The concept of "redistribution" falsely implies that the existence of property is prior to the existence of the state. #mythofownership
— Matt Yglesias (@mattyglesias) September 18, 2012
Journalist and political blogger Matthew Yglesias bought a three-bedroom, three-bath condo on Q Street in Logan Circle for $1.2 million. In a converted Victorian rowhouse, the unit has original exposed-brick walls and a private patio. Yglesias writes about business and the economy for Slate.
So, party at Matty's this weekend? I mean, I'm sure he won't mind if we crash the joint, what with that myth of owning private property and all.
Here at the HQ, we have our sights set much lower. All we're trying to do is get Ace a new cardboard box for the Spring, and maybe an upgrade to the fancy paper plates and individual plastic utensils ... although I hear he's going pretty well with his Assault Spork there under the bridge.

Property plainly existed before any state, unless you can define a single person as a state. After all, the first property was defined with a statement tot he effect, "Touch my stuff and I'll kill you." The individual could either back up the threat or he couldn't. Those who could were able to amass property.
Where the state came in was when a bunch of guy figure out they could take down Mr. Property Owner by ganging up on him and in turn better retain property by cooperatively assigning members to defend while the others were doing other necessary tasks.
So it should be remembered that the state has its origin in group thuggery.

Yeah, I'm flashing back 20 years to college, where douches with trust funds wearing $150 Birkenstocks would tell me and my $19 Target knockoffs that capitalism was evil. What I didn't realize at the time was they hated it because it allowed poor people to have the same decent standard of living--shelter, food, entertainment, new clothes now and then--as they could. Sure, smaller houses, pleather instead of leather, fewer brand names, spring break in Kansas instead of Aruba, but if you're decently hard-working and correctly prioritizing, you can put new shoes on your kids' feet instead of begging for castoffs, like poor people in the "good old days."

Now that the douche chill I just got has passed for the moment, I have to ask a question: If we derive our property rights from the State, then from where does the State get its property rights?
If the State is just people acting on our behalf, how is it possible that they can rightfully do things that we cannot do ourselves?
How can an agent have more authority than his principal, from whence his authority came?

FS, I still go with the "Aaron Kosminski" theory that Paul Begg and Martin Fido came out with nearly 20 years ago. I think it's the one that fits the known facts as closely as it does. If you've ever read any of Colin Wilson's work on true crime (especially his "right man" theories), you'll see why I think the big name suspects like Dr. Gull or Walter Sickert are complete red herrings.
And I hope you enjoy the book!

Isn't it wonderful how he can just fart out words like that as if he knows what the fuck he's talking about? Why, it's almost like he thinks he's a Big Boy with Big Ideas! As if he's not just parroting the terms and phrases of failed commies down through the centuries.
By the way, I'm sure early man -- let us say a "caveman" named Ugbuk -- would love to know that the wooden spear with the flint spearhead and the bone knife he made for himself to hunt and ward off predators WEREN'T REALLY HIS, since there was no "state" to speak of at the time and thus no such thing as property. If Muglug had tried to claim that bone knife as his own, Ugbuk would have stoved his head in with a rock, because fuck Muglug. "Ugbuk knife!"
And then he would have been soundly lectured by Yglesias for not being a good little Communist, at which point Ugbuk would have wholloped Matty over the head with a mammoth femur and used his corpse as bait to lure cave lions, because fuck Yglesias. "Ugbuk knife!"
Dear Yglesias,
Make no mistake: what happened in your mouth was redistribution.
Sincerely,
The HQ

This is a problem I run in to quite a bit with the lefties who flit through the real world:
Whenever some asinine bullshit like this flies past their teeth, I feel the wheels in my mind churning out epic mega-rants which I intend to use to slice, dice, julienne and generally take a massive shit upon their dumbassness.
Then I realize that there is nothing I can say, no data I can present, no fact I can prove that will change their minds even one millimeter.
So I say to myself, 'Fuck it,' and go about my day like it never happened.
Am I losing an opportunity to spread the truth or am I saving myself from smashing my skull into a stupidly immovable object? Anyone else run into this? How have you handled it, and what were the results?

The thing about people like this....and I deal with them EVERY. SINGLE. DAY. in my office, is that if you point out the obvious, and quite legitimate objections to them, they are still clueless.
You could be sitting in a bar with Yglesias and say, "Matt, that was some serious bullshit you tweeted. You really believe that the State pre-dates the human conception of property? Really? C'mon, man." And he would just roll his eyes and look at you like you're some fucking simpleton. Like everything that springs from the fevered recesses of his mind is so glaringly self-evident that to deny it marks you as deluded at best and mentally ill at worst.
They literally cannot conceive of a world where people can civilly disagree with them on the merits, or lack thereof, of their arguments. They cannot conceive of a world where the answer may lie somewhere between what they believe and what their opponent believes.
.....
Which is why they must be terminated with extreme prejudice.

Personally I think a short, meaningful barb does a lot more good than a longwinded rant. Like the earlier commenter said, "So if there's no such thing as property, that means the indians weren't mistreated." BOOM. Short, sweet, to the point, and it forces a lefty to entertain for the moment the fact that he or she is advocating two conflicting points of view. None of them are smart enough to grasp this right off, but that's okay. All you do is say it, then walk away. Don't let them respond; just walk away. If you allow them the last word they'll think they've "won" and they'll never reflect on what you said. So just ignore their sputtering shouts of rage, turn your back and walk away.
And always remember: you're right, they're wrong.

Ace needs money?
Here's a thought.
How about the powers that be at AoSHQ put together a proposal of what it would cost to put together a seriously working website with all the bells and whistles. On top of that, toss in operating expenses for a year. Then, let's include a generous stipend for our talented host.
From that point, leave it to the award winning commentariat to figure out how to raise the money.

This is what i'm thinking, too. Because if a person's body is not their own, then frankly it doesn't matter if you sell someone into slavery, rape them, murder them, eat them with a delicately flavored wine sauce, harvest their organs, or feed them to the dogs.
Oh, and it also means that "a woman's right to choose" isn't actually a right, because her body and everything inside it isn't her own. But if the state thinks she should have an abortion, then she'll have one whether she wants it or not.

If property doesn't exist until a state exists, then I guess we don't owe the Native Americans a damn dime.
Except I guarantee you Yglesias would argue that the Sioux Nation or the Five Nations of the eastern tribes were actual "states," so pay up, paleface.

This is why people invented "ganging up on you," also known as "government."
If he'd said that once the state arises, property rights cease to exist (practically speaking), that would make sense. At the very least, it's a contention that means something.
But making sense and meaning things is not his job.

Except that, as I understand it, tribal beliefs at the time were that no one could "own" the land. So all the settlers did was inhabit something that the indians had inhabited previously. They had to get rid of the indians to do it, but hey, if the natives didn't own the land, then they didn't have to defend it, now did they? They could have just walked away. "Oh look, other people. They want to live on that patch of ground, too? well, okay. It's not mine, so I can't stop them. I'll head west."

If Ace actually lives of of this thing, he needs to step it up a notch.
Althouse highlights a portion of purchases made the previous day through her website's Amazon account. Small shit, normally amounting to a buck or two to her. With dozens of sales per day, it adds up.
$50 in commissions per day is $1500 per month to the blog owner. That's enough to upgrade to a better brand of cat food, but it's one additional income stream.
I know you buy stuff through Ace's Amazon account now, but people like to see their shit highlighted. It's the "hey, that was me!" aspect of human interaction.

There is a difference between possessing something, and having a legal title to something. The second requires a government, the first does not. The second is not permission to own--but a guarantee by the government that it will back up your property rights--your possession of something--with force if necessary.
But--and this is the important point that our uber-genius, with that expensive Ivy League advanced education in Snarkology he has, forgets--I am also able to use force in a state of nature to secure my possession of something. I can just apply force more efficiently with a government behind me. Thus, governments do not exist to give me access to something called "property" which I could not do without government, and certainly they do not exist to give me permission to have property, but they exist to better secure my possession of property, by providing me recourse to greater force than I could most likely muster by myself.
Thus, governments come about because it is a better deal than being by myself. And--here is an important point--if I could muster greater force to protect my property than the government, then, historically, I become the government.
And of course, I could then take your property.
Property thus exists prior to the existence of the state, because I could be the first government in an area (say, after the monolith taught me how to use the jawbone of an ass), and take away the water hole you had--but it existed as yours before I established dominion and started saying things I called "laws".
What the state determines is who gets to keep property, via dint of greater force. Not whether or not something called property exists. Since force exists in a state of nature, so will property.

But where I'm going with this is that land title in Pennsylvania is a historical artifact, and was established and mediated by the sovereignty of a state at every point in the process. There is no real estate property derived from natural law in the world as experienced. Where natural law theory and common law practice come into effect is what happens after the new-minted land property is transferred from the state to the individual, and that's where Yglesias shits the bed. Just because the power of the state created the fact of the estate, it does not follow that the authority of the state can unmake the estate at whim. For one thing, real estate is the beginning of property, not the end of it. For another, there are many striking and practical reasons why property, once created by the state, cannot be simply extinguished by the state. Ask the Indian states, whose lack of solid private property law put them at a fatal disadvantage versus the European settler states.

So: property as established by feudal claim and medieval city charters. Both have their origin in monarchical authority, and although that authority was at a very low ebb in the 1580s, it still was the head and source of all property of note in France. The state had well-neigh liquidated at this time, and it still was the sole source of property right - as opposed to open banditry, which also was a quite real element in possession in such conditions - available. Q.E.D., the state is the sole differentiation between mere possession and ownership, between a burgher and a bandit.
