zimmerman destitute and force him into a deal. It's hard to imagine any judge bending over further for the prosecution than this one has without getting flamed to a crisp by an appeals court somewhere up the chain, and I think the clearly farcical nature of this show-trial will bring out the wallets for defense contributions, but I wouldn't put it past them to try either or both of the above.

313 This prosecutor apparently thinks a shitstorm of speculation and wild theories about irrelevant injuries are the equivalent of proving murder 2 beyond a reasonable doubt.  I mean this is what a defense attorney is supposed to be doing, casting reasonable doubt on the case.  The jury needs to be reminded again and again on the defense close what the standard for a murder conviction is.

This is what happens when a case is overcharged from the beginning.  Or brought too early, as in Anthony.  No rush in a murder case.   

 

Throwing it all up there and hoping something sticks is not a great way to win a case.  I could see a focused involuntary manslaughter case possibly winning based on excessive force.  Not a slam dunk, but not  utterly ridiculous like M2.

It boggles my mind that it's showing up on the prosecution.   Defense can do it and get away with it, since the defendant is innocent until proven guilty beyond reasonable doubt.

But for the prosecution to use it is an appeal to "guilty until proven innocent" - unless the defense proves complete innocent motives on GZ's part, you the jury must consider all the possibilities that might make him guilty, even though I've utterly failed to establish guilt beyond reasonable doubt.  

Any jury verdict other than "Not Guilty" is a step towards the burning times.

And THAT, ladies and germs, is an image those "emotional" women of the jury will NEVER be able to get out of their heads.

 

The fact that one of those yutes lived in the complex, coupled with the fact that he not only got out of jail a few months later and went right back to committing more  crimes was not lost on those ladies......

Got out of the Army a year later, moved back to MA, never got called once in 16 years living in MA. Moved to NC and I've been called twice in 5 years, but both times I wasn't required to even show up. Just called an automated phone line that told me my number was not going to be called.

Were you to ask directions, they'd have no way of helping unless they acted as guide. I was walking our dog once, and a lady asked directions. I gave her the directions, naming the streets to take. She had no idea what I was referencing, no idea of the streets she traveled daily in her commute out of the neighborhood. When we went to visit friends out of state, and couldn't find our way through a neighborhood's street maze, the teenagers who grew up there couldn't help, either, except to say 'go down there, turn left, or right, or whatever'. They know the name of the street where they live. But not the other neighborhood streets, whether they traffic the unknown street-name route or not.

Quick warning for those of you wondering if this is the best the state can do why were the charges filed and expecting acquittal.  Be careful.  A prosecutor's words carry a great deal of weight and it doesn't matter that thinking people could never convict on this.  A jury can.  The jury may. 

Doubt me?  Well, any trial lawyer will tell you they've lost cases they couldn't lose.  It can happen.  I've seen it happen against worse cases and argument than BLDR is bumbling through.

Do not forget, Barack Hussein Obama was elected twice.  Deceitful lying manipulative scheming secretive vacuous Obama literally read empty words written for him off a teleprompter and was elected president, twice.  People voted for him.  People who sit as jurors.
