For @PRyan: Why The Senate's Immigration Bill Is Amnesty

As Ben noted in the news dump, Paul Ryan wants to debate anyone who calls the immigration bills moving through Congress "amnesty". Well, with all due respect, Congressman Ryan, game on!

On Wednesday, Wisconsin Republican Rep. Paul Ryan, who has supported forms of immigration reform since he was a House staffer in the 1990s, declared that he would "debate anybody" who calls the current bipartisan effort "amnesty."

"Earned legalization is not amnesty," Ryan said during a forum on immigration sponsored by the National Association of Manufacturers. "I will debate anybody who tries to suggest that these ideas that are moving through Congress are amnesty. They're not. Amnesty is wiping the slate clean and not paying any penalty for having done something wrong."

Ryan pointed to provisions baked into the Senate bill from the beginning that require those in the United States to pay a fine, back taxes, undergo background checks and enter a years-long probationary period before earning citizenship, a process that can take up to 15 years.

"That," Ryan said, "is not amnesty."

Ooooh. So we're going to pass a law. A law!

And that law says all these things need to happen before the current crop of illegal immigrants, who we should admit will cease being subject to deportation the second this piece of crap passes, can step foot on the path to citizenship.

Well, Congressman Ryan, we have immigration laws on the books right this very second that say these folks should've already been kicked out of the country.

These laws are not being enforced and haven't really been since the last amnesty in 1986.

President Reagan set out to correct the loss of control at our borders. Border security and enforcement of immigration laws would be greatly strengthened—in particular, through sanctions against employers who hired illegal immigrants. If jobs were the attraction for illegal immigrants, then cutting off that option was crucial.

He also agreed with the legislation in adjusting the status of immigrants—even if they had entered illegally—who were law-abiding long-term residents, many of whom had children in the United States. Illegal immigrants who could establish that they had resided in America continuously for five years would be granted temporary resident status, which could be upgraded to permanent residency after 18 months and, after another five years, to citizenship. It wasn’t automatic. They had to pay application fees, learn to speak English, understand American civics, pass a medical exam and register for military selective service. Those with convictions for a felony or three misdemeanors were ineligible.

If this sounds familiar, itÂ’s because these are pretty much the same provisions included in the Comprehensive Reform Act of 2006, which its supporters claim is not amnesty. In the end, slight differences in process do not change the overriding fact that the 1986 law and the recent Senate legislation both include an amnesty. The difference is that President Reagan called it for what it was.

Gee, those provisions from 1986 and 2006 do sound awfully familiar, don't they?

Anyone who believes enforcement efforts will increase once an amnesty is passed must ignore all previous evidence to the contrary.

In reality, what will happen is that the second this bill passes, the people who have been talking about how deplorable it is for people to have to "live in the shadows" will make a slight shift in the argument to talking about how deplorable it is that the newly-amnestied illegals are being forced to live as second-class citizens while they wait in line.

I would be shocked if anyone failing to meet any of the criteria Ryan laid out is ultimately denied an open door to full citizenship.

Additionally, there's a border security trigger in the Senate bill that Ryan failed to mention. Probably because it doesn't matter; the borders will either be declared secure or the second-class citizen argument will just wrap that in.

Put simply, any bill that doesn't accomplish enforcement first - border security, employer sanctions, enforcement of overstayed visas, etc. - is, in fact, an amnesty bill and will simply repeat the mistakes of the 1986 amnesty on a larger scale.

So, yes, it's amnesty. Reagan wasn't afraid to call it what it was. And once upon a time, Marco Rubio wasn't either:

The current proposal going through the Senate does nothing to solve the problem, which is that all the incentives are for illegals to keep coming.

 

1. A nation that can't control its borders is no longer a nation.

 

2. Even with a perfect "secure the border" policy, the illegals will keep coming, because the incentives are all in their favor.

 

3. Until we pitch the family reunification policy, the incentive remains for grandma, brother-in-law Rodrigo, and third cousin Selma to pile in.

 

4. Until we clarify the Constitution to eliminate birthright citizenship for children of people here in violation of the law, anchor babies and "visits" to give birth will still be the order of the day.

 

Yeah, the system needs to be reformed, but not like the Senate means.

- the border will have to be improved
- illegals won't get ObamaCare
- illegals have to wait 10 years to vote
- illegals won't get earned income tax credits (paying them tax money, rather than their paying in tax money)

- illegals will have to pay a fine

What on earth stops Obama from issuing a signing statement, like he repeatedly has, saying "I sign this bill into law, but cross off all the above items"?    Even without a signing statement, we know he directs the DHS and other agencies to refuse to enforce the laws. New Black Panthers violating election laws? Refuse to enforce. Arizona enforcing immigration law? Sue them and refuse to enforce.

There are no strings that can be attached when the Mexican Illegal Importation and Progressive Voter Expansion Act of 2013 is passed.

Give them marriage -- good and hard. Sure, the whole point of "partner benefits" for same-sex partners is stupid for a species that reproduces sexually, but there are so many benefits in which you just have to live together or travel together or know vaguely of each other's existence to share in the benefits, that we should just shut it down. I really like the bit about the back taxes, given that illegals are generally paid in cash under the table and therefore untraceable.  And even if their earnings could be calculated with any degree of accuracy, odds are they will have a near-zero tax liability anyway, thanks to the way the income tax code is tilted.

 

Oh, and jwest, I'm looking forward to the legions of illegals being deported because they can't afford to pay the $2,000 in application fees.  Yes, that's a metaphysical certainty.

There are two avenues to the liberal process.  The first is to provide insufficient funding for the goal or have the goal actually impossible to achieve.  That way you are always demanding more power and more money to achieve the goal.

 

The second is to have the infrastructure built for one goal, and once that goal is achieved you move onto a new goal because you can't give up the power and infrastructure you have even though its accomplished its goal.

Sherry's question prompted me to remember two stories.

 

1)  I kept getting calls from some weird outfit saying they were responding to an online application I filled out.  Of course, I never filled out such a thing.  So one time I got a call from these people, I answered the phone in an official tone "Security Duty Station, Commander Galloway speaking."  There was silence on the other end for about 3 seconds and they hung up.  Haven't been bothered since.

 

2)  My first apartment after college had a phone number that was one digit off from the pro shop of a municipal golf course.  We kept getting calls for tee times, and it was bugging us to tell them no, we aren't the pro shop.  So my roommate just started giving out tee times.  We always wanted to go hang out in the pro shop on a busy Saturday just to watch the fun but we never had the nerve.  Eventually the pro shop changed their number....

I hate to admit it, but this immigration capitulation by the Repukes has squashed what small amount of optimism I had that we could ultimately climb out of this hole that the fuckheads have dug.  One thing I liked most about Reagan was his tireless optimism about the future of the country but I'm having a hard time seeing it now.

No matter what happens, I'm done with the GOP, because while I love Christians, prefer to be around them, have the utmost respect for their integrity and code of life, I am not one, and I am no longer taking a hit where I am expected to, on the one hand, agree to rigidly enforce a rule in a book written 2000 years ago, and on the other hand, grant sweeping exemptions to rules written in another book three decades ago--and pronounce it good. Especially as the first touches upon arbitrary biology which may not be the fault of those involved, and the second on free will and free choice of those in violation of that law.

If you wish to live by the law, then live by law.

I have no problem with the GOP choosing the SoCon battles it fights. None whatsoever. But I'm not wasting any more of my time on Earth taking hits for it. Especially as I would never win a GOP primary. I'll fight with and for SoCons anyday as far as being able to exercise their rights and convince the public of their views without being ostracized or penalized, and I probably don't even mind them winning, but I am done with being a GOP man. Period.

Amnesty is not a SoCon thing, I understand. But it is like I said above--I am not fighting for an unpopular cause when those in it cannot do the same for a cause I think essential--but not some of the others.  Just like any other coalition.

If it makes you feel any better  though I  am leaning that it won't,  you don't have to question  yourself  on  why you  wasted time on  doing the correct procedure.  

 

I   have told people in your situation its similar to  carrying a handgun.   It  seems like it would be less hassle to just get yourself a gun and carry it instead of going through the process of going to classes, getting fingerprinted, paying for your  license and renewals, taking required continuing relicensing classes , etc.  to get your CCW  but its really not.  

 

These illegals aren't going to be citizens for a long time whether this bill passes or not.   And if they do get a pathway,  its  not going to be a smooth one.

Now, I have severely questioned my own political knowledge (not my beliefs) since last years debacle, but, I really don't see how opposing this bill hurts the GOP in any way. The Dems seem to be banking on using opposition to this bill as well as the failed gun control to bash Republicans with, but I see no real support for these issues. Is there really a silent majority of Pubs and indy leaners that will punish the GOP for actually listening to their constituents for once?

There's no number you or your attorney can call to plan for the future. They expect you to have your whole new life ready when they get around to your application -- Do you have a job, a lease, savings? Etc. But they are similar on a few points and Cruz's plan still falls under the umbrella of "immigration reform". Also, I have made it clear that I oppose the Gang of Eight proposal and will continue to do so. But calling a policy disagreement "treason" is a bridge too far for me. I recognize there that have been times when Rubio and others have lied (though so have Heritage and Breitbart.com) but there is a real difference of opinion on this issue.

223 About 10-15 years ago I had people from all over the nation calling me thinking I was a national telephone wake-up service. I told them over and over that I wasn't in any way a wake-up service. But the calls kept coming until I started to just tell them, "Okay. 6:30 am wake-up? Sure". (I would never call)

The phone calls stopped after two weeks.

224 217 208 I keep reading that, even from the right-ish people that I follow on Twitter or other blogs (there are other blogs?) Now, I have severely questioned my own political knowledge (not my beliefs) since last years debacle, but, I really don't see how opposing this bill hurts the GOP in any way. Reid is doing it to rally his base and the LIVs. Branding the Republicans as racist obstructionists is easier than actually having to pass legislation. This has been his position on the budget and numerous other issues and it is true here as well. That is why he handled the amendment issue the way he did. He wants the bill to be so poisonous that the House dare not touch it.
