Gun Thread 7/21/2013

Stand Your Ground On Stand Your Ground Laws

Charles C.W. Cooke, who is tied with Jonah Goldberg as my favorite NRO writer, has written another enjoyable piece. The topic is the media's current infatuation with Stand Your Ground Laws.

In essence, “Stand Your Ground” is a blanket term for any legal regime in which individuals do not have a duty to run away in the event that they are attacked. In states with such systems, juries are not expected to consider whether an individual could feasibly have retreated before resorting to violence in his defense; in states that do not, juries must inquire as to his chance of safely fleeing. In other words, in most of the country the Castle Doctrine has been extended to the village.

Jacob Sullum of Reason also wrote an article explaining why the Zimmerman case had nothing to do with Florida's Stand Your Ground law.

Andrew Branca Participates On NPR Zimmerman Panel

Andrew Branca, author of the book The Law Of Self Defense, has been covering the Zimmerman trail for Legal Insurrection. Recently, he was asked to participate in a panel discussion on gun rights and the Zimmerman case.

(answer below) Colorado Recall Of Two State Senators To Proceed

A Denver judge Thursday ruled petitions submitted to oust a pair of Democratic senators from office are valid, a pivotal ruling that sets in motion Colorado's first-ever recall election of state lawmakers.

"The petitions here substantially comply with law," Denver District Court Judge Robert Hyatt said in his oral decision from the bench. "Recalls are a fundamental right of Colorado citizens."

The special election will take place September 10th. Be sure to turn out and vote if you live in either of their districts. It is important that our elected officials know there are consequences for restricting our access to firearms.

Gun Of The Week Answer
That piece of crap is the French Chauchat (pronoucned sho-sho) machine gun. It is generally accepted to be one of the worst machine guns ever put into service. Don't take my word for it, take R. Lee Ermey's.

Why You Should Teach Your Kids About Gun Safety If You Own A Gun

This girl is unbelievably lucky she didn't blow her own head off. She violated every rule of gun safety. If you own a gun and have kids, you should teach them about gun safety. You can't just depend on the safe, trigger lock, safety, or that shoe box on the top shelf of your closet. Kids have a way of getting into their parents' things.

24 I actually owned a "shosho" for a brief period of time. Ir was a demil, with welded chamber and defaced blt head. It begged the question "why even bother to demil it?". I sold it to a guy who had a huge collection. Within that, he had a large number of French guns. He always brought up the point that French guns are like their cars. You look them over, and go, wow, thats clever, or innovative, and then you hit a brick wall and say "what the fuck did they do that for". There is nothing clever or innovative about a Chauchat.

25 I'm still astounded by those on the Right who keep insisting that Zimmerman was stupid to get out of his truck the night of the shooting. A free man has the right to walk the streets of his own neighborhood without fear of assault. These guys keep suggesting that the thugs have the right to veto our freedom, and I'm never going to buy that.

27 It's a nice little feat the racists in Florida have pulled: Convince the blacks that it is anti-racism to make it easier to lock up more blacks. I mean, if you were a racist and you wanted to put more black men in prison, what better way than to remove laws protecting self-defense or lowering the burden of proof?

30 A question for the legal Morons here: Going only on the evidence presented in the Zimmerman trial, if GZ hadn't shot him could St. Trayvon have been convicted of a crime? Like assault or assault and battery, or attempted murder even? This is what drives me nuts about all this crap. Trayvon. Martin. Assaulted. An. Armed. Man. And in so doing discovered the truth of the old saying that "God made men, but Sam Colt made them equal".

34 Most States that allowed people to have a gun at all had those "must flee if possible" laws for a long time.  The States in the South had them but generally did not enforce them to a great extent. And in the South, if someone came into your house the only requirement was that the body hit the floor still inside the house.

The voters started getting fed u with that and that is when we started getting "must issue" and "stand your ground".  That is except in those liberal dominated Northern States whether they WOULD rather see a dead innocent than a dead criminal.

After all, that is their major voting block.

36 Gun safety? My first task, as the very young child of a gun owner, was to learn (and demonstrate) the safe and sure steps to UNLOADING every weapon in his collection. Even those that, because of age and/or rarity, were never loaded, much less fired.

I still instinctively check every gun I touch.

P.S. We didn't have a "gun safe," trigger locks or any of that stuff the do-gooders think is essential. I was so well indoctrinated that I wouldn't even point a toy gun at any of the other kids when we were playing "war."

44 That young girl playing with that sidearm, scared the beejesus out of me. When I was a kid, they had guns laying all around, all loaded. I was taught rather harshly at a young age (even before I could speak I think) not to ever touch them. Most likely not the ideal parenting with respect to firearms, but I survived. They made me shoot my first pistol at age 4 (a, 22 revolver). I did not want too , it was very heavy and extremely loud to me at the time. I cried alot. But I took to those guns like a duck to water after that. Thank God everyone in my house is an adult, has at least 1 gun, knows firearms safety and not to play with them. They are not toys for sure.

As I understand the FL assault laws he could have been charged with aggravated assault as long as he didn't kill Zimmerman.

That would probably have been plea-bargained down to misdemeanor simple assault and he would have got off with a "warning".

69 I've been considering the purchase of a Remington 887, but my friends advise against it. Would the 870 tactical be a better choice (save $100) or the Winchester Defender (save more).

I've looked at the H ampersand K 'partner' and see at least one low quality brazed joint that should be welded or solid.

I prefer the 887 except for the kludgy way the magazine tube is extended.

88 Show of hands - if Trayvon's next punch had killed Zimmerman - everyone who thinks he would have hung around for the police to show up...

Ok - everyone who think that the police would have tried very hard to find out who it was who killed Zimmerman...

Ok - everyone who thinks if the fight had ended that way it would have ever made more than page six in the local news paper...

Here is a hint for perspective jurors: when there is a stranger on stranger killing and the person who did it hangs around for the police to show up - it probably was self defense; murderers generally try to hide from the consequences of their actions.

91 I've been considering the purchase of a Remington 887, but my friends advise against it. Would the 870 tactical be a better choice (save $100) or the Winchester Defender (save more).

I've looked at the H ampersand K 'partner' and see at least one low quality brazed joint that should be welded or solid.

I prefer the 887 except for the kludgy way the magazine tube is extended.

94 My dad always had guns.  He traded them, bought them, sold them, just like people did in the bad old days when we didn't have politicians blatantly trying to subvert the Constitution.  I fired a gun for the first time at 4 or 5 years of age and we were taught how to handle guns and how to shoot.  My father impressed upon me and my brothers that his guns were not toys, not to be played with and not ours and that if we bothered his guns, we would be beaten like red-headed stepchildren and he meant it.  My younger brother and I, at least, did not touch Dad's guns.  I can't say for sure about my older brother, but he is still alive, so maybe he didn't bother them, too.  We did occasionally open the closet door and stare at them, though.

The H and K was within my price range, but once disassembled it was a disappointment.

The Mossberg 550 was also considered as a rifled barrel can be procured thus enabling the use of sabot rounds. Those sabot rounds were the only ammunition available locally for a time, as apparently most shotguns already in private hands are smooth bore.

Should normalcy ever return. it will be truly welcome. Unless, of course, what we have now is the new normal.

172 There are no latino or women leaders - they are all fronts for leftist commie groups who have dictated that black trumps all. I kid you not. Go read Tammy Bruce. She resigned from NOW because they would not condemn a guy who cut his exwife's head off because he was black.

173 133 River Oaks counter protestors have moved their initial meeting place. HPD originally offered them high school parking lot, but it dawned on them it was so they couldn't carry. Moved the meet up to a public park. Suggested signs are "sorry we had to ruin your New Black Panther Party" Posted by: Thunderb at July 21, 2013 11:10 AM (zOTsN) Hey thunderb, thanks for the updates on the River Oaks thing. I hope you'll continue updating. I live in San Anotnio but I have relatives in that area of Houston. I dont know what I'd do if I had a group like that protesting my neighborhood. That's just nuts.

174 "30 A question for the legal Morons here:

Going only on the evidence presented in the Zimmerman trial, if GZ hadn't shot him could St.

If Zimmerman had not been carrying a gun that night, this would be the story of his life as sung by the Grateful Dead at Woodstock:

183 Watching "Beverly Hills Pawn" and some Hollweird critic is going all batshit crazy over a gun that was used in the movie "Monster". I mean the female worker picked up the gun and posed like shes going to shoot it and he damn near shit himself over how "sexy" the gun makes her look. I must have heard the phrase "I LOVE this gun!!" like 5 or 6 times. Now I'm confused. I thought that Hollyweird hated guns and gun owners. Hmm. Hypocracy much?

185 "157 Morons of a certain age might remember that Carl Rowan used an illegal handgun to shoot a white kid for swimming in his pool, in Washington DC, and wasn't even fucking charged.

The best part about that incident was that Carl Rowan went on to insist that 1) The gun laws in DC were totally excellent and 2) he had not done anything either wrong or illegal.

I believe it was George Orwell who invented the word "doublethink" for the concept of accepting  two mutually contradictory beliefs as correct.  What I thought most impressive at the time was how Carl Rowan bristled indignantly when anybody pointed this out.

well THAT gun was a gun of "empowerment" which was sorta my point on links in the "new and improved serial killer follies" links...

see watch any Horrywood Flick on Serial Killing and voila "white male aged 35..."

The facts are a little different the average serial killer has a lower than mean IQ, is racially diverse if not egalitarian etc etc..

the media fosters an unreal expectation of uniformity.

187 Just got through tuning a new Marlin 336. The old '94 is simply too valuable to shoot and beat up anymore. I think Marlin may have finally settled in with Remington after a rough start. I do note that oddly enough the screws were all loose, something others have mentioned. I don't get this. Do they disassemble the gun after the fire test? I think so.

190 Picked up 3 boxes of 50 Winchester .40 S&W rounds at Wal-Mart yesterday for $19.77 per box. They had all kinds of stuff on the shelves except .22 LRs. Is ammo coming back to reasonable prices and availability? Finally? The last time I checked for ammo at Wal-Mart, the shelves were bare and had an inch of dust on them. YMMV.

Posted by: Former Lurker at July 21, 2013 09:28 AM (Yoym7)

191 My Walmart, strangely doesn't sell guns but does do a lot of ammo. I used to wait at 650am to get rounds when stocked. You don't have to do that any more except for 22s. Although I am still kicking myself for not grabbing two 100 boxes of 357jhp a couple months ago. I didn't have a357 then, now I do and no more 357 rounds since. Been shooting 38so in it.

192 Gander Mountain here had more ammo than I've seen there in 8 months. Prices were steep. Steeper than usual. $260 for UMC bulk 500 rounds 9MM?  They were selling the same in .45acp for $239 just two months ago.

Traye, TR, I was having decent luck getting ammo from Cabela's at almost decent prices. I think the lowest I paid was about $22/box of 50. Wal-Mart has a limit of three boxes/day per customer. They had several more boxes and I would have bought more if my wife had been there. Every once in a great while, you can find decent prices on UMC Bulk 250 at GunAuction.com, but you have to pay for shipping and some sellers charge 3% if you use a credit card. Still, if you can buy 250/500/700/1000 at a time, you can get some decent prices.

Lucky Gunner seems to have a lot in stock, but they aren't the best prices, either.

194 MoronSeed? Hell yes! I've even got the gun for it (Marlin 795). Speaking of, my Marlin was fine out of the box, no loose screws or other defects that are being blamed on Remington. I'm wondering how much of this is a Monday/Friday sort of thing (never buy a car built on a Monday or Friday).

Speaking of, the Mustang II was not a bad car for it's time, but the time was pretty bad for American cars. Ironically the thing that doomed so many of them to the scrapyard wasn't that the car was so bad, it's that the front suspension on them were so good. Hot rodders bought the car, cut the front suspension off of it to use on something else, and then scrapped the rest of the car. As a testament to this statement, please note that you can still buy the Mustang II front suspension as a kit from several aftermarket manufacturers.

I have seen 7mm pretty consistently on the shelves so the next hunting rifle I get (Remington model 700) will likely be in that caliber rather than the surprisingly hard to find 30-06. I sure will be happy to see .22LR make a comeback on the shelves, but so far I haven't seen any supply easing signs.

198 1. While the execution of the operating principle of the Chauchat (long recoil) was fundamentally unsound (most major stoppages require disassembly to clear), it was the quality control that was an even bigger handicap.  The gun's components made by a bunch of job shops and assembled.  Frew of them apparently were able to hold the required tolerances.  Supposedly there was one contractor who actually managed to mostly adhere to the specs.  Their guns were merely bad as opposed to utterly worthless.

2. There were a number of similar guns, ranging in quality from better, to infinitely better.  The Russians fielded substantial number of conceptually similar Madsen guns, which were then captured by the Germans and issued to Storm Troopers on the western front.  The Benet-Mercier machine rifle/Hotchkiss Portative was, while no example of firearms design genius, was also superior.  It was the gun used by U.S. troops against Pancho Villa's forces in their raid on Columbus, New Mexico.  The U.S. Marines were actually issued Lewis Guns, which were taken away and replaced with Chauchats... rather like replacing S&W Model 27s with pot metal R.G.s...

199 " The Russians fielded substantial number of conceptually similar Madsen guns, which were then captured by the Germans and issued to Storm Troopers on the western front."

I forgot to mention that the Brazilian police were still using similar guns in the 1990s.  A somewhat odd gun, with a rather Byzantine operating cycle, but reliable and liked by its users.

201 The girl with the gun video might be a hoax video First off the gun is offscreen when it fires, yet we somehow see muzzle flash? The real tip for me though was looking at the pistol as she fumbled with it. The pistol did not look right for what she did with it. The pistol appears to be some 92 type Beretta or perhaps some Taurus clone. The basic action is double-action, exposed-hammer and hammer-decocking manual-safety. Which means when the hammer is cocked ,as seen in the video, the trigger falls back into a more rearward position inside the trigger guard, which was not seen! How could the hammer be cocked while the trigger still sits in the double-action position? Perhaps the pistol is not a real firearm, and instead is an air-soft or replica non-gun. The noise and flash might be simple special effects added to the video.
