Health Care Freedom Activist Helps Him Get His Policy Restored, and Now FindsHimselfBeing Audited
— Ace When I first heard the cancer patient who complained of getting his health care policy cancelled was being audited -- for ten year old returns -- I didn't cover it.
It's not because I didn't suspect Obama's minions of harassing their opponents. I did. But I didn't cover it because I figured there was no way to prove it. Audits happen, after all, and I'm sure anyone willing to harass a political opponent is also willing to fake up some paperwork showing the audit was random or based on some acceptable legal reason.
But now I find out that it wasn't just the cancer patient who suddenly had the IRS alert and curious and on the case -- it was also his advocate, an insurance salesman and Obamacare critic who was helping the man get his hold policy back.
This man was also suddenly being asked questions by the IRS -- mostly about his trouble-making client.
It is unavoidable; it is open and shut; it is a serious political scandal. The fact that two men who came forward to criticize Obama are both hit with a snap IRS inspection days after making their complaints public can simply not be attributed to chance.
There is a principle in law: res ipsa loquitor. "The thing speaks for itself." In some cases, you don't have to prove an element of a tort, if it is obvious, based on circumstances, that wrongdoing has in fact occurred.
It is deliberate. It is, in fact, conspiracy.
Read the whole thing. It's shocking. They're not even hiding it any longer: Citizens who dissent from government policy will be subject to harassment by the government's law enforcement and para-law-enforcement shock troops.
I'm going to skip a bit about how, specifically, this man, Stephen C. Tucker helped the cancer survivor, Bill Elliot, get his insurance back. It's worth reading but I can't quote the whole thing.
Let's get to the part where Tucker announces his Intent to Cause Trouble.
My goal is to inform every American who has had their policy canceled about this law and instruct them on how to use it to get their policy restored. Since this story broke I have been in contact with the organization representing Whitney Johnson and I have been in direct contact with Eileen and Steve Benthal. Whitney is a 26 year old single mother who has been featured in the news. Whitney has multiple sclerosis and she had her policy illegally canceled as well.
...
It is immoral, illegal, and unconscionable that Barack Obama's administration would instruct her insurer to cancel her health insurance coverage and force her to accept an Obamacare compliant "Medal" plan which will increase her premium by $1,000 a month and remove Johanna's access to her current hospital and doctor. This, after Barack Obama promised over and over and over again, 'If you like your plan you can keep your plan and no one will take it away from you, period.' Barack Obama is a pathological liar and innocent, sick Americans are now suffering because of his lies.
So there's his crime: Speaking ill of the New Messiah and using legal and proper means to get people's cancellations overturned.
When we had some Q and A, a few days ago, you were about to be visited by a representative of the IRS, on Friday, December 6th. Who asked for that meeting? Did the IRS say what they wanted to meet about, before it occurred?Tucker: Yes, Treasury Inspector General Robert Williams made an unannounced visit to my old office in Palatine on December 4th, 2013....
When I hung up the phone. I immediately called my attorney. He then connected me on a three way phone call to William J. Sneckenberg, Esq., Senior Litigation Attorney and Appellate Specialist at the Sneckenberg, Thompson, and Brody law firm in Chicago. After hearing the story, Mr. Sneckenberg said it was 'highly irregular' for the IRS to be sending a letter of demand for a tax return that was filed more than a decade ago. Normally, the look back period is anywhere from 3 to 5 years. He then said he wanted to be in my home to represent me when Treasury Inspector General Williams arrived.
On Friday morning Mr. Sneckenberg arrived and reviewed the letters of demand from the IRS and then contacted his CPA. His CPA also agreed that this is highly irregular. Then Treasury Inspector General Williams arrived with an associate. He showed me his business card and his badge and then sat down to begin his inquisition of sorts during which he and his associate took copious notes. To my surprise his questions were not designed to find out why I was sent the letters of demand but more to find out more about me and even more surprisingly my new friend Bill Elliott.
He asked for Bill Elliott's phone number twice. I did not give him Mr. Elliott's phone number. He then asked for a timeline of events. He asked 'How did you first meet Bill? What law did you use to help him get his policy restored? What television program did he appear on?' etc....
And, then at the end of his line of questioning he made sure to tell me that 'you need to resolve these issues with the IRS, if not, as you may be aware, you may be visited again by other IRS representatives in your home and we do reserve the right to garnish your wages and lien your assets.' Mr. Sneckenberg and I then wished them a Happy Holiday and showed them both the door.
After they left and whilst the exhaust from their government vehicle was still lingering in my driveway I received a knock on the door from my post man who had in his hands a certified letter from the IRS. That letter stated 'Intent to seize your property or rights to property. Amount due immediately $2,106.05.' If you do not call us immediately or pay the amount due by December 19, 2013, we will seize ("levy") your property or rights to property and apply it to the $2,106.05 you owe.'
This supposed amount they are demanding payment for is for the year 2010, where they state I did not file my W2s. My tax documents are prepared by a licensed CPA and are done correctly each year. If I had not filed my W2s I would not have been able to complete my 2010 corporate and personal tax returns which are sitting right next to me as I write you these responses. My CPA and my attorney are completely baffled by both the 2010 demand and the 2003 demand for $3,592.19.
...
Considering the very real connections with Bill Elliott in this series of events and his audit and its timing and your subsequent series of contacts by the IRS, what do you draw from their behavior toward you each?
Tucker: I feel a bit like Catherine Englebrecht right now. Catherine and her husband are Tea Party patriots who were systematically targeted by the IRS, ATF, FBI, and OSHA for a 'long train of abuses' over a three year period in what is arguably the most egregious abuse of this administration's power over law abiding citizens as of yet on record.
After listening to Lois Lerner plead the 5th during congressional testimony and then conveniently 'retiring' early and then listening to the IRS chief counsel use the term 'I don't recall,' no less than 80 times during congressional testimony, I no longer believe in coincidences. I believe Bill and I are both being targeted for exercising our first amendment rights by accurately criticizing Barack Obama's disastrous health care law.
Yeah, I'm believing less in coincidences myself these days.

Yes. BY DEMOCRATS.
Every single Democratic federal officeholder should be being put on the spot with this one brutally simple question:
If allegations of use of the IRS against political enemies warranted issuing an article of impeachment against Nixon, why should the identical allegations against Obama not also warrant the identical response?
Get them on camera while the question is asked.

Keep in mind, in a coup d'etat, one of the main tactics is confusion.
Keep those who could thwart the coup from acting just long enough (by creating doubt about exactly who is in authority and where the targets are) for the actors to seize power.

President ObamaÂ’s nominee to head the embattled Internal Revenue Service testified at a Senate hearing Wednesday, with lawmakers showing virtually no resistance to his confirmation.
Senate Finance Committee Chairman Max Baucus (D-Mont.) encouraged his colleagues to approve restructuring expert John Koskinen quickly so the full Senate could vote on his nomination. The panel has scheduled a vote on the matter for Friday.
So, the Republicans get to use their rubber stamp once again. I'll predict -- voice vote approval. Won't even take a roll call.

Two wrongs do not make a right, of course, but eye for and eye as well--the world is out of balance until this is played in reverse. In other words, karma sometimes needs a little help.

I suspect that with the implosion on the launch pad of Obamacare, the protective layer of black democratium may finally be starting to wear thin so far as the general public are concerned. Clear majorities now describe the POTUS as "untrustworthy".
Note that impeachment does not equal removal from office, as the sordid Clinton-Lewinsky matter proved.
Consider the huge attention which would be paid to impeachment in the House, with a rigorous prosecutorial presentation of evidence against Obama, and subpoenaed testimony from a horde of underlings. As the Watergate era proved, "I don't recall" stops working after a certain number of iterations, when the public figure out that a deliberate stonewalling is being attempted.
Even if Reid's upper chamber won't remove Obama under any circumstances, the proceedings would read it into the record and make it clear in the public mind just how abusive and illegal this administration's conduct has been.

Think about it. The press is kept away. He can disappear at any time and no one would know. It's secure (except for satellite but that's why the abundance of different courses) physically, sound and visual. No one can frame a question that wouldn't get pooh poohed over being nonsense.
And number of people could be meeting with Obama in secret and there wouldn't be any "gaps" of where he was supposed to be.
Even the secret service could be limited in knowledge. They could put those less secure at the perimeters and use only trusted lackeys for close in coverage.
And you have to ask yourself; he never showed this degree of dedication to the game before the election. He goes off at the weirdest and most inappropriate times (but appropriate if it was an emergency meeting) and he's a lousy golfer.

I used to know a guy who owned (still does, as far as I know) a gun store in Nashville. He's a Hassidic Jew who also happens to be a graduate of Harvard Law. He used to sell his own brand of handgun/self defense ammunition and labelled it "Blue Bunny" ammunition.
His contention was that if you ever shot anyone in self-defense and it went to court, the prosecutor would use the ammo type against you to try to show intent, and that as such names like "Hydra-Shok" or "Golden Saber" would play into that...but trying to paint someone as a cold-blooded killer because they were using "Blue Bunny" wouldn't go over so well.

Also this:
Democrats continued their promised march of confirmation votes on Thursday morning, approving Chai Rachel Feldblum to be a Member of the Equal Employment Opportunity Commission by a vote of 54-41. Two Republicans, Sens. Susan Collins of Maine and Lisa Murkowski of Alaska voted for Feldblum.

I was audited last year and although it was probably because my number came up, like jury duty, I really need to reconsider using my real name everywhere I go online. I also need to reconsider making donations to the Republican Party, partly because I think my donation record might raise a flag for the IRS and partly because NO ONE IN REPUBLICAN PARTY LEADERSHIP IS SPEAKING OUT ABOUT THIS BULLSHIT.
Sorry for shouting. That IRS audit was no fun at all. On the other side of that coin, if my name doesn't appear on the enemies' list of a government tyrannical and petty enough to have an enemies' list, then I'm not trying hard enough.

Don't get too despondent. Just because they act confident, doesn't mean they'll be effective.
They're getting they're way now because the citizenry isn't fighting them on an equal basis.
There's been many a tyrant full of confidence with the backing of the police and the military that have eventually failed.
Remember no matter what they do, they ARE outnumbered and most are not isolated from the citizens they are trying to control.
Once the citizens realize that the police/military are just a thin line and that disobedience doesn't bring much more hazard than obedience, that line will be destroyed.
It takes time for that to reach the lowest common denominator of the public awareness.
As they become more obvious and vicious, they attract the attention of more and more of those tending to other cares.

I think the argument some people have made that we should accept the deal to keep the heat on Obamacare is within reason.
But anyone claiming that the budget deal is in and of itself anything other then a disaster...
So I guess the question is, Is Boehner an idiot, or does he think we are idiots?

For most situations where people have had to pull their CC the confrontation is a gun fight in a phonebooth (within 10 yards or less).
At those ranges, it doesn't make much difference: just make as many new holes in the perp as you can as quickly as you can.

Some pistols don't like hollowpoints. I own an AMT Backup .45, a very Miami Vice 80's kind of old-school cool and very reliable when shooting ball ammo, but will simply not shoot HP without at least one FTF per magazine. So I stick to ball ammo, no problem. A bad guy coming at me from 7 yards away won't know the difference.

Got audited once because the IRS couldn't do simple subtraction and addition, anyway they ended up owing us exactly $1.00. Which they wouldn't pay because it was too small an amount to issue a check.

The amount due on the CP504 (Notice of Intent to Levy) is below the threshold for 6672 civil penalty (CIVPEN) assessments. The notice itself says the taxes aren't for 1040, but rather CIVPEN.
CIVPEN assessment are for a portion of unpaid payroll taxes (the employee's withholding, essentially). They are also called trust fund taxes. Its the way the government holds an individual responsible for the non-payment of a business' debt.
A CIVPEN is assessed by a Revenue Officer (RO) via the 4180 interview process. An RO will not waste his time to assess a CIVPEN for such a low amount.
This is really fucked up. Sloppily fucked up.

Non-stop archived webcast of drawings. If there's one thing TinyURL proves its that you can do this sort of thing with a SHORT identifier when you allow uppers, lowers, and numbers. 62 to the 4th = big.
The IRS is basically being allowed to profile at a whim. The regular police generally require 'probable cause' - or some sort of justification for a wide net.
If the audit has probable cause - that's something completely different.
But for RANDOM audits, make them prove it was random. This is a 'fix government!' thing that Conservatives should be on board with, Republicans -should- be ok with, should fly with Independents, and should fly fine with not-a-party-hack Democratics. And the part hack types will be out on a very small limb screaming vehemently about how they hate it.
Thus: Excellent R idea.

You know it's funny. I'm certain we have all sorts of laws at multiple layers to punish misconduct. Now we need laws to force the law to be enforced. It just reinforces proof of the evident lawlessness in this country by those tasked with governing it. The "fix"? Even more laws... which won't be fairly enforced.
In the private sector, you look askance at something and the government comes crashing down upon you should you even manage its endless manipulation of your behavior. One cannot but help but break law. One is only saved by the discretion of prosecutors.
In the public sector? Prosecution is relatively rare. One might get suspended or moved interdepartmentally, but the wrist slap - if it comes at all - is negligible. The hive protects itself and it is shielded because and only because it's the government.
We are in fact a lawless nation. Oh, the public tries to follow the law, but the administrators of it at the highest echelons do not. Not when it matters.

IRS auditors are not part of TIGTA, and TIGTA does not participate in audits, or collections. TIGTA was the agency that was releasing the scathing reports about IRS earlier this year (several of which were talked about here).
If TIGTA was out visiting this guy because of his TV appearance, it is likely based on allegations that he (or his client) was audited in retaliation for badmouthing Obamacare. In other words, TIGTA was looking into whether the IRS did something wrong. Either this guy knows this, and chose to misrepresent the meeting, or he "lawyered up" during the interview thinking it was an audit, and never learned the purpose of the interview.
