Hey, Guys, We're Going To Collide With The Debt Ceiling
— Gabriel Malor

Alternate Headline: "Your Move, Mr. Cruz."

There is talk of a deal being worked out this afternoon, but I thought I might mention that even if a deal is worked out today or tomorrow, we are almost certainly going to find out what happens when the debt ceiling isn't raised by Thursday.

Quite simply, there isn't enough time for the Senate to consider a bill before the Thursday deadline . . . unless there's unanimous consent to waive the Senate rules. Here's what has to happen before the Senate can pass a bill raising the debt ceiling.

(1) The bill has to be drafted. Figure this takes a day.
(2) The bill has to be moved to the floor. This takes 3 days if it's a new bill that has to be calendared. It's faster if Sen. Reid amends a bill that's already on the calendar. It's also faster if the Senate takes up a bill from the House.
(3) Without unanimous consent, they'd need to file for cloture on the motion to proceed. Add a day, since a cloture vote has to be filed a day in advance of the vote.
(4) Without unanimous consent, they'd then have 30 hours of post-cloture debate.
(5) Without unanimous consent, they'd need to file cloture on the bill itself.
(6) Without unanimous consent, they'd then have 30 more hours of post-cloture debate.
(7) And then the Senate would get to vote on final passage of the bill.

There just isn't that much time between now and the deadline. This means that if any Senators object to waiving the rules, we're going to run headfirst into the debt ceiling even if Sens. Reid and McConnell came out with a deal this very second.

I checked with a pal who works on the Senate side. Though he cautions that there are a lot of ifs involved, he confirmed my understanding of the rules. He suggested that if there's unanimous consent, the Senate could pass something in a couple days. Without unanimous consent, the Senate's not going to be passing a bill until next week.

Does anyone here believe that a deal struck between Reid and McConnell is going to get unanimous consent from Senate Republicans? I sure don't. And don't forget, even if a deal makes it through the Senate, it then has to make it through the House.

The bottom line: we're about to find out what actually happens when the United States government runs up against the debt ceiling.

Updated [4:35]: Wait, wait, wait. I'm confused about the objection to the alternate headline, which I thought was amusing. Do you think that Sen. Cruz would agree to waive the rules to allow quick passage of the deal we're hearing rumors about? It'd sure surprise me.

Well, it looks like we have a good  comparison of federal spending as a household budget: how long would it take a family to go bankrupt   if they spent at the rate (percentage-wise) as the  gubmint? A year, two, maybe?

38 I don't think I've ever seen such a look of misery and dejection on the face of my daughter as I just did a moment ago. I sat down with her on the sofa and (as calmly as I could) tried to explain to her why the Republicans won't raise the debt ceiling. I tried to keep my voice steady, but it became increasingly difficult - the rage and feelings of helplessness were just too much. She could tell something was wrong. I found myself at such a loss for words - nothing made any sense; nothing makes sense anymore. I finally had to admit, " I just don't know - I don't know what's going on in this country anymore..." When I finished her lower lip started to tremble and her eyes began to fill with tears, "Mommy" she said, "why are the Republicans doing this to the country?" Well, that was it for me: I finally fell apart. I just fell into her arms and we both began sobbing for several minutes. She had to comfort me and get me back on my feet. Sometimes I just think itÂ’s too much, but seeing the strength in my daughters voice helped me to get through.

71 In a memo being circulated on Capitol Hill Wednesday, Moody’s Investors Service offers “answers to frequently asked questions” about the government shutdown, now in its second week, and the federal debt limit. President Obama has said that, unless Congress acts to raise the $16.7 trillion limit the nation will be at risk of default. Not so, Moody’s says in the memo dated Oct. 7. “We believe the government would continue to pay interest and principal on its debt even in the event that the debt limit is not raised, leaving its creditworthiness intact,” the memo says. “The debt limit restricts government expenditures to the amount of its incoming revenues; it does not prohibit the government from servicing its debt. There is no direct connection between the debt limit (actually the exhaustion of the Treasury’s extraordinary measures to raise funds) and a default. - See more at: http://www.teapartypatriots.org/2013/10/default-boogeyman-d-c-claims/#sthash.Y6ssDaoy.dpuf

Does anyone actually think we haven't already hit the debt ceiling, blown past it like    Willy Wonka's   glass elevator, and are just waiting for the debris to clear to see how far behind us we've left fiscal sanity?

96 My understanding of what happens when the debt ceiling is hit that the event triggers a computer algorithm that removes restrictions on EBT card limits nationwide.

It's called a "glitch"

Use it wisely.

Feh, they don't care about it. They only care insofar as they game out whether the Supremes will strike it down, or how long it'll be until then.

Also, why didn't any of said characters have the home team accent. I like the part where you have no real idea where Charlie is from. Is it Poland? America somewhere? Sure they'll pay interest payments but they have no problem at all punishing the American people if it furthers the goal. 190 Does anyone here believe that a deal struck between Reid and McConnell is going to get unanimous consent from Senate Republicans? I sure don't. And don't forget, even if a deal makes it through the Senate, it then has to make it through the House. *** No. And, even a bigger "no" in the House. The scary thing is that Dems do not care about collateral damage. For them, the ends justifies the means and, if the shutdown is any indication of where cuts will be made, we can assume that the most painful, most visible cuts will take place. As someone who spent a number of years developing strategy for a half-billion dollar customer-industry at a multi-billion dollar company, I admire the strategy and messaging on the part of the Dems. I wish the Republicans had it even half as together as they. You can bet that, somewhere, is a white board with an "if this, then that" strategy scrawled across it... If R'pubs block this, then we follow with that... If the shutdown occurs, then we do this... If the citizenry goes apeshit, then when spin it this way... If we "default", how can we strike a blow, and how do we handle the fallout? Then they disseminate the message across the entirety of the party. Their leaders, Pelosi and Reid, make certain to spell out the consequences of straying from the party line. Although it appears that they can act on whim and turn on a dime, they do not. they have mapped out their responses to any number of issues in advance. If A then B if B then C. They are a machine. For all their claims of "feeling" the pain of others, they are altogether detached from the reality of that pain. They are the Terminator. And, although I admire their abilities, I wouldn't wish their brand of mental illness and lack of compassion on my worst enemy. The GOP may not be as good at strategizing and messaging, which must be addressed but, generally, they ARE on the side of causing the least amount of pain. It may sound like an over-simplification but, in my mind, this is a fight between good and evil.

Only time to correct a few errors.

It would not take a day to draft a debt limit extension.  You - literally - just change the numbers and dates from the last one.  This is a puzzling assertion, really.

The whole week-long timetable assumed objection to unanimous consent.  Without that objection, the whole thing could be wrapped up in an hour.  There's no ripening period for Senate business, only budget resolutions carry statutory debate times, etc.

"Your move, Mr. Cruz" when you then note that the House (duh) needs to approve the same vehicle?  Huh?  What sense does that make?

Sorry, Gabe, you need better Senate friends.  In addition to a few other things, but I'll eschew the vituperative and invidious lecture at this juncture.

As noted above, the Constitution makes it quite simple, up to a point:  debt service and repayment of principal gets done, first.  Then, with the (ample, in this case) funds left over out of federal cash flow, other things get done.  But, as also noted above, as the Constitution is (no hyperbole) basically a dead letter whenever deemed convenient by looters and social engineers (this latter group includes the racist and sex-preference jihadis, btw).  If it takes two centuries to even consider enforcing perhaps the clearest mandate in the entire document (2nd Amendment), and even then it's mangled and partially done, well let's not pretend to wonder what will happen to the 14th the first time it's called into action.

Oh - and one other option - though I cannot believe it will get to this, unfortunately - in the event of the cash-flow-only fed. govt. funding, does anyone doubt that they will pull a "California".  To summarize, in that maneuver (also wildly and hilariously unlawful and unconstitutional when it was done here in CA), the "government" just starts stiffing contractors, er, paying them IOUs (ditto for tax refunds).  Absurd?  Yes.  Unlawful?  You betcha.  Humiliating and an act of political suicide in this country as short as 10 years ago?  Obviously.  Today - something (literally) barely noted by the dumbed-down, NPR-stupid electorate, which doesn't have the first idea how its government is supposed to work, anyway.

330 Prior to 1973, all games were blacked out in the home city of origin regardless of whether they were sold out. This policy, dating back to the NFL's emerging television years, resulted in home-city blackouts even during championship games. For instance, the 1958 "Greatest Game Ever Played" between the Baltimore Colts and New York Giants was unavailable to New York fans despite the sellout. (Many fans rented hotel rooms in Connecticut to watch the game on Hartford TV, a practice that continued for Giants games through 1972.) Similarly, all Super Bowl games prior to 1973 were unavailable in the host city's market.

The policy was put into effect when, in 1972, the Washington Redskins made the playoffs for only the second time in 27 seasons. Because all home games were blacked-out, politicians – including devout football fan President Richard Nixon — were not able to watch their home team win. NFL commissioner Pete Rozelle refused to lift the blackout, despite a plea from United States Attorney General Richard Kleindienst. Kleindienst was to suggest that the United States Congress re-evaluate the NFL's antitrust exemption.

Rozelle agreed to lift the blackout for Super Bowl VII on an "experimental basis." Nonetheless, Congress intervened before the 1973 season anyway, passing Public Law 93-107, which eliminated the blackout of games in the home market so long as the game was sold out by 72 hours before game time. The league will sometimes change this deadline to 48 hours if there are only a few thousand tickets left unsold; much more rarely, they will occasionally extend this to 24 hours in special cases.

... I seem to recall that Public Law 93-107 passed in record time.... and speaking if the "Washington Redskins" .. I find the use of "Washington" in the team's name offensive.

Perhaps the "Anacostia Deficits" would be better

376 Queeq was fiction.  Arnheiter was real life.  DER USS Vance departed Pearl to operate off the Vietnam coast as part of Market Time.  Before departure, Arnheiter used the crew MWR fund to buy a speedboat.  While transiting the Pacific, suffered an engineering casualty and filed a false report on down time.  Then off the coast of Vietnam would use that speedboat to troll for enemy gunfire just so Arnheiter could 'respond to being attacked' by having USS Vance open fire.

379 We are already at the debt ceiling.  We have used it all up.  But every day debt matures and new debt can be issued to replace it.  It is always turning over.

A default will only happen if the Secretary of the Treasury chooses to not make an interest payment.

There is not a hard and fast deadline as far as time goes.  Given that our expenditures exceed our revenues there will come a time when we cannot pay a bill on time.  That is not good but not a default in a credit rating sense.  That requires a failure to make an interest payment or a principal payment on time.

However, with a continuing deficit, we do need to increase the debt ceiling to avoid an eventual default.  But it would take incredibly poor cash management for the default to happen at midnight the 17th.

0bama could cause it to happen to increase pain but I am not sure that he has the balls to do that.

Oh - and I'm not criticizing those with the opposite approach - I find lots of the humor and wit amusing, even if the substance sometimes is stretched or flawed.

But this post just seemed pretty silly - in error on the core substance, and with a snarky non-sequitir tossed in.  I only read it at all because the bit about there being now way to pass an extension 'afore next week struck my dusty but substantial Senate procedural memory banks as plain wrong.

Purp gets it...here's the deal for those who don't love gathering belly button lint...

we will NEVER pass another real budget until the dollar collapses...

Donkey knows the American people will look at the tax base needed for THIS THIS is "paradise..."

those cocksuckers have devalued the USD by about 80% in the last 15 years and it is not enough....

because the democrats are a graft machine, not "welfare"...

and the GOP are mewling quims not people who defend free markets.

438 Oh, and Gabe's take on the rules is totally correct. Like it or not, the Senate rules are not designed for speed, just the opposite, they are designed to slow shit down that the House might throw at them. Don't fuck with the messenger.

439 Does Cruz control the Senate now?  Hey Gabe, there would have been plenty of time to deal the debt issue if the Senate (read: Harry Reid) had taken up any number of the billS, with a capital 'S', sent by the House to handle the funding issue.  Seems to be a Harry Reid issue and not a Ted Cruz issue.

I really don't think the country would collapse if, in the unlikely event there is a deal (I don't think there is or will be for some time), it were a few days late.

Did the House pass the 6 week debt limit extension?  That's always an option if people really are concerned about TEH HORRIBLE BURNINGZ.  If people (Democrats) don't want to pass that, then obviously this isn't that serious a catastrophe.

Democrats want to see what is on the other side of the debt ceiling hit.  I'm kind of curious myself.  I don't think the result will be instantaneous ruin, and neither do they, obviously.

And if it is so ruinous to hit the debt ceiling, why do we have one?  If it is such a threat to the United States it should be eliminated in favor of Unicorn Skittles or whatever the hell else it is 'political realists' want these days.

The massive debt this nation has racked up over the past few decades is killing us, so the party who solves the problem will become the hero.

If this were a  family facing these financial problems, the best resolution would be for the responsible adult to take control of the checkbook and to place the family on a sustainable budget.

That's all well and good, but to be the hero, that same responsible adult should be the one that goes out to the barn and finds the priceless antique that grandpa bought for pennies when he was a boy.

Pay off all the debt, buy some infrastructure, retire all the student loans, mortgage debt and credit cards in one massive transaction by selling off a real (or imagined) national asset.

Reset the global economy and ride the hero wave for the next century.

476 So, what exactly is money?  I get paid for my time, so money is a representation of my time gone by -- time that I can not get back.

Since we are mortal it can only be true that continuing spiraling upward debt is a form of slavery.  CJ Roberts 'tax is the only true god' finding in the Obamacare case reaffirms that only welfare takers are immune to money poorly spent.

Because of the false debt ceiling, the slavery really hasn't hit me yet.  Maybe it will never actually hit me.  But it sure seems likely that it will hit someone, sometime, because as a nation we are like junkies -- we just can't stop ourselves.

When we can no longer put off the inevitable, either the money I traded my life to get will become worthless, or it will be confiscated to pay the debt.  Either way, my life was traded away in D.C. and not by my choice.

OMG

Five thoughts on the Obamacare disaster
In the weeks leading up to the launch I heard some very ugly things about how the system was performing when transferring data to insurers — a necessary step if people are actually going to get insurance. I tried hard to pin the rumors down, but I could never quite nail the story, and there was a wall of official denials from the Obama administration. It was just testing, they said. They were fixing the bugs day by day.
According to Bob Laszlewski, those problems arenÂ’t resolved. TheyÂ’re just not getting much attention because the health-care lawÂ’s Web sites arenÂ’t working well enough for people to get that far in the process.

When you’ve lost Ezra Klein, DC’s boy-version of “Chatty Cathy”, there is no defense.

In looking at polls right now, lets remember we've just seen two straight elections with incredibly low GOP voter turnout, even while Pew is saying the voting population is turning significantly more conservative in every. single. state.

It's never pretty looking at a political battle, but the trend lines are pushing the GOP to take an ideological stand.  Sure, John McVain is whining about it but who cares?  He made his case to the public once before, and he lost.  Elections have consequences.  The biggest of which is that your ideology is rejected, and that conclusion is doubly true after Romney-bot drew even FEWER GOP votes than did McVain.

And as the Alinsky inspired Community Organizer, he and Val Jar have already gamed it out. 1) Republicans fold and "do the right thing", and Barry gets to curb stomp them. 2) in the name of the "full faith and credit" if the United States, Barry grabs more Constitutional power and unilaterally raises the debt ceiling himself with an XO. Either way, Imperial Facist Presidency, and Congress is emasculated further. Low information voters and Low consequence voters will approve, as will the Barry loyalists. Not the same thing but I understand what you are saying. If we get a budget conference committee, the number of concessions the Republicans get depends on the amount of leverage they have and whether the Senate Democrats decide it is in their best interest to deal. I don't know  where the fewer GOP votes stat comes from but Romney had over a million more votes than McCain and won 24 states to McCains 22.

Given there's a couple of hundred billion rolls in every month and interest is only $25 B, There are only a couple of ways the USA could default.

One: is the President orders Treasury to not to pay the interest, pay other things and let the money run out.  That would be unconstitutional but that's never stopped Obama before.  Even then, Treasury might pay it anyway under its own authority.  Impeachment should ensue.

Two: Treasury forgets to make the payment or otherwise fuks up or the transfer system shuts of something.

I don't think there's anything the House could do to force a default.

Why can't even republicans and conservative or fair and balanced media understand this and drop the brinksmanship.

Since only Obama can cause default, even mentioning default, or in other words, questioning the good faith and credit of the US is cause for impeachment.  It may not pass both houses, it would make for some good discussions, a teaching moment if you will.

That being said, as they come close to the deadline, media outlets will begin discussing this rationally with things like "isn't there enough money coming in every month to pay the interest and prevent a default?".

Drop some knowledge on this Canadian and tell me where I'm going wrong?

Btw, If someone wants their principal back, they can borrow to replace it since it would have no net effect on the debt ceiling.

Sorry of the spacing fks up.

717 No they weren't right FlatBush Joe. They spent their time immediately saying they would fold and are now stunned that Obama and the Dems are waiting for total surrender. Boehner should have passed the three different CR's and a debt raise for 3-6 months and then sent Congress home. Let the Republicans run around their districts blasting the Democrats, especially the vulnerable Democrats in the Senate. Instead we got McClellan levels of battle leadership.

719 Who keeps saying the failure to raise the debt ceiling equals DEFAULT ? It simply means we cannot borrow more money. Money coming in is more than enough to service our current debt, at least for the next few years.

721 Your move Mr. Cruz?

It isn't his fault the GOP leadership is relentlessly incompetent.

If they weren't, they'd would have come up with some sort of coherent plan that would have made use of the enormous enthusiasm once displayed by the Tea Partiers, circa 2010. Instead, they turned an enormous electoral victory into meh.

Real men of genius. And as usual, the blame for this latest failure is being dumped off on the nearest non-establishment figure, in this case Ted Cruz.

Nothing to do with the deep-seated, diamond-plated political incompetence of the Republican establishment.

Nope. The buck always stops at someone else's desk.

Good luck with that GOP, because it has worked so well, so far.

725 Gabe, didn't you want a fight over the debt ceiling? Isn't the public now seeing how low the Democrats will go? Doesn't that help the GOP in the upcoming debt ceiling fight? Do you think hitting the debt ceiling means automatic default? What was your battle plan?
