Forensic Expert: Trayvon Martin Was Atop Zimmerman When He Was Shot
— Ace

How does he know? The separation between clothing and skin at the time of the shooting. If Trayvon were standing, or on his back, his t-shirt would be right next to his skin or actually resting on top of it.

But that's not the case in the Martin shooting, where the evidence indicates the shirt was hanging 2-4 inches away from his skin -- the distance a shirt would hang from the body were the wearer leaning over someone.

The prosecution is having another rough day. Attempting to rebut the notion that Zimmerman needed to shoot Martin were he in fear for his life, the prosecution has advanced the notion that Zimmerman had a non-lethal alternative to the gun -- a flashlight.



I imagine (but don't know) that the following is about BDLR speculating about the martial arts uses of a flashlight. Update: Actually I think the line of speculation is that Zimmerman's injuries could have been caused by something else, like him hitting a tree or something. I've joined in progress so I don't know.

66 This case was already a losing one for the prosection, but it appears that Di Maio has dealt the coup de grace. Everything is as Zimmerman described it, he was in reasonable fear of his life so his actions did not represent those of a "depraved mind", meaning "with reckless disregard for human life" in Florida's legal definition. I still think that the jurors will hang 5-1 toward acquittal, but the prosecution has been so thoroughly embarassed that they won't bother to retry if it hangs.

I stand by what I said earlier, the trail lawyer is just a modern day Sophist, we need a second coming of Socrates to kick these guys in the nads. (I'm guessing that the prosecution is hoping the average juror is defaulted to "guilty" so if they can raise just enough hypotheticals they'll win.  Which is an inverse of the whole "beyond a reasonable doubt" thing. Someone did the math somewhere (I honestly forget where) and based on the racial makeup for the county Sanford sits in, they determined that if you randomly generated a jury (no exclusions) there was over a 50% chance it had no blacks.

Well the immunity for a prosecutor is not absolute. He could be sued for malicious prosecution, and I think the evidence for that is very strong. This is not a case that would merit much consideration for prosecution except for the political aspects.

I was laughing so hard I couldn't breathe. Needless to say, that made my wheezing "no, no, not at all" less than believable.

617 Already been said, but the old maglights are effective bludgeoning weapons in the 4+ D-Cell range.  Best to know what you're doing with it though if you have to use it as such.  We were trained on how to use it as a billyclub for perimeter patrols of the Guard base we used for CAP meetings.  Have a new one that's still sturdy enough to use as such, but a lot of the maglight models anymore cheaped out on the metal.

Grasping at straws, the prosecution has nothing and they are only trying to disrupt her testimony.

This last objection, where they are at bench now, should never have been sustained either: He's not offering her testimony for the truth of the matter she is relating, merely to show that she had spoken to these people.

Worse, there is nothing that she could relate that would hurt the prosecution's case--unless 1) she is a liar or 2) the truth is damaging to them.

So, by objecting, they are calling her a liar.

Who was on top doesn't concern me, you don't have the right to shoot someone simply because your losing a fight.  If that were the case South Beach and the local bars would be a war zone. 

As for the Black Community and others trying to make this racial, perhaps they should be a little more worried about all the other black people murdering each other in their neighborhoods.  Perhaps if they were this outraged over absentee fathers, murder rates, drug use and crappy schools maybe they might take steps to correct these problems.  Nah, it's always someone else's fault.

yes, but you don't know if you are not going to need to recall him until after you rest your case.  Defense has not done that.  Perhaps the punishment should be that they cannot recall him now even if they wanted to

693 Reading comments above. I think Zimmerman does have the burden. He committed a homicide and is now asserting the affirmative defense of self-defense. I'm not familiar with Florida law, but here burden on affirmative defense is preponderance. So I think the state can try "to poke holes" as referenced by some above. Can somebody tell me I'm wrong?

On Jun 25, the state was in its second day of witnesses.  Witnesses that day were the Sanford PD neighborhood watch coordinator, the President of the Twin Lakes HOA, a Sanford PD crime scene tech, and Sanford PD Sgt, and a neighbor, Selene Bahadoor, the first "ear" witness presented by the state, who gave some new testimony about hearing running from right to left, but could not ID the screams of either man

He is asserting no such thing.  The state is charging him with murder 2; the state need to prove beyond a reasonable doubt that Zimmerman went out with ill will and a depraved mind to initiate contact with Martin and start the fight.

If you had been following the case, you'd know this.  And that the state is failing miserably in its quest to prove this.

708 Owens' last comment about the 'what ifs" is spot on.  I testified as an expert witness in a case many years ago that ended up being retried.  The defense attorney's in both cases tried to do this to me over evidence that a blunt instrument had been used to beat someone in the head.  Some of the evidence had been withheld from the witnesses and the public during parts of the testimony, so the first time I testified, I was unaware that a 2X4 had been used.  When I gave my opinion I said that a baseball bat or a piece of wood like a 2X4 could have been used.  They both tried desperately to get me to say that a baseball bat was more likely, I think, because of desperation.  Juries pick up on things like that.
